TheminutesoftheregularmeetingheldDecember19,1972,werethenapprovedascorrected. 2.PresidentLaCroixannouncedthattheitemontheagendawithregardtotheregulationofmassage establishmentswouldbeheldoverforfurtherstudybytheCityAttorneyofcertainadditionalguides thePoliceDepartmentwishedtohaveincorporatedintheproposedordinance.Hesaidthematterwould undoubtedlybebeforetheCouncilatitsnextregularmeetingonJanuary16. 3.J'PresidentLaCroixalsostated he hadtalkedwithMr.FrankGottsteinandlearnedhehadbeenvery illbutwasnowhomefromthehospital.Mr.GottsteinhadexpressedappreciationfortheCouncil's letterofconcernforhishealthandsaidhewouldagainbeattendingCouncilmeetingsinthenearfuture. PresidentLaCroixdirectedthatthecommunicationbeacknowledgedandreferredtothefi1eonthe subjectoftheHarborBayIs1edevelopment. 7.V/FromNr.WilliamS.01ds,2605CentralAvenue,requestingthattheCouncilrescheduleitsspecial meetingforconsiderationofRevenueSharingFundstopermitcitizenparticipation. ThePresidentaskedthepleasureoftheCouncilinthismatter.Therewasnoindicationthatachange inthemeetl"ngwasdesiredanditwasstatedtheCouncilwouldmeetinspecialsessiononthismatteras planned. Mr.01dsaskedtospeakandmaintainedthattheCityCharterandtheMunicipalCodespelledoutthat theremustbeopenhearingsandpublicparticipationinanyallocationoffunds.Hepointedoutthese werepriorityfundstobeusedtomeetthedemandsofthecitizensandthereforethepeoplehadtheright toasktobeconsideredintheallocation. PresidentLaCroixsaidheagreedwholeheartedlyandthespecialmeetingwasbeingheldfortheinterest andedificationoftheCouncilandtheknowledgeofthecitizens.Nodecisionswereanticipatedatthe meetingastoexpenditureofthefunds.InreplytoaquestionbyMr.01ds,itwasstatedwrittencommuni- cationswouldbewelcomedonthesubject. CityAttorneyCunninghampointedoutthatcitizenparticipationwasnotnecessaryinthedecision-making processonthissubject,asitwasnotnecessaryonotherexpendituresofmoneybytheCity. 8.PresidentLaCroixannouncedthatanypersonsinterestedinthecamperregulationordinance,onthe agendaforpassageatthismeeting,wouldbegiventheopportunitytospeakonthesubjectatthattime. 9.Mr.DonaldJohnson,PlanningDirector,statedthatwhiletheHearinghadbeenclosedonthesubject oftheoff-sitesignordinancetherewereseveralpeopleintheaudiencewhowouldliketobeheardon thissubject.PresidentLaCroixstatedthosewishingtospeakwouldberecognizedatthepropertime. 10.Mrs.GeorgeSkells,2624ClayStreet,representingthe~amedaArtAssociation,expressedthe supportoftheAssociationontheproposalbyMr.BellthattheAlamedaHighSchoolbeusedfora civiccenter. REPORTSANDRECOMMENDATIONS: 11.FromtheCityManager,reportingallworksatisfactorilycompletedontheprojectofInstalling CulvertsatVariousLocations,recommendingitbeacceptedandtheNoticeofCompletionbeordered filed. CouncilmanLevymovedtherecommendationbefollowed,thattheworkonthedesignatedprojectbe acceptedandtheNoticeofCompletionbefiled.ThemotionwassecondedbyCouncilmanLongakerand carriedonthefollowingrollcallvote.Ayes:Five.Noes:None.Absent:None. UNFINISHEDBUSINESS: 12.ContinuedfromtheregularmeetingheldDecember19,1972,wasthematterofthePlanningBoard's recommendationforapprovaloftheTentativeMapforthesubdivisionknownasTract3465,subjectto