AMENDING ORDINANCE NO. 2088 TO EXTEND FRACHISE AGREEMENT
WITH WASTE MANAGEMENT FOR SOLID WASTE COLLECTION
DISPOSAL THROUGH OCTOBER 5 , 2002
WHEREAS, Ordinance No. 2088 , adopted by the City of Alameda City Council on April
, 1982 , authorized execution of Model Franchise Agreement with Oakland Scavenger Company
(which later became Waste Management of Alameda County, Inc.) for the Collection and
Removal of Refuse and Garbage; and
WHEREAS , such franchise had an initial term of twenty years , from June 1 , 1982; and
WHEREAS, the City of Alameda and Waste Management of Alameda County, Inc.
WMC") desire to modify the Agreement on the terms and conditions set forth in the
amendment attached to the staff report submitted to City Council on December 18 2001.
NOW , THEREFORE , BE IT ORDAINED by the Council of the City of Alameda that:
Section 1 . Qrdinance No. 2088 shall be amended by amending Page 2 , Section 1
paragraph 1 , Tenn and Purose of the Agreement is modified to read as follows:
The Tenn of this Agreement shall begin on the 1st day of June 1982 and shall tenninate
on October 5 , 2002. The City hereby gives and grants to WMAC the exclusive franchise , right
and privilege to collect, remove , and dispose of, in a lawful manner , all refuse accumulating in
the City that is required to be accumulated and offered for collection to WMAC in accQrdance
with the City's legislation and consistent with this Agreement.
Section 2 . All other provisions of Ordinance No. 2088 will remain in full force.
Section 3 . The City Manager or his designee is hereby authorized to execute , for and on
behalf on the City of Alameda , the Amendment to Agreement substantially in the form and
containing the tenns and conditions and covenants as set out in the Amendment to Agreement.
Section 4 . This ordinance shall remain in full force and effect from and after the
expiration of thirty (30) days from the date of its final passage.
