The Pledge of Allegiance was led by Councilmember Lucas. Reverend Lois "Suji" Hochenauer, Home of Truth Spiritual Center, 1300 Grand Street, Alameda, gave the invocation. ROLL CALL - Present: Councilmembers Appezzato, Arnerich, Lucas, Roth and President Withrow - 5. Absent: None. PROCLAMATIONS AND SPECIAL ORDERS OF THE DAY 94-714 Proclamation declaring the month of December, 1994 as World Aids Month. Mayor Withrow read the proclamation and presented same to Cindy Acker. 94-715 Mayor Withrow read proclamation noting Santa Claus symbolizes the tradition of giving, and residents of Hillhaven Corporation's facilities have established the Hillhaven Ho Ho Hotline in deference to children's dreams of Santa Claus; and designated the Hotline as a North Pole Substation. 94-716 Mayor Withrow read proclamation on LITA (Love is the Answer) volunteers who have been providing sensitive humanitarian care to convalescent hospital residents in Alameda since 1984; and declared December 6, 1994 as LITA Day in Alameda. 94-717 Presentation of Certificate of Appointment to Laurie J. Hobbie, appointed to the Rent Review Advisory Committee (Tenant Member) on November 15, 1994. Mayor Withrow presented the Certificate to Ms. Hobbie. 94-718 Presentation of Certificate of Appointment to Robert J. Vice Mayor Roth moved approval of the remainder of the Consent Calendar, and Councilman Arnerich seconded the motion which carried by unanimous voice vote - 5, with the exception of one abstention by Councilmember Lucas on (*94-719), Minutes, as she did not attend the November 15th meetings. Regular Meeting, Alameda City Council December 6, 1994 *94-722 Resolution No. 12589 "Reappointing T. David Edwards as a Trustee of the Alameda County Mosquito Abatement District." Adopted. *94-723 Resolution No. 12590 "Accepting the Alameda Countywide Transportation Plan as a City of Alameda Policy Document." Adopted. *94-724 Bills, certified by the City Manager to be true and correct, were ratified in the amount of $2,100,652.36. 94-725 Resolution No. 12591 "Supporting the Transportation Advisory Committee's (TAC) Recommendation Regarding Diagonal Parking on the South Side of Central Avenue Between Willow Street and Oak Street, Extending the Preferential Parking Permit Program and Amending the Preferential Parking Permit Zone Map." Adopted. Councilmember Lucas requested that an additional parking space for the handicapped be provided. Vice Mayor Roth commented on parking permit programs and diagonal parking, and requested that the Park Avenue Permit matter be revisited. Councilmember Lucas moved approval. Councilman Arnerich seconded the motion which carried by the following voice vote - Ayes: Councilmembers Appezzato, Arnerich, Lucas and President Withrow - 4. Nayes: Vice Mayor Roth - 1. Absent: None. Abstentions: None. 94-726 Resolution No. "Adopting the Public Agency Retirement System (PARS) for Part-Time Employees." Held over. Punvipa Wendy Grice, Alameda, stated she is a Library part-time employee, is concerned about PARS as she does not know who will be investing the funds nor how funds will be invested; she is comfortable with Social Security; and requested a pamphlet regarding PARS, and a statement on what is available, be provided to the part-time employees. The City Manager stated that the majority of part-time employees favor the proposal as it benefits them and the City; however, if some persons are concerned and want more time, holding the resolution over to the next meeting would be better. Ray Cleone, Alameda, stated Item 9, Exhibit A, of resolution, is ambiguous; and requested staff be directed to distribute comprehensive information to the employees; resolution be returned to staff for clarification of contributions and fiduciary arrangements, and considered at a future meeting. Regular Meeting, Alameda City Council December 6, 1994 Councilmember Appezzato stated he had asked this matter be pulled for discussion, however, his concerns have been addressed and he will wait for the matter to come back. Councilmember Lucas moved to hold the matter over. Councilman Arnerich seconded the motion which carried by unanimous voice vote - 5. 94-727 Resolution No. 12592 "Authorizing Participation in State/Federal Surplus Personal Property Program." Adopted. John Scott Graham, Alameda, presented his observations on the Surplus Personal Property Program. Councilmember Lucas moved approval. Councilman Arnerich seconded the motion. The motion carried by unanimous voice vote - 5. REGULAR AGENDA Mayor Withrow announced that the resolution regarding a street to be named for Robert Davey, Jr., will be taken out of order. 