1993-04-06 Regular CC Minutes2 MINUTES OF REGULAR COUNCIL MEETING OF THE ALAMEDA CITY COUNCIL APRIL 6. 1993 The meeting convened at 8:05 p.m. (following the Housing Authority Board of Commissioners Meeting), with President Withrow presiding. The Pledge of Allegiance was led by Vice Mayor Roth. Reverend Doug Henderson gave the invocation. ROLL CALL - Present: Councilmembers Appezzato, Arnerich, Lucas, Roth and President Withrow - 5. Absent: None. ANNOUNCEMENTS OF CLOSED SESSION ACTIONS Mayor Withrow announced that Council met for staff information and briefing at 7:00 p.m., adjourned to Closed Session at 7:05 p.m., adjourning at 7:10 p.m., and considered: 93-154 Pendina Litiaation, Murphy v. City of Alameda, and Guyton v. City of Alameda, pursuant to Subsection (a) of Government Code Section 54956.9 of the Brown Act: Mayor Withrow stated no action was taken. 93-155 Sianificant Exposure to Litiaation, pursuant to Subsection (b) of Government Code Section 54956.9 of the Brown Act: Mayor Withrow stated no action was taken. PROCLAMATIONS AND SPECIAL ORDERS OF THE DAY 93-156 Proclamation Declaring the week of May 2 through May 8, 1993, as Clean Air Week. Mayor Withrow read the proclamation urging citizens to consider adjustments to their lifestyles, particularly driving habits, to improve air quality and good health. 93-157 Proclamation Declaring April as Keep America Beautiful Month. Mayor Withrow read the proclamation. CONSENT CALENDAR At the request of citizens and Councilmembers, report 93-170 concerning status of 1-880 Signage, report 93-171 concerning Stop Sign Control, report 93-172 regarding award of contract to Gateway Landscape Construction, and report 93-173 regarding Firearms Dealer Licensees were removed from the Consent Calendar for discussion. Mayor Withrow also stated that he and Councilmember Appezzato would be abstaining on Resolution of Intent *93-167 concerning Bay Farm Island Dike Maintenance Assessment District [due to possible conflict of interest]. Introduced. April 6, 1993 -‘ 4 ! *93-169 Bills, certified by the City Manager as true and correct, were ratified in the amount of $1,550,697.10. 93-170 Report from Public Works Director on the Status of I- 880 Signage and Allocation of Funds for Design Costs and the Cost of Signage. Councilman Arnerich stated he would like staff to watch over the High Street, near East Eighth Street, sign with respect to height, coloring and readability; and the signs made by the City should be aesthetically pleasing. The Acting Public Works Director stated the signs made by the City's maintenance sign shop will be to the Caltrans standard design; and described the material and colors. Councilman Arnerich moved acceptance of the report. President Withrow commended the Public Works Department, the City of Oakland and Caltrans for cooperating together to address this issue, following many years of a lack of signage. Gerhard Degemann, Alameda, expressed his desire to have the name East Eighth Street changed. Councilmember Lucas seconded the motion which carried by unanimous voice vote. 93-171 Report from Public Works Director recommending approval of Stop Sign Control at the Intersection of Bridgeway and Puddingstone Roads. Thomas Jordan, Executive Director, Community of Harbor Bay Isle Owner's Association, referred to letter from Pamela DeSimone, President of the Community Board of Directors, indicating the Board, in conjunction with the neighborhood associations, are not aware of objections to the proposed stop sign control; the issue is one of safety for pedestrians and bicyclists. Councilman Arnerich expressed concern that while the presidents of the associations have approved the stop sign control, the homeowners may not be aware of the matter and, if Council approves, may be upset that they were not contacted. President Withrow commented the area is highly organized, and the presidents of each association approved what they consider to be the consensus of their neighborhood; if homeowners contact him, he would recommend they attend the next Board of Directors meeting to discuss the matter. Larry Starr, Alameda, stated he believes the issue should be reconsidered; input from homeowners obtained; and noted reasons why he does not believe stop signs are needed. April 6, 1993 115 Councilmember Appezzato stated Council has put stop signs in places where Public Works and the Traffic Advisory Committee have advised against them; in this case they recommend