FEBRUARY 4, 1992
The meeting convened at 7:41 p.m. (following the Alameda Public
Improvement Corporation Meeting) with President Withrow presiding. The
Pledge of Allegiance was led by Councilmember Roth. Reverend Mary Rowe
gave the invocation.

Mayor Withrow announcec. that Council, as the Housing Authority Board of
Commissioners, adjourned to Closed Session at 6:15 p.m., to discuss a
special issue and the results of that discussion will be announced at
the next regularly scheduled Housing Authority [Board of Commissioners]
Meeting.
ANNOUNCEMENT OF CLOSED SESSION ACTIONS
Mayor Withrow announced that Council adjourned to Closed Session
[convened at 6:50 p.m.] at a Special Meeting to consider:
92-079 Pending Litigation, Turner v. City of Alameda, pursuant to
Subsection (a) of Government Code Section 54956.9 of the Brown Act:
Mayor Withrow stated Council discussed matter; no action was taken.
92-080 Real Estate Negotiations concerning real property identified as
Parcel No. 74-905-20-3, Atlantic Avenue/Alameda Belt Line real
property, pursuant to Section 54956.8 of the Brown Act: Mayor Withrow
stated Council gave instructions to the City negotiator.

92-089 Resolution No. 12193. "Authorizing Cooperative Agreement
Between the City of Alameda and the State of California for the Bay
Farm Island Bike Bridge Project." Adopted.
Don Roberts, Alameda, requested information on the funding sources for
the Bike Project.
Public Works Director responded that funding from sources already
committed amounts to about $1,500,000; no General Fund Money is
involved; source being investigated is Proposition 116 money and if
that is received, that could come close to the total funding package.
Councilmember Lucas moved approval of the resolution. Councilmember
Camicia seconded the motion.
Councilman Arnerich stated he wants no money taken from General Fund
or surplus accounts.
The motion was carried by unanimous voice vote - 5.
AGENDA ITEMS
92-090 Public Hearing to obtain Citizens' Comments on Housing and
Community Development Needs,
Jim Franz, Red Cross Social Services Coordinator, stated he has

observed some rental assistance for one or two months can sometimes
keep persons from becoming homeless, which is less costly than helping
after people become homeless; and encouraged Community Development to
consider homeless prevention as a major [factor] in homeless situation.
Lawrence VanHook, Alameda, requested Council consider CDBG funds for
expansion of programs in West End Ten Program, for teaching e.g.,
communication skills, tutoring, ethics.
Clayton Guyton, Alameda, stated he would like CDBG funds to be used in
creative ways to employ City youth who have difficulty in school, and
encourage them to participate better, reduce tardiness, absenteeism,
and better interact with school authority figures.
Herman Collins, Alameda Youth Development Association, West End Teen
Program, stated the program has been growing and the children have
benefitted; requested Council continue to develop the youth in the
community.
Councilman Arnerich moved acceptance of recommendation [to hear
comments]; with citizens' comments to be noted by staff. Councilmember
Camicia seconded the motion which was carried by unanimous voice vote -
5.
92-091 Report from Vice Mayor Lucas regarding Business Retention
Program.
President Withrow stated he agrees with Vice-Mayor's issue [to schedule
regular Business Roundtable with larger employers); addressing City's
businesses is imperative; he has sent letter to over 2000 businesses,
and met with many; City must show firms Alameda is a place businesses
can grow and prosper; noted a major German firm was deterred from
coming to Alameda, for reasons of size but also because an attorney
firm from another city, sent letter stating Alameda is tightly knit,
highly organized, group of radicals; the City must overcome that
image.
Councilmember Lucas stated appreciation for Mayor's efforts; a
long-term organized channel of communication should be put in place;
she would like to establish a business communication between local
business and local government.
Councilman Arnerich stated Councilmember Lucas's suggestion is
brilliant; companies owe Council notification that they intend to
leave; any such information staff receives should be forwarded to
Council.
Councilmember Roth inquired what is to be accomplished at the meetings
and why not schedule for all of Council to attend.
Councilmember Lucas stated businesses may communicate more freely
without the press present.
Councilmember Roth suggested perhaps meetings should be on a
one-to-one- basis, an held at the business site.

