1993-11-03 Adjourned Regular CC MinutesMINUTES OF ADJOURNED REGULAR MEETING OF THE ALAMEDA CITY COUNCIL NOVEMBER 3. 1993 The meeting convened at 7:39 p.m. with President Withrow presiding. The Pledge of Allegiance was led by Councilmember Lucas. Reverend Michael Cunningham, St. Philip Neri Church, gave the invocation. ROLL CALL: Present: Councilmembers Appezzato, Arnerich, Lucas, Roth and President Withrow - 5. Absent: None. ANNOUNCEMENTS OF CLOSED SESSION ACTIONS 93-669 Mayor Withrow announced Council adjourned to Closed Session to consider: Labor Relations, pursuant to Subsection (a) of Government Code Section 54957.6 of the Brown Act: no action was taken. Pending Litigation, Howard v. City of Alameda, pursuant to Subsection (a) of Government Code Section 54956.9 of the Brown Act: Howard v. City was not discussed. PROCLAMATIONS AND SPECIAL ORDERS OF THE DAY 93-670 Mayor Withrow presented Mayor Herbert Wemelka of Hainberg, Germany with a Honorary Citizen Certificate and City Flag. CONSENT CALENDAR Councilman Arnerich moved approval of the Consent Calendar. Councilmember Lucas seconded the motion which carried by unanimous voice vote - 5. Items so enacted or adopted are indicated by an asterisk. *93-671 Minutes of the Regular Council Meeting of October 19, 1993. Approved. *93-672 Report from Chair, Transportation Advisory Committee, Recommending Adoption of "Friendly Meter Enforcement Parking Program Guidelines: and Approval of Amendment to Agreement Between Park Street Business Association (PSBA) and City for Attendant Parking Lot Operations. Accepted. *93-673 Report from Public Works Director Recommending Adoption of Plans and Specifications and Calling for Bids for Construction of Sherman Street Extension North from Eagle Avenue to the Easterly Terminus of Atlantic Avenue (Phase 2), No. P.W. 12-92-18. Accepted. *93-674 Report from Fire Chief recommending authorization to November 3, 1993 execute Alameda County Mutual Fire Assistance Agreement. Accepted. *93-675 Resolution No. 12466 "Approving Parcel Map No. 5984, Located at 1226/1228 Regent Street, Subject to Certain Conditions and Granting an Exception from Subdivision Ordinance Section 30- 84.7 Requiring Undergrounding of the Utilities." Adopted. *93-676 Bills were ratified in the amount of $2,116,172.70. REGULAR AGENDA Actions Related to Base Conversion Process. 93-677 Status Briefing on Base Conversion Process. Project Manager Don Parker discussed establishing a data base; a meeting with City staff on Thursday, November 4th; a tour of the Navy Base on Saturday, November 6th; a recent two-day conference sponsored by the Navy; and interest of the_Coast Guard and Concord Weapons Facility in the Navy Base site. Mayor Withrow announced that the staff of Good Morning America spoke with Project Manager Don Parker and Captain Denny Major; he [Mayor Withrow] met with the anchor for an hour; and that the interview will be broadcast on Sunday, November 14th, at 7:00 a.m. Councilmembers commented on the Navy-sponsored Conference. Neil Patrick Sweeney, Alameda, addressed Navy-base related matters such as the McKinney Act and Environmental Toxic Clean-up. In response to public speaker Gerhard Degemann, Vice Mayor Roth stated the Navy-sponsored conference was not public for reasons of control and conducting workshops. 93-678 Comments by representatives of Base Reuse Advisory Group [BRAG] and Social Service Human Relations Board regarding addition of a Human Impacts Subcommittee to the BRAG. President Withrow stated he is concerned that the human impacts of base closure have not been taken into consideration by the East Bay Conversion and Reuse Commission, and that the matter has to be a part of the process. Lois Workman, President, Social Service Human Relations Board, stated citizens need a forum to address their needs, and a Human Impacts Subcommittee could help coordinate programs and improve quality of life. Jon Schiller, Xanthos, Inc., Alameda, stated that he supports a Human Impacts Subcommittee and described problems related to displacement. Councilmember Lucas stressed the importance of regional November 3, 1993 0 c? cooperation. Larry Schulz, Alameda, stated he agreed with the proposal; a group of community leaders are working together on how to deal with the human impacts; a program will be presented on coordination of services; and that the process should not be a part of BRAG. Vice Mayor Roth stated that he believes the human impacts matter needs to be a part of BRAG as a communication link, and moved to support a Human Impacts Subcommittee and the appointment of a Chair by the Mayor. Councilmember Lucas seconded