signs; Council should have consistency. Councilmember Appezzato moved to accept the report and recommendation to put in the stop signs. Vice Mayor Roth seconded the motion. Councilman Arnerich stated he would like the matter held over in order to canvass the constituency. Vice Mayor Roth stated there is time before the installation of the signs for people to come forward. Councilmember Lucas stated she believes Council is very consistent; every time there is a question of a stop sign, Council puts it in, and she believes that increases safety. Councilmember Appezzato stated he believes the intersection is heavily traveled and dangerous. The motion was carried by the following voice vote: Ayes - Councilmembers Appezzato, Lucas, Roth and President Withrow - 4. Noes: Councilman Arnerich - 1. Absent: None. 93-172 Report from Public Works Director recommending Award of Contract to Gateway Landscape Construction for Accessibility Upgrades to Buena Vista and McKinley Parks, No. P.W. 11-92-17. Councilmember Appezzato stated he has a concern that Gateway Corstruction, who does a substantial amount of business in the City, is making contributions to Alameda's political scene; Gateway should be alert to the perception; and if the Contractor can afford contributions, suggest they reduce their bill to the City or donate money to the General Fund. Councilmember Lucas moved approval of the recommendation. Councilman Arnerich seconded the motion which carried by unanimous voice vote - 5. 93-173 Report from Chief of Police regarding Firearms Dealer Licensees in Alameda. (Councilmember Lucas) Hester Peterson, Alameda, expressed concern that the report is to remove dealerships from homes to storefronts. President Withrow stated the report concerns the status of licensees in the City. Vice Mayor Roth stated the intent is not to move dealers from home occupations to storefronts; the intent is that licensed dealers should be paying a business license, and some are not. April 6, 1993 Mrs. Peterson stated she agrees dealers should have licenses; she had the impression the intent was to close down businesses. President Withrow stated the report is informational only. Robert Peterson, Alameda, stated concern that Council is using this program to disarm the American people. Kent Figone, Alameda, stated he is a Federal Firearms Licensee [FFL] dealer; expressed concern that home FFL dealers are perceived to be part of problem with illegal guns in the streets; spoke of legitimacy of his home occupation, and desire for a storefront when he is [financially] able. Councilmember Lucas stated the Federal Bureau of Alcohol, Tobacco and Firearms (ATF) licenses people to sell guns; she would like Planning Director to provide report on current situation for home use permit, and whether neighbors are notified; and noted of all the licensees, only six have business licenses in Alameda and that is where a loss of revenue has occurred. In response to President Withrow, the Finance Director replied very few licensees have reported sales to the State. President Withrow stated he has a problem with why licensees are in business if there is no flow of cash. The Finance Director stated the City contacted the State Board of Equalization to determine the process, contacted dealers without current business licenses to ascertain if they are doing business and notified them of procedures they should follow. Robin Figone, Alameda, stated she and her husband have a home business, a home occupation permit; want to work with the City; and would like to know how to keep informed. The City Manager noted the need for obtaining business licenses and home occupation permits. The Planning Director stated there is a one-time fee for a home occupation permit. Glenn Bulman, Alameda, stated perhaps some persons [licensees] do not understand what is needed and should be informed so the City can receive the revenue. James Fraser-Paige, Alameda resident, City and County of San Francisco Police Officer, stated Federally-licensed dealers should have City business licenses; and he is concerned there is going to be a movement against home dealers. Jeffrey Marienthal, Alameda, stated he agreed with previous speaker; came to meeting due to concern about possible infringement of rights, however, matter is under control and he hopes that April 6, 1993 1-!7 continues. Gene Brandenburg, stated he knows Kent Figone, and believes him to be above-board in all his dealings. Steven