Ordinance 2887CITY OF ALAMEDA ORDINANCE NO. 2887 New Series AMENDING THE ALAMEDA MUICIPAL CODE BY REPLACING SUBSECTION 23-3 (ALLOWING BRANCHES TO EXTEND OVER SIDEWALKS), OF SECTION 23-3 (TREES AN SHRUBBERY) OF CHAPTER XXIII (PARS, RECREATION ARAS AND PUBLIC PROPERTY) BE IT ORDAIND by the City Council ofthe City of Alameda that: Section 1 . The Alameda Municipal Code is hereby amended by replacing subsection 23- 3 (Allowing Branches to Extend Over Sidewalks), of Subsection 23-3 (Trees and Shrbbery), of Chapter XXIII (Parks , Recreation Areas and Public Propert) thereof to read: 23-Trees and Shrbbery. 23-3 Trees , Plants , Shrbs that Extend into or Over Sidewalks and Streets. All persons owning real property in the City of Alameda are responsible for keeping trees , plants , and shrbs which originate on their property from encroaching into the public right- of-way, from impeding pedestrian or vehicle traffic , or from obscuring traffc control devices. Property owners are responsible for maintaining a minimum eight (8) foot vertical clearance over the width of the sidewalk which abuts their property. Property owners are also responsible for maintaining a minimum vertical clearance of thirteeri (13) feet , six (6) inches over any street adjacent to their property as measured from one (1) foot , six (6) inches from the (3 face ofthe curb. Section 2 . This Ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage.
