1983-02-01 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY FEBRUARY 1, 1983 The meeting convened at 7:30 p.m. with President Corica presiding. The Pledge of Allegiance was led by Councilmember Stone. The Invocation was given by Rev. Su Schlagel, Twin Towers Methodist Church. ROLL CALL: Present: Councilmembers Diament, Gorman, Sherratt, Stone, and President Corica - 5. Absent: None. MINUTES Councilmember Diament made a motion, seconded by Councilmember Sherratt, that the Minutes of the Regular Council Meeting of January 4, 1983, be approved as submitted; the motion carried by unanimous voice vote - 5. CONSENT CALENDAR Councilmember Gorman made a motion, seconded by Councilmember Sherratt, that the following items on the Consent Calendar be adopted; the motion carried by the following roll call vote: Ayes: Councilmembers Diament, Gorman, Sherratt, Stone, and President Corica - 5. Noes: None. Absent: None. Items so enacted or adopted are indicated by an asterisk ( *). REPORTS AND RECOMMENDATIONS *83 -046 From Public Works Director recommending extension of 130 days to July 11, 1983, to complete improvement of Harbor Bay Parkway, No. P.W. 12- 81 -12. Approved. RESOLUTIONS *83 -047 Resolution No. 9973 "Establishing fees to be charged for play on the Mif Albright Par -3 Golf Course." Adopted. *83 -048 Resolution No. 9974 "Adopting Plans and Specifications for the repair and resurfacing of certain streets, Phase 2, calling for bids and directing City Clerk to advertise same." Adopted. *83 -049 Resolution No. 9975 "Authorizing open market purchase of various vehicles for the Public Works Department and City Attorney's Office." Adopted. BILLS *83 -050 An Itemized List of Claims, certified by the City Manager as correct, was approved in the amount of 5189,157.93. RETURN TO REGULAR AGENDA REPORTS AND RECOMMENDATIONS 83 -051 From Chairman of Recreation Commission submitting information regarding Friends of Alameda Parks & Recreation Foundation, Inc. February 1, 1983 Councilmember Sherratt made a motion, seconded by Councilmember Stone, that the report be accepted and the recommendation approved; the motion carried by unanimous voice vote - 5. 83 -052 From Public Works Director recommending final extension of time of three months to March 5, 1983, to complete improvements for Tract 4121 (Harbor Bay Isle Village 3). Councilmember Sherratt made a motion, seconded by Councilmember Diament, that the report be accepted and the recommendation approved; the motion carried by unanimous voice vote - 5. RESOLUTIONS 83 -053 Resolution No. 9976 "Authorizing execution of agreements with Housing Authority of the City of Alameda relating to legal representation for said Authority." Councilmember Stone made a motion, seconded by Councilmember Sherratt, that the resolution be adopted; the motion carried by the following roll call vote: Ayes: Councilmembers Diament, Gorman, Sherratt, Stone, and President Corica - 5. Noes: None. Absent: None. 83 -054 Resolution No. 9977 "Authorizing reprogramming of unexpended Second and Third Year Community Block Grant Entitlement Funds in the amount of $45,845 for operating funds for a Local Development Corporation." Councilmember Diament made a motion, seconded by Councilmember Sherratt, that the resolution be adopted. In response to inquiry of Councilmember Diament regarding monies for curb cuts and other monies authorized to be spent from those funds, the City Manager stated that he would provide a status report. In response to inquiry of Councilmember Diament as to expenditure of monies derived from sale of property at 1317 Pacific, the City Manager stated he would submit a recommendation in the near future. The motion to adopt the resolution carried by the following roll call vote: Ayes: Councilmembers Diament, Gorman, Sherratt, Stone, and President Corica - 5. Noes: None. Absent: None. INTRODUCTION OF ORDINANCES 83 -055 Ordinance No. , New Series "Amending the Alameda Municipal Code to provide for certain Animal Shelter service fee increases." Councilmember Sherratt made a motion, seconded by Councilmember Stone, that the ordinance be introduced and passed to print; the motion carried by the following roll call vote: Ayes: Councilmembers Diament, Gorman, Sherratt, Stone, and President Corica - 5. Noes: None. Absent: None. 83 -056 Ordinance No. , New Series "Amending the Alameda Municipal Code by establishing alarm systems regulations." February 1, 1983 Councilmember Sherratt made a motion, seconded by Councilmember Gorman, that the ordinance be introduced and passed to print; the motion carried by the following roll call vote: Ayes: Councilmembers Diament, Gorman, Sherratt, Stone, and President Corica - 5. Noes: None. Absent: None. FINAL PASSAGE OF ORDINANCES 83 -057 Ordinance No. , New Series "Amending the Alameda Municipal Code by amending Section 9 -121 thereof to limit the number of domestic fowl allowed to be kept by City residents." Mary Levine, 1827 Nason Street, stated that she had contacted a 4 -H Youth Advisor and a representative of the Department of Agriculture, and they had indicated to her that more than six chickens per residence should be allowable. She requested the Council to reconsider the limit of six chickens. Susan Potter, 1717 - 5th Street, spoke in opposition to the limit of six chickens per residence. After discussion, Councilmember Sherratt made a motion, seconded by Councilmember Stone, that final passage of the ordinance be held over to the next meeting and that staff be directed to contact the persons Ms. Levine had spoken with and furnish additional information; the motion carried by unanimous voice vote - 5. UNFINISHED BUSINESS 83 -058 Councilmember Sherratt requested Fernside Boulevard Extension be posted with speed limit signs and proper markings on roadway and that an ordinance extending the truck ban through Fernside Boulevard Extension be prepared. The Public Works Director stated that Caltrans had been contacted regarding those matters. 83 -059 Councilmember Diament inquired regarding the Ad Hoc Efficiency Committee report on the Bureau of Electricity and stated that more information was needed. The City Manager stated that the report might go to the Public Utilities Board first and that he was sure the Board would be happy to provide the Council with additional information. He noted that the 115 -KB Conversion Project is underway. 83 -060 Councilmember Stone made a motion, seconded by Councilmember Diament, to approve a formal ribbon cutting ceremony for the Maitland Drive Project; the motion carried by the following vote: Ayes: Councilmembers Diament, Sherratt, Stone, and President Corica - 4. Noes: Councilmember Gorman - 1. Absent: None. 83 -061 President Corica stated that he was concerned about the progress relative to Cable Television construction, and he wanted to alert the people involved about the time frames and that the system should be fully connected by August 6, 1983. He noted that the penalty would be 51,000 per day if facilities are not built on time. 83 -062 In response to inquiry of Councilmember Diament as to whether there had been damage to South Shore Beach as a result of the recent storms, the City Manager stated he had spoken with a representative of East Bay Regional Park District, and there had been no damage to South Shore Beach. February 1, 1983 83 -063 President Corica referred to a recent report from East Bay Regional Park District relative to the disposal site and noted it was unsatisfactory as it requested the same acreage as the first one. The City Manager stated the matter is still under discussion. 83 -064 Councilmember Sherratt referred to a letter from Bay Conservation Development Commission (BCDC) regarding leasing of accessways along East Shore and expressed concern relative to problems encountered with BCDC. Councilmember Sherratt made a motion, seconded by Councilmember Stone, that a letter be sent to the Governor, signed by Mayor Corica, on behalf of the Council expressing concern about that Commission. (No vote was taken on the motion as discussion immediately ensued.) President Corica stated that he had sent a letter to the Governor on that subject but had not received a reply. The City Manager suggested that he and the City Attorney submit recommendations to the Council identifying problems with BCDC and that the Council take an official position. It was the consensus of the Council that recommendations be prepared as suggested. FILING 83 -065 Agreements with Housing Authority relating to legal representation for said Authority. Plans and Specifications for repair and resurfacing of certain streets, Phase 2. ORAL COMMUNICATIONS, GENERAL 83 -066 Fred Scullin, 1120 Chestnut, mentioned hazards related to Genetic Engineering and referred to a Berkeley ordinance on that subject. President Corica requested the City Attorney to research regulations. 83 -067 Fred Scullin, 1120 Chestnut, referred to the Solid Waste Generating Plant and a meeting attended in Fremont. President Corica stated he would provide Mr. Scullin with a report from the Mayors' Conference on that subject. 83 -068 John Potter, 1717 5th Street, expressed concern regarding a power pole at 4th and Central which had been damaged for quite some time.