Anderson, Esq. Palo Alto, stated Penal Code Section 12071 requires anyone selling six guns or more to have a City license in order to get a State license; once a State License is obtained, every transaction is reported on a Dealers Report of Sale Form and a copy goes to the Chief of Police. In response to President Withrow, the Acting Chief of Police stated he has received many Dealers Report of Sale Forms and they are accessible to the Finance Director. Councilmember Lucas stated she would like to be sure all local regulations are enforced in Alameda, tax revenues are received, and gun dealers comply with safety requirements. The Acting Police Chief advised Council that a proposal on the matter will be brought to Council at a later date. Councilman Arnerich stated concern that dealer- and home inventories are not reported. Vice Mayor Roth stated the Police, Planning, and Finance Departments should work together on identifying Federally-licensed dealers who do not have City business licenses or Home Occupation Permits. In response co inquiry from Mayor Withrow, Mr. Anderson stated Federal licensees give! up the right against search and seizure to the extent the Bureau of Alcohol, Tobacco and Firearms can come in anytime and conduct an audit; as part of a City license, it would not be unreasonable to require the licensee to annually file an accounting of firearms; and a condition to granting a license could be unannounced search and inspection of records. In response to Councilmember Lucas, Mr. Anderson commented on safety requirements and gunsmiths. Vice Mayor Roth moved acceptance of the report; Councilman Arnerich seconded the motion which carried by unanimous voice vote - 5. 93-174a Appeal of a Planning Board denial of Variance, V-92-20, and Use Permit, UP-92-5, for an as-built, two-story addition and a 16 foot by 20 foot deck at 3363 Fernside Boulevard. Applicants/Appellants: Dieter and Helene Rabe. 93-174b Resolution Upholding the Planning Board's Denial of Variance V-92-20 and Use Permit UP-92-5, relating to an As-Built Residential Addition and Proposed Deck at 3363 Fernside Boulevard. * * * * Recessed to reconvene at 9:40 p.m. April 6, 1993 ! * * * * President Withrow announced that Councilmembers Lucas and Appezzato would both be abstaining on this issue. Councilmember Appezzato stated he voted on this matter when he was President of the Planning Board and does not believe voting again on this issue would be fair, even though it is legally permissible. The Planning Director explained the background of the matter, stating structures that encroach on the rear of the property which is held by the federal government through the U.S. Army Corps of Engineers, acquired for creation of the Tidal Canal, require a Use Permit; the basis of the Appeal is that most of the property owners adjacent to the Tidal Canal maintain homes built over and onto adjacent federal land, and that the Corps does not require removal of the [Rabes'] enclosed patio. Kurt Braun, Alameda, stated he is adjacent neighbor to the south, and he has no problem with the Rabes' addition. Dieter Rabe, Alameda, Appellant, stated he cooperated with Corps of Engineers and Planning Department, will do whatever is necessary to bring everything up to Code, and requested Council consider, and grant, his Appeal. In response to inquiry from Vice Mayor Roth, Mr. Rabe stated he did the work himself, with the help of a carpenter; the window in the storage area will be eliminated when the deck is dropped down; the deck was most likely built when the property was developed, maybe 1975; and former owner did not disclose deck was over the property line. Sandra Prill, Castro Valley, stated the Rabes are her parents; her sister is confined to a wheel chair and extra space is important; typically owners on the street build over the [property] line; and requests Council grant the Variance. Mike Crnjanski, Alameda, stated his property is close to Rabes' property and he favors the Appeal; noted sometimes buyers do not understand property lines; he has not heard other property owners object. Lisa Fasano, Alameda, stated her aunt and mother own adjacent property to Rabes and have strong objections; Rabes tore down the community fence and rebuilt it on their [Fasano/Kruger] property; addition looks down on their property and directly into their rear yard. For the record, during the Planning Board Hearing, Applicant indicated he had a professional