Uponrequest,CityAttorneyCunninghamreportedthatonvehiclenoisestheCitywasregulatedbythe StateMotorVehiclesCodebutothernoiseswereacontinuallyincreasingproblem.Hesuggestedthata reportberequestedfromthePoliceDepartmentonitsexperiencesundertheexistingordinances.said hewouldnotrecommendadoptingastronganti-noiseordinancebecauseofthedifficultyofenforcement andpointedoutFederallawswerebeingformulatedontheoverallsubject. dtocontrol Mr.HarveyaddressedtheCouncil.Hesaidhehadcomplainedmanytimesoverthepastfiveyearstothe PoliceDepartmentandtheusualanswerwasthattheviolatormustbecaughtbeforehecouldbecited. UNFINISHEDBUSINESS: 11.V'Presentedforconsiderationwasthematterofadoptionofmassageestablishmentcontrolsandregulations. PresidentLaCroixcommentedthatapproximatelyayearagoaproposedordinanceforsuchregulation hadbeenconsidered by theCouncilandhesuggestedthatpossiblyanordinancecouldbeadoptedat thistimetoimposesuchcontrolsaspossibleonthesebusinesses. TheCityAttorneyreportedonthestatusofthismatter,pointingoutthatattheconclusionof previoushearingsonthesubjecthehadcommunicatedwiththePoliceDepartmentwithregardtothe recommendationsoftheCouncilthatthemorestringentprovisionsbemodified.ThePoliceChiefhad statedthepositionthatifthechangesopposedbytheDepartmentweretobeadopteditwouldprefer nottohavetheordinanceatall,asitwouldonlycreateadditionalworkwithoutaccomplishing necessarycorrections.HesaidhefeltthePoliceDepartmentwasveryimportantinthiscasebecause itwaschargedwiththeenforcementofanyregulationsandfurtherstudywasindicatedbeforepresent- ingsuggestedrevisnons.Hesaidhehadavastfileofmaterialfromlegitimatemassagetraining centerswhichwereinfavorofsomekindofeducationalrequirements,whichwasnowastandardfeatureinallsageestablishmentcontrols. Mr.CunninghamsaidhefelthecouldpresentforconsiderationbytheCouncilanordinanceproviding reasonablecontroloversuchestablishments,insuringthattheoperatorsandtechnicianswouldhave atleastasemblanceoftherequirededucationalbackground,etcetera,allofwhichtheCitycould livewith.Hepointedoutadegreeofenforcementwouldberequiredbuttheordinancewouldnothave criminalpenaltiesforperformingactsotherwiseprohibitedbyStatelaw.Hesaiditwashisopinion thattheCitycouldnotadoptanordinancewhichwouldputtheestablishmentsoutofbusiness. Itwasrequestedthataredraftoftheproposedordinanceontheseestablishmentsbepresentedtothe Councilforconsiderationassoonaspossibleafterthefirstoftheyear. Mr.CunninghamsaidhewouldhaveaseparatereportfortheCouncilonthesubjectofadultbookstoresoperatingintheCity. 12.PresidentLaCroixbroughtupthesubjectoftheEnvironmentalImpactReportontheHarborBay IsleprojectandthedeliberationsoftheCouncilataspecialandanadjournedspecialmeetingheld onNovember29andDecember1,1972,respectively,onappointmentofaconsultanttoperformthis study.TwoprospectivecontractorshadbeeninterviewedandthemembersoftheCouncilweretoweigh thematterindividuallyforpossibleactionatthismeeting.Hecalledfordiscussion. CouncilmanLevycommentedthathehadbeenmostimpressedwiththefirmofArthurD.Little,Inc., whichseemedtohavethebestsetuptodoacomplete,comprehensiveandunbiasedstudyofthetype theCitywaslookingfor,pointingoutthefirmwasnationalincharacter,largeenoughnottohave tofarmoutanyofthestudiesandmulti-disciplinedsothatitwouldnotbeinfluencedbyanylocal pressures.Hesaidalthoughitsbidhadbeenslightlyhigherthantheotherfirminterviewed,he felttheCityshouldhavethebestavailableinthiscaseandthisfirmshouldbetheonetobe considered.Itwaspointedoutthestudywouldconsumeaboutfourmonths I time.Theothermembers oftheCouncilindividuallyexpressedtheirconcurrence. UponadviceofMr.Cunningham,itwasdecidedtoadopttheresolutionwhichhadbeenpreparedforthe purpose,authorizingexecutionofanagreementtobepreparedbytheCityAttorneyforsuchEnviron- mentalImpactReportbyArthurD.Little,Inc.,atacostof$50,000,forexecutionandattestationbytheMayorandtheCityClerk,respectively. Thematterwasaccordinglyreferredto"Resolutions". NEWBUSINESS: 13.PresidentLaCroixremarkedthattheCityManagerhadrecentlybeenappointedPresidentofthe InternationalCityManagementAssociation,whichwasagreatprofessionalachievementinhisfield. CouncilmanMcCallthenreadapreparedstatementwithregardtotheproposedCharteramendmenttobe submittedtothevotersattheGeneralMunicipalElectiononMarch13,1973,statinghehadsome questionsastothewaytheamendmentwouldworkandhowitwouldaffecttheCityifitshouldpassand hefeltthequestionsweresharedbyagreatmanycitizens.Hesaidhehadnowishtodiscouragecitizen actionwhichrepresentedtheeffortsofpeoplewhocaredenoughabouttheirtytodowhattheyfeltwas necessarytobringaboutachange,thathewascertaintheproponentsoftheissuewereverysincerein theirobjectivesandtheydeservedthegreatestrespectforshowingthisconcernforthecommunity. CouncilmanMcCallsaidhefeltthepeoplehadtherighttoknowjustwhattheimplicationsoftheCharter amendmentmightbeandhowitwouldaffectthehousingpictureintheCity;forexample,theeffecton theschools,whetherthevalueofexistingpropertywouldgoupordown,whatkindofdevelopmentcould beexpectedintheCityundertheamendment,etcetera.Heexpressedtheopionthatthemembersofthe CityCouncilhad a dutytoseethatamatterofthiskindwouldbescrutinizedfromeverypossibleangle andthatthepeoplewouldbeinformedsothattheywouldhavetheknowledgeneededtomakeasensible choice,andthatthisinformationshouldbefurnishedassoonaspossiblesothatwhenthesubjectwas discussedanddebatedinthecomingmonthstheCouncilmenwouldknowwhattheyweretalkingabout.He requestedthattheCityManagerrectedtoprepareananalysisoftheproposedCharteramendment fromthepointofviewofhisoffice,thatthePlanningDirectorberequestedtodothesame,anda similarrequestgotoMr.JamesNolin,PresidentoftheBoardofEducation,sothattheCouncilwould havehisBoardlsstaffinputwithregardtotheschools.Finally,heaskedthattheCityAttorneysubmit hisopiniononthewordingoftheproposedamendmentandhowitwouldbeconstruedinlegalterms,point- ingoutthiswasvitalinspeakingofsomethingasimportantandfar-reachingasabasicchangeinthe CityCharter.Herequested,iftheothermembersoftheCouncilconcurred,thattheinformationbesub- mittedwithinfourweeks,whichshouldprovideadequatetimeforpreparationofthecomments.Heexpressed theopinionthataftertheseexpertviewsweremadepubliceveryonewouldhaveamuchbetterunderstanding oftheinitiativeandthepeoplewouldbemuchbetterequippedtojudgeitsmeritswhengoingtothe polls.HeexpressedthehopethattheothermembersoftheCouncilwouldconcur. PresidentLaCroixcommendedCouncilmanMcCallonhisstatementandexpressedtheopinionthatthepublic shouldbefurnishedinformationinanunbiasedandcompletelyforwardmanner.suggestedthatthe Councilshouldcertainlyaddressitselftotheinformation,whetherornotitwouldtakeastandonthe issue. Mr.JohnBarn;,1438 ParkStreet,requestedtheopportunitytospeak.HeconcurredwithCouncilman McCall IS statementsbutsaidhewouldliketohaveincludedareviewbytheAssessoroftheproperties affectedastheproposalwouldinessencebeadown-zoningofpropertyandtherewouldbeaconsiderable lossofassessments,whichwouldinturnaffectthetaxrate. PresidentLaCroixexpressedtheopinionthatthisinformationwouldundoubtedlybeincludedintheCity Managerlsreport. Mr.JosephSullivan,3221LibertyAvenue,askedtospeakandsuggestedthattheCityofficialsinterview 10,000 ofthevoterstodeterminewhethertheywishedtheCitytobeoneofhigh-risebarracksorto keepitasitwasatpresent.Hesaidhesti 11 heardamis-nomerof "nc-qrowth"andpointedoutwhatwas intendedwas"s10wgrowth"andtheproposedCharterchangecouldbeamendedintwoyearsifsodesired bythepeople.
