SUPPORTING THE COMPLETION OF THE I-80 OPERATIONAL
IMPROVEMENT PROJECT FROM THE BAY BRIDGE TO STATE ROUTE
4 AND URGING THE ALAMEDA COUNTY SUPERIOR COURT TO
EXPEDITE ITS CONSIDERATION OF THE LAWSUIT BROUGHT BY
URBAN ECOLOGY AND TO LIFT THE STAY OF CONSTRUC~ION
WHEREAS, Caltrans has designed and had begun construction on
a project which will add continuous High Occupancy Vehicle (HOV)
lanes on I-80 from State Route 4 to the Bay Bridge, ("Project");
and
WHEREAS, this Project also incorporates seismic retrofit of
several interchanges on I-80; and
WHEREAS, the Project has been modified to meet adjacent
jurisdictions' concerns, from the original scope which included
both new travel lanes and discontinuous HOV lanes; and
WHEREAS, transportation modeling has shown that this Project
will relieve congestion in the I-80 corridor; and
WHEREAS, caltrans has prepared and adopted an EIR for the
original project and after an internal review, Caltrans deemed
that no supplemental document was required for the revised
Project; and
WHEREAS, this Project is included in many regional plans
including the state Transportation Improvement Program and the
countywide Congestion Management Plan; and
WHEREAS, in September of this year, Urban Ecology and three
other environmental groups filed a lawsuit and requested a stay
of design and construction on this Project, and said lawsuit
alleges that the environmental document for this Project is not
adequate because it failed to address "changed" conditions and
because the Project has been substantially "changed" from the
original project identified in the EIR; and
WHEREAS, the Alameda Superior Court issued a stay of
construction on September 15, 1992 ·and also agreed to hear.the
issue on October 30, 1992; and
WHEREAS, at its October 1, 1992 special meeting, the Alameda
county congestion Management Agency (CMA) adopted a resolution
relating to the I-80 Operational Improvement Project which
expresses the CMA Board's support for completion of the Project,
and the CMA Board's intent to continue to advocate for transit
operating assistance funds throughout Alameda County and this
corridor; and
WHEREAS, the resolution also calls on the Alameda County
Superior Court to expedite its consideration of the lawsuit
brought by Urban Ecology, and three other environmental groups,
and to lift the stay of construction first imposed on September
15,1992; and
WHEREAS, completion of the $350 million Project will help to
sustain the economy of Alameda County by providing access to the
urban core for both people and commerce; and
WHEREAS, the Project is estimated to generate some 21,000
direct and indirect jobs at a time when our economy has resulted
in job losses; and
WHEREAS, according to Caltrans, the Cypress structure
replacement could be jeopardized by a delay to the I-80 Project,
to which it must connect; and
WHEREAS, Alameda County's transportation system and economy
would suffer negative impacts it these two projects which
together total over $1 billion ware lost; and
WHEREAS, Caltrans has ef;tJma.ted that the cost of delay to
the I-80 Project is $1.3 million per month; and
WHEREAS, the cost of delay to the Cypress project is not
easily quantified; however, the Cypress Project is identified as
one of several projects to be funded from Emergency Relief (ER)
monies, and if the Cypress Project is delayed, other projects may
use up the ER funds before the Cypress is ready to proceed; and
WHEREAS, the Cypress project would then need to be funded
through other competitive state funds, which would then usurp
these funds for other state and local projects;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the
City of Alameda does hereby support the completion of the I-80
Operational Improvement Project; and
BE IT FURTHER RESOLVED, that the City Council of the City of
Alameda requests that the Alameda Superior court act quickly to
lift the stay of construction for the I-80 Operational Improve-
ment Project; and
BE IT FURTHER RESOLVED, that the City Council of the City of
Alameda hereby authorizes the City Clerk to transmit a copy of
this resolution to the appropriate courts and to Caltrans for its
use, as appropriate.