contractor build the addition, and he has now told Council he built the addition himself with the help of a carpenter; and stated they are the only neighbor impacted. Responding to Councilman Arnerich's questions, Ms. Fasano stated the Rabes have built on the fence line, which her records indicate is the property line. April 6, 1993 119 The Planning Director stated the City has done no surveying to find where the building is, relative to the property line. Vice Mayor Roth stated he has a problem approving a building on someone else's property line, whether it belongs to the Corps of Engineers, the City or a private individual; a seven foot setback is required for a two-story building and he cannot support this [Appeal]. In response to Councilman Arnerich's questions concerning why this building is different from others, the Planning Director replied because it [tidal canal land] is owned by federal government; two other [neighboring] properties have received lot line adjustments, and therefore, own the footprint of their building. Responding to President Withrow concerning why the Rabes may not have an adjustment, the Planning Director stated although the Corps does not object [to lot line adjustment], the matter would go to General Services Administration; a question exists concerning who has the responsibility for toxic cleanup; the City is in discussion with the Corps, as is the City of Oakland; and the federal government is not prepared, at this point, to enter into a lot line adjustment for this one property; and the process is extensive. The City Manager clarified the Corps has stated they would like the City to hold them harmless on any toxic cleanup, as a condition of sale; and the City has refused. Replying to President Withrow's query, the City Manager stated the City may deed or lease tidal canal land, as with the Eastshore properties. In response to inquiry from President Withrow, the City Attorney commented a number of restrictions apply to the time limit for response to complaints, however, an [enforcement] agreement could be entered into with the property owner on time limits [for removal of addition]. Following Council discussion constraints, position of the U.S. property line, Vice Mayor Roth across the property line and if want to do it. on possible solutions, legal Army Corps of Engineers, and the stated his problem is building Council allows this, others may Ms. Fasano stated our complaint is the Rabes built on our property line; there are a number of hazards with having buildings so close; and an issue exists as to the location of the property line. In response to President Withrow, the Planning Director stated the [Variance] application filed by the Rabes indicates an 18" setback from the property line. Further discussion ensued concerning condemnation of adjacent property; roofing contractor, property line and setback. April 6, 1993 * * * * Vice Mayor Roth moved to continue the meeting past 11:00 p.m. Councilman Arnerich seconded the motion which carried by the following voice vote: Ayes: Councilmembers Arnerich, Roth and President Withrow - 3. Noes: None. Absent [from the dais]: Councilmembers Appezzato and Lucas - 2. * * * * The City Attorney stated the time limit for the addition to be removed could be determined administratively, absent a request that it be done immediately. President Withrow and Councilman Arnerich indicated that a period of at least two years is reasonable. President Withrow moved the Appeal be approved. Councilman Arnerich seconded the motion which failed due to lack of a majority vote (3 ayes): Ayes: Councilman Arnerich and President Withrow - 2. Noes: Vice Mayor Roth - 1. Absent: None. Abstentions: Councilmembers Appezzato and Lucas - 2. * * * * Councilmembers Appezzato and Lucas returned to the dais. * * * * 93-175 Report from Chair, Navy Base Committee, requesting Council's authorization of the establishment of a Navy Base Committee Retention Fund, and an Appropriation in the Amount of $15,000. Chuck Corica, former Mayor, requested $15,000; reported on the rally to be held Thursday, April 8th, at the College of Alameda, noted participants in the rally, and cooperative efforts. John Scutt Graham, Alameda, stated he supports Mr. Corica's request for $15,000, and keeping the base open; if NAS is closed, he would like federal government to provide a retraining program. David Sillers, Alameda, inquired if the City can afford $15,000. President Withrow