thetermsandconditionsoftheCityEngineer'sReportdatedDecember5,1972,andthattheparkfee requirementremainintact.Thiscoveredaproposedsixteen-unitcondominiumdevelopmentat2513- 2515CentralAvenue,byMr.HerbertJacksonandShaw &Lunt. Mr.LanceRussum,Attorneyforthepropertyowners,addressedtheCouncil.Herequestedthatthe Councilwaivetherequirementforpaymentoffeeinlieuofopenspace,pOintingouttherewouldbe anareaofopenspaceonthethirdflooroftheproposedstructure,andthatonlyanominalamount hadbeencollectedunderthisprovisionoftheordinance. TherewasdiscussionwithregardtotherequestoftheCouncilthattheproposedordinancerevision bebeforeitbytheendofJanuary.Mr.Johnson,onrequest,statedthePlanningBoardhadindicated aninterestinthematterandifitweretohearandreviewtheproposedrevision,itwouldnotbe possibletohavethedocumentbeforetheCouncilbytheendofthemonth. CouncilmanMcCallsuggestedtheCounciltakeemergencyactiontoinvokea$150feeperunitinthese instancesandthatactionbewithheldontheTractMapsbeforetheCouncilatthepresenttimepending adoptionofanemergencyordinancetosetsuchafee. Mr.JohnBarn i,Jr.,1277BayStreet,saidtheproblemofwaitingforadoptionofarevisedordinance wasthattherewouldbepub1ichearings,inwhichhewasinterestedashefeltconversionprojects shouldbeforcedtopayafeeaswellasnewconstruction,andthedelaywouldcausethedeveloper hardshipasitwouldundoubtedlystretchouttoaconsiderablelengthoftime.Hesaid2,800square feetofprivaterecreationalopenspacewasprovidedintheroofareaoftheproposedstructure, whereas3,050squarefeetwassetforthintheCityEngineer'sReportastherequirementfordedica- tion.Herequestedthatthedeveloperbegivencreditfortheopenspaceprovided.Mr.Barnisaid hebelievedtheproposed$150perunitwasquiteequitableandthatitwouldbeadopted. PresidentLaCroixsuggestedtheCouncilactuponthetworequestsbeforeitthiseveningandthen agreethatnonewcondominiumsubdivisionswouldbeconsidereduntilsuchtimeasanordinancewas beforeitforaction. Mr.Cunninghampointedoutthattheso-calledbedroomtax,ifitshouldbeadopted,wouldbepayable atthetimeofapplyingfortheBuildingPermit.Thenewbedroomtaxordinancewouldnotbea recreationallanddedicationordinanceinanywaysimilartothepresentone.Theapprovalordis- approvalofsubdivisionmapswouldnotinitselfconstituteexclusionofthedeveloperfrompayment ofthebedroomtax,assumingpassageoftheordinance. Mr.JosephSullivan,3221LibertyAvenue,askedtospeak.Hepointedouttherewasanordinanceon thebooksonthismatteranddiscussiononitsrevisionhadgoneonforalongtime.Heexpressed theopinionthatthepresentlawshouldbeenforcedand,ifsodesired,aprovisobeaddedtocover applicantsfromthismeetingon. Mr.CharlesTillman,2415RooseveltDrive,saidthismatterhadbeendiscussedquitethoroughlyat thelastmeetingofthePlanningBoard.HesaidtheCityofWalnutCreekhadsubmittedthefirst caseunderitsordinancetotheSupremeCourtandithadbeenacceptedastolegality.Hehadbeen informedthatthatCityhaddevelopedapproximately$100,000ofrevenuefromitsordinanceplus severalacresofland.HeimploredthattheCouncildosomethingtosettlethequestionofthis ordinance. Mr.RussumurgedthatsomethingbedonesothattheCitywouldhaveauniformregulationinthis matter,includingtheconversionaspect. CouncilmanLongakermovedtheTentativeMapforthesubdivisionknownasTract3465beapproved,as