1992-05-12 Special CC MinutesMINUTES OF SPECIAL MEETING OF THE ALAMEDA CITY COUNCIL MAY 12, 1992 The meeting convened at 7:33 p.m., with President Withrow presiding. Councilmember Roth led the Pledge of Allegiance. ROLL CALL - Present: Councilmembers Arnerich, Camicia, Lucas, Roth, and President Withrow - 5. Absent: None. 92-345 Hearing to Consider Appeal of Non-Renewal of Dance Permit for Establishment Located at 1544 Webster Street, Johnny's Cocktail Lounge. (Continued from October 1, 1991.) President Withrow stated the procedures for the Hearing, including basic ground rules for witnesses. Councilmember Camicia read a statement which gave reasons for abstaining on the matter, and stepped down from the dais. Charles O. Triebel, Jr., Attorney at Law, representing Petitioners, objected to Mayor Withrow hearing the matter and requested that the Mayor exclude himself from the Hearing; Mayor Withrow made a statement, and denied the request. Present: Robert Logan, Attorney at Law, representing City Council Carol Korade, Alameda City Attorney, representing Alameda Police Department Doug Dang, Attorney at Law, outside legal counsel, representing Alameaa Police Department James B. Chanin, Julie Houk, Charles O. Triebel, Jr.: Attorneys at Law, representing Petitioners Alison Berry-Wilkinson, Attorney representing Officer Jones and Sergeant O'Connell Jill Ann Clark, Court Reporter. Police Department's Witnesses: Robert Shiells, Alameda Chief of Police, testified and was cross- examined. [The meeting was recessed; and was reconvened at 9:10 p.m.] The following persons testified and were cross-examined. William C. Norton, City Manager Sergeant Mark O'Connell, Alameda Police Department, Internal Affairs. Officer Ron Jones, Alameda Police Department. May 12, 1992 Councilman Arnerich moved to continue the meeting past 11:00 p.m. Councilmember Roth seconded the motion which carried by the following voice vote: Ayes: Councilmembers Arnerich, Lucas, Roth, and President Withrow: - 4. Noes: None. Abstentions: Councilmember Camicia - 1. Following further questioning [of Officer Jones], Petitioners' Attorneys requested a three minute recess at 11:25 p.m., and reconvened at 11:47 p.m. Following numerous objections by Alison Berry-Wilkinson, Attorney for Officer Jones, Attorney Chanin stated it was a good time to break and Attorney Dang stated the hearing should be continued to a convenient date. Councilmember Lucas moved to continue the hearing, Councilmember Roth seconded, and the motion carried by the following voice vote: Ayes: Councilmembers Arnerich, Lucas, Roth, and President Withrow - 4. Noes: None. Abstentions: Councilmember Camicia - 1. Discussing the continuance, Council and Attorneys agreed the matter could be completed in one meeting, and Petitioners' Attorneys would be calling for six witnesses or less.
