MUCIPAL UTILITY DISTRICT , AS GRATEE , AN THE
CITY OF ALAMEDA , AS GRATOR, FOR THE NAVAL
STATION ALAMEDA REPLACEMENT WASTEWATER
INTERCEPTOR SYSTEM PROJECT
WHEREAS , on May 4 , 1999 , the City Council approved an Agreement between East
Bay Municipal Utility District (EBMU), City of Alameda and the Port of Oakland for Design ofthe
Alameda Point Estuary Sewer Relocation Project; and
WHEREAS , on December 7 , 1999 , the City Council adopted a Negative Declaration
and Mitigation Monitoring Program for the Naval Air Station Alameda Replacement Wastewater
Interceptor System Project; and
WHEREAS , the project relocates the existing sewer serving Alameda Point :tom the
western portion of the Alameda Oakland Estuar to a location approximately 1.5 miles to the east
adjacent to the Webster Tube; and
WHEREAS , final alignent of the pipeline necessitates a modification to the
pennanent easement; and
WHEREAS , the City of Alameda owns or administers , as Tidelands Trusts , the
underlying property for the easement.
NOW , THEREFORE , BE IT ORDAID by the Council of the City of Alameda
that:
Section 1 . The City Council ofthe City of Alameda hereby accepts a quit claim deed
from East Bay Municipal Utility District Relinquishing a previous easement for the Naval Air
Station Alameda Replacement Wastewater Interceptor System Project and approves and authorizes
the City Manager to execute a revised easement between East Bay Municipal Utility Distrct , as
Grantee , and the City of Alameda, as Grantor , for the Naval Air Station Alameda Replacement
Wastewater Interceptor System Proj ect.
Section 2 . This ordinance shall be in full force and effect ITom and after the
expiration of thirty (30) days from the date
