AMENDING THE ALAMEDA MUICIPAL CODE BY AMENDING
SUBSECTION 27-5(d) (CITYWIDE DEVELOPMENT FEE ESTABLISHED)
OF SECTION 27-3 (CITYWIDE DEVELOPMENT FEES), OF CHAPTER XXVII
(DEVELOPMENT FEES) AMENDING THE CITYWIDE DEVELOPMENT FEES
BE IT ORDAIND by the City Council of the City of Alameda that:
Section 1 . The Alameda Muncipal Code is hereby amended by amending
subsection 27-5 (d) (Citywide Development Fee Established) of section 27-3 (Citywide
Development Fees), Chapter XXII (Development Fees) thereofto read:d. For development which intensifies the use of an existing non-vacant structure or a
structure for which the Citywide Fee has not been paid , the fees shall be payable prior to
issuance of a building permit , or if no building permit is required , prior to the issuance of
a certificate of occupancy or the commencement of the use (pursuant to a Use Permit or
other similar permit).
Regardless of whether a building permit is required, a strctue , subject to
any permit , which has been vacant shall be assessed the Citywide Development Fee
based on the proposed use at the time of permit issuance. No credit shall apply to such
vacant strcture. "Vacant" for the puroses of this section shall mean absence for a
period of 24 months or more of actual occupancy or use.
Notwithstanding section 27-3.5(d.l), a strctue for which the Citywide
Fees have been paid shall not be considered vacant for the purposes ofthe Fee and shall
be assessed consistent with the provisions of subsection 27-13.
Section 2 . This Ordinance shall be in full force and effect from and after the
expiration of thirty (30) days from the date of its final passage.