stated City cannot afford much, but looking at a possible loss of $1.5 billion put into the local economy by the Navy, and 44,000 jobs, investment of $15,000 is not a lot of money. Michael Hastings-Smith, Alameda, stated he is opposed to putting banners up; everyone is aware of the [possible] closure; inquired why the City cannot give money to the JROTC, and sports program being cut; and he opposes spending the $15,000. President Withrow stated if the Navy pulls out, the School District will be closing Encinal High School because it will lose $2.5 million. Councilman Arnerich further explained that the City funding and School District funding are separate and the $15,000 cannot be used for the District. April 6, 1993 Neil Sweeney, Alameda, stated he is in favor of the $15,000; would like vendors contacted to contribute; volunteered his help; requested others volunteer to help at Base Committee Retention Headquarters, 2900 Main Street. Councilman Arnerich moved to appropriate $15,000 for the Navy Base Committee Retention Fund. Councilmember Lucas seconded the motion. Larry Wagner, Alameda, stated he supports the $15,000 appropriation which is an investment in the City's future. The motion was carried by unanimous voice vote - 5. 93-176 Report from Public Works Director on City of San Leandro Imposing New Business License Fees on Oakland Scavenger Operations at Davis Street Transfer Station. (Councilmember Appezzato) Councilmember Appezzato stated he requested this item be put on agenda as he is disturbed with the City of San Leandro imposing a fee increase on Oakland Scavenger which will possibly affect Alameda; and moved to send a letter to the City of San Leandro, with copy to Joint Refuse Rate Review Committee (JRRRC], opposing 3,000% increase and the effect it may have on the citizens of Alameda. Councilman Arnerich seconded the motion which carried by unanimous voice vote - 5. 93-177a Resolution No. 12377 "Providing for Notice of Hearing for Alameda Special Assessment Improvement Procedure Law." Adopted. Councilmember Lucas moved adoption of the resolution. Vice Mayor Roth seconded the motion which carried by the following voice vote: Ayes: Councilmembers Arnerich, Lucas, Roth and President Withrow - 4. Noes: Councilmember Appezzato - 1. Absent: None. 93-177b Ordinance No. 2627. N.S. "Amending the Alameda Municipal Code by Adding Article VI (The City of Alameda Improvement Procedure Code) to Chapter III (Finance and Taxation) Thereof, Providing for the City of Alameda Special Assessment Improvement Procedures Law, Including General Provisions and Definitions, Powers and Procedures for the Purpose of Providing Financing for Specified Purposes, and Certain Other Supplemental Provisions." Adopted. Councilmember Lucas moved passage of the ordinance. Vice Mayor Roth seconded the motion which carried by the following voice vote: Ayes: Councilmembers Arnerich, Lucas, Roth and President Withrow - 4. Noes: Councilmember Appezzato - 1. Absent: None. 93-178 Written Communication from Chair, Amah Tribal Band, Woodside, requesting support in their effort to obtain formal recognition by the United States Congress. April 6, 1993 Larry Wagner, Alameda, stated he would like Council to support a resolution for formal recognition. J. Paul Gutleben, Alameda, stated three skeletons and artifacts had been dug from his yard, dated by museum curator as 500 years old, and placed in Museum; presented a mortar and pestle which would also be given to the Museum. James Soto, Castro Valley, stated his sister had written the letter requesting recognition; Cities of San Francisco and Albany, and County of Santa Clara, have provided resolutions. In response to President Withrow's query, Mr. Soto stated very few tribes are recognized; in his immediate family tribe are 350 to 400 tribal people. President Withrow inquired about Ohlone recognition and Mr. Soto replied when the United States was about to sign a treaty, the Gold Rush occurred and the treaty was set aside. Counci:_man Arnerich commented on the cenotaph erected in Lincoln Park about 60 years ago to honor Indians and that Mound Street is named for Indians. Responding to Councilmember Lucas's question concerning benefits of recognition, Mr. Soto stated grants by a number of agencies and companies, e.g., Hewlett Packard, and scholarships, are given to native Americans who are recognized. Councilmember Lucas moved approval of proposed resolution. Councilmember Appezzato seconded the motion which carried by unanimous voice vote - 5. 