1994-12-06 Special CC Meeting6 SPECIAL MEETING OF THE ALAMEDA CITY COUNCIL DECEMBER 6. 1994 The meeting convened at 6:06 p.m. with President Withrow presiding. ROLL CALL - AGENDA: Present: Councilmembers Appezzato, Arnerich, Lucas, Roth and President Withrow - 5. Absent: None. Public comment on agenda items only. Eve Roberson, Alameda, stated she lives across the street from 1574 Pacific Avenue, and the owner of that property received a Block Grant from the City four years ago in order to change a two- bedroom, one-bath, single-family residence with two off-street parking spaces into two non-conforming buildings with 8 bedrooms, 5 baths and no usable off-street parking at all; noted requirements the owner must comply with and stated the owner has violated such requirements which allows the City to immediately foreclose; and urged Council to foreclose without delay. Flora Trujillo, Alameda, stated, 1574 Pacific was a two-bedroom, one-bathroom; 25 persons came to City Hall in opposition to the expansion, and no one listened. Barbara Kerr, Alameda, submitted a letter to Council, stated the reason she is speaking in favor of foreclosure is that, if this is what infill is like, and if it is permitted to continue like this, an outcry against infill will occur that equals the outcry against concentrated public housing; she is not only calling for foreclosure for the fees but for foreclosure on the Block Grant. S.S. Schwartz, Alameda, stated that essentially, the landlord of 1574 Pacific, Mr. Tayag, is hostile to the neighborhood, is neither cooperative nor interested in being part of the neighborhood; the best thing to do now is to leave the two units in front, remove the unit in the rear, and create parking and an environment where people who live in the front units can socialize in the rear instead of out front on the street. Brock Grunt, Alameda, stated he is a neighbor across the street from the project and it appears that the number of living spaces on this property is too much for the property to handle. There being no other speakers, Mayor Withrow closed the public portion of this agenda item [regarding 1574 Pacific Avenue]. [Note: Announcement by Mayor Withrow was made in Council Chamber, immediately following Closed Session and prior to the Community Improvement Commission Meeting] 94-713 Mayor Withrow announced that the City Council met in open session in Room 316 and Closed Session in Room 305; stated that, in Closed Session, Conference with Real Pronertv Neaotiator, on 1574 Pacific Avenue, Council directed staff to continue non-judicial foreclosure and take steps to remedy problems; Conference with Legal Council - Anticipated Litigation, gave directions to City Attorney, no final action taken; Public Employee Performance Evaluation, discussed performance evaluation for City Manager, City Attorney, and City Clerk, no action was taken; and Conference with Legal Counsel - Initiation of Litigation, discussed class action lawsuit against P.G.& E., City cannot join the class action because Special Meeting, Alameda City Council December 6, 1994 38 it does not have an electric franchise which is the essence of the class action; it was an information item.