recommendedbythePlanningBoard,subjecttothetermsandconditionsoftheCityEngineer'sReport datedDecember5,1972,andthattheparkfeerequirementbewaived.CouncilmanForesecondedthe motion. Speakingonthequestion,CouncilmanMcCallpointedoutMr.GrantMainland,RecreationDirector,had stronglyrecommendedthattherequestforwaiverberejectedandtheinlieufeesberequiredfrom thedeveloperandthattheCityEngineer'sRepor t tockasimilarposition.Hemovedthemotionbe amendedtoprovidethatthedeveloperpayafeeof$2,400or$150perunit.ThemotiondieDforlack ofasecond. Afterbrieffurtherdiscussion,thequestionwasputandtheoriginalmotioncarriedonthef'cllowinq rollcallvote.Ayes:Foul'.Noes:Councilman~1cCall,(1).Absent:None.CouncilmanMcCall explainedthathewasforthedevelopmentbutcouldnotvoteforthemotion. 13.v/ContinuedfromtheregularmeetingheldDecember19,1972,thematterwasbroughtuponthe communicationfromthePlanningBoardsubmittiI1gwithoutrecommendationtheTentativeMapforthesub- divisionknownasTract3468,aproposedcondominiumsubdivisionofforty-fiveunitsat1825ShoreLine DriveforDoricDevelopment,Inc. CouncilmanLongakermovedtheTentativeMapofsaidSUbdivisionknownasTract3468beapproved,subject tothetermsandconditionsoftheCityEngineer'sReportdatedDecember5,1972,andthattheparkand recreationinlieufeesbewaived.CouncilmanForesecondedthemotion. Speakingonthequestion,CouncilmanMcCallpointedoutthissubdivisionwaslocatedontheSouthShore andthedeveloperhadprovidedrecreationareasat$2,500peracre,sohefeltdifferentlyonthismatter thanonthepreviousaction. Absent:None. 14.yiCalledupfordiscussionwasthematteroftheproposalbythePlanningBoard,onItsOwnMotion, toamendcertainsectionsoftheMunicipalCode(ZoningOrdinance)relatingtosignregulations CouncilmanMcCallmovedthlsmatterberaisedfromthetable.Counci1manForesecondedthemationwhich onrollcallcarriedunanimously. CouncilmanForesaidhehaddonesomeindependentresearchontheproposedbillboardordinanceandhad beenincontactwithDr.JamesClaus,whowasconsideredoneofthecountry'smostknowledgeablescholars intheareaofsignboards.ThreeofDr.Claus'booksonthesubjecthadbeendistributedtothemembers oftheCouncilfortheirperusal.HethenintroducedDr.Clauswho,hesaid,wascurrentlyworkingfor theCityofSanDiegoasaconsultantonitssignordinance. Dr.R.J.Claus,Ph.0.,3093RossRoad,PaloAlto,thenaddressedtheCouncilatsomelengthonthe subjectofoff-premisesignlegislation.HedisagreedwithstatementsbyMr.BernardCarter,Assistant Planner,inhismemorandumdatedMay5,1972,tothePlanningBoardonthissubject.Heclaimedbill- boardswerealanduseasmuchasasingle-familyhome,agasolineservicestation,abusinessofany kindoranindustrialshop,andbanningthemwouldestablishaprincipleoflawwhichthebillboard peoplewouldfightbecaureofthefailuretocompensatefortheloss.HepointedouttheCouncilcould writeanordinancetoaccomplishanythingitwishedtodo.Hesaidhecouldsee 110 reasonforcreating aconfrontationenvironment. InreplytoaquestionbyCouncilmanMcCall,Dr.Claussaidtherewasnodoubtthatsignscouldbescaled downinsize.Thiswouldenterintotheplanningphaseofthematterandmustbecarefullydone. Settingdownsuchrulestotheindustrywouldhavetobedoneinapublicsafetywayandtrade-offs couldbemade.HecommentedthatinPhoenix,Arizona,theCityPlannershadwantedtocreateopenspace