94-728 Resolution Approving a Street Name Change of Sweet Road to Davey Road in Village V, (Columbia), Harbor Bay Isle. (Mayor Withrow) (Councilman Arnerich) Not adopted. Resolution No. 12593 "Approving a Street Name Change of Bridgeway Road to Robert Davey Jr. Drive." Adopted. Lucille Rodriguez, Alameda, spoke on behalf of naming a street or road as soon as possible in honor of Officer Davey, who was killed in the line of duty while defending our community; and requested his full name, Robert Davey, be used. Al Cofer, Alameda, thanked Council, on behalf of the Alameda Police Officers Association, for honoring one of their fallen officers, and stated that in the Association's latest letter to Council, they suggested, and requested Council's support, to rename Bridgeway Road to Robert Davey Drive, for a number of reasons including, Bridgeway Road is a street with substantial traffic flow and high visibility, and there are no homes or businesses subject to the hardship of changing addresses on business or legal documents; and stated Sweet Road has a 100 foot length and remote location; Association Members stood in support, and an illustration of the proposed street sign was displayed. John Scott Graham, Alameda, suggested Times Way be considered by City Council also. Councilmember-elect Charles Mannix, Alameda, thanked Council for putting the matter on agenda; stated, when an officer is killed in Regular Meeting, Alameda City Council December 6, 1994 the line of duty, the attack is also on each member of the community; we have a long-overdue debt service to pay; the proposed out-of-the-way street is a nice gesture but if logistics can be worked out [to rename Bridgeway Road], the City might be able to do better. Diane Coler-Dark, Alameda, stated former Officer Davey should be recognized, and if Council does not see fit to use Bridgeway Road [for renaming] she suggests Times Way as an alternate; persons driving down Park Street could see the [street] sign; and a remote road in a residential area [Sweet Road] is unsuitable. Neil Patrick Sweeney, Alameda, stated the City has made a mistake waiting so long to honor Officer Davey; with military base conversion and future community improvement plans, we [City] will have opportunity to honor our fallen heroes. President Withrow stated he requested City Manager place matter on agenda in order to accelerate the process; he agrees with the recommendation for Bridgeway as it fits all the criteria Council requested, a visible main thoroughfare without many residences or businesses; and dual signing can be installed with Bridgeway Road and Robert Davey Drive signs on each pole. Councilman Arnerich stated Robert Davey Jr. was not only a dedicated police officer but one who lived in Alameda all his life; to give him anything less than the best, would not be in the best interest of the City; the reason for the Police logo on the sign is so people in the future, who may not remember Robert Davey, will know that [the street name] is in honor of a fallen police officer. Councilman Arnerich moved renaming Bridgeway Drive [Robert Davey Jr. Drive] be implemented as quickly as possible. Councilman Arnerich requested that the Alameda Police Department logo be included on the street sign, and dual signs be posted not more than 90 days. Councilmember Appezzato seconded the motion, apologized for the delay, and suggested to the Police Officers' Association that "Jr." be included on the street sign. The motion carried by unanimous voice vote - 5. 94-729 Written Communication from Morrie Dragna, Alameda, suggesting naming Bocce Ball Courts in Lincoln Park after John Ratto. (Councilmember Lucas); and Report from Chair, Recreation Commission, transmitting Commission's recommendation to not name components within a park or recreational facility. Regular Meeting, Alameda City Council December 6, 1994 Morris Dragna, Alameda, reviewed the history of the Ratto family, and gave the background of matter; described efforts of John Ratto's rebuilding of the Bocce Ball Courts in accordance with professional guidelines, and in memory of John Ratto's father; proposed the naming of the Bocce Ball Courts after John Ratto; and stated funds will be donated for the plaque; to help defray most of the expenses of the ceremony, manpower will be furnished