Atthistime,PresidentLaCroixrecognizedMrs.LorraineMarberry,2840OtisDrive,representing AlamedaTodayandTomorrow,asanopponenttotheproposedrezoning.Mrs.Marberrystatedthatthe groupiscomposedofcitizenswhoareproponentsofcontrolledgrowthandcomprehensiveplanning. Mrs.MarberryintroducedMr.TomDodson,2222StuartStreet,Berkeley,anEnvironmentalConsultant hiredbyAlamedaTodayandTomorrow.Mr.DodsondistributedmaterialtoCouncilinconnectionwith hispresentation,statinghewouldaddresshisremarkstodefininganEnvironmentalImpactReportand whethertheHarborBayIsle i theenvironmentalimpactcriteriaestablishedbyboth theStateandtheAlameda guidelinesforsuchareport.Hesaidhewaspresentto urgetheCouncilandtheciofAlamedatonanduseobjectiveenvironmentalinformationindeliberationsontheparticularproject. Mr.Dodsonstatedthatanimpactstatementisnotjustalongindecipherablereportonanissuebut itisspecificallyanassessmentoftheconsequencesthatoccurinanenvironmentasaresultof alteringexistingstatusquo.Assuch,allcomponentsoftheenvironmentshouldbeconsidered, includingthesocial,aesthetic,economicandecological.Thattheimpactreportisaninstrument ofreview~ndatoolforcontrollingthefuturearacterandqualityofAlameda. Heproceededinhisremarksbystatingthereportpreparedbythedeveloperwasamassivedocument coveringmanyfacetsoftheenvironmentwell,especiallythenaturalcomponents,butfailedasanimpact statement,inhisopinion,inseveralareas;thatthereportpreparedforthedeveloperwasabiased documentgearedtoselltheprojecttotheCity.Hestatedhebelieveditwasnotanobjectivediscus- sionofwhatanimpactreportshouldbe;thatthesummarieswerebaseduponthedeveloper'sopinionof whattheimpactswouldbe.HereferredtothetableofimpactspreviouslypassedouttotheCouncil-menandmembersoftheaudience.HesaiditwashisunderstandingthattheCitywasgoingtohavea subsequentimpactstatementprepared,whichPresidentLaCroixconfirmed. Mr.DodsonsaidthatAlamedaTodayandTomorrowcontestsDoric'sopinionconcerningthebeneficial valueofHarborBayIsletotheCity,feelingthattheimpactstatementisincompleteandtheproject's adverseimpactoutweighsitsbenefits.Hecommentedontheinadequacyofthereportincoveringissues concerningpublicservices,airpollution,population,constructionactivity,andtraffic.Hestated hefoundseveralthingslackinginthereport,namely,streethabitability,growthinducingimpact, alternatives,sociologicalchanges,agedistribution,regionalimpactandvisualanalysis.Hediscussed thefutureairportrunwayatOaklandAirport,thepotentialforaSouthernCrossiandanoff-shore freeway,allofwhichheassertedwouldbeaffectedHarborBayIsle. Mrs.MarberrynextintroducedMr.GeorgeW.Beckam,Jr.,3259FernsideBoulevard,aprofessional TrafficEngineerandmemberofAlamedaTodayandTomorrow. Mr.Beckamutilizedslideprojectionstoillustratehisremarks.saidmostfrequentlyexpressed concernregardingtheHarborBayIsledevelopmentwasthatoftrafficandthisaspecthadnotbeen adequatelyevaluatedbythedeveloper'sconsultants,JHK &Associates,ortheCitystaff.Hecommented aboutongoingandforthcomingdevelopmentswithintheCitywhichwouldaffecttheoveralltraffic patternandstatedthesehadnotbeentakenintoconsiderationbythedeveloperofHarborBayIsle. Mr.Beckamdescribedthepresentandproposedcirculationoftraffic,quotingfromreportsmadeby WilburSmith &Associates,Inc.;Peat,Marwick.MitchellandCo.,(nowownasK &Associates); PaulN.Bay,P.E.,(presentlyDeputyDirectoroftheMetropolitanTransportationCommission). Mr.Beckamspokeindepthconcerningtheconsultant'sscheduleoftraffichandlingimprovements,the realitiesofhistimetable,andtheimpactsoftheseimprovementsuponAlamedaandthesurrounding communities.HestatedconsiderationmustbegiventotrafficvolumesonallstreetsintheCityof Alameda,withdueregardtothecitizenswholiveonthosestreets.Hemaintainedthatdevelopment, notonlyonBayFarmIslandbutintheentireCity,shouldbelimitednotbyspeculationaboutpossible