APPROVING AND AUTHORIING THE LEASE OF CITY OWND
PROPERTY LOCATED AT 1525 BAY STREET TO KAN ZIMMERMAN
AND KENNTH EDGERLY DBA ABC PRESCHOOL
WHEREAS , on April 18 , 2002 , the Alameda Unified School District (AUSD) conveyed the
Mastick School site , located at 1525 Bay Street , to the City of Alameda; and
WHEREAS , AUSD also transferred to the City an existing lease (Lease Agreement) with
Karen Zimmerman and Kenneth Edgerly dba ABC Preschool (Lessee), for the use of modular
buildings located on the Mastick School site; and
WHEREAS , the term of the Lease Agreement ended on June 30 , 2002 and Lessee currently
has a month-to-month tenancy; and
WHEREAS , the Lessee wishes to renew the lease for a three-year period effective May 1
2003 , allowing the City two three-year options to renew; and
WHEREAS , a form of the new lease containing the covenants , terms and conditions to be
entered into is attached to the staff report presented to the City Council at the September 3 2002 City
Council meeting; and
WHEREAS , the long-term lease agreement will provide ABC Preschool with the continuity
and stability required to operate a preschool; and
WHEREAS , pursuant to City Charter section 3-, no real propert of the City shall be
leased for a period in excess of one year or sold, except upon the affirmative vote of four members of
the City Council.
NOW , THEREFORE , BE IT ORDAID by the Council of the City of Alameda that:
Section 1 . The form oflease referred to in the preamble hereof, and the terms , conditions and
covenants contained therein , be and the same are approved upon the affirmative vote of four
members of the City Council.
Section 2 . The City Manager ofthe City of Alameda or his designee is hereby authorized to
execute , for and on behalf of the City of Alameda , a Lease substantially in the form and containing
the terms and conditions and covenants as set out in the Lease attached to the staff report presented
to City Council at the September 3 , 2002 City Council meeting, and the City Clerk is hereby
authorized and directed to attest to the same.
Section 3 . This ordinance shall be in full force and effect from and after the expiration of
thirty (30) days from the date of its final passage.
