HELD TUESDAY FEBRUARY 12, 1980
Convened at 7:30 o'clock p..m. with President Corica presiding.
ROLL CALL: Councilmen Diament, Sherratt, Stone, Tillman and President Corica - 5.
Absent: None.
A copy of the Notice and Agenda of this Special meeting is on file in the
Office of City Clerk. Purpose of the Special Meeting was consideration of a
report from Secretary of Planning Board regarding critical ratios as they relate
to condominium conversions, continued hearing on the Negative Declaration for
the proposed Housing Element and on the proposed Housing Element, and the
resolution adopting the Housing Element.
80 -124 From Secretary of Planning Board regarding critical ratios as they
relate to condominium conversions.
The City Manager recommended that the issue of critical ratios be discussed at
the time of adoption of modification to the existing Condominium Conversion
Ordinance and that the Housing Element establish general goals relative to
providing protection for senior citizens and low and moderate income families in
terms of condominium conversions.
Councilman Tillman recommended that modifications to the Condominium Conversion
Ordinance be considered at the March 4, 1980, meeting and stated that Council
could consider a moratorium on condominium conversions at that time.
After considerable Council discussion, Councilman Sherratt made a motion,
seconded by Councilman Stone, that the report be accepted and forwarded along
with Councilman Tillman's recommendation regarding condominium conversions
and other relative material to the Planning Board for their recommendation
to Council; the motion carried by unanimous voice vote - 5.
80 -125 Continued hearing for review of the Negative Declaration for the
proposed Housing Element and on the proposed Housing Element.
President Corica stated that the Planning Board had approved the Negative
Declaration and the hearing had been continued from the February 5, 1980
meeting.
President Corica explained the procedures to be used in the hearing.
On the call for proponents there were no speakers.
On the call for opponents, the following persons spoke in opposition to adoption
of the Draft Housing Element as written:

and a letter from Elaine de Man in support of the Housing
Rehabilitation Program.

Steve McEntire, 1000 Paru Street
President Corica declarec' the public portion of the hearing closed and stated
that the Council would consider the letter submitted by Barbara Worden, Chairman
of the Housing Element Advisory Committee, dated February 5, 1980 outlining
recommendations for corrections to the Housing Element.
Councilman Sherratt made a motion, seconded by Councilman Diament, that the
recommendation that the points contained in Mayor Corica's letter to Lawrence
B. Simons, July 10, 1979 be included in the Housing Element be approved; the
motion carried by unanimous voice vote - 5.
Councilman Stone made a motion, seconded by Councilman Sherratt,that a paragraph
be added on Page 5 under "Rehabilitation and Neighborhood Preservation" as
follows - "Utilize self -help techniques to reduce rehabilitation costs." The
motion carried by unanimous voice vote - 5.
Councilman Sherratt made a motion, seconded by Councilman Diament, that the
last paragraph on Page 5 read, "If sufficient funding is available, acquire control
of sufficient land to develop units of new owner - occupied housing scattered
throughout the City in the next three years." The motion carried by the following
roll call vote: Ayes: Councilmen Diament, Sherratt, Stone, and President Corica - 4.
Noes: Councilman Tillman - 1. Absent: None.
Councilman Tillman made a motion, seconded by Councilman Sherratt, that on Page 6,
the following paragraph be added under "Government Process" - "Investigate
advanced techniques and materials in construction to reduce costs." The motion
carried by unanimous voice vote - 5.
Councilman Stone made a motion, seconded by Councilman Diament, that on Page 8
the reference to a specific.: recommendation as to City spending be eliminated
and that the phrase, "The City could consider funding through local resources,"
be added; the motion carried by unanimous voice vote - 5.
Councilman Sherratt made a motion, seconded by Councilman Stone, that the section.
"Enforcement of Codes," on Page 9 be deleted; the motion carried on the following
roll call vote: Ayes: Councilmen Diament, Sherratt, Stone, and President Corica - 4.
Noes: Councilman Tillman - 1. Absent: None.
Councilman Stone made a motion, seconded by Councilman Diament, that the section
"Housing Corporation" on Page 12 be eliminated; the motion carried by the
following roll call vote: Ayes: Councilmen Diament, Stone and President Corica - 3.
Noes: Councilmen Sherratt and Tillman - 2. Absent: None.
Councilman Tillman made a motion, seconded by Councilman Stone, that the paragraph,
"In order for condominiums to be affordable to middle income households, prices
need to be in the range of S40,000 to $55,000 for a two person unit and S45,000
to S65,000 for a three person unit. If these price ranges are being exceeded
the City would be trading off renter hardship for upper income home ownership
opportunities. Even with prices in these ranges, long range affordability remains
an issue in the current market situation," which was contained in the staff report
dated January 28, 1980, under "Recommendations to the Housing Element Draft

