AMENDING ORDINANCE 2776 AN GRATING A 5 YEAR EXTENSION OF
NON-EXCLUSIVE CABLE TELEVISION FRANCHISE TO COMCAST OF
ALAMEDA, INCORPORATED
WHEREAS , the curent ftanchise, Ordinance 2776 between the City of Alameda
and Comcast of Alameda , Inc., a California Corporation, formally United Cable
Television of Alameda, Inc. hereinafter referred to as "Grantee , is up for renewal; and
WHEREAS , provisions of the current franchise provide for a one-time, five-yearextension ofthe ftanchise agreement provided all terms and conditions of the franchise
have been met; and
WHEREAS , Grantee is committed to improving its infastrctue so as to
improve its distribution of services to the citizens of Alameda; and
WHREAS , Grantee has agreed to upgrade the Emergency Alert System
equipment that is curently in use by Grantee for local activation; and
WHREAS , Grantee has been providing cable communcations services to the
citizens of Alameda under the existing franchise agreement for five years.
that:
NOW, THEREFORE, BE IT ORDAID by the Council ofthe City of Alameda
Section 1. The City Council Ordinance fids that the Grantee is substantially in
compliance with the ftanchise agreement.
Section 2. The City Council does hereby exercise its right to extend the existing
franchise with Comcast of Alameda, Inc., formally United Cable of Alameda, Inc. for a
second ftanchise period of five years.
Section 3. Insurance requirements contained in paragraph 8.1 and 8.2 wil be
upgraded to curent City standards as set out in Exhbit A.
Section 4. This ordinance shall be in full force and effect ftom and after the
expiration of thirty (30) days from the date of its final passage; provided however, that
this Ordinance shall not become effective unless and until Grantee fies written
acceptance thereof and an agreement to be bound by and comply with all of the
requirements thereof.
