1991-03-19 Regular CC Minutes73 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ALAMEDA MARCH 19, 1991 The meeting convened at 7:35 p.m., with President Corica presiding. The Pledge of Allegiance was led by Councilman Arnerich, Reverend Dorothy Kimbrell gave the invocation. ROLL CALL - Present: Councilmembers Camicia, Arnerich, and President Corica - 3. Absent: Councilmembers Thomas and Withrow - 2. 91-151 President Corica congratulated the St. Joseph Notre Dame High School Men's Varsity Basketball Team team for winning the State Championship; read congratulatory letter from Mayor Tom Bradley, Los Angeles; and read proclamation commending the team and the school. Tony Aiello, Principal of St. Joseph's High School, accepted the proclamation, expressing his appreciation. Frank LaPorte, Coach, introduced Team Members and others noted below, who were each congratulated by each member of Council; and Team Members were awarded Certificates of Appreciation for Athletic Achievement as well as City pins and City Seal buttons by Mayor Corica. Team Members were Kris Stone, Malik Jasper, Andre Cornwell, Thad Hufmann, Martin Bond, Tony Damele, Tavvy Gatlin, Jason Kidd, Chuck Smith, (Nick Millosovich and Adrian Ealy, absent); Managers were Kirby Harris, John Pardo, Ron Sacramento (Dan Mills, absent); Ball Boys were Gordy Johnson, Jr., Max Caraballo (Steven Rodrigeus, absent); Assistant Coaches Gordy Johnson, Jose Caraballo, and Vice-Principal Philip Gravem. Accepted. *91-154 From Public Works Director reporting on City Hall Furnishing Standards and authorization to issue Request for Proposals. Accepted. "Reclassifying and Rezoning Certain Properties within the City of Alameda by amending Zoning Ordinance No. 1277, New Series, that property located on the south side of Buena Vista Avenue between Benton and Arbor Streets." Adopted. *91-162 Ordinance No. 2535, N.S. "Reclassifying and Rezoning Certain Properties within the City of Alameda by amending Zoning Ordinance No. 1277, New Series, that property located at 2112 and 2114 Lincoln Avenue." Adopted. *91-163 Ordinance No. 2536, N.S. "Amending the Alameda Municipal Code by Amending Sections 0-141, 20-142, 20-161, and 20-171 of Article 4, Title XX thereto pertaining to the Time for Compliance and the Appeal Fees for Adjustments of the Affordable Housing Requirements for New and Expanded Development." Adopted. BILLS *91-164 Bills, certified by the City Manager to be correct, were ratified in the amount of $1,817,868.13. MINUTES Councilmember Camicia moved approval of the Minutes of the Adjourned Regular Council Meeting of March 7, 1991, and the Special Council March 19, 1991 75 Meeting of March 12, 1991. Councilman Arnerich seconded the motion which was carried by unanimous voice vote - 3. SPECIAL ORDERS OF THE DAY 90-165 Presentation of Service Certificate to Vincent Luczak, former Pension Board Member. President Corica commended Mr. Luczak for his efforts on the Pension Board and dedication in service to the City; and presented a Certificate of Service to Mr. Luczak, WRITTEN COMMUNICATIONS 90-166 From Eugene Chase, Alameda, concerning the three-way stop sign at the intersection of Bayview Drive and Court Street. Eugene Chase, 1076 Camellia Drive, requested Council to recognize that no traffic problem exists at the intersection; the solution to problem on Bayview is traffic synchronization so east-west traffic through Alameda can move without frequent, time-consuming stops at signal lights; if achieved, no one would use Shore Line/Bayview Drive route. Charles Millman, 2916 Bayview Drive, stated residents' pets have been killed by speeders; a no-left-turn sign should be placed at Otis and High to make flow of traffic smoother and faster after coming off the bridge; an additional stop sign is needed at Laguna Vista on Bayview; and commented Traffic Advisory Committee [TAC] is meeting tomorrow [3/20/91], the matter is agendized for their consideration, and sufficient notice was given to residents. The Public Works Director stated the staff report recommends if Council wishes to consider removing the stop sign, Council could refer the matter to TAC; and in anticipation that Council might do that, the matter was placed on the TAC agenda and notice was given the people. Councilman Arnerich stated he believes the stop signs have worked effectively, and went on record that he will not recommend removal of the stop signs from Bayview. Councilmember Camicia moved acceptance of the written communication. Councilman