Vice Mayor Roth's motion. Under discussion, Councilman Arnerich -stated he has concern regarding adding another level to BRAG and that he agrees with Mr. Schulz 's comments. President Withrow stated that shared information is important to the process, and the role of BRAG is to be sure our residents are protected. Councilmember Lucas stated that the subcommittee could consider contributions from organizations, e.g., ministerial association. Lois Workman stated subcommittee members should be selected based upon their expertise and appointed by the Chair. Councilmember Appezzato stated that he supports a Human Impacts Subcommittee, and he would like to go with the most qualified. Vice Mayor Roth stated that the subcommittee can work out the details and structure. John Scott Graham, Alameda, stated the East Bay Conversion and Reuse Committee (EBCRC) should not be controlling. Vice Mayor Roth amended his motion to include that all social groups working with the City work out details of their involvement. The motion carried by unanimous voice vote - 5. Issues Related to UCSF. 93-679 Ordinance No. , N. S. "Authorizing the Acquisition of Approximately 10.28 Acres of Real Property Located in the Harbor Bay Isle Business and Research Park for Use as Soccer Fields and Facilities for University of California, San Francisco, and Declaring Great Necessity for Being Effective Immediately Upon Final Passage Pursuant to Charter Section 3-12." Introduced. Neil Patrick Sweeney, Alameda, suggested uses for NAS property, e.g., Kaiser Hospital; and noted EBCRC meeting. November 3, 1993 Jon Schiller, Alameda, voiced his opposition, indicating that the developer will profit and "we" [City] will lose. Larry Schulz, Alameda, disagreed with previous speaker; stating matter has nothing to do with the developer, only the future of Alameda, and he hopes Council will sustain the process. Councilmember Lucas moved introduction of ordinance. Vice Mayor Roth seconded the motion. Councilman Arnerich noted the second reading of the Ordinance and a Public Hearing are scheduled for November 30; stated he raised many questions two weeks ago and if all questions are answered [to his satisfaction], he will support the project. Councilmember Appezzato stated his vote has not changed, and will not change unless there are major changes in the proposal; and that the proposed action is only a bailout of Doric Development. Councilman Arnerich noted possibility of obtaining property at a bargain price; and stated if he is satisfied with detailed answers he is to receive, he will vote for proposal. The motion carried by the following voice vote: Ayes: Councilmembers Arnerich, Lucas, Roth and President Withrow - 4. Noes: Councilmember Appezzato - 1. Absent: None. 93-680 Report from the Community Development Director Transmitting Annual Report of the Alameda County Lead Abatement Program. (Mayor Withrow) Steven Schwartzberg, Interim Director, Alameda County Lead Poisoning Prevention Program, Oakland, provided the City Council with an overview of the program. Councilman Arnerich noted the City's financial contribution to the program; questioned Mr. Schwartzberg on the 1992-93 goals, and commented that marinas give out more toxic levels than homes. President Withrow reviewed the 1992-93 goals with the Director and pointed out the inequal services provided within the service area. Vice Mayor Roth stated that the County needs to report back with a better accounting, and Council may consider withdrawing early from the Program. Councilmember Lucas noted that she had voted against the Program, and she does not support it. Councilmember Appezzato commented that he was not serving on the City Council when the Program was approved. November 3, 1993 400 Vice Mayor Roth moved acceptance of the report. Councilman Arnerich seconded the motion, which carried by unanimous voice vote - 5. 93-681 Report from the Public Works Director Regarding 1994 Trash Services. Gerhard Degemann, Alameda, requested the City Council to deny any garbage rate increases. In response to Councilman Arnerich, the Public Works Director stated tipping fees and Measure D fees have added to garbage collection costs. Councilman Arnerich stated waste management companies across the entire country are ripping off the consumers. Marge McLean, Management Analyst, explained the figures in the staff report. Councilman Arnerich stated that large appliances should be picked up by commercial companies, and there is a need to revisit curbside recyclables. The Public Works Director reviewed the staff report. Councilman Arnerich stated the garbage companies are reaping untold