CITYOFALAMEDARESOLUTIONNO.14922 INITIATINGPROCEEDINGSFORAPROPOSEDINCREASEIN ASSESSMENTS,THECONSOLIDATIONOFZONES2AND3 INTOASINGLEZONE8,ANDTHEFILINGOFAN ASSESSMENTENGINEER'SREPORTFORISLANDCITY LANDSCAPINGANDLIGHTINGDISTRICT84-2,PROPOSED ZONE8 WHEREAS,theCityofAlameda(the"City")hasdulycreatedtheIslandCity LandscapingandLightingDistrict84-2(the"District")proposestoconsolidateZones2 and3intoZone8(the"Zone")undertheLandscapingandLightingActof1972 (Sections22500andfollowingoftheStreetsandHighwaysCodeofCalifornia)(the "Act")toinstallandmaintaincertainlandscapingandlightingimprovements(the "Improvements");and WHEREAS,theCityCouncilandthelocalbusinessassociationsdesireto increasetheassessmentswithintheZones;and WHEREAS,NBShaspreparedanEngineer'sReportinaccordancewithSection 22565etseq.oftheCaliforniaStreetsandHighwaysCodethataddresses,inpart, proposedchangedboundariesandanalysisofspecialandgeneralbenefitswithinthe Zones,themethodologyforassessmentsandtheproposedassessments;and WHEREAS,theCityEngineerhasreviewedandapprovedtheEngineer's Report. NOW,THEREFORE,BEITRESOLVED,DETERMINEDANDORDEREDbythe CityCounciloftheCityofAlameda,pursuanttoChapter2,Section22585oftheAct that: 1.TheCityCouncilherebyproposestoincreasetheassessmentswithin Zones2and3andtoconsolidateZones2and3inasinglebenefitzone(Zone8)under theActSection22585,topayforthecoststoprovideimprovementsandserviceswithin theDistrict.AllmaintenanceandserviceitemswillbedetailedintheEngineer'sReport. 2.TheimprovementsprovidedwithintheDistrictarefurtherdefinedinthe Engineer'sReportandinclude,butarenotlimitedto,theoperating,maintaining,and servicingofallpubliclandscapingimprovements,consistingoftrees,medians,refuse containers,sidewalks,plantmaterials,pathways,irrigationsystems,lightingsystems, andassociatedappurtenantfacilities.Servicesinclude,butarenotlimitedto, personnel,materials,contractingservices,electricalenergy,waterrequiredforall necessarymaintenance,replacement,repairandadministration,requiredtokeepthe abovementionedimprovementsinahealthy,vigorousandsatisfactorycondition.The MaintenanceandCleaningProgramincludesregularsidewalksweeping,alleycleaning, refuseremoval,regularlyscheduledsteamcleanings,pressurewashing,graffiti removal,treepruningandwatering,treewellweedingwithcrushedgranite replenishment,aswellasotherrelatedactivities. 3.TheboundariesoftheproposedZone8oftheIslandCityLandscaping andLightingMaintenanceDistrict84-02islocatedintheCityofAlamedainthearea generallylocatedalongWebsterStreetsouthofAtlanticAvenueandnorthofCentral Avenue. 4.TheproposedZone8iswithintheboundariesoftheCityofAlameda, withintheCountyofAlameda,StateofCalifornia;asshownupontheboundarydiagram includedintheEngineer'sReport,whichisonfileintheofficeoftheCityClerk.The distinctivedesignationoftheDistrictis"IslandCityLandscapingandLightingDistrict84- 2,Zone8oftheCityofAlameda". 5.TheCityCouncilherebyorderstheEngineer'sReportthattheCity Engineerapproved,concerningtheproposedassessmentsforZone8,whichwilltake effectforFY14-15,inaccordancewiththerequirementsoftheAlamedaMunicipal Code,tobefiledwiththeCityClerk. ***** I,theundersigned,herebycertifythattheforegoingResolutionwasdulyand regularlyadoptedandpassedbytheCounciloftheCityofAlamedainaregular meetingassembledonthe zo"dayofMay,2014,bythefollowingvotetowit: AYES:CouncilmembersEzzyAshcraft,Tamand MayorGilmore-3.