Arnerich seconded the motion. Councilmember Camicia stated he is not unsympathetic to Mr. Chase; however, there are a number of people in the neighborhood who have worked over a long period of time for the [three-way] stop sign, and until there is a great outcry to remove it, which he does not see happening, he does not believe Council should remove the [three-way stop] sign. The motion was carried by unanimous voice vote - 3. March 19, 1991 7 6 HEARINGS 91-167 Consideration of establishing liens for repairs to sidewalk, Driveway, Curb or Gutter at various locations in the City of Alameda. President Corica explained the procedure of the hearing. The Public Works Director reviewed background of matter and requested deletion of five addresses from the list of real properties against which liens are to be recorded, 2708 Lincoln, 1108 Union Street, 2300 Central Avenue, 1549 Bay Street, and 1420 Pacific Avenue; and requested addition of 434 Haight Avenue for $593.72. President Corica opened the public portion of the hearing. On the call for proponents, there were none. On the call for opponents, there were none. President Corica closed the public portion of the hearing. Councilmember Camicia moved the related resolution be taken out of order. Councilman Arnerich seconded the motion which was carried by unanimous voice vote - 3. Councilmember Camicia moved the resolution, incorporating changes detailed by the Public Works Director. Councilman Arnerich seconded the motion which was carried by unanimous voice vote - 3. 91-168 Resolution No. 12083 "Confirming Report of Superintendent of Streets in the Matter of the Repair of Sidewalk, Driveway, or Curb and Gutter in Front of Various Properties and Directing the Filing of a Notice of Lien on These Properties with the County Auditor." Adopted. Councilmember Camicia moved same [previous] motion [to adopt resolution, incorporating changes as outlined by the Public Works Director]. Councilman Arnerich seconded the motion, which was carried by unanimous voice vote - 3. REPORTS AND RECOMMENDATIONS 91-169 From Chair, Cable Television Oversight Committee, submitting the 1990 Annual Report. Councilmember Camicia moved the recommendation. Councilman Arnerich expressed concern about the number of complaints received regarding Cable's telephone service, and suggested calls could be directed to the Citizens Response Center regarding difficulty in getting through to Cable, perhaps for a short time, to evaluate the situation. March 19, 1991 77 President Corica stated that would place a burden on the City to provide what Cable should be providing; he would dislike starting something because once the number is given out, calls will continue to come in, and he does not believe it is the responsibility of the City to provide that type of service; Cable should increase its personnel if necessary. Councilman Arnerich stated he will approve [the recommendation] if the City Manager will make Cable aware of the Council's desire to have Cable provide another person or more available phone lines. The Assistant City Manager stated Cable receives around 9000 calls per month and have added a new receptionist, nevertheless, there appears to be a problem, and he will communicate Council's wishes to Cable. Councilmember Camicia suggested the City review the National Cable Television Organization's standards of performance, and the Committee regularly check whether Cable is in compliance. Councilman Arnerich moved the recommendation [that Committee continue to monitor and evaluate Cable]. Councilmember Camicia seconded the motion which carried by unanimous voice vote - 3. 91-170 From Finance Director regarding Awards of Excellence received by the City of Alameda. President Corica stated Council is proud of receiving the award and commended the Finance Director. Councilmember Camicia moved the report. Councilman Arnerich the motion which was carried by unanimous voice vote - 3. 91-171 From Recreation and Parks Director regarding request two additional Park Maintenance Workers. seconded to hire Donald Sherratt, 74 Basinside Way, Chairman, Recreation Commission, stated additional staff is needed, the request to add two more personnel to the maintenance crew is viable, and he hopes Council will respond in a positive manner. Councilman Arnerich stated the positions are needed; Recreation and Parks Department personnel is down considerably from twenty years ago while demands have increased due to new parks and more people [served]; and moved the recommendation [to authorize hiring for two additional maintenance positions]. Councilmember Camicia seconded the motion which was carried by unanimous voice vote - 3. 