1989-02-27 Special CC Minutes64 SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF ALAMEDA HELD MONDAY - - - - - - - - - - - - - - FEBRUARY 27, 1989 The meeting convened at 7:35 p.m. with President Corica presiding. ROLL CALL: Present: Councilmembers Arnerich, Camicia, Thomas, and President Corica - 4. Absent: Councilmember Monsef - 1. 89 -153 Consideration, pursuant to Section 2 -10 of the City Charter, of designating a person to perform the duties of the City Attorney at such time as the Office of the City Attorney becomes vacant and until a permanent successor may be appointed. President Corica read a memorandum from Councilmember Monsef explaining his absence from the meeting and commenting, on the subject of the City Attorney, that he would like Bruce Quan employed to carry on the responsibilities of the City Attorney's office on an interim basis until the vacancy is permanently filled. President Corica stated he requested Mr. Quan submit a resume which was received this afternoon; and he believes Mr. Quan would be the one to be considered for the temporary position. Councilman Arnerich stated he had no names to submit for the position. President Corica called for any other names Councilmembers wished to submit. Marilyn Lewis, Lewis & Lewis, 2411 Santa Clara #17, offered her service for the Interim City Attorney position; reviewed her background, expertise, description of her firm's capability, and noted she is the litigator in her firm and has taught at Boalt Hall School bf Law. President Corica reiterated that the position is an interim position. The timeframe for appointment was discussed. Councilmember Camicia stated he understands there is an urgency but is a little uncomfortable to make a decision tonight as he has not had sufficient time to review Mr. Quan's resume. Councilman Arnerich inquired if Ms. Lewis is interested in this position on a part -time basis, to which she responded she understood it would require full time. February 27, 1989 Councilmember Camicia stated there is a need for an Interim City Attorney and a need to start a whole process for a permanent successor. A discussion followed on whether the position title is Interim or Acting City Attorney, the length of time of the temporary position, and whether or not there should be a contract. The City Manager suggested Council consider hiring someone as a temporary employee and that the hiring be done in time for a briefing by the present City Attorney. President Corica commented that the matter of Measure A would be coming up in court soon, and Mr. Quan knows about Measure A as he was present at the time it was put into effect. Councilmember Camicia stated that, although he has not been able to review Mr. Quan's resume before this evening, President Corica's point is excellent, and therefore he will make a motion to hire Mr. Quan. Councilman Arnerich commented that the selection of Mr. Quan would be a good one as he knows City Hall and its workings, and seconded the motion. Councilmember Thomas stated she will abstain as she could not recommend another lawyer to a client without knowing the full background and she cannot do for her City what she cannot do for a client. The motion was carried by the following voice vote: Ayes: Councilmembers Arnerich, Camicia and President Corica - 3. Noes: None. Absent: Councilmember Monsef 1. Abstentions: Councilmember Thomas - 1. Councilmember Thomas stated the Interim City Attorney should start as soon as possible. Councilman Arnerich agreed. A brief discussion ensued regarding the time an appearance will'be made on Measure A. Councilmember Camicia stated he has information regarding law firms who work for municipalities, and he would leave it in the City Manager's office for Councilmembers who may be interested. The City Manager inquired if Council would like some recommendations from the Manager's Office for a selection process open to all firms and individuals.