if needed; and a set of bocce balls given to Recreation & Parks Department when the Bocce Ball Courts are listed as a sport played in Lincoln Park. Councilmember Lucas stated Mr. Ratto has contributed to this sport for many years; and moved to name the facility the John Ratto Bocce Courts. Councilmember Appezzato seconded the motion. Gail Wetzork, Chair, Recreation Commission, stated a letter from the Commission was sent to Council recently regarding renaming of parks and areas within parks; in 1993, the Commission placed a moratorium, to October, 1994, on renaming until suggested procedures could be formulated, also suggested a bocce ball tournament each year in honor of John Ratto; if the Commission allowed the renaming of a certain area of a certain park, proposed procedures would be of no value. Councilmember Appezzato stated a policy he has indicates "City of Alameda's desire to establish a uniform policy to name City facilities and portions thereof..." Chair Wetzork stated that is true, however, the Recreation Commission has the mandate regarding naming and renaming; and that the Commission is only an advisory body. Councilman Arnerich stated if a recommendation comes to Council from a Commission or Board, and Council overturns its decision, he has decided that he will always send matter back for a re- evaluation. Councilman Arnerich moved a substitute motion to refer the matter back to the Recreation Commission for further study and evaluation. Vice Mayor Roth seconded the substitute motion. Councilmember Appezzato stated he will stand by the second to Councilmember Lucas's motion but will support Councilman Arnerich's motion if the other motion does not carry. Councilman Arnerich stated Council could, upon reapplication by Mr. Dragna, go ahead with Councilmember Lucas's original motion at a future date; Mr. Dragna may even get support from the Recreation Regular Meeting, Alameda City Council December 6, 1994 Commission; and that is why he is sending the matter back. Vice Mayor Roth stated that the current Council has never approved policy proposal of the Recreation Commission, Council has not had an opportunity to discuss their recommendation, Commission should submit proposal before Council is faced with naming facility, and he will support the motion to send the matter back. Substitute motion carried by the following voice vote: Ayes: Councilmembers Arnerich, Roth and President Withrow - 3. Nayes: Councilmembers Lucas and Appezzato - 2. Absent: None. 94-730 Resolution No. 12594 "Appointing Edwin Cooney as a Member of the City Civil Service Board." Adopted. Vice Mayor Roth moved adoption of the resolution. Councilman Arnerich seconded the motion which carried by unanimous voice vote - 5. The Deputy City Clerk administered the Oath of Office. 94-731 Resolution No. 12595 "Appointing Christ C. Christ as a Member of the City Historical Advisory Board." Adopted. Councilmember Lucas moved adoption of the resolution. By consensus of Council, the resolution appointing Mr. Christ was adopted. The Deputy City Clerk administered the Oath of Office. 94-732 Resolution No. 12596 "Reappointing James T. Kennedy as a Member of the City Economic Development Commission." Adopted. Councilmember Lucas moved adoption of the resolution. Councilmember Appezzato seconded the motion which carried by unanimous voice vote - 5. The Deputy City Clerk administered the Oath of Office. 94-733 Resolution No. 12597 "Reappointing James G. Pittard as a Member of the City Economic Development Commission." Adopted. Vice Mayor Roth moved adoption of the resolution. Councilmember Lucas seconded the motion which carried by unanimous voice vote - 5. The Deputy City Clerk administered the Oath of Office. 94-734 Resolution No. " Appointing Anthony H. Daysog as a Member of the City Economic Development Commission." Not Regular Meeting, Altuneda City Council December 6, 1994 adopted. Vice Mayor Roth moved adoption of the resolution. [Failed due to lack of a second] Councilmember Lucas stated there has been controversy concerning this appointment, and made a substitute motion that the matter be held over to the next Council meeting. Councilman Arnerich seconded the substitute motion. Mayor Withrow expressed disappointment. Councilman Arnerich stated he is voting in the light of his opinion that the person who would be replaced [Economic Development Commission Member Diane Coler-Dark] has done a fine job. Vice Mayor Roth stated Mr. Daysog has demonstrated