APPROVING AN AUTHORIING EXECUTION OF LEASE
BETWEEN THE CITY OF ALAMEDA (LESSOR)
THE COUNTY OF ALAMEDA (LESSEE)
FOR REAL PROPERTY LOCATED AT 1429 OAK STREET
WHEREAS , the City of Alameda owns certain real property located at 1429 Oak
Street in Alameda, Californa (herein "real property ); and
WHEREAS, the real property has been utilized by the City as the Children
Library in the past but is no longer occupied as such; and
WHEREAS , the County of Alameda leases the property located at 2226 Santa
Clara Avenue from the City in order to operate its Behavioral Health Services programs
which benefit the community; the current County lease will expire on April 18, 2005; and
WHREAS , both the City and the County of Alameda desire that the County
Behavioral Health Services program continues operating in the Alameda downtown area;
and
WHREAS , the City and the County of Alameda desire to relocate the County
Behavioral Health Services program to the real property located at 1429 Oak Street; and
WHEREAS , it is in the public interest that said premises be so leased; and
WHEREAS, pursuant to City Charter section 3-, no real property of the City
shall be leased for a period in excess of one year or sold , except upon the affrmative vote
of four members of the Council.
NOW , THEREFORE , BE IT ORDAIED BY THE COUNCIL OF THE CITY
OF ALAMEDA, by four affirmative votes , that:
Section L The City Council hereby approves execution of the Lease between the
City of Alameda as Lessor and the County of Alameda as Lessee.
Section 2 That the form of Lease referred to in the above , and the terms
conditions and covenants contained therein are hereby approved.
Section 3 . That the Acting City Manager of the City of Alameda be , and is
hereby authorized to execute , for an on behalf of the City of Alameda , the Lease
substantially in the fomi and containing the terms and conditions and covenants as set out
in the Lease on file in the Office ofthe City Clerk.
Section 4.This ordinance shall be in full force and effect from and after
expiration of thirty (30) days from the date of its final passage.