facilitieswhosefutureexistenceisalmostentirelybeyondthecontrolofthedeveloperandtheCity, butshouldbelimitedinsizesoattrafficgeneratedbydevelopmentscouldeasilybandledon availablefacilitieswithoutimpactingandundesirablychangingthecharacterofexistingneighbor- hoods.HesaidthattherezoningofBayFarmIslandanddevelopmentofHarborBayIsleshouldbe governednotbyahighlyspeculativetimetableofpossiblefutureimprovements,butasfacilitiesand technologicaladvancesareabletoprovidethemeansfortransportationofpeopleandgoodstoand fromthedevelopmentwithoutundulyaffectingtheenvironmentofsurroundingareas. Mrs.MarberrystatedthisconcludedthebulkoftheirpresentationbutothermembersofAlamedaToday andTomorrowwouldmakeindividualremarks. Mr.JohnPloss,1242BayStreet,discussedsomeofthefinancialaspectsofHarborBayIsleandintro- ducedthemintoaplanningconceptfortheCity.HestatedthefinancialsectionofDoric'sreport onHarborBayIsledealt exclusivelywitheducationandthisplacedtheprojectinthebest possiblelight.HesaidthatthisyearAlamedahasbudgeted$1,300,000forCitystreetsand highwaysandhisbestguesswouldbethatAlamedawouldhavetospend$10,000,000duringthetwelve yearsofHa~borBayIsleconstructionjusttoaccommodateHarborBayIsletraffic.Heasked CouncilwhethertheCitycouldaffordtobuythatmuchstreetconstructionforHarborIslewhen manystreetsarealreadyatcapacityandotherproposedprojectshaveyettobetakenintoaccount. Hespokeoftheplightof 0 Altoinsuchahappening.osshadpreviouslydistributedawri reportandexhibitstotheCouncilandcommentedonthese.statedthataprivatecizen'sguess astothepossiblecostwasnotanadequatebasisforaCouncildecisiononHarborBayIsle~butit pointedupaneedforauthoritativecostinformationfromqualifiedplannerssoadecisioncouldbemade onthebasisoffinancialfacts.Heurgedthatadecisionnotbemadewithoutconsideringtheeffect ontherestofAlameda,theCityofOakland,orthefinancialconditionoftheStateHighwayprogram. HerecommendedthenecessitytodeviseaplanforthefuturedevelopmentofAlamedawhichshouldincorpo- ratethedesiredlanduseforHarborBayIslefillandallothervacantproperties;projectedcoststo theCity,CountyandStateforallhighways,utiliandservicesneededtosupporttheplan;andan evaluationofthecapacityoftheCity,County~State,andprivatedeveloperstofinancethesesupport requirements.statedthattomaketheplanwork,procedureswouldbeneededforconnualupdating oftheplansothatitwouldrelatetothe"realworld". CouncilmanMcCallremarkedthatheconcludedfromthestatementsofbothMr.PlossandMr.Beckam.that theyweresuggestitheonlywaytosettletheproblemwouldbeeitheraRoute61,Off-ShoreFreeway. ortheSouthernCrossiHestatedthatthiswasthesolution.althoughithadbeenvoteddown.Mr. PlosssaiditwasoneofthewaysofhandliHarborBayIsletraffic,thesecondbeingtheplanpresented by DoricDevelopmentinvolvingotherstreetswhichitisfeltcannotbebuiltinmetosaveAlameda fromadisastroussituation.Mr.osssaidthathe,personally,wasopposedtoanoff-shorefreeway. Mr.Beckamconcurredinislatterstatement,statingRoute61isnotinactiveplanningandwouldnot beuntilafterMetropolitanTransportationCommissionreviewsoverallplanningfortranspoon inthisarea. Mr.AshleyJones,1040FairoaksAvenue,askedwhattheCouncilwouldliketheCitystafftorecommend. suggestedthatCityannersshoulddosome"planningllinsteadofreviewingsubmittedplansandmaking recommendations.HestatedtheyexpectedtheCitytocomeforwardthpossiblesolutionsoralterna- tives.HesaidtheCouncilshouldasktheCistaffwhatcouldbedoneththelandsothatitcould beputtothebestpossibleuseforcizensofAlameda. Mrs.LindaPritchard,3263SanJoseAvenue,presentedtotheClerkapetitionsignedbyapproximately518 persons,requestingthattheCityCouncilnotapprovetherequestfortherezoningofthefilllandon BayFarmIslandbyHarborBayIsleAssociatesuntilanimpartialandindependentenvironmentalimpact studyismade,andtwosignedlettersinoppositiontotheproject.Mrs.Pritchardremarkedshefelt