a strong desire to be a part of the function of the City and has the energy, desire and educational background to be able to contribute to the City; and he is disappointed. Councilmember Appezzato stated he is not voting against Mr. Daysog, but will be voting for Diane Coler-Dark, who has performed admirably on the Economic Development Commission; and in the next administration, a suitable place will be found for Mr. Daysog. Councilmember Lucas stated her motion does not reflect upon Mr. Daysog, she wanted only to give the next administration the opportunity to make the appointment, especially as Ms. Coler-Dark has done an outstanding job on the Commission. The substitute motion was carried by the following voice vote: Ayes: Councilmembers Appezzato, Arnerich, and Lucas - 3. Nayes: Vice Mayor Roth and President Withrow - 2. Absent: None. 94-735 Communication to the Secretary of the Navy, with respect to change of homeports of nuclear carrier battle groups. (Mayor Withrow) Councilmember Appezzato stated he believes the letter is premature and, for Alameda to take a unilateral position without consulting our [regional] neighbors, is inappropriate. Councilmember Appezzato moved to allow new City Council to deal with issue of the Navy remaining in Alameda. Councilmember Lucas seconded the motion which carried by the following voice vote: Ayes: Councilmembers Appezzato, Arnerich and Lucas - 3. Nayes: Vice Mayor Roth and President Withrow - 2. 94-736 Public Hearing to consider allowing the Port of Oakland Regular Meeting. Alameda City Council December b. 1994 to use Tax-Exempt Bonds for the portion of their dredging project within Alameda. (Continued from Council Meetings of November 1 and November 15, 1994) The City Manager stated the Port of Oakland has not yet signed the Indemnification Agreement and the Public Hearing should be pulled from the agenda. John Scott Graham, Alameda, stated he is against Port of Oakland receiving tax-exempt bonds. Councilman Arnerich moved that the City Manager not place the matter on agenda until the Port of Oakland comes back with a definite date. Vice Mayor Roth seconded the motion. The motion carried by unanimous voice vote - 5. 94-737 Report from Planning Director on status of Certified Local Government Grant Program. Robert DeCelle, Alameda, reviewed historic preservation grants received and accomplishments because of the grants; and stated that the City has received a grant for 1995 to establish a microfiche archive of historic plans in the City's possession. Councilman Arnerich moved acceptance of report. Vice Mayor Roth seconded the motion which carried by unanimous voice vote - 5. 94-738 Report from Public Works Director recommending appropriation of funds, selection of locations for temporary City Hall facilities, and authorization for the City Manager to apply for and/or enter into negotiations for leasing of various sites. (Councilmember Lucas) Frank Lopez, Alameda, stated he represents some merchants on Park Street; that Independent Order of Odd Fellows will allow use of their property for $1 a year; suggested use of ground floor of old museum, vacant space in the Times-Star building and other sites and requested the City not leave the area because merchants need City Hall in this area. Jerry Sherman, Alameda, implored Council to look only at Park Street area for relocation, and stated he believes the east wing of the High School and smaller sites provide enough space to accommodate City Hall. Al Downey, Independent Order of Odd Fellows, stated the organization is willing to rent the site [11,000 square feet] at the corner of Park Street and Santa Clara Avenue for $1.00 a year Regular Meeting. Alameda City Council December 6, 1994 for two years, provided the City modernizes the elevator, makes other improvements needed, and pays utilities and maintenance. Responding to Mayor Withrow, Mr. Downey explained that the elevator changes will not cost as much as previously believed, as a new elevator company has offered a different solution at a lower price. Mr. Downey, replying to Councilman Arnerich's query, stated the new elevator proposal has not been referred to the City for review for compliance with Americans with Disabilities Act [ADA] requirements. Councilman Arnerich stated sites must be reviewed by the City because some sites may appear to be workable when they are not. Kate Pryor, Alameda, stated that she is a business owner on Park Street and requested City Hall