Councilmember Lucas stated that is a possibility; however, a luncheon
setting is not quite so formal, is a way of making [business persons
feel more welcome, a part of the community; she does not want t
short-cut any other formal relationships going on, but the Roundtabl_
is to be an additional effort.
President Withrow stated this [effort] would fill the void of having a
Chamber of Commerce that does not have depth, breadth and capacity
other cities have.
Councilmember Lucas stated she is hoping for a more permanent organized
effort that will continue in the future.
Councilmember Camicia suggested expanding the idea to inviting
businesses not yet in Alameda.
Councilmember Lucas moved to request staff to work out details of the
Business Roundtable. Councilmember Camicia seconded the motion which
carried by unanimous voice vote - 5.
92-092 Report from Public Works Director recommending acceptance of
work by Watkin & Bortolussi, Inc. for Construction of Landscape
Improvements for Alameda Shoreline Park, Tract 5905 and Tract 4500,
Phase 3B, No. P.W. 1-90-02.
Councilmember Camicia moved acceptance. Councilmember Roth seconded.
Councilman Arnerich commended the Public Works Director for completing
the work under budget, and thanked all departments involved.
The motion carried by unanimous voice vote - 5.
92-093 Resolution No. 12194. "Appointing Valuation Assessment
Commissioners of Bay Farm Island Reclamation District No, 2105."
President Withrow and the City Manager stepped down from the dais as
they reside in the area under discussion.
Vice-Mayor Lucas assumed the Chair.
Thomas Jordan, Executive Director, Community of Harbor Bay Isle
Homeowners' Association, stated the Board supports the recommendation
before Council, to appoint the Valuation Commissioners, but want to
make clear they do not wish to prejudice ongoing discussions between
community and City regarding feasibility of City taking over function
and responsibility of assessment district through the General Fund.
Councilmember Roth commented on three options: 1, City take over and
fund completely; 2, assessment district under City control and 3,
assessment district under homeowners control.
Mr. Jordan replied the only option the community wishes to discuss is
the option of the City taking it [function of district] over through
the General Fund; if that is not feasible, the community's position
would be that the District should remain as it is.

The Assistant City Manager stated the intention was to move ahead and
not have [appointments] interfere with ongoing discussions or
jeopardize decision in the future.
Councilmember Roth moved approval of the recommendation [to, adopt
resolution, appointing William R. Kirkland, James R. Stillman, and
John J. Keeting as Valuation Commissioners]. Councilman Arnerich
seconded the motion which carried by the following voice vote: Ayes:

92-094 Resolution No. 12195. "Determining to Undertake Proceedings
Without Further Action under Division 4 of the Streets and Highways
Code, City of Alameda, Harbor Bay Business Park Assessment District
92-1." (Held over from January 21, 1992, Council Meeting)
Councilmember Camicia moved acceptance. Councilmember Lucas seconded.
In response to Councilman Arnerich, the City Manager stated the action
consolidates five existing assessment districts into one, and
refinances, which will both consolidate and bring lower interest rate;
the significant savings will be the coupon rates on those bonds, and
the property owners will ultimately be the beneficiaries.
Councilmember Roth inquired if the motion would be amended to include
passage of the four related resolutions [92-094, 095, 096, 097]
Councilmember Camicia agreed. Following reading of 92-095, 96, 97, the
motion carried by unanimous voice vote - 5.
92-095 Resolution No. 12196. "Appointing Engineer, Attorneys and
Underwriter, City of Alameda, Harbor Bay Business Park Assessment
District 92-1." (Held over from January 21, 1992, Council Meeting)

92-096 Resolution No. 12197. "Resolution of Intention to make
Acquisitions and Improvements, City of Alameda, Harbor Bay Business

92-097 Resolution No. 12198. "Preliminarily Approving Engineer's
Report, Appointing Time and Place of Hearing Protests and Directing

92-098 Resolution No. 12199. "Proposing to amend the City of Alameda
Charter Pertaining to the Preservation of Alameda's Public Parks and to
include the Proposal in the Consolidated June Primary Election to be
held in the City of Alameda on Tuesday, June 2, 1992." (Continued from
January 21, 1992, Council Meeting) Adopted.
Claire Gadsden, Alameda, stated her support of placing the proposed
measure on the ballot; commented no one can predict how future
Councilmembers might vote on the issue.
Louise Merritt, Alameda, stated she would like measure put on the
ballot; parks are needed by youth.

Edward Trevethan, Member, Golf Commission, stated he believes presen4-
Council would not sell recreational or open space lands; cost 0
putting measure on ballot could not equal future citizens' assurance
requested Council put measure on ballot and allow citizens to vote.
Don Roberts, Alameda, discussed with City Attorney the provision, to
replace land sold, with comparable size and utilities; and urged
Council vote for change in presenting this [matter] to the people; he
does not believe Councilman Arnerich's intent has been fully written
into the resolution, as he believes a loophole exists which would allow
a future City Council to make a decision to sell or trade a portion of
the Golf Course.
Don Sherratt, Alameda, stated he supports Councilman Arnerich's
proposal and if any question exists that the City's parks or open space
can be sold, it should be made certain there will be no loss to the
community of City's open space or parks.