91-172 From Public Works Director regarding Airport Roadway Project Status Report. President Corica stated an additional $25,000 is requested for the study; he has a problem with that; Council promised the people March 19, 1991 nothing would be done [with the project] until a determination WE made that the project would benefit the City of Alameda; that ha_ not been determined; if the Port of Oakland, City of Oakland, and developers want to proceed, they can pick up the City's portion of funding. Councilman Arnerich clarified financing with the Assistant City Manager, e.g., that the funding is not from General Fund but Traffic Improvement Fund (TIF), and is already set aside. In response to President Corica, the Public Works Director noted other TIF projects include the new signal at Packet Landing Road and Bridgeway, and a portion of the Doolittle widening project; and some signal improvements on High Street and Fernside will be eligible for funding. President Corica stated his point is that not all TIF will be used for the Project; and he is not willing to contribute more money until a determination can be made that the Roadway is a benefit to the City. The Public Works Director noted the preliminary indications of traffic predictions done as part of the study, indicate the Roadway will make some improvements on the High Street/Fernside corridor, several intersections would be at a better level of service both no and in the future; and the Environmental Impact Report will give detailed look at traffic and other implications from the Roadway. Councilmember Camicia stated President Corica has brought up a good point, as Council has stated it would like to see the net benefit to Alameda; he sees no harm in holding the matter over for a month until a report [providing the net benefit of Project to Alameda] comes back from the Public Works Director, and so moved. President Corica stated perhaps a way can be worked out to approach the Roadway from Harbor Bay Parkway only. Councilman Arnerich seconded Councilmember Camicia's motion which was carried by unanimous voice vote - 3. RESOLUTIONS 91-173 Resolution No. 12084 "Approving Salary-Classification Resolution for Non Full-Time Positions." Adopted. Councilmember Camicia moved adoption. Councilman Arnerich stated he has noticed that some stop signE installed over the past year have extension bars for visibilit purposes; hopes the new sign [at Garden Road and Mecartney] will nc have any obstructions; and a list of stop signs with obstruction:. will be forwarded to Public Works. Councilmember Camicia moved introduction. Councilman Arnerich seconded the motion which was carried by unanimous voice vote - 3. 91-185 Ordinance No. , N.S. "Amending the Alameda Municipal Code by Amending Section 17-342.4 of Chapter 3, Article 4, Title XVII and Repealing Subsection (50) of Section 17-342 Relating to Parking Restrictions on Saturdays in the 1300 Block of Park Avenue." Councilmember Camicia moved introduction. Councilman Arnerich seconded the motion which was carried by unanimous voice vote - 3. NEW BUSINESS 91-186 Councilmember Camicia stated he is receiving complaints from residents about excessive speed and trucks on Grand Street between Constitution Way and the beach; he would like the matter placed on the next Traffic Advisory Committee's Agenda and Council provided [staff/TAC] recommendations to resolve the problem. 91-187 Vice Mayor Arnerich stated he has noticed there is no white middle line on Grand Street from Otis to Central Avenue, ar requested staff to look into the matter. 91-188 Councilmember Camicia requested a report at the next Counci.. Meeting on possible implications of providing health benefits to all retired Councilmembers. March 19, 1991 81 91-189 Vice Mayor Arnerich stated he believes there are obstacles, a traffic control electrical outlet and 5-foot-high bush, at the corner of High Street and Fernside Blvd., opposite the convalescent hospital, which create difficult turns. ANNOUNCEMENT BY MAYOR OF CLOSED SESSION ACTION 91-190 President Corica announced that, prior to the regular meeting, Council adjourned to Closed Session, and took the following action: Taylor, N. v. City of Alameda, pursuant to Subsection (a) of the legal counsel section of the Brown Act: discussed status of the case and took no action.