Concerning Condominium Conversions" not be included in the Housing Element;
the motion carried by unanimous voice vote - 5.
Councilman Sherratt made a motion, seconded by Councilman Diament, that the
references to conditions relative to condominium conversions under "Rental
and Home Ownership Assistance" contained in the staff report dated January 28,
1980, not be included in the Housing Element inasmuch as they should be
considered when revisions to the Condominium Conversion Ordinance are before
Council; the motion carried on unanimous voice vote - 5.
Councilman Sherratt made a motion, seconded by Councilman Diament that the
recommendation in Councilman Tillman's memorandum dated February 5, 1980,
"Paragraph 7, page 5 - Rental and Home Ownership Assistance - Study the revision
of Condominium Conversion Ordinance in order to allow cooperative and condominiums
affordable to existing tenants," be added to the Housing Element; the motion
carried by unanimous voice vote - 5.
Councilman Diament made a motion, seconded by Councilman Stone, that the reference
to 75 scattered units contained in the staff report dated February 6, 1980,
under No. 5, Page 3, not be included in the Housing Element; the motion carried
by the following roll call vote: Ayes: Councilmen Diament, Sherratt, Stone
and President Corica - 4. Noes: Councilman Tillman - 1. Absent: None.
Councilman Tillman made a motion, seconded by Councilman Stone, to delete
reference to 15% under No. 6, Page 3, of the staff report dated February 6, 1980,
and change wording to "Encourage developers to provide new affordable Housing."
The motion carried by unanimous voice vote - 5.
Councilman Stone made a motion, seconded by Councilman Sherratt, that the
following statements be inserted in the Housing Element on Page 4 and 5.
Home Ownership Opportunities, Goals and Policies
To allow condominium conversions in circumstances which
would increase ownership opportunities for middle income
people without undue tenant displacement.
Renter Goals and Policies
To maintain the supply of rental units at a high proportion
of the existing rental inventory.
Rental and Home Ownership Assistance
Study the application of cooperative conversion to
specific situations in Alameda in order to provide ownership
opportunities with long range affordability to middle income
households within 80% to 120% of regional family income.
The motion carried by unanimous voice vote - 5.
The City Attorney recommended that the third paragraph on Page 82 in the
Housing Element relative to Article 34 of the State Constitution be deleted.
Councilman Diament made a motion, seconded by Councilman Sherratt, that the
entire paragraph be deleted in accordance with the recommendation of the City
Attorney; the motion carried on unanimous voice vote - 5.

Councilman Sherratt made a motion, seconded by Councilman Diament, that the
resolution adopting the Housing Element, as amended, be considered; the
motion carried by unanimous voice vote - 5.
RESOLUTIONS
80 -126 Resolution No. 9235, "Amending Comprehensive General Plan by adopting
Housing Element thereof and certifying review and consideration of the Negative
Declaration for said Element." Councilman Tillman made a motion, seconded
by Councilman Diament, that the resolution be adopted; the motion carried by
unanimous voice vote - 5.
80 -127 Councilman Tillman made a motion, seconded by Councilman Stone, that
the Council and the Housing Authority write a communication to the Board of
Realtors requesting assistance in locating Section R Housing within the City
and that the matter be placed on the Council agenda of February 19, 1980;
the motion carried by unanimous voice vote - 5.
ADJOURNMENT
80 -128 Councilman Tillman made a motion, seconded by Councilman Diament, that
the Council adjourn to Executive Session for consideration of personnel matters
and litigation. The Council adjourned to Executive Session in respect to the
memory of Reginald Williams.
At the conclusion of the Executive Session, it was determined that no action
would be taken.
There being no further business to come before the meeting, the Council adjourned
at 11:15 p.m., to assemble in regular session on Tuesday, February 19, 1980,
at 7:30 o'clock p.m.