andhadusedbillboardstoformmini-parks. Mr.Johnson,PlanningDirector,pointedouttheproposedordinancehadbeenendorsedbyagreatnumber ofpeopleintheCityandapproximatelyonehundredpeoplehadappeareddirectlyorindirectlyinsupport, withfourinopposition.HesaidhedidnotwishtodiscreditDr.Clausinanywaybutpointedoutthe Councilcouldlegislateaesthetics,andhewouldnotsubstitutehisjudgmentnorthatoftheCityCouncil forDr.Claus'sinthefieldofoutdoorsigningintheCityofAlameda.Hepointedouttheproposed ordinancewasnotconfiscatory,itcouldbesustainedandtheCityAttorneyhadstateditwasdefensible, thecitizenswanteditandthePlanningBoardandstaffhadrecommendedit. Dr.Yale~1axon,PresidentoftheCaliforniaRoadsideCouncil,addressedtheCouncil.Hepointedoutthat ahalfmilliondollarshadbeenspentbytheCitytoundergroundutilitylinesintheprogramofimproving theenvironmentandalogicalsecondstepwastorequireeliminationofoff-siteadvertising.Hesaid theCityhadinitiatedanexcellentandlaudableprogramofupgradingitsphysicalappearanceandall thatwasnecessarynowwastocarryitthrough. InreplytoaquestionbyCouncilmanLongaker,Dr.Maxonsaidhisorganizationconsideredtheproposed ordinanceagoodone.PresidentLaCroixpointedouttheRoadsideCouncilhadstatedinalettersome monthsagothattheproposedregulationwasoneofthefinestordinancesithadseenthroughouttheState, whichshowedagreatdealofinterestintheworkofthePlanningDepartment. InreplytoaquestionbyCouncilmanMcCall,Dr.Maxonsaiditwashispersonalfeelingthatallbill- boardsshouldbebanned. Mr.ChuckCarica,1000PostStreet,suggested,sincetherewereapproximatelytwentyillegalsignsinthe Cityaboutwhichthesigncompanieshaddonenothing,thattheproposedordinancebepassed. Mrs.MarionBothwell,875PortolaAvenue,urgedthattheCouncilbringthismattertoavote.She commendedMr.Carterastheauthoroftheproposedordinance. Mr.WilmontSweeney,6014MarketStreet,Oakland,AttorneyforFoster &Kleiser,saidhecouldnotadd muchtothecommentsofDr.Claus.HepointedoutthatbanningsignboardoperationsintheCitywasin factconfiscatingproperty,thatthiswastherightoftheCityforthepublicgoodbutcompensationof theprivatepropertyownerwasrequiredunderthelaw,andthiswasnotproposedundertheordinance. Hesaidtheindustrycouldnotsitbackandquietlypermitmillionsofdollarsworthofitspropertyto betakenawayfromit.HeagreedthatthiswasnotasubjectforpoliceactionandthattheCity cauld legislateaestheticsifitsodesired.Hesaidtheindustryagreedtoandfeltthereshouldbereason- ableregulationbutitdidnotagreethatitwasprovidingsomethingwhichwasofnobenefitorreal 40 usetothecitizens.~1r.Sweeneyrequestedthattheordinancenotbeadoptedandthatappropriate bodiessitwiththemembersoftheindustryinanattempttoresolvetheexistingdifficultiesand comeupwithsomethingmorereasonable. PresidentLaCroixsaidhefeltverystronglythatthePlanningBoardandDepartmenthadbeen challengedtoprepareanappropriateordinancetoridtheCityofthisformofpollution.Hesaidhe hadbeenverypleasedwiththeresultsofremovingthebillboardsontheSchoolpropertyontheeast sideofWebsterStreetandcleaninguptheareawithafinefencetoprotectitfromunwanteduse whichhadbeenimposedonitinrecentyears.HesaidMr.StanleySmith,GeneralManagerofthe