CouncilmanForealsoreadapreparedstatementopposingtheproposal,andadvocatingcontrolledgrowth. CouncilmenMcCallandLongakeraddedtheircommentsthatacitizenhadtherighttolivewhereverhe choseandtheanswerlayingoodplanningandgoodbuiltingbuttolimitthepopulationwouldbeamistake. Afterdiscussion,CouncilmanForemovedlettersbeaddressedtotheAssociationofBayAreaGovernments andtotheMayors I ConferencestatingthepositionoftheCouncilinoppositiontotheproposal.Council- manLongakersecondedthemotion. CouncilmanMcCallsaidhewouldgoalongwiththemotionprOVidedapropercommunicationwoulddirected bytheCityManagerandtheCityAttorneytoABAG,expressingthepositionoftheCouncilinthematter, withacopytoPresidentLaCroixastheCity'srepresentativeonthatbodyandontheMayors I Conference, sothathewouldbefullyinformedonthediscussion.ThiswasagreeabletotheothermembersoftheCouncil. Thequestionwasputandthemotioncarriedonthefollowingrollcallvote. Absent:PresidentLaCroix,(1).r.Noes:None. 4.FromThePortolaCondominium,signedbyMr.J.B.S.Johnson,Jr.,PresidentoftheardofDirectors, requestingthatstepsbetakentocleanupandplanttheCitylandboundedbyPortolaAvenue,Westline DriveandEighthStreet. ItwasstatedthismatterwasunderstudybytheRecreationCommission. CouncilmanMcCallcommentedthathehadcriticizedtheCitywithregardtotheconditionofsomeofits propertiesandhewashappytoreceivetheletter.HesaidhefelttheCityhadaresponsibilitytomain- tainthelowerportionofWashingtonParkandthetriangularpieceofpropertyunderdiscussionandhe wouldliketoseetheCommission,theCityManagerandtheCityEngineerpursuethequestion. Onrequest,CityManagerWellerpointedoutthetriangularareainquestionwasconsideredaportionof theWashingtonParkextension,fordevelopmentwiththatarea.Heexplainedthecostofdevelopingthe smallareawithoutreferencetoeventualdevelopmentofthelandonthewesterlysideofWestlineDrive couldbeaveryexpensivemistakeonthepartoftheCity;herespectedthedesiresofthehomeownersin questionbutacomprehensiveandreasonableplanfordevelopingapproximatelytenacressouthofthepresent WashingtonParkplusthetriangularparcelwouldinvolveasubstantialamountofmoney.Hesaidhehad requestedthattheRecreationDirectorreviewtheGeneralPlansuggestionsforWashingtonParkFilland bringthemuptodate,particularlyinconnectionwiththeprospectivewideningofEighthStreet,andto comeupwithastaffrecommendationfortransmittaltotheCouncil,hopefully,withinamonth.Hesaid ifsomethingcouldbedoneatreasonablecosttomaketheareaunderdiscussionmoreaestheticallypleasing,hewouldhavenoobjection. CouncilmanMcCallsuggestedthatBureauofOutdoorRecreationfundsbeexplored theRecreationDirector. Itdirectedthatthecommunicationbeacknowledgedandreferredtothestaffforstudy. 5.FromMrs.HelenTrotsky,3312rAvenue,expressingobjectiontoincreaseduseofRunway27attheOaklandInternationalAirport. ItwaspointedoutthatrepresentativesoftheCityhaddone possibletomakeknownto AirportLandUseCommissionthepositionoftheCityinthematterofproposedexpansionoftheAirport,andtheAlamedames-Starlistedpeopletowhomcomplaintsshouldaddressedonthissubject. ItwasdirectedthattheClerksendacopyofMrs.TrotskylslettertotheAirportLandUseCommis-sion. 6.FromPan-PacificDevelopmentCompany,signedbyMr.WilliamB.Kirkland,Jr.,President,request- ingatimeextensionuntilMarch 31.1973,forcompletionofthepublicimprovementsinconnection