AMENDING THE CITY COOPERATION AGREEMENT
BETWEEN THE CITY OF ALAMEDA AND MARINA VILLAGE
WHEREAS, the City of Alameda and Alameda Real Estate
Investments and Alameda Marina Village Associates (hereinafter
collectively referred to as Marina Village) entered into a City
Cooperation Agreement on December 18, 1984 as amended by that
certain Amendment dated March 18, 1987 and as further amended by
Amendment No. 2 dated February 21, 1989 (collectively, the
"Agreement"); and
WHEREAS, the City Cooperation Agreement provides for a
method of funding the development of project and off-site public
improvements; and
WHEREAS, Marina Village used its property as collateral
for the Issuance of Assessment Bonds to pay for financing the
Public Improvements; and
WHEREAS, the City of Alameda and Marina Village desire to
amend the agreement to provide for an additional advance from the
Marina Village Assessment District 84-3 toward additional Project
Improvement costs; and
WHEREAS, the Project Public Improvements will benefit
adj a cent, undeveloped properties and funds received from those
properties will be used to reimburse the cost of development
required of the assessed owners;
NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Alameda hereby approves and authorizes Amendment No. 3 to
the City Cooperation Agreement.