AlamedaChamberofCommerce,hadonthisdatereiteratedthepositionoftheChamberinfullsupport oftheproposedordinance.UtahInternational,Inc.,operatoroftheSouthShoreShoppingCenter, hadseenfittobanbillboardsintheCenterandtheSouthShoreMerchantsAssociationsupported thatposition.HesaidnumerousgroupsthroughouttheCitysupportedtheordinanceandhefeltthe peopleoftheCitywantedpositiveactiononthisquestion. CouncilmanMcCallsaidhewouldopposepassageoftheordinanceashewouldnotoperatewithtwo setsofrules.HesaidhefelttheCouncilshouldconformallthewayandhedidnotfeelthiswas beingdone.HesuggestedtheCitypaycompensationfortheremovalofthesignsinquestion. CouncilmanLongakercommentedthatlegislationhadbeenpassedontheFederalandStatelevelwith aneyetoeliminationofvisualpollutionandthatlargesumsofmoneyhadbeenspentbytheCity forundergroundingutilitylines.Hesaiditwasobviousthatthepeoplewishedtoseetheproposed ordinanceadopted;hefeltifthereweregravelegalquestionsconcerningthetakingofpropertythe matterwouldhavetogotocourtforfinaldetermination-therewasnoquestionaboutthefact thattherehadbeenpressure.HesaidhewouldliketogivecredittothePlanningBoardandtrust thiswouldmarkthefirststepoftheBoardandstaffinpreparinglegislationregardingarchitectural designcontrol,historicalarchitecturalpreservationandthosepointsdiscussedbyCouncilman McCallregardingtheoverheadsigns. Therebeingnoobjections,themeetingproceededto"IntroductionofOrdinances". INTRODUCTIONOFORDINANCES: 15.CouncilmanLongakermovedthefollowingordinancebeintroduced,afterwhichitwouldbelaid overunderprovisionoflawandtheCharter: "OrdinanceNo. NewSeries AmendingtheAlamedaMunicipalCodebyAmendingSections11-14Bland 11-14B2Thereof,byAmendingArticle4-8ofChapter1,TitleXIThereof, andByAddingSections14-B8Through14-B15toSaidArticle,Regulating theDesign,MaintenanceandLocationofOn-PremiseandOff-PremiseSigns andProvidingfortheAbatement,RemovalandProhibitingofNon-Conforming OutdoorAdvertisingDisplaySigns." CouncilmanLevysecondedthemotion,statingthatduringtheseveralmonthsthismatterhadbeenbefore theCouncilnoconcretecompromisehadbeenofferedtotheproposedordinance.Hesaidhefeltif passagewasaccomplishedamendmentscouldbemadewhichwouldbemoreequitabletothesigncompanies. Speakingonthequestion,CouncilmanForereadapreparedstatementthathewasnotinagreement withtheapproachofbanningsignsentirelyandthattherewasalackofjusticeinalawwhich attackedonekindofsignandnotanother.Hepointedoutparticularlyunsightlysigndisplays attachedtoplacesofbusiness,politicalsigns,etcetera,andsaidhefelttheproposedordinance didnotgodeepenoughtogettotherootofthematter.Hesaidhefeltwhatwasneededwasaset ofstandardstoinsuregoodtasteandcommonsenseinthedesignandplacementofsignsandsomekind ofreviewboardorcommitteetodrawupsuchstandards,madeupofpeoplewithadegreeofprofessional interestsuchasartists,decorators,etcetera.HesuggestedthePlanningDepartmentandtheCity Attorneyconsultonthisproposalashefeltthiswaswhatthepeoplewanted. Thequestionwasthenputandthemotioncarriedonthefollowingrollcallvote.Ayes:Four. Noes:CouncilmanMcCall,(1),whostatedhefelttheordinancewasillegal.Absent:None. PresidentLaCroixcongratulatedMessrs.JohnsonandCarterontheordinance,pOintingoutachallenge hadbeenissuedtocomeupwithanon-premiseordinancetocomplementtheonejustintroduced. Mr.JohnsonacknowledgedthePresident'scommentsandcommendedMr.Carter,whohesaidwasleaving CityemployattheendofJanuary. 