remain in the Park Street Business District. Michael Littman, Alameda, stated he represents several landlords, including the I.O.O.F. building landlord; the I.O.O.F. building has a domed meeting room that would work well as a Council Chamber, and believes the building would be viable. Mayor Withrow discussed square footage. Councilmember Lucas stated Council has an urgent need to make a decision; if Council invests money in Building 6, there is a potential for renting the space when the City vacates the building; the City should look at I.O.O.F. building, the first floor of the east wing of the Historic Alameda High School, and continue evaluating Building 6 as the main facility. Vice Mayor Roth stated the rent of $1.00 per year for I.O.O.F building is only for two years, and improvements must be made; he favors Building 6; the School District, may not be able to allow the City to utilize the east wing of the Historic Alameda High School beyond three years, and parking is a problem; therefore, he would like to omit the east wing as a possible site. Councilmember Appezzato stated he has major concerns regarding Building 6, the Navy has no budget he is aware of, to assist the City at this time; the City would be responsible for the property e.g., maintenance and utilities; there may be costs that have not been factored into Building 6; his preference at this point is to remain in the Park Street Business District, continue to look at Building 6, and the east wing of the Historic Alameda High School; and his vote would be for the east wing. In response to Councilmember Lucas, the City Manager stated improvements would cost $400,000 and $600,000 for Building 6; that he has requested further reduction; the total cost is about Regular Meeting, Alameda City Council December 6. 1994 $840,000 and includes utilities, plans and specifications, office planning, and the Public Works Director has more detailed information. Councilman Arnerich stated that Park Street, north of Lincoln, generates 19.1 percent of the sales tax revenue and as much as South Shore; he believes 20,000 square feet is all that is required for City staff, enough floor space in the east end of town can be found, and the one additional place on Webster Street; and he will not deviate from his position. Councilmember Appezzato moved that the City Manager continue looking at Building 6 and the east wing of the Historic Alameda High School. Responding to Councilman Arnerich, the City Manager stated he will look at the I.O.O.F. building. Councilmember Lucas seconded Councilmember Appezzato's motion. Councilman Arnerich stated he has no intention of going into Building 6. Councilmember Appezzato clarified his motion is to continue with Building 6 because the east wing may not work, and if it does not, City still needs the option of Building 6; but also continue to look at the I.O.O.F. building and perhaps one or two others City Manager is looking at, and the matter will return on [December] 20th [agenda]. The motion carried by unanimous voice vote - 5. 94-739 Report from Public Works Director regarding proposed Mandatory Seismic Retrofit Regulations for existing residential structures. David Baker, Alameda, objected to staff's recommendation that seismic retrofitting would be required when a building permit is issued for any addition or remodel with a valuation of over $20,000; believes proposal will force people to not make improvement. Christopher Buckley, Alameda, stated the proposal should be broader than pre-1940 buildings; all the seismic hazard issues around the City should be looked at, and a comprehensive strategy developed; the proposal imposes a significant financial burden on a selected number of buildings. Barbara Kerr, Alameda, submitted a letter to Council; stated her personal financial decisions are not the City's business; she chooses to carry earthquake insurance and that is her right; and Regular Meeting, Alameda City Council December 6, 1994 0 suggested starting with affordable retrofitting, e.g., P.G.