Mr.WiemkenrequestedfavorableconsiderationbyCoun1ontwoitems,(1)theBoard'srecommendation ontheparkandrecreationfeeof$3,075.76and(2)thematteronwhiacommunicationhadreceived fromJones-Tillson &Associatesrequestingexceptiontotherequirementforundergroundutilities.He arguedthattheparkandrecreationrequirementordinancehadbeenenforcedononlyoneoccasionwhen newconstructionhadbeeninvolvedandaskedthatexceptionbegrantedfromthepaymentofafeeonthe basisthatthebuildihadbeeninexistencesince1963andachangeintheformofownershipwould createnoincreaseddemandforCityservices.Withregardtotheundergroundingrequirements,Mr.Wiemken explainedthattheutilitypolesanddistributionlineswerelocatedacrossBentonStreetfromthe propertyinquesonandya "servt cedrop"wasinvolved;asurveyhadshownthundergroundingwould costmorethan$2,500thnorealgain,andthiswouldbeanunduehardship.expressedthehopethat theCouncilcouldgivetentativeapprovaltotheontheconditionthattheBureauofety wouldconcurthhisstatements. 82 TherewasdiscussionbytheCouncilastowhetheritshouldawaitthereportfromtheBureauof ElectricitybeforetakingactiononthisMap,alsoonthematteroftheparkandrecreationdedication orinlieufee,onwhicharevisedordinancewasunderstudy. Onquestion,Mr.WiemkensaidthesubdividerswouldbewillingtoacceptapprovaloftheTentative MaponthesubdivisionsubjecttotherecommendationsoftheBureauofElectricityinthematterofundergroundingtheutilities. UNFINISHEDBUSINESS: 29.BroughtupatthistimewastherequestofMrs.SueMathesontomakeapresentationonbehalfof XanthosHouse,whichhadsubmittedapleaforanappropriationof$15,000fromRevenueSharingFunds. Mrs.Matheson,1255ShermanStreet,introducedDr.RobertSchultz,whosaidtheproblemsinwhich XanthosHousewasinvolvedwerethoseinwhichteen-ageyoungstersfoundthemselvesconcerningdrugs, familyandpersonalproblems,etcetera,andtheirneedforsomeonetotalktoonthesesubjects. HesaidXanthosHouseprovidedagoodcounselingservice,aswitchboard,educationalopportunities andalternativeactivities.Athisrequest,Mrs.Mathesonexplainedthepresentfundingsituation oftheendeavorwascoveredtheproposalsubmittedtotheCouncil.ShesaidtheHouse'scontract undertheCaliforniaCouncilonCriminalJusticehadbeenrenewedanditwastheirbeliefthatthe tencenterspresentlyfundedundertheAlamedaCountyHealthDepartmentComprehensiveDrugAbusePlan wouldnotberefundedatthepresentlevel.AsofJanuary1,1973,nofundswouldbecomingin; withfundsonhanditwouldbepossibletooperatethroughmid-Februaryanditwouldthenbenecessary toclose.Shesaiditmightbepossibletosalvagetheswitchboardactivityonavolunteerbasisbut therewasnowayofsalvagingthecounselingcenter, PresidentLaCroixstated,asChairmanoftheAlamedaCountyRegionalCriminalJusticePlanningBoard, thattherewasstillapossibility,althoughsomewhatnegative,thatXanthosusewouldreceivefunds asitsrequesthadgonetotheCaliforniaCouncilonCriminalJusticethroughtheCountyBoard. InreplytoaquestionbyCouncilmanLevy,Mrs.MathesonstatedthecostofoperatingXanthosHouse atthepresentlocationwouldbeapproximately$20,000.Shesaiditwashopedthattheneedforaid wasonlyoneyearastheHousewasworkingwiththeothercentersintheareaforotherfunding sourcesforthefuture. TheHonorableFredF.Cooper,SupervisorfromtheThirdDistrict,AlamedaCounty,addressedtheCouncil onthesubject.HestatedtheBoardofSupervisorsonthisdatehadinstructedCountyAdminis- tratortopursuethismatterontheStatelevelandtheDirectorofHealthCareServiceshadbeen directedtoinvestigatethepossibilityofobtainingfundsforthecentersthroughSenateBill714. IthadalsoagreedtofundtheoperationofthecentersthroughthemonthofJanuaryanddirectedthat thecitiesinvolvedbecontactedwithregardtoparticipatingintheeffortafterJanuary31,1973, ifStatefundscouldnotbeobtained,foratleastone-halfofthenecessarymoneyforseveralmonths whilethematterwasinvestigatedfurther.HesaidpartoftheproblemoftheStateagencywasthe questionofevaluatingtheprogramsanditwasthethinkingthatthecitieswerebetterableto performthisfunctionandtoprovideassistancetothecenters. Dr.MelvinSchwartz,453ColaBallena,thenaddressedtheCouncilonthesubject.quotedstatistics fromamedicalpublicationontheattitudesofstudentsandtheiruseofdrugsandsaidtherewasno placeinAlamedaforstudentstogetadequatecounselingandhebelievedtherewasaneedforacenter whereyoungpeoplecouldcommunicatefreelyabouttheirproblems.Hesaidhefeltcounselingcenters wereasimportantasemergencyhospitalstoacityandthecitizensshouldbewillingtopaythe cost.HerequestedthattheCityCouncilhelpinfinancingXanthosHouse. Dr.RobertMcConnell,SuperintendentofSchools,speakinginhisownbehalf,pointedoutXanthosHouse providedseveralprogramswhichtheschoolsystemcouldwellhaveprovidedbutwhichprobablywould nothavebeenacceptedreadilybythoseneedingtheservices,suchasseminarsforteachersand studentsatthehighandmiddleschools.instructioncoursesforwhichteachersreceivedcredit providedthroughXanthosHouse,instructionforteachersandnurses~activitiesoccurringoffcampus andawayfromtheSchoolDistrictinwhichpeoplewouldnotparticipateontheschoolpremises.He saidhedoubtedseriouslythatthequantityorqualityofservicesprovided providedbyanysocialinstitutionintheCity,includingchurches,schoolsor concurredwiththerecommendationsofDr.SchwartzthattheCityconsidersome leastonatemporarybasis,forthisworthwhileactivity. Dr.SchultzthenintroducedMr.NedKendall~workingwiththeAlamedaCountyProbationDepartmentona specialdrugunitintheCityofAlameda.Mr.Kendall,2050ClemensRoad,Oakland,saidhehadworked intheCityforthepastsixyearsandforthepasttwoyearswithcasesparticularlyinvolvingdrug abuse.HesaidhewasawareoftheproblemsofXanthosHousetoexistandalsoofthehighqualityof serviceofferedtotheyoungpeopleoftheCity,andwholeheartedlysupporteditsrequestforfinancial aid.InreplytoquestionsbyCouncilmanLongaker,Mr.Kendallsaidhefelttherehadbeensomelevel- ingoffintheoverallpictureofdrugabusenotinthequali~beingused,thatpeoplewereturning toharderdrugs.thatitwasverydifficulttoevaluatetheeffectivenessofsuchanendeavorbuthe feltcommunity-basedprogramssuchasthatofferedbyXanthosHouseshowedthegreatestpromise. XanthosHousecouldbe theCity.Heheartily kindofsubsidy, PresidentLaCroixpointedoutithadbeenfoundontheCountylevelthatrewasfrustrationofongoing programsasbeingineffectiveandtheCriminalJusticeBoardhadtakenthepositionthatlocally-based programsseemedtoofferoneofthebestavenuesofreaching1eneedingthistypeofcounseling. Dr.WilliamNear,Psychologist,2440ClayStreet,Sancisco,CounselingCoordinatorforXanthos House,thenaddressedtheCoun1.pointedoutthatXanthosHousehadbeenabletodoagreatdeal cooperativelywiththeschools,teachersandguidancecounselors,whichhad ofgettinginforma- tionintotheschoolswhichcouldbeutilizedbytheyoungsters.saidhewouldliketoseeabridge betweencommunity-basedprogramsandestablishedinstitutions. PresidentLaCroixcommentedthattheCitywouldbecloselyscrutinizedbytheFederalGovernmentinthe allocationofRevenue-SharingFundsforthebestinterestsofthecommunity.Hesaidhewouldpersonally liketoseetheCouncilsupportXanthosHouse,whetherintheamountof$15,000or,inlinewithSuper- visorCooper'sstatements,inajointventuresituationwiththeCounty.HesuggestedthattheCouncil holdameetingfordiscussionoftheRevenue-SharingprogramassoonaspossibleinJanuary,1973,and, afterdiscussingalloftheissuesinvolvedandtheamountofmoneyavailabletotheCity,toevaluate fullytherequestforXanthosHouseandmakeadecisionastotheallocationoffundsandthat,hopefully, somefundscouldbeearmarkedforthisendeavor. CouncilmanLevystatedhewasdefinitelyopposedtohavinganymoneyfromtheRevenue-Sharingdsused forthistypeofallocation.Hesaidhewasverysympathetictotherequestbutfeltitmightbepossible toobtainmoneyfromanotherCityfundsothataprecedentwouldnotbesetforsimilarrequests.He movedtheCityobligateitselfinprinciple,asitwasnotknownattheamountinvolvedwouldbe,to supportXanthosHouseforatleastsixmonthsuntilitsproblemscouldberesolved. TherewasdiscussionastoproperactionfortheCounciltotake.CouncilmanLevysaidhewould amendhismotiontoprovidethattheCityappropriate$3,750from ~Q'no>'~Fundmoneyforispurpose. Onquestion,Mr.WelleragreeditwouldbemuchbetterifRevenue-Sharingfundswereinvolvedinis matter.HeexpressedtheopinionthatiftheCouncilfeltinclinedtosupporttheprogramunderdiscus- sionauthorizationshouldbegivenforfundingforafullsixmonths,ayearorwhateverseemedreasonable. SupervisorCoopersaiditwouldbedesirablefortheCitytomakesomecommitmentatismeetinginthe matter,andsuggestedthetyappropriate,possibly,$3,750conditionedontheCountydoingthesame thingasthiswouldgiveprogramsinothercitiesoftheCountyaprecedentwiththeirCityCouncils. ThematterwascallupwithregardtotherequestfromSt.PhilipNeriChurchtooseVanBuren StreetbetweenHighandFountainStreetsforseventy-veminutesduringtheschoolday. AssistantCityManagerGossreportedtheChurchhadrequestedthestreetbeclosedfrom12:00to 1:15o'clockp.m.foruseasaplayareaandtheschoolstaffwouldplaceandremovebarricadesand supervisethestudents.TheschoolwouldalsoinsuretheCitywithrespecttotheactivity.Mr.Goss saidhefeltagoodcasecouldbemadeforadditionalspaceattheschoolandhefelttheschoolrepre- sentativeshadnotmadetheproposalwithoutseriouslyconsideringternatives.Hesaidtherewere certainreservationsfromastaffpointofview,suchassettingaprecedent,liabilityoftheCity, safetyinasmuchastherewouldbeonlytemporarybarricadesandthefactthatVanBurenStreetwas immediatelyoffofHighStreet,awell-traveledstreet.Basically,issuewaswhetherthepublicstreet shouldbeusedtemporarilyforschoolpurposes. Onquestion,theCity ineerstatedhehadfoundnorealbarrierstograntingtherequest. :34 CouncilmanLongakersaidhehadbeeninvolvedinasimilarsituationwhenthenewWashingtonSchool wasbeingconstructedandwithsupervisiontherehadbeennoproblems.Hesuggestedthealternative ofasplitnoon-hourbeexplored.Mr.Gosssaidheunderstoodthishadbeenconsideredbuttheplay areawassoclosetotheschoolthiswoulddisrupttheteachingactivityandtheideahadbeenrejected. ItwasstatedtherewouldbenoproblemconcerningingressandegressforFireDepartmentequipment. PresidentLaCroixsuggestedthattheclosingmightbegivenatrialofninetydayscommencing January2,whenschoolwouldopenaftertheholidayseason,withreportbacktotheCouncil.There wasdiscussionwithregardtoconsiderationofthesplitnoon-hour,thehazardofcarsturningoff HighSchoolintoVanBuren,prohibitingparkingintheblockandtheincreasedexposureoftheCity toliability.ItwasstatedatelephonecallhadbeenreceivedfromaresidentofClintonAvenue inoppositiontotheproposal. CouncilmanLevymovedthepermitbeissuedforclosingVanBurenStreetinthedesignatedblockfor seventy-fiveminutesduringschooldaysforatrialperiodofninetydayscommendingonJanuary2, 1973,subjecttotheCitybeingfurnishedwithacertificateofinsurance,forapprovalbytheCity Attorney,holdingtheCitycompletelyharmless,andcontainingspecificconditionswithregardto parking,etcetera,andthatattheendofthatperiodanevaluationreportbesubmittedtothe CouncilbytheCityManager'sofficewithregardtocontinuanceofthepermit. Mr.Marescasaidhedidnotquarrelwiththedesireforanewordinancebutdisagreedonthepointsthat sincetheordinancewas t tobeunfairitshouldnotbeenforcedandthewordingoftheordinancewas thattheCouncilmayacceptprivateopenspaceinlieuofpublicopenspaceifitwasinthepublic interesttodoso.HesaidhewouldinterpretthistomeanthattheCitywouldbegettingabetterdeal fromacceptingtheprivateopenspacethanifthespaceortheinlieufeeweregrantedandfailedto see,inthesituationswherethisprovisionhadbeeninvolved,howtheCityhadreceivedabetterdeal byallowingthedevelopertousehisprivateopenspacetosatisfytherequirements.suggestedthat abadprecedenthadbeenestablishedandtheCityhadlostonthesedecisions.