16.ContinuedfromtheregularmeetingofDecember5,1972,considerationofadoptionofthemassage establishmentcontrolsandregulationshadbeencontinuedtothenextregularmeetingoftheCouncil onJanuary16,1973. Aten-minuterecesswasdeclared.Uponreconvening,theCouncilproceededwiththeregularorderof business. NEWBUSINESS: 17.CouncilmanLevybroachedthesubjectofearthquakesandthepossibilityofamajordisasterin the HeinquiredastothestatusoftheDefenseandDisasterCouncil. Uponrequest,CityManagerWellerstatedtheCivilDefenseCouncilwasstillinexistenceinconformity withStatelaw;itsadministrationhadbeenhandledforthelastthreeorfouryearsundercontract 41 withAlamedaCounty.Heexplainedthat,intheeventofamajordisaster,therewouldsimplybean enlargementofanexistingorganizationinvolvingthepublicutilitiescompany,andthepublicorgani- zationsandcitiesandcountieswouldsimplyhaveto"beef"uptheirorganizationsinordertocope withtheproblems,whatevertheymightbe.Hesaidintheeventofastateofextremeemergencythe MayorisrequiredbytheCityChartertotakecommandandtogovernbyproclamation. CouncilmanMcCallsuggestedtheCouncilmenmightwishtovisittheDisasterCenterlocatedinthebase- mentofWoodminsterAmphitheatre,underthedirectionofMr.WilliamW.Ward,aformerresidentofthe City. 18.ThefollowingresolutionwasintroducedbyCouncilmanLevy,whomoveditsadoption: "ResolutionNo.8014 CallingGeneralMunicipalElectiontobeHeldintheCityofAlamedaon Tuesday,March13,1973;EstablishingElectionPrecincts;FixingNumber ofElectionOfficersontheBoardofElectionforEachPrecinct;Fixing CompensationofElectionOfficersandDesignatingHoursofVotlng." Uponrequest,theCityAttorneyexplainedthattheproblemoflivingincampersonpublicstreetshad occupiedthePoliceDepartmentforsometime.Aslongas tVio yearsagotheDepartmenthadrequested thatanordinancebepreparedwhichwouldtakecareofthesituation.Thefirstdraftwasfeltbythe Counciltohaveanunduerestrictionontheuseofcampersonprivatepropertyandaredrafthadbeen preparedinthepresentform,eliminatingtheSectiononthisaspect.Thisdrafthadbeenreviewedby thevariousCityDepartments,includingthePoliceChief,whosecommenthadbeenthatthenewdraftwas anoutstandingideainwhichtheDepartmentconcurredandrequesteditspassage.Hesaidthesubstance oftheordinancewouldprohibithumanhabitationinthedefinedvehiclesinpublicplacesandviolation wouldconstituteamisdemeanor.TheregulationViasfelttobenecessary,nottobeenforcedarbitrarily, unreasonablyordiscriminatorily,anditwouldaccomplishthepurposedesiredbythePoliceDepartment. Mr.CharlesBlackJock,1821st.CharlesStreet,addressedtheCouncilonthissubject.Hesaidhewas verymuchconcernedabouttheproposedordinanceandobjectedtothehoursof10:00o'clockp.m.to 6:00o'clocka.m.andtotheprovisionsgenerally.Hesaidheresentedanyattempttotiehiminwith wrongdoersandexpressedthehopethattheordinancewouldbepigeon-holed. ~1rs.Hilda~1ayVolk,ExecutiveDirectoroftheCaliforn i aOutdoorRecreationLeague,astatewideorgani- zation'spokeonbehalfoflocalresidentswhoweremembersoftheLeague.Shesaidtherewereprobably about12,500recreationalvehicleownersintheCity,themajorityofwhomwouldbeaverage'law-ab