Alameda, stated Councilman Arnerich's proposal has merit;
the problem, would Council be willing to vote for [the
cost is small compared to money spent on consultants;
support the proposal.
Mike Janvier, Alameda, stated he, as citizen and parent, supports
Councilman Arnerich's resolution, commented on importance of parks, and
requested Council allow citizens to make the decision.
Sal Ferris, Alameda, urged Council put matter on the ballot to alloy
citizens to vote regarding parks.
Clayton Guyton, Alameda, stated he would like the money that would be
used to place item on the ballot, be used at Woodstock Park.
President Withrow stated he believes the risk in this matter is remote,
looks at the issue as buying an insurance policy, for things that are
of value, or have a low probability of occurring; and that may be what
Council must consider to protect open areas of the City on the long
term; and that is what he is weighing.
Councilmember Lucas stated she supports Councilman Arenrich's proposal;
the proposal is good, is an insurance policy; parks and open spaces
are an asset to the community.
President Withrow inquired if Council made a Charter change reflecting
the [proposed] restriction, would that preclude courts from directing
conversion.
The City Attorney replied she could not imagine a situation where a
federal judge could order the City to violate this [proposed] Charter
provision.
Councilmember Roth stated Californians have always supported parks and
State Government Code deals with the subject; if the City wanted to
sell a park, steps to be taken allow for ample public input, and
requires offer in writing to many agencies, e.g., State Resources
Agency; and further described procedure; current Council would not

sell; when the City has more money, the item can be put on the ballot.
Councilmember Camicia agreed, stated the process [to sell] would take
years, within that timeframe, it would be easy to place a measure on
the ballot; therefore, in the midst of a recession, he will not vote
for the proposal.
Councilman Arnerich stated he believes in his proposal; wants to see
open space preserved; people could vote on the matter; if the cost of
$3000 to $6000 bothers Council, he will recommend Council not to go to
any more conferences this year, and he will personally pay for
placement of measure on ballot.
Councilman Arnerich moved Council support the resolution as proposed
and [and the matter of] selling of open space in future be placed on
the ballot in June [1992] to permit citizens to decide the issue.
Councilmember Lucas seconded the motion.
Councilmember Camicia stated he would like to clarify to citizens that
no current proposal exists to sell parks; and no threat exists.
President Withrow stated one concern is that a Council might come under
pressure if an economic downturn becomes a problem; he is concerned
about attitude of courts in the area and the threat that a judge could
order the City to use some open space for some type of utilization is a
risk; cost involved is a reasonable insurance policy to protect
against [that risk], and the City Attorney stated a Charter provision
would effectively forestall a federal judge from [issuing such order].
The City Attorney inquired if Councilman Arnerich wants to include the
remaining paragraphs of the recommendations in his motion, that Council
may direct City Attorney to prepare impartial analysis, and that
Council may designate itself, a member or some of its members, to
prepare ballot measure arguments.
Councilman Arnerich stated the City Attorney should prepare impartial
analysis, and he would want to prepare the argument together with any
other Councilmember who wishes to support his position. Councilmember
Lucas agreed to second that amendment to motion. The motion carried by
the following voice vote: Ayes: Councilmembers Arnerich, Lucas and
President Withrow - 3. Noes: Councilmembers Camicia and Roth 2.

Councilmember Camicia moved adoption of the ordinances. Councilmember

92-114 Ordinance No. 2590, N.S. "Accepting Dedication of 0.117 Acre
Shoreline Pedestrian Access Parcels from Alameda Marina Village
Associates."
Councilmember Camicia moved adoption. Councilmember Roth seconded the
motion which was carried by unanimous voice vote - 5.
92-115 Written Communication from William and Patricia Voulgaris,
Yellow Checker Cab Company of Berkeley, expressing desire to serve
Alameda.
Patricia Voulgaris, Co-owner, Yellow Checker Cab Company, described
background of Company; expressed desire to serve Alameda; noted the
Company services, e.g., seniors, handicapped, children, hospital; Mr.
Voulgaris (Co-owner) is master mechanic; Company owns its own cabs;
and petitioned Council allow Company at least two or three permits.
In response to Councilmember Camicia,s inquiry, the City Manager
supplied background on the establishment of the 96 cab permit limit;
noted 11 or 12 cab companies service the City.
Council discussed wiLh Chief of Police, taxicab service in the City,
e.g., issuance of perre.ts, permit limit, turnover.
The Voulgarises compared upkeep they provide their cabs to upkeep by
other cab companies, and commented on reliability of their Company.
Responding to President Withrow, the City Manager stated permits were