93-179 Written Communication from President, Park Street Business Association, Inc., [PSBA] recommending certain changes to the street parking and parking lot facilities in the Park Street Business District. Frank Lopez, Alameda, PSBA, Chairman, Parking Task Force, gave background of efforts; stated if Council does not permit meters to be bagged, PSBA would like to stop managing the parking lots as it is costing too much time and money; requested Council allow the meters to be bagged; noted the program was produced with efforts and cooperation of staff, PSBA and West Alameda Business Associacion [WABA]. Vice Mayor Roth discussed conversion, operation and funding of parking lots with Mr. Lopez. Russell Lombardo, proprietor of Cottage Health Food Store, Park Street, Alameda, stated he and his wife have been in business in Alameda many years; complained City is using meter funds to run the government; City must face up to parking, crime, and traffic flow. April 6, 1993 Frank George, PSBA Parking Task Force, stated he believes bagging would be a good idea, does not believe money would be lost; and if program does not work, the bags can come off; the parking lot issue is PSBA's problem, however, as laid out in the [implementation] plan [attached to the letter], all the bases are covered, and it has a lot of possibilities. Vice Mayor Roth discussed, with Mr. George, the affects of the recession, and the timing of PSBA's request. Councilmember Lucas discussed lack of citizen use, and location, of parking lots with Mr. George. Council discussed issues pertaining to merchant/customer parking, violations and signage with Mr. George. Councilmember Appezzato moved to send the matter to TAC [Traffic Advisory Committee] for their comment. [Motion failed due to lack of a second.] Councilmember Lucas stated she believes that, at this point, the City cannot afford to grant the request; and wants to shelve it for financial reasons. President Withrow stated he would like staff to develop a Plan which would wean the City away from the use of parking meters as a way of raising funds; and to establish goals so that meters disappear. Councilman Arnerich stated he would like the matter brought back in 30 days, including a report on City-wide parking meter revenues for the last two years covering the period October 1, through March 31; and so moved. Vice Mayor Roth agreed with President Withrow on the need for a long-range Plan, and stated he would not mind Councilman Arnerich's recommendation being included in it. Vice Mayor Roth added he does not want staff spending a lot of time and effort on changes only to have Council say no to the proposal. Councilmember Appezzato stated he is not prepared at this time to support the PSBA proposal. Following further discussion, Councilmember Lucas moved the matter be re-agendized in four months. Councilman Arnerich seconded the motion which carried by unanimous voice vote - 5. In response to Councilmember Appezzato, Councilmember Lucas stated TAC input would be provided. 93-180 Written Communication from Mayor Pro Tem, City of Garden Grove, requesting support for an initiative to obtain a Constitutional Amendment to specify what tax revenue shall be reserved for local governments. April 6, 1993 Councilmember Lucas moved Council express endorsement. Vice Mayor Roth stated he would second the motion, however, he would like to add [Council] endorsement of resolutions from the Association of Bay Area Governments and Independent Cities Association; and that Council should look at the two League resolutions also. The City Attorney suggested Vice Mayor Roth not include the City of Alhambra at this time; CRA and the League of California Cities are pending decisions on whether to ask cities to join the litigation effort; and a decision will not be made until next month. Councilman Arnerich clarified Councilmember Lucas's motion is to accept provisions a, b, c and d, outlined in the Staff Report; and seconded the motion, which carried by unanimous voice vote - 5. NEW BUSINESS AND UNFINISHED BUSINESS 93-181 Consideration of Mayor's nomination of appointment to the Golf Commission. Mayor Withrow nominated Fred Leitz for appointment to the Golf Commission. 93-182 Consideration of Mayor's nomination of appointment to the Housing Commission. Mayor Withrow pulled the item off the Agenda. 93-183 Appointment to the Finance Committee.