i d i nq citizens.ShesaidshefelttheCityhadordinancestotakecareofanyviolationsinthisconnection. Mrs.VolkstatedthevehiclemanufacturersintheStateemployed24,000workersofMexicandescentwho wouldbeonthewelfarerollsiftheywerenotsoemployed.Shesuggestedthatthevehiclesbearingthe manufacturers'greenfairhousingtagsbeexemptedfromregulations. Hr.Wi11iamS.01ds,2605CentralAvenue,expressedoppositiontotheproposedordinanceapplyingonly tocampers,motorhomes,etcetera,statingtheregulationcreatedanoddsituationinthatactivities notpermittedinthesevehiclesbytheordinanceVlouldbelegalifcommittedinothertypesofvehicles, suchasstationwagons,sedansorboats. Mr.DeanNelson,3282SanJoseAvenue,pointedoutthere Vlere nofacilitiesintheCitywhichcouldbe usedbyvisitingcampersneedingtorest,Heurgedthatpassageoftheordinancebedeferreduntilsuch facilitiescouldbeestablished. Mr.RobertDwinnell,1328RegentStreet,pointedouttheCityofSanLeandrohadatleastfourteenmotor parksandithadnoordinancesuchasthatunderdiscussionwhiletheCityofAlamedahadnosuch facilities,andsomepropertieswouldnotaccommodatethesevehicles. Mr.LouisSchmitz,Jr.,1815CentralAvenue,spokeinoppositiontotheproposedregulation,statingthe changehadprobablybeeninitiatedasaresultofnuisancecallstothePoliceDepartment. Mr.RayJohnson,2060SantaClaraAvenue,statedhehadacommercialpickuptruckandcamperandhelda BusinessLicense,andhefelttheproposedordinancewasdiscriminatory. CouncilmanMcCallexpressedtheopinionthatthereshouldbearestareaintheCityandthisshouldbe theresponsibilityoftheEastBayRegionalParkDistrict.!fthiscouldnotbedone,hesaidhefelt theCityshouldmakeanareaavailableforthispurpose,andsaidhehadhopedthelandbetweenthePosey TubeswouldbeacquiredbytheCityforafacilityofthiskind.Hesuggestedthatcampervehicleowners 42 trustthePoliceDepartmenttodotherightthinginenforcingtheregulationandsuggestedthata permitsystemmightbeemployedtoprotecttheinnocentandconscientiouscamperowners. CouncilmanLongakerpointedoutthathe,inintroducingtheordinance,hadintendedtoobviatethe Policeoperatingwithoutanordinancetotakecareofpeopleactuallylivingintrailersonthe streetsandithadnotbeenhisintentiontocausehardshiptopeoplelivinginthecommunityand whomightfinditnecessarytouseatraileroccasionallywithintheCity.Hesaidhefeltpossibly amistakehadbeenmadeandhewouldliketoseeanopportunitygiventoworktheproblemout satisfactorilywiththePoliceSergeant. PresidentLaCroixsuggestedthattheordinancebeleftasithadbeenprepared,thatitbetabled andariderbeattachedwherebyconsiderationwouldbegiventoaproperpermitforthebenefitof properuseofthesevehicles.UponadviceoftheCityAttorney,herequestedthatCouncilmanMcCall representtheCouncilinmeetingwiththePoliceSergeantconcernedwiththisproblemandarepre- sentativeofthegroupinterestedinthesubjecttoformulateapolicywhichwouldbeagreeableand whichwouldsupporttheneedsofthePoliceDepartment. CouncilmanMcCallmovedtheordinancebetabled.CouncilmanLongakersecondedthemotion. PresidentLaCroixrequestedthatthematterbefollowedthroughbytheCityManagerforameeting withthedesignatedparties.ItwassuggestedbyamemberoftheaudiencethatMr.Blacklockrepresent thecamperowners.ThiswasacceptabletoMr.BlacklockandhewasