Ordinance 2895CITY OF ALAMEDA ORDINANCE NO. 2895 New Series AMENDING ORDINANCE NO. 2754; AND APPROVING AND ADOPTING TH FIRST AMENDMENT TO THE COMMUNITY IMPROVEMENT PLAN FOR THE ALAMEDA POINT IMPROVEMENT PROJECT WHREAS, the City Council of the City of Alameda (the "City Council"origiy approved and adopted the Community Improvement Plan for the Alameda Point Improvement Project (the" APIP") on March 3, 1998, by Ordinance No. 2754; and WHREAS, the City Council origialy approved and adopted the Communty Improvement Plan for the West End Community Improvement Project (the "WECIP" on July 51983, by Ordince No. 2141, as subsequently amended on January 2, 1985, by Ordince No. 22, on December 6, 1994, by Ordinance No. 2682, and on November 20,2002, by Ordince No. 2889; and WHREAS, the City Council origially approved and adopted the Communty Improvement Plan for the Business and Waterfront Improvement Project (the "BWIP" on June 18, 1991, by Ordice No. 2559, as subsequently amended on December 6, 1994, by Ordice No. 2681, on July 6, 2000, by Ordice No. 2835, on September 19 2000, by Ordice No. 28, and on April 3, 2001, by Ordice No. 2857; and WHREAS, the Communty Improvement Commsion of the City of Alameda !: (the "Commion) ha be designted as the offcial redevelopment agency to car out in the City of Alameda the fuctions and requiements of the Communty ,. Redevelopment Law of the State of Caorna (Health and Saety Code Setion 33000 et seq.and to implement the Communty Improvement Plan for the APIP; and WHAS, the Commsion ha prepared a First Amendment to the Communty Improvement Plan for the APIP (the" APIP AIendment"), a Fif Amendment to the Communty Improvement Plan for the BWI (the "BWIP Amendment") and a Four Amendment to the Communty Improvement Plan for the WECI (the "WECI Amendment) (collectively, the "Amendments) to: (i) delete certain area (the "Exchange Area) from the APIP Project Area; (ii) add the Exchange Area to the BWIP Project Area; (iii) fially merge the BWI and the WECIP; (iv) extend emient domain authority in the BWIP (excluding residential); (v) re-establish emient domai authority in the WECIP (excluding residential and certain non-blighted parcels); and (vi) make other conforming and techncal changes to the APIP, BWIP and WECIP Community Improvement Plans in connection therewith; and WHEREAS, Commission staff have determined that the deletion of the Exchang;e Area from the APIP Project Area and the addition of the Exchange Area to the BWIP Project Area is advisable to provide for the effective redevelopment of the BWIP and to facilitate the development of the Catellus mixed use project, which wil, in turn, alleviate blight within the BWIP and provide residential development, including affordable housing, within the BWIP Project Area, as amended; and WHREAS, the Planng Board of the City of Alameda (the "Planng Board" has reviewed and recommended the approval and adoption of the Amendments, and provided its report tht the Amendments to the BWIP and WECIP conform to the General Plan of the City of Alameda; and WHREAS, the Economic Development Commssion of the City of Alameda (the EDC") has reviewed and recommended the approval and adoption of the Amendments; and WHREAS, the EDC held a community workshop to consult with residents and communty organations on the Amendments; and WHREAS, the Commsion prepared and circulated a Mitigated Negative Declaration on the Amendments in accordance with the Caorna Environmental Qualty Act (public Resources Code Setion 2100 et seq.), the Guidelies for Implementation of the Caiforna Environmenta Quality Act (14 Ca. Code Regs. Setion 1500 et seq.) and environmental procedures adopted by the Commsion pursuant thereto; and WHAS, the City Council ha received from the Commsion the proposed Amendments, together with the Report of the Commsion and the Mitigated Negative Declaration on the Amendments; and WHREAS, the City Council and the Commsion held a joint public hearing on March 18, 2003, on adoption of the Amendments and the Mitigated Negative Declaration, in the City Council Chabers, City Hall, 2263 Santa Clara Avenue, Alameda, Caiforna; and WHREAS, a notice of said hearing was duly and regularly published in the Alameda Joural, a newspaper of general circulation in the City of Alameda, once a week for four successive weeks prior to the date of said hearg, and a copy of said notice and affidavit of publication are on fie with the City Clerk and the Commission; and WHEREAS, copies of the notice of public hearing and a statement concerning acquisition of property by the Commission were mailed by first class mail to the last known address of each assessee of each parcel of land in the existing APIP, BWIP and WECIP Project Areas (collectively referred to as the "Project Areas), as shown on the last equalized assessment roll of the County of Alameda; and WHREAS, copies of the notice of public hearing were mailed by certiied mail with retu receipt requested to the governg body of 'each taxing agency which receives taxes from property in the Project Areas; and WHREAS, copies of the notice of public hearing were mailed by first class mail to al residents and businesses in the Project Areas; and WHREAS, the Commsion and the City Council have reviewed and cbnsidereCl the Mitigated Negative Declaration, as prepared and submitted pursuant to Public Resources Code Setion 21151 and Health and Safety Code Setion 33352, and determed tht there is no substatial evidence tht the Amendments wi have a signcant effect on the environment; and WHREAS, the City Council has considered the Report of the Commsion, the Report and Recommendations of the Plang Board, the Amendments and the Mitigated Negative Declaration, ha provided an opportty for al persons to be heard and ha received and considered al evidence and testiony presented for or agait any and al aspects of the Amendments, and ha adopted wrtten fidigs in respons to each wrtten objection to the Amendments from an afected tag entity or propert owner, if any; and WHREAS, al actions required by law have been taken by al appropriate public bodies. NOW, THREORE, TH CIT COUNCIL OF TH CIT OF ALAMEDA DOES HEREBY ORDAIN AS FOLLOWS: Setion 1The purpose and intent of the City Council with respect to the APIP Amendment is to amend the Communty Improvement Plan for the APIP to delete the Exchage Area, thus allowig the Exchage Area to be added to the BWIP Project Area, which wil facilitate the effective redevelopment of the BWIP Project Area, including the Exchange Area, facilitate the development of the Catellus mixed use project and allow for residential development, including affordable housing, within the BWip Project Area, as amended. Section 2.The City Council does hereby specifically find and determine that: a. The APIP Amendment wil enable the APIP and BWIP Project Areas to be redeveloped in conformity with the Community Redevelopment Law and in the interests of the public peace, health, safety and weUare. This finding is based upon the fact that redevelopment of the APIP and BWIP Project Areas, including the Exchange Area, as contemplated by the Community Improvement Plan for the APIP and the BWIP, as amended by the APIP and BWIP Amendments, wil implement the objectives of the Community Redevelopment Law by facilitatig the development of the Catellus mied use project in the BWIP Project Area and in the Exchange Area; faciltatig development of housing, including afordable housing, in the Exchage Area; aiding in the elimation and correction of the conditions of blight and deterioration in the BWIP and APIP Project Areas; providing for plang, development, redesign, clearance, reconstrction or rehabiltation of properties wit: the APIP and BWI Project Areas which need improvement; pr()viding' .ifordabl housing, including housing for low- and moderate-income persons; providing additional employment opportuties; and providing for higher economic utization of potentialy usefu land. b. The adoption and carg out of the APIP Amendment is economicaly sound and feasible. Th fidig is based on the fact that the APIP Amendment wi not signcantly affect the ficial feasibilty of the APIP, and wil not adversely afect the constrction or rehabiltation of any affordable housing project with the APIP Project Area. Residential development with the remag portion of the APIP Projec Area is projected to match the ta increment generatig potential of al residential development as described in the 1998 APIP Report to Council. Th fiding is fuer based upon the fact tht the Communty Improvem.ent Plan for the APIP and the BWI, as amended, wi alow for the ficial feasibilty of the Catellus mied use development project in the BWI Projec Area and the Exchage Area. Th fidig fuer based upon the fact tht under the Communty Improvement Plan for the APIP, as amended, the Commsion wi be authorized to seek and utiize a variety potential fiancing resources, including ta increments; that the natue and tig public redevelopment assistace wi depend on the amount and availabilty of such financing resources, inclug tax increments generated by new investment in the APIP Project Area; and tht under the APIP Communty Improvement Plan, as amended, no public redevelopment activity will be undertaken uness the Commssion can demonstrate that it has adequate revenue to fiance the activity. c. The carrying out of the APIP Amendment wil promote the public peace, health, safety and welfare of the City of Alameda and wil effectuate the purposes and policies of the Community Redevelopment Law. This finding is based upon the fact that redevelopment, as contemplated by the APIP and BWIP Community Improvement Plans, as amended, will benefit the APlP and BWIP Project Areas, by correcting conditions of blight and by coordinating public and private actions to stimulate development and improve the economic, social and physical conditions of the APIP and BWIP Project Areas, including the Exchange Area. Setion 3.The Council is satisfied that all written objections, if any, received before or at the noticed public hearing have been responded to in writing. In addition written findings have been adopted in response to each written objection of an affected propert owner or taxing entity, if any, which has been fied with the City Clerk either beore or at the noticed public heaing. Setion 4.The City Council finds and determes that the APIP Amendment is covered by the Mitigated Negative Declaration adopted by the Commssion on lach 18 2003, by Commsion Resolution No. 03-107 ,and reviewed by the City Council on Ma 18 2003, in City Council Resolution No. 13566 . The fidings and determtions of the Commsion and City Council i1 said Resolutions are incorporated herein by reference. Setion 5Subject to the conditions set forth in Setion 7 beow, the Communty Improvement Plan for the Alameda Point Improvement Project, as adopted by Orce No. 2754, is hereby amended as set fort in the proposed "First Amendment to the