JANUARY 18, 1994
The meeting was convened at 7:35 p.m. (following the Community
Improvement Commission Meeting) with President Withrow presiding.
Boy Scout Pack 6, Den 2, presented Color Guard ceremony and led
Pledge of Allegiance.
ROLL CALL -
Present: Councilmembers Appezzato, Arnerich,
Lucas, Roth and President Withrow - 5.
Absent: None.
ANNOUNCEMENTS OF CLOSED SESSION ACTIONS
94-019 Mayor Withrow announced that Council net in a Special
Meeting at 6:30 p.m., and adjourned to Closed Session to consider:
Labor Relations, pursuant to Subsection (a) of Government
Code Section 54957.6 of the Brown Act: Council provided guidance
to City's negotiator; and
Initiation of Litigation, pursuant to Subsection (c) of
Government Code Section 54956.9 of the Brown Act: no action was
taken.
PROCLAMATIONS AND SPECIAL ORDERS OF THE DAY
94-020 Mayor Withrow introduced two exchange students from
Spain, Alejandra Fernandez, guest of the Charles & Barbara Johnson
family, and Diego Gracia, guest of the Mayor's family.
CONSENT CALENDAR
Mayor Withrow, at the request of a citizen, removed report 94-030
regarding award of fireboat from Consent Calendar for discussion.
Vice Mayor Roth moved the remainder of the Consent Calendar;
Councilman Arnerich seconded the motion which carried by unanimous
voice vote - 5.
*94-021 Minutes of the Regular Council Meetings of December 21,
1993, and January 4, 1994, and the Special Council Meeting of
January 4, 1994. Approved.
*94-022 Report from Public Works Director recommending Award of
Contract [to Mori Hatsushi & Associates] for Planting of Street
Trees in the City of Alameda, No. P.W. 11-93-15. Accepted.

*94-023 Report from Public Works Director recommending
Authorization of Execution of an Extension of Agreement for
Provisional Charges for the Closure and Post-Closure Maintenance of
Altamont Sanitary Landfill [Waste Management of Alameda County,
Inc., (formerly Oakland Scavenger)]. Accepted.
*94-024 Report from Community Development Director Recommending
Reprogramming CDBG Funds, Amending Fiscal Year 1993-94 Final
Statement and Authorizing Amended Grant Agreements [ACHCD and
Alameda Red Cross]. Accepted.
*94-025 Report from Finance Director transmitting Investment
Report for period Ending December 31, 1993. Accepted.
*94-026 Resolution No. 12494 "Resolution of Intention to
Vacate a Portion of Mecartney Road Right-of-Way Adjacent to 158
Maitland Drive, and a Determination that the Project is
Categorically Exempt Pursuant to Subsection 15305(A) of the
California Environmental Quality Act (CEQA), and Fixing a Date and
Time for Public Hearing." Adopted.
*94-027 Resolution No. 12495 "Authorizing Execution of State-
Local Transportation Partnership Program Agreement No. SLTPP-5014
and Program Supplement No. 003, (Repair and Resurfacing of Certain
Streets, Phase 15)." Adopted.
*94-028 Ordinance No. , N.S. "Authorizing Amendment to the
Bay Farm Island Recreation Center Lease Agreement Between the City
of Alameda and Bay Fairway, Inc." Introduced.
*94-029 Bills, certified by the City Manager to be true and
correct, were ratified in the sum of $2,352,899.48.
94-030 Report from Fire Chief regarding Award of Surplus
Fireboat from the General Services Administration.
Gerhard Degemann, Alameda, requested the Fire Chief report to the
public on why the City is obtaining a fireboat.
The Fire Chief explained the City's long-standing need for a
fireboat; the provision of service needed for marine facilities,
ferryboats, and Coast Guard Island; and that the fireboat was
obtained for transportation cost.
In response to Vice Mayor Roth, the Fire Chief replied negotiations
are taking place with a couple of marinas, for docking of the
fireboat.
Vice Mayor Roth moved acceptance; Councilmember Lucas seconded the

motion which carried by unanimous voice vote - 5.
AGENDA ITEMS
Actions Related to Base Conversion Process.
94-031 Status Briefing on Base Conversion Process.
Neil Patrick Sweeney, Alameda, stated he would like BRAG and EBCRC
to furnish all public information to ethnic media; and perhaps
more people will provide ideas concerning NAS.
Gerhard Degemann, Alameda, stated that at the last Board of
Education Meeting, an informative report was made by Navy Commander
Alfred B. Elkins, and suggested he [Elkins] be invited by Council
to provide information.
President Withrow noted Commander Elkins is the single point of
contact designated by the federal government, is doing a good job
and Mr. Degemann's idea is good.
Don Parker, Project Director, gave update on draft budget and EBCRC
in relation to the budget, legislative status (on new laws enacted
several months ago concerning process); aviation briefing to be
held on January 26; a port briefing to take place in February or
March; Alameda Science City, EBCRC's efforts on asset
proposal/conceptual business plan; reported on January 5th Reuse
Authority meeting, hosted by Mayor Withrow at EBCRC's request,
including bloc voting, membership, and period of transition.
Councilman Arnerich requested briefing by Project Director;
following discussion, Vice Mayor Roth requested Work Session to
allow for Council discussion for briefing by the Project Director.
Mayor Withrow requested the City Manager provide a position paper
that would assess and evaluate options available to the City; and
provide a recommended City position for discussion at the Work
Session. Councilmember Appezzato stated he endorses holding a
public Work Session; Councilmember Lucas requested evening meeting.
Mayor Withrow reported on meeting called by Senator Barbara Boxer,
held at Fort Mason; noted Navy presented position on NAS, Oak
Knoll, Treasure Island & Mare Island; and discussed toxic cleanup.
94-032 Public Hearing to consider Ordinance No. 2655, N.S.
"Amending the Alameda Municipal Code by Amending Subsections 5-2.2
(Separate License for Each Place of Business); 5-2.6 (License for
Less Than Full Period); 5-3.8 (Transfer of License; Procedure); 5-
3.10 (Lost License); 5-4.2 (Minimum Tax); 5-5.2 (Veterans); 5-7.2
(License A Debt); and Adding Subsections 5-2.7 (Evidence of Doing
Business); 5-3.11 (No Bill Required); 5-7.6 (Collection of

Delinquent Charges and Fees) to Chapter V (Licenses and Permits)
Pertaining to City of Alameda Business Licenses." Adopted.
William Garvine, Alameda Chamber of Commerce, requested that
whenever Council considers business license increases or fees, that
it do so with the information at hand as to where we are on a
competitive basis with other municipalities; commended staff and
stated he would like City to keep up the good work.
Vice Mayor Roth stated he voted against this originally, and he
wants to be sure Council is aware that this [ordinance] does not
increase fees, drops small business fees from $96 minimum to $50 or
$75 depending on income; passage of the ordinance will result in
decrease of revenue; if City does not send bills to ongoing
businesses, they may forget to renew license resulting in dunning
letters and late fees; and Council should address that.
Councilmember Lucas stated although the minimum license tax is
being lowered; she believes much stricter enforcement is possible
which may make up for the difference in revenue; and moved approval
of final passage. Councilman Arnerich seconded the motion which
carried by the following voice vote: Ayes: Councilmembers
Appezzato, Arnerich, Lucas and President Withrow - 4. Nayes: Vice
Mayor Roth - 1. Absent: None.
94-033 Report from President, Social Service Human Relations
Board, Regarding "SSHRB EXCHANGE: What's In It For Kids?".
Accepted.
Councilman Arnerich moved acceptance of the recommendation. Vice
Mayor Roth seconded the motion which carried by unanimous voice
vote - 5.
94-034 Report from Public Works Director recommending
Authorization to Participate in the State Revolving Loan Program
for Funding of Infiltration and Inflow Projects. Accepted.
Councilmember Lucas moved approval. Councilman Arnerich seconded
the motion.
In response to Councilmember Appezzato concerning possible rate
increase in the near future, the Public Works Director stated the
sewer rates have not been revised for almost six years; by
participating in Program, the City may be able to keep increase
smaller, but will return in May or June for cost increase in sewer
rate.
The motion was carried by unanimous voice vote - 5.
94-035 Report from Community Development Director Recommending

Funding Allocations for Homeless Services. Accepted.
President Withrow commended Virginia Krutilek, Dr. Alice Challen,
and a large number of volunteers for time and energy expended on
the program throughout the year.
Councilman Arnerich questioned if the homeless will receive all the
funding, and if a public hearing is required.
The City Manager responded, when dealing with Block Grant process,
hearings will take place, next year's will be agendized in February
and the awards in March and April; reallocations can be made during
the year.
Councilman Arnerich requested the Community Development Director
forward dates to Council as mentioned by the City Manager.
Councilman Arnerich moved acceptance of recommendation. Vice Mayor
Roth seconded the motion which carried by unanimous voice vote - 5.
94-036 Ordinance No. 2656, N.S. "Authorizing Grant of Access
Easement to Peter R. and Trijntje Kluitenberg on the Property
Adjacent to 211 Beach Road." Adopted.
Councilmember Lucas moved final passage. Vice Mayor Roth seconded
the motion which carried by unanimous voice vote - 5.
ORAL COMMUNICATIONS, NON-AGENDA
94-037 Neil Patrick Sweeney, Alameda, noted telephone numbers
and publications for base conversion information, Senator Barbara
Boxer's meeting, and suggested uses for NAS property.
94-038 John Scott Graham, Alameda, commented on Peralta College
and encouraged persons who may lose jobs at NAS to attend schools
to retrain for new job opportunities.
94-039 Stanley Voogd, Alameda, stated he is retired; had applied
for Golden Handshake program; position has not been filled; and he
requests he be included in the program.
President Withrow requested a report from the City Manager who
responded the City has informed Mr. Voogd of the City's position,
and copies will be forwarded to Council.
94-040 Alan Garcia, State President, Retired Peace Officers'
Association of California, Sacramento, stated he has been following
a number of such incidents statewide; and would suggest Council
examine the issue and make it right for Mr. Voogd.

NEW BUSINESS AND UNFINISHED BUSINESS
94-041 Vehicle Impound Program for Drivers with Suspended/
Revoked Licenses. (Councilman Arnerich) (Continued from December
21, 1993, Council Meeting.
Councilman Arnerich requested staff look into the type of program
in effect in Santa Rosa, whereby cars are impounded when stopped by
police and drivers are found to have invalid licenses, and report
back to Council.
Councilmember Lucas commented perhaps some NAS facilities could be
used for storage [of cars].
94-042 Councilman Arnerich requested status report on all
agencies in Alameda involved in Disaster Preparedness, that
everything be in place, and information, on what to do and where to
go in earthquake emergency, be dispensed.
Councilmember Lucas stated she would like emergency instructions
mailed with Bureau of Electricity bills.
94-043 Councilmember Appezzato stated recently the Ninth Circuit
United States Court of Appeals struck down a ruling on cable
television and basically stated a city can limit the number of
cable operators but cannot grant an exclusive franchise if utility
poles and other facilities can handle more; and requested report on
whether, if we go out to bid, we can reduce costs if we can get
competition, and whether we have facilities; and we should be
prepared to seek competition if that is possible.
ADJOURNMENT
94-044 President Withrow adjourned the meeting in memory of
those who lost their lives in Southern California during the recent
earthquake; and to reflect upon the suffering being experienced by
many of the survivors.