withTracts3011and3105,andrequestingCityacceptanceofthelandscapinginthemedianstripofBallenaBoulevard. CityEngineerHannaexplainedthatTract3105waswithintheoverallsubdivisionknownasTract3011, whichwasvirtuallyalloftheprivatepropertyundercontrolofPan-Pacificandtheirworkwas essentiallycompleted.Tract 3105 wastheportiononwhichL.B.NelsonCorporationwasundercons- tructionandthereweresomechangesinthatareasuchasmovingofChannelDrivesoutherlyand renamingitTidewayDriveandchangesofsanitaryandstormsewers,etcetera.Hesaidtherewasno disadvantagetothecommunity,theresidentsoftheTractortheneighborhoodinallowingtheextension andherecommendeditbegranted. CouncilmanLongakermovedtherequestbegranted,thetimeextensiontoMarch 31,1973,beallowedfor completionofsaidpublicimprovementsandtheCityacceptthelandscapinginthemedianstrip. Themeetingreturnedtotheregularorderofbusiness. 20.FromthePlanningBoard,signedbytheSecretary,recommendingabandonmentofcertainstreet rights-of-wayandresaleofcertainpropertiesinthevicinityofBroadwayandBlandingAvenuein connectionwiththeproposedredevelopmentoftheLoopLumberCompany-CalRockproperties. Mr.DonaldJohnson,PlanningDirector,explained,inaccordancewiththeBoard1sletterofOctober13, 1972,thatthematterconcernedareferralbytheCounciltotheBoardtoconsidertheproposalbythe SutterHillDevelopmentCorporationforredevelopmentoftheLoopLumberCompany-CalRockproperties. Theproposalwastoacquirethe8.2-acresiteforashoppingcenter,containingapproximately94,000 squarefeetoffloorarea,parkingfor393carsandapublicusecommitmentslightlyinexcessofone acreonastripoflandborderingthetuary.HepointedouttheCityinvolvementconcernedcertain streetrights-of-way,certainpropertiesownedinfeebytheCity,aGeneralPlanrecommendationand theEnvironmentalImpactReportrequirement.TheproposalwasthatthenortherlyextensionofBroadway, about80feetby320feet,andaparcel30feetby100feetonPearlStreetbesoldtothedeveloperand thenortherlyextensionofPearlStreet,60feetbyapproximately420feet,beabandonedaswellasa smalltriangular-shapedportionofBlandingAvenue.Thedeveloperproposedtoimproveanewextension ofBlandingAvenuetointerconnectwithFernsideBoulevardandTildenWay. TheBoardhadfoundandrecommendedtotheCouncilthat (1)thecirculationelementoftheGeneralPlan wasneitherimpairednorenhancedbytheproposal,thatClementAvenuewasnotinterconnectedwithFern- sideBoulevardandTildenWaybutneitherwasthisconnectionprecludedatsomefuturedate;(2)the recreationelementwasimplementedbytheone-acreshorelinebandcommittedtopublicuse,arequirement oftheBayConservationandDevelopmentCommission,whichhadalreadyapprovedtheproject;(3)the abandonmentandresaleofcertainstreetrights-of-waywererecommendedsubjecttoretentionofnecessary easementsforutilityservicesanddrainagestructures;(4)theparcelofCity-ownedpropertyonPearl StreetnowusedforwarehousingwasnotnecessaryforfutureCityuseandwasrecommendedforresale. Mr.RandalF.Dickey,Jr.,Attorneyforthedeveloper,pointedouttheextensionsofBroadwayandPearl StreethadformanyyearsbeenutilizedbytheownersofadjacentlandsunderarrangementwiththeCity sotheyhadnotbeenavailableforpublicuse,andtheextensionofBroadwayhadoriginallybeensold totheCitybytheownerofthelandso,ineffect,hewouldbegettingthelandbackundertheproposal. Hestatedtherehadbeenalternativesforthedevelopment,oneprimarilyforhousing,butbecauseofthe increaseddemandsonthepublictaxrolls,particularlywithregardtoschools,ithadbeenrequested thatthisnotbedoneandtheshoppingcenterdevelopmenthadbeenchosenasamorereasonablealternative. HesaidthedeveloperfelttheproposalhadbeenapprovedbyBCDCwithregardtoitsrequirements,the