Communty Improvement Plan for the Alameda Point Improvement Projec" attched hereto as Exbit Aand incorporated herein and made a part hereof by reference. As so amended, the Communty Improvement Plan for the Alameda Point Improvement Project is hereby incorporated by reference herein and deSignted as the offcial Communty Improvement Plan for the Alameda Point Improvement Project. Setion 6. The Exective Director of the Commsion is hereby authoried to combine the Communty Improvement Plan for APIP, as amended by the APIP Amendment, into a single docent, and said document, when fied with the City Clerk and the Sereta of the Commsion, shal constitute the offcial Communty Improvement Plan for APIP in place of the document curently constitutig said Communty Improvement Plan. Setion 7The approval contained in Section 5 hereof are specifcaly subject to and conditioned upon the followig becomig effective: Those provisions of Ordinace No. 2896 Approving and Adoptig the Fif Amendment to the - Community Improvement Plan for the Business and Waterfront Improvement Proje adding the Exchange Area to the BWIP Project Area. Setion 8In order to implement and facilitate the effectuation of the APIP Amendment, together with the BWIP Amendment and the WECIP Amendment, it may be necessary for the City Council to take certain actions, and accordingly, this City Council hereby (a) pledges its cooperation in helping to carry out the Community Improvement Plans for the APIP, BWIP and WEClP, as amended; (b) requests the various officials, departments, boards and agencies of the City of Alameda having administrative responsibilities in the Project Areas likewise to cooperate to such end and to exercise their respective functions and powers in a maner consistent with the redevelopment of the Project Areas pursuant to the Community Improvement Plans for the APIP, BWIP and WECIP, as amended; (c) stands ready to consider and take appropriate action upon proposals and measures designed to effectuate the CommuJ;ty Improvement Plan for the APIP, BWIP and WECIP, as amended; and (d) declares its intention to undertae and complete any proceedings necessar to be carried out by the City under the provisions of the Community Improvement Plan for the APIP, BWIP and WECIP, as amended. Section 9 by this Ordinance. Ordinance No. 2754 is contiued in full force and effect as amended Setion 10. The City Clerk is hereby directed to send a certiied copy of this Ordince to the Commsion, whereupon the Commsion is vested with the responsibilty for caring out the Communty Improvement Plan for the APIP, as amended. Setion 11. The City Clerk is hereby directed to record with the County Recorder of Alameda County a notice of the approval and adoption of the APIP Amendment pursuant to th Ordince, contaig a statement that proceedigs for the redevelopment of the APIP Project Area, as amended by the APIP Amendment, have been intituted under the Caiforna Communty Redevelopment Law. Setion 12. The City Clerk is hereby directed to tranmit a copy of ths Ordice, a desription of the land with the Exchage Area, and a map or plat indicatig the amendments to the boundares of the APIP Project Area, to the' auditor, assessor and tax collector of the County of Alameda, to the governg body of each of the taxing agencies which levies taxes upon any propert in the APIP Project Area, as amended, and to the State Board of Equalization. Setion 13Effective Date.Ths Ordinance shall'be in ful force and effect from and after the expiration of thity (30) days from the date of its final passage. Section 14Publication. The City Clerk is hereby ordered and directed to certify to the passage of this Ordinance and to cause the same to be published once in the Alameda Journal, a newspaper of general circulation, published and circulated in the City of Alameda, California. Section 15SeverabilityIf any part of this Ordinance, or the APIP Amendment which it approves, is held to be invalid for any reason, such decision shall not affect the validity of the remaining portion of this Ordinance or of the APIP Amendment, and this City Council hereby declares that it would have passed the remainder of the Ordinance, or approved the remainder of the APIP Amendment, if such invalid portion thereof had been deleted. The "Legal Description of the Project Area Boundaries" attached to the Plan as Attachent No.1 is hereby replaced in its entirety with Attachment No. attached hereto as Exhbit, A and incorporated herein by this reference. 2. The "Project Area Map" attached to the Plan as Attachment No.2 is hereby amended to exclude that certain area depicted in the "Exchange Area Map, attached hereto as Exhibit B and incorporated herein by this reference, and described in the "Legal Description of the Exchange Area," attached hereto as Exhbit C and incorporated herein by ths reference (the "Exchange Area 3. The "Redevelopment Land Use Map" attached to the Plan as Attachent No.3 is hereby amended to exclude the Exchange Area. 4. Section B.2, 404, Single-Family Residential Uses, in Part IV of the Plan, is hereby amended to delete the reference to "East Housing. 5. Secton C.1407, Public Rights-of-Way, in Part IV of the Plan, is hereby amended to delete the references to Decatu Street, Arnold Avenue and any other street located entiely with the Exchange Area. 6. Any additiona provisions of the Plan, including the text and attachents, applicable to the Exchange Area shall be void and of no futher force and effect.