thatifthe.Fernsideextensionwereusedforamainthoroughfareandaparallelbridgewasbuilt,that truckswoulduseFernsideandSanJoseAvenueandsheobjectedtos.Shesuggesteddownzoningoran alternateuseoftheland. Mr.StuartE.Richardson.35344BlackwoodDrive,Newark,PresidentoftheNorthernChapteroftheCali- forniaEnvironmentalHealthAssociation,statedhisorganizationrepresentedthenineBayAreaCounties includiAlameda.Mr.RichardsonaskedpermissiontoreadintotherecordaResolutionofhisBoardof Directorsopposinganymajordevelopmentwhichdidnotsufficientlytakeintoconsiderationthehigh concentrationofpopulationonalandfillsubjecttoliquefactionasanaftermathofamajorearthquake, theplacementofanentirecommunityadjacenttoaninternationalairport,theadditionalloadofsolid waste,thedisposalofliquidwasteandsewage,andrequestingtheconsiderationofopenspaceasan alternateplan,withthecreationofparksandrecreationfacilitiestobeenjoyedbythegeneralpublic. r~rs.LoisPryor.1814 ClintmAvenue,quotedfromseveralPlannedResidentialDevelopmentsurveyscover- ingtheuseofpublictransportationandmini-bussystems,showingthataboutofthe persrn sinter- viewedreportedtheyusedthebusbutonly5%.reportedusingtheserviceasoftenasmedayaweek. Mrs.DarleneBanda,919DelmarA~enue,spokeconcerningthesafetyofpedestrians.especiallychildren, inthevicinityofOtisDriveiftheprojectshouldbeapproved,notingadd;onaltrafficwhichwould becreated.Shestatedthatatthepresenttimethereareinsufficienttrafficsignalsthelengthof OtisDrive.Shesaidthatmanypersonsopposedtodevelopmentarenotopposedtoplan location.ItwasherthoughtthattheCouncilshouldberepresentativetothepeoplewhoarehere today,notthosewhowillheretomorrow. Mr.MillardM.Miesner,1518Broadway,wishedtogoonrecordasopposingtheprojectas,inhisoplnlon, itwouldhaveanadverseenvironmentalimpactuponthearea.Hequestionedwhetherthecostofaddi- tionalwaterandsewageserviceswouldpaidbythedeveloper,theEastBayMunicipalUtilityDistri orthepeople. Mr.WilliamS.Olds,2605CentralAvenue,commentedontrafficbeyondtheboundarylinesoftheproposed project,statinghedidnotbelievethedeveloperwas ngatruecturetheproblem. Mrs.HarrietteRoberts,3275ThompsonAvenue,quotedfromaletterpublishedinAlamedaTimes-Star andwrittenbyMrs.lynMollcoveringtheuseofCitydump.Shestateditwasessentialat Cityretainthisfacility. Mr.JamesMaresca,2818CentralAvenue,spokeregardingalternativestotheproposeddevelopment.He saidtheCityhadbeenpresentedwiththreealternatives,namely,accepttheHarborBayIsleplan,allow piecemealdevelopingaccordingtotheexistingzoning,ortheCitybuytheland.spokeaboutthecost ofpurchasingthelandandsuggestedadd;analalternativesincludingvaryingpercentagesofparkland, increasedindustrialandprofessionalzoningandsomeamountresidentialzoning.. Mrs.PhilomenaStewart,627ArlingtonIsle,recommendedadditionalparksandopenspacefortheCity, statingshewouldvoteinfavorofsuchadissue. 18 Mr.FrankRatto,1053IslandDrive,recalledthattwoyearsagoation,containingapproximately 5,000signatures,hadbeensubmittedtotheCouncil"beqqinq"forenvironmenta1studiesandgrowth control.Hesaidhefounditdifficulttounderstandwhyittooksuchalongperiodoftimeanda StateSupremeCourtdecisionbeforeactionhadbeentaken.HestatedtheCitywasinneedofan ArchitecturalReviewBoardandbetterBuildingCodes,withenforcement.Hesaidithadbeenthe people'sbeliefthatBayFarmIslandwouldbedevelopedwithlower-pricedsingle-familyhomesand hisoppositiontoHarborBayIslewasitstotalcommitmenttocluster-typehousing.Hesaidhewould liketoseethemajorityofnewbuildingtoconsistofbetterquality,betterarchitecture,and single-familydetachedhomesregardlessofprice.Hecommentedonthetaxratewhichhadbeenkept downbutpropertyassessmentshadrisen.HestatedthattheCharterAmendmentwhichwouldbebefore thevotersnextMarchwaspartiallycausedbytheHarborBayIsleproposalandtheissuewouldbe decidedatthattime.HemaintainedthattheCityshouldenforcethepresentOrdinanceproviding