EnvironmentalImpactStudyhadbeencompleted,givingbasicallyafavorablerecommendation,andhe requestedthattheCityproceedonthematterattheearliestpossibletimeandnotlaterthanthenext meetingoftheCouncil. Onrequest,Mr.Cunninghamexplainedwhatwasneededwas (1)approvalofthePlanningBoardreport;(2) directiontothestafftotakethenecessarystepstoimplementthereport,namely,preparationofappro- priatedocumentsforactionbytheCounciltoaccomplishvacationofthestreetsandsaleoftheproperty uponcompletionofnegotiationswithregardtothesaleandconsiderableengineeringworkwithrespect tothestreets.HepointedoutthedevelopershouldberequestedtofurnishtotheCityassurancesthat hewould,uponthisactionbytheCouncil,furnishthenecessaryengineeringdataandwouldbuildand improvetheareainaccordancewithinformalunderstandingbetweenhimandtheCity;and(3)thatthe CouncildirectthestafftopreparetheEnvironmentalImpactReport.Hesaidthesestepswouldtakecare ofthematterinsofarasthedeveloperwasconcernedandwouldadequatelyinsuretheCityoftheperform- anceinformallyunderstoodbetweentheCityandthedeveloper. OnquestionbyCouncilmanFore,Mr.JohnsonsaidheconsideredthefirmofAppliedScience &Resource Planning,Inc.,whichhaddonetheEnvironmentalImpactStudy,areputablefirm.inwhichCouncilmanMcCallconcurred. CouncilmanMcCallmovedthereportofthePlanningBoardinthismatterbeaccepted,thatthestaffbe directedtomaketheEnvironmentalImpactandrequiredengineeringstudies,andreqrementsoftheBay ConservationandDevelopmentCommissionbefollowed.CouncilmanLongakersecondedthemotion,withthe provisionthathewouldliketoknowtheCitywouldreceivethefairmarketvalueforallpropertiessold. Mr.CunninghamsaidheassumedthedirectionwouldincludethattheCityManagernegotiatethepriceifthishadnotalreadybeendone. Thequestionwasputandthemotioncarriedonthefollowingrollcallvote.Ayes:Four.Noes:None. Absent:One. 21.FromtheActingCityManager,recommendingthedeviseoftheMeyersproperty accepted. Mr.Goss,AssistantCityManager,explainedthatthelateDr.EdithM.Meyershadincludedinherwilla gifttotheCityofherone-thirdinterestinthefamilyproperty,homeandotherimprovementsat2021 AlamedaAvenueand2024CentralAvenuewhichcomprisedthreeparcels,withthetwo-storydwelling,a three-cargarage,astudioandpumphouse.Thegifthadbeenconditionedtoprovidethattheproperty wouldbeusedasaneighborhoodpark,thatthehousebeusedasaclubhouseoradministrativeheadquarters andmaintainedingoodconditionandthatthegiftbeacceptedpriortoNovember12,1972.Hepointed outthegiftwassubjecttoatrustforDr.Meyers I twosisters,whoownedtheremainingtwo-thirds interestinthepropertyandwhopresentlyoccupiedthehome.Therefore,immediateuseoftheproperty bytheCitywasnotcontemplatedsinceitwouldnotcomeintotheCity1spossessionuntilsometimeinthe future.Hesaidthisappearedtobeaverygenerousgiftofanolderwell-maintainedhomeandsomething whichwouldappeartobeanassettotheCityinthefuture. CouncilmanLongakermovedthereportbeaccepted.ThemotionwassecondedbyCouncilmanMcCalland unanimouslycarried.Therebeingnoobjections,themeetingproceededto"Resolut tons". RESOLUTIONS, 22.ThefollowingresolutionwasintroducedbyCouncilmanLongaker,whomoveditsadoption: 4 "ResolutionNo.7995 AcceptingDeviseofRealPropertyfromEstateofEdithM.Meyers (2021AlamedaAvenue-ParkPurposes).II ThemotiontoadoptsaidresolutionwassecondedbyCouncilmanMcCallandcarriedonthefollowing rollcallvote.Ayes:Four.Noes:None.Absent:One. TheCouncilmenexpressedgreatadmirationforDr.Meyersandsinceregratitudeforhergenerousgift totheCity.CouncilmanMcCallsaidhefeltthat,atthetimeofacceptingthegift,theCityshould recognizeinasuitablemannerthemanygenerousactsofthisoutstandingwoman. VicePresidentLevysuggestedthataletterbeaddressedtoMissesMildredandJeanetteMeyersexpress- ingthedeepappreciationoftheCouncilforthisgift. UNFINISHEDBUSINESS: 23.V~Atthistime,Mrs.DorothyC.Allen,PresidentofAlamedanswithHOPE,madealengthypresenta- tion,pointingoutHOPEhadrequested,atthePlanningBoardmeetingonSeptember25,thatimmediate actionbetakentocompletetheHousingElementoftheCity'sGeneralPlanandthattheElement requiredinputfromthecommunitytothePlanningDepartmenttodeterminehousingneedsofthecurrent populationaswellasprojectionintothefuture,thattheHousingElementwouldberequiredbythe AssociationofBayAreaGovernmentswhichhadpubliclyexpressedconcernforpopulationcontrolalong withotherregionalgovernmentsthroughouttheState,thatshebelievedthecontrolaboutwhichthey wereconcernedwasapolicyofinvitingnewpopulationintoCaliforniaratherthanprovidingforthecitizensalreadyintheState. Mrs.AllensaidthesecondrecommendationoftheorganizationconcernedappointmentofaLow-Cost HousingCommittee,astheCommitteewhichwasappointedsomeyearsagowasnolongeractive.Shesaid shefelttheconcernatthistimewasmoreforlower-pricedhousingincludinghomesformoderate- incomeaswellaslow-incomefamilies,anditwasaskedthatacommitteebere-activatedoranother beappointedtoformsuchasponsorshipunderHUDrequirementstoaidtheCityinprovidinghousing availabletobuyersofhomesqualifyingforSection235mortgageloanassistance. Mrs.AllensaidthethirdrecommendationwasthattheCityassistinprovidingfinancialhelpto sponsorsoflow-costandmoderate-incomehousing.Shepointedoutaneffectivewayofprovidingmore moderately-pricedhousinginolderneighborhoodswasbyrehabilitationofexistinghousingandtwo purposescouldthenbeaccomplished-well-builtolderhomeswhichgaveAlamedaneighborhoodscharacter couldbepreservedandatthesametimewithpropertaxreliefincentiveforhomeimprovementandfor homeimprovementloansystemsthroughlocalfinancialinstitutions,rehabilitationwouldcostlessso thathomescouldbemadeavailabletofamilieswithmoderateincomewhoqualifiedforthisassistance. Shepointedoutmanythesefamilieswereheadedbycivilserviceemployees. Mrs.AllenstatedHOPEhadaskedthattheCityAttorneybedirectedtostudywaysinwhichtheCity couldaidwithfinancingtoencouragepropertyownerstoimproveandrehabilitatetheirproperty. ShesaidtheorganizationbelievedtherewasadequatehousingintheCityforlow-incomesenior citizens,studentsandyoungcouples,aswellasformoderate-incomefamilies,thatithadneverbeen infavorofbuildinghousingprojects,thatonewayofincreasingthesupplyofmoderately-priced housingwouldbebyimprovingexistingstructuresinsteadofallowingthemtobetorndownforhigh- costnewconstruction.ShesaidalthoughHOPEconsideredunsatisfactorythewordingoftheproposed CharteramendmentmeasuretobeontheMarchElectionballot,itsupportedtheintentofthepetition andoftheinitiativetohaltconstructionprojectswhichwerechangingthecharacteroftheCity'sneighborhoods. Mrs.AllensaidHOPErecommendedthatthePlanningBoardbeencouragedtoinitiateapolicyof"down- zoning"topreventdestructionofsingle-familydwellingswhichwerebeingreplacedbyhigh-rent multiples.ShesaidtheexpressedattitudeoftheCityCouncilinfavorofdown-zoningandofpre- servingolderhomeswoulddiscouragelandspeCUlationintheCityandeventuallylowerthepriceof landandofhousing.ShesaiditwasimperativethattheCouncilmenindividuallyandtheCouncilas abodyexpressconcernforthecitizensitrepresentedandthatitsdecisionsandattitudesshowthat concern. TherewassomediscussionofthesubjectbytheCouncilandthestaff.Itwasdecidedtoapproach thebankingandfinancialinstitutionsoftheCityandrequesttheleaderstobecomeinterestedinthis problemtoseeifsomethingcouldbeworkedout. Mrs.AllensaidtheHOPEorganizationwouldlikesuchacommitteetocontinuetoservebeyondthe considerationofitsrecommendationsatthistimeastherewasalwaysaneedforaconcernforhousing. OnquestionbyCouncilmanMcCall,Mr.Johnson,PlanningDirector,explainedthedraftingin1967of theHousingElementoftheCity'sGeneralPlan.HesaidthecurrentHousingElementwasavery lengthy,involvedproceedingandwouldcosttheCityconsiderablesumsofmoney,thathisDepartment waspreparedtoundertaketheresponsibilityandhewouldassumetheCouncilwouldbackhimupwith eitherstafforconsultinghelptoaccomplishtheproject.Hesaidhewouldrecommendthatitbeundertaken. Therewasdiscussionwithregardtotheproblemoffinancingsuchastudy,andthepossibilityofits beingincludedintheprospectiverevenue-sharingfunds. VicePresidentLevyrequestedthatCouncilmanMcCallservewithhimonacommitteetoobtainsomeexpressionfromleadersinthecommunityonthismatter. 24.CouncilmanMcCallstatedhewasstillinterestedinobtainingaboatramponthelandbehind EncinalHighSchool.Hesaidithadbeenhisunderstandingthattherehadbeenaverbalagreement betweentheCityandtheBoardofEducationthatthiscouldbedevelopediftheCitycouldcomeupwith plans,andheknewtherewas$150,000availablefortheprojectinSacramento,andothermoneys,witha costtotheCityofnotmorethan$50,000forconstructionofarampmuchbetterthantheoneatthe northendofGrandStreet.HeremarkedthatthegreatestfisheryintheGreaterEastBayAreawaslocatedofftheareainquestion. CityEngineerHannastatedapreliminaryplanontheproposalwassittingonhisdeskawaitinghisatten- tionandhehadbeenunablephysicallytocarryoutthepersonalengagementswhichwouldbeinvolved. HesaidsomeonewasneededtovisitBCDCandgetitsreaction,thenvisittheWildlifeCommissionand makesuretheplanwasacceptabletoitandputthepackagetogether,makingsureitwouldbeacceptable fromalldirections.ThenhepresumedtheCitywouldmakearequestforagrantfromtheStateandproceedinthatdirection. ItwasstatedtherewerefundsinthedelandsTrustFundwhichcouldbeusedforthepurpose. CouncilmanMcCallrequestedthathebeexcusedfromparticipationonthecommitteewithregardtothe housingproblemandhebepermittedtodirecthiseffortstothismatter. VicePresidentLevythenrequestedthatCouncilmenForeandLongakerservethhimonthecommitteeonthehousingquestion. NEWBUSINESS: 25.VicePresidentLevystatedtheCitywashonoredbytheelectionofMayorLaCroixastheChairman oftheMayorsandCouncilmenDivisionoftheLeagueofCaliforniaCities,whichwasagreatresponsibility. HealsocommentedthattheCityManagerhadreceivedasignalhonorinbeingpresentatthesigningof theRevenue-SharingBillbyPresidentNixonandhadreceivedamemento,apenbearingthePresident'ssignature. 26.CouncilmanLongakerremarkedthattheCityManagerhadrecentlybeenelectedasPresidentofthe InternationalCityManagers'AssociationandhewishedtostatethatMr.Wellerwasknownandrespected byhisfellowprofessionalsinCitygovernment,notonlyinCalifornia,whereherankedamongtheelder statesmenofCityManagers,butthroughouttheUnitedStatesasthehonorconferreduponhimhadindicated.