limited to 96 because excessive competition of cab companies fighting
among themselves for patrons resulted in lack of good service.
Councilmember Camicia suggested Council accept communication ana
request staff report back to Council with details how Council might
expand [the limit].
President Withrow stated he likes that [suggestion].
Councilman Arnerich requested the report include the number of cab
companies in the City, and their names.
Mrs. Voulgaris stated Company cars are from factories, built as taxi
and police packages, while individual cabs are personal cars, operators
do not have garage, operate 24 hours a day, nor have dispatchers, as
Company has; and further described Company's operation; noted Alameda
residents call for service but Company cannot respond due to lack of
permit; requested a few permits to prove themselves.
Councilmember Lucas noted staff report states Richmond and San Leandro
have no limit on cabs and inquired why that cannot work for Alameda.
The Chief of Police replied when the number of cab companies was
deregulated, the amount went beyond manageable limits to about 175
cabs; cabs were not maintained; and better overall service by
limiting the number of cabs appeared appropriate.
Councilmember Lucas inquired if the cabs could be limited by requiring
high standards, e.g., 24 hour availability, high maintenance standards,
which would benefit Alameda citizens and eliminate marginal operators.

ORAL COMMUNICATIONS, NON-AGENDA
92-116 Clayton Guyton, Alameda, requested outside investigation to
determine whether or not a problem exists in the Police Department, and
to restore confidence in the Department.
92-117 Lawrence vanHook, Alameda, read the letter [received 1/28/92] he
and Mr. Guyton had sent Council requesting an outside investigation of
the Police Department; stated an investigation is needed.
NEW BUSINESS AND UNFINISHED BUSINESS
92-118 Consideration of nominations for three appointments to Mayor's
Committee for Handicapped.
Mayor Withrow stated thirteen individuals applied to serve; each were
qualified, the Committee has had a problem reaching a quorum as some

Members have severe handicaps preventing regular attendance; the Chair
of the Committee requested expansion of committee; and he intends to
nominate all thirteen applicants to serve.
Councilmember Lucas stated she would second as she can understand the
reason some members are unable to attend, and since there are such
varieties of handicaps, a large membership is good.
Councilman Arnerich stated there is some merit to the Mayor's idea but
he would like the matter to be brought back so Council has time to look
at matter; he might have problem with an 18-member Committee and would
like to review in detail to determine whether he can support proposal.
Don Roberts, Alameda, stated some candidates have checked boxes
objecting to background investigation.
Mayor Withrow stated he will withdraw nominations and request staff
reagendize matter, with recognition by the Council of his desire; and
he will reconfirm with individuals regarding background check.
92-119 Consideration of nominations for two appointments to Library
Board to fill unexpired terms ending June 30, 1992 and June 30, 1993.
Mayor Withrow nominated Bonnie B. Conner and Nancy J. Lewis for
appointment as Members of the Library Board. Councilman Arnerich

Utilities Board to fill an unexpired term ending June 30, 1994.
Mayor Withrow nominated Mark J. Hanna for appointment as Member of
the Public Utilities Board. Councilmember Lucas seconded the
nomination. Council, by consensus, supported nomination.
92-121 Consideration of a nomination for appointment to Recreation
Commission to fill an unexpired term ending September 30, 1993.
President Withrow nominated Marie L. Robinson-Gilmore for appointment
as member of the Recreation Commission. Councilmember Lucas seconded
the nomination. Council, by consensus, supported nomination.
92-122 Councilmember Lucas stated she has been informed minors between
ages of 13 and 21 year may lose their driver's licenses if they commit
vandalism by defacing property with paint or any other liquid; she has
discussed the item with the Recreation and Parks Director; the matter
needs to be publicized among juveniles in Alameda.
Councilmember Roth stated the Alameda Unified School District should be
made aware, so they can inform students.
Mayor Withrow stated that could be addressed at meeting with the School
Board.
The Recreation and Parks Director stated information could be dispensed
in registration brochures and flyers.

92-123 Councilman Arnerich requested a staff report be placed on th
March 3, 1992, Council Meeting Agenda reflecting how much revenue migh
be lost as a result of bagging Alameda's parking meters for a period o..„
six months, March 17, 1992, through September 13, 1992, in order to
stimulate interest in shopping.
92-124 Councilman Arnerich requested staff review purchasing procedures
and make a concerted effort to buy from Alameda merchants, and buy
American products, and encouraged all Alamedans to shop in Alameda.