forfeesinlieuofopenspaceforrecreationalpurposes. Mr.George J.McCloskey,1552EverettStreet,spokeabouttheCitypublicsafetyserviceswhichwould berequiredbyincreasedpopulationonBayFarmIsland. Mrs.WayneFloyd,2858SantaClaraAvenue,askedthattheCounciltakecognizanceofthewishesof thepeopleinthismatter.Sheprotestedthealternativeswhichhadbeensuggestedandrequested thatothersbesought.Shequestionedhowthe "f i ll"originated. Mrs.HelenFreeman,833LaurelStreet,spokeinreplytoMrs.oyd'squestionandexplainedthe mannerinwhichthetidelandshadbeenacquiredbytheCity,assertingthattheCitystillownedthem. Mr.EdmondL.Plonczak,3209OtisDrive,broughtupthesubjectoftrafficcongestioninthevicinity ofOtisDriveandreiteratedhispreviouscomplaints. Mr.PaulMiesner,1208UnionStreet,commentedonthenecessityofformingcitizensgroupstoperform workwhich,healleged,shouldbedonebytheCitystaff. Mr.CharlesA.Tillman,2415RooseveltDrive,spokeingeneralitiesregardingthesoilanalysisof BayFarmIsland.HedisplayedtotheCouncilandaudiencethe1958ProgressEditionoftheAlameda Times-StarpertainingtotheAlamedabeaches.HequestionedwhenUtahInternational,DoricDevelop- ment,orDelRapiniConstructionCompany,wouldbereleasedofresponsibilityforthefillareaand whowouldassumefutureresponsibility.HecommentedonthepositiontakenbytheChamberofCommerce andvariousmerchantsinfavoringtheproject.Mr.TillmansuggestedthattheCouncilmakenodecision onthepetitionforrezoninguntilaftertheMarch,1973Electionwhenthecitizenswouldvoteforor againsttheproposedCharterAmendmentlimitingmultipledwellings. Dr.NicholasToth,2604BayviewDrive,statedthatsincehisappearanceatthelastCouncilmeeting hehadbeenapproachedbymanyofhisneighborswhosharedtheviewsheexpressedinhispriorpre- sentation.Hespokeofarticlesinrecenteditionsofthelocalnewspaperlaudingtheprojectand whichappearedtobeapublicitycampaignonthepartofthedeveloper.Hepresentedanewspaper clippingfromtheOctober15,1972editionoftheFremontArgusheadlined,"Studysaysgrowthdoes notpay,"andcommentedonitscontents.Dr.Tothagainstatedhisconcernaboutstudiessubmitted bythedeveloperandmadecomparisonsbetweentheHarborBayIsleproject,theFremontdevelopment, andaproposalrecentlyrejectedbyCamari110 inVenturaCounty. Atthistime,PresidentLaCroixthankedtheaudiencefortheircourtesyduringtheHearing.Heasked Mr.GossregardingtheCouncil'spositioninselectingtheenvironmentalistwhowoulddotheimpact studywhichtheCityCouncilhadordered.Heexplainedtheprocedurewhichhadbeenagreedupon,in thatthreeselecteeswouldbeinterviewedandonechosentomakestudy. Mr.Gossstatedthepreliminaryscreeningwasjustaboutcompleteand,hopefully,aselectioncould bemadewithinthenextweek.PresidentLaCroixinformedthosepresentthattheCityCouncilwould sitinsessionasanExecutiveCommitteediscussingpersonnelmatters,whichwouldproperlybea closedmeeting.HesuggestedthattheHearingonHarborBayIslebeadjourneduntilsuchtimeasa selectionhadbeenmadeandthestudycompletedandsubmittedtotheCouncilforitsperusal.He statedtheHearingwouldbethenreopenedforanysummariesandconclusionmakingwhichmighttake place. CouncilmanMcCallaskedifanytimelimithadbeensetforcompletionofimpactstudy.CityPlan- niDirectorJohnsonrepliedthereisapparentlyatimebindemerging;thatitmaybeaverydifficult jobforaconsultanttoreviewthewealthandvolumeofmaterialavailableandtocompletethework insofarasanacceptableEnvironmentalImpactStatementisconcerned.Hesaiditisentirelypossible thattherewouldbeatimeproblembut,hopefully,itwouldbecompletedsixtydaysfromDecember1, 1972,buthecouldnotmakeacommitmentatthistimeregardingthetimingofeventualconsultant whowouldbeselected. PresidentLaCroix,inexplanation,statedtheCouncilwouldmoveasquicklyandproperlyaspossible inmakingthenecessaryselectionoftheenvironmentalist. Afifteen-minuterecesswascalled.UponreconveningtheCouncilproceededwiththeregularorder ofbusiness.