& E. install flexible connections. Darlene Banda, Alameda, stated she hopes Council will take a cautious look at proposal, study other communities, and not do anything to discourage the upgrading of properties. Diane Coler-Dark, Alameda, questioned the City's right to mandate seismic retrofit regulations; real estate has extensive disclosures; what she does with her property is her choice; agrees property owners will be discouraged from making improvements. Councilmember Lucas stated strapping water heaters is low-cost, and Council should attempt to make it a requirement for all property owners; disclosures are not required to be made to renters and that issue needs to be addressed. Vice Mayor Roth stated it will be necessary to educate the public, and citizens should participate in developing draft proposal. President Withrow stated Council should provide some values to the City Manager. Vice Mayor Roth stated the people must provide input. Councilman Arnerich discussed the problem of continual government mandates; agrees with Vice Mayor Roth, Council must study matter and receive public input, e.g. Board of Realtors. Councilmember Appezzato stated safety is important but Council cannot legislate every eventuality; agrees with Vice Mayor Roth that the matter should be studied, and when it comes back, he would like some idea of the range of residential structures discussed, cost involved, and obligation when there is no building permit. Councilmember Lucas moved the recommendation [to direct Public Works Director to develop draft mandatory seismic retrofit regulations for existing residential structures and present proposed regulations to Council at a future meeting]. Vice Mayor Roth seconded the motion which carried by unanimous voice vote - 5. 94-740 Report from Finance Director transmitting the City of Alameda Comprehensive Annual Financial Report for Fiscal Year ending June 30, 1994. (Audit) Councilman Arnerich stated some cities are in poor financial condition and he is proud that Alameda has $5,000,000 in reserves, City is doing well; and staff has done a great job. President Withrow stated the City is financially sound, has reserves, and is much better off than most cities in the East Bay, Regular Meeting, Alameda City Council December 6, 1994 401 if not the whole Bay Area; and that the credit goes to the City Manager and his staff. The City Manager stated the audit is clean and reflects that the City is complying with government accounting standards, the City has been kept in a good financial position, and that will continue to be a challenge. Councilman Arnerich moved to accept the report. Vice Mayor Roth seconded the motion which carried by unanimous voice vote - 5. 94-741 Report from Community Development Director regarding appropriating additional funds for United Pilipinos of Alameda grant closeout activities and approving an Amended Loan Agreement to allow continued use of the Concordia Property for Youth Tutoring and Mentoring Program and Administrative Office. Councilmember Lucas suggested Council hold off decision on this matter until another Council meeting, so that members of the UPA can be represented. Ginny Krutilek, Alameda, stated her concern is loss of the Concordia Street property out of the housing loop; that she hoped property might become a place for transitional housing that would supplement the emergency shelter. Councilmember Lucas moved to continue the matter. Councilmember Appezzato seconded the motion which carried by unanimous voice vote - 5. 94-742 Resolution No. 12598 "Commending the United Pilipinos of Alameda for Services to the Community through the Operation of an Emergency Shelter for Women and Children." (Social Services Human Relations Board) Adopted. Councilmember Lucas moved adoption. Councilman Arnerich seconded the motion which carried by unanimous voice vote - 5. 94-743 Ordinance No. 2680. N.S. "Amending the Alameda Municipal Code by Amending Subsection 8-7.9 (Heavy Commercial Vehicles) of Section 8-7 (Parking Prohibitions) of Chapter VIII (Traffic and Motor Vehicles)." Finally Passed. Pat Haynes commented on neighbors' distress due to the diesel tow truck in the neighborhood. Christine Servente, Alameda, stated she hopes the ordinance will be passed because of the disturbance from the A11-City Towing trucks. Jay Olaysen, Alameda, stated he lives on Lincoln Avenue and Regular Meeting. Aliunecla City Council December 6, 1994 4.02 neighbors have dealt with the problems for a couple of years and the vehicles are parked over the lawn and near driveways; no residential areas should have such commercial business. Vice Mayor Roth moved final passage. Councilman Arnerich seconded the motion which carried by unanimous voice vote - 5. 94-744 Ordinance No. 2681 N.S. "Amending the Community Improvement Plan for the Business and Waterfront Improvement Project." Finally Passed. Vice Mayor Roth moved final passage.