hundreds of millions of dollars in profits and thinks the time has come that Councils must do something to address the problem. President Withrow requested staff to send a letter to the Joint Refuse Rate Review Committee informing them that Alameda does not want any price increases, and that Council will not support JRRRC if they do. Councilman Arnerich stated perhaps in the future, the City should not pick up heavy items, e.g., refrigerators, because tonnage is too high. Councilmember Appezzato stated that he is not prepared to approve rate increases, and he would like staff to include information from this evening in the January 1994 report [on proposed 1994 garbage rates]. Councilmember Lucas stated that she agreed with Council's comments; and she believes the discount given low-income units, and paid by the ratepayers, is unfair. Vice Mayor Roth complained about the surcharge on second cans. Councilmember Appezzato moved acceptance of the staff report and directed staff to include information from this evening's discussion, and the information which will be received from JRRRC, November 3, 1993 401 in the January report. Councilman Arnerich seconded the motion, which carried by unanimous voice vote - 5. 93-682 Ordinance No. . N. S. "Amending the Alameda Municipal Code by Adding Article III (Permit Parking), Section 12-17 (Preferential Parking Zones), to Chapter XII (Designated Parking) Establishing Preferential Permit Parking on Certain Streets." Introduced. Vice Mayor Roth stated that he believes the proposal will eventually lead to the whole City having Preferential Parking Zones, therefore, he is not in favor. Councilmember Appezzato stated concerns that long-term parkers would move to adjacent neighborhoods; and the program would be subject to abuse e.g., passing permit stickers to others to use; and the matter should be studied. The Public Works Director explained the proposed parking program. Councilmember Lucas noted the program gives residents the option of control over their own blocks; noted the need in some areas, e.g., Shore Line Drive; and if residents are willing to pay for the administration of the program, she would like to try it. Councilman Arnerich stated he could agree with permitting the Shore Line Drive area, however the program could become elitist as some persons may not be able to afford the fee, so he cannot support proposal. Councilmember Lucas moved introduction of the ordinance. The motion failed for lack of a second. Vice Mayor Roth suggested TAC [Traffic Advisory Committee] should test an area and see if the citizens are willing to participate; and if they are willing to pay $40 or $50 a year to park. Acting Chief of Police, in response to Councilman Arnerich, stated the Department could not police the proposed program without additional staff. Councilman Arnerich stated proposed program is too cumbersome and would be costly to the City; however, agreed South Shore might be a good trial area. Councilmember Lucas moved to introduce the ordinance, redefined Preferential Permit Parking area: Westline Drive between Otis Drive and Shore Line Drive; Shore Line Drive between Westline Drive and Willow Street; cul de sacs between Westline Drive and Grand Street; Otis Drive between Grand Street and Willow Street; and directed program be implemented for a one year trial period. Councilman Arnerich seconded the motion which carried by the following voice vote: Ayes: Councilmembers Appezzato, Arnerich, November 3, 1993 4O Lucas and President Withrow - 4. Noes: Vice Mayor Roth - 1. Absent: None. 93-683 Written Communication from Reverend Mark W. Teyler, Castro Valley, commending City Police Officers who volunteered time to help with security for All East Bay Youth Rallies held September 26-29, 1993. Councilman Arnerich moved acceptance of the communication; and compliments to those involved. Councilmember Lucas seconded the motion which carried by unanimous voice vote - 5. ORAL COMMUNICATIONS, NON-AGENDA 93-684 John Scott Graham, Alameda, encouraged people to attend a diesel mechanics course offered at the College of Alameda, and suggested that Council and City staff not use acronyms when addressing an issue. NEW BUSINESS AND UNFINISHED BUSINESS 93-685 Consideration of Mayor's nomination for appointment to the Planning Board. Mayor Withrow nominated C. Courtney Knight for appointment to the Planning Board. 93-686 Consideration of Mayor's nomination for appointment to the Social Service Human Relations Board. Mayor Withrow nominated Thomas L. Lew for appointment. 93-687 Consideration of Mayor's nomination for appointment to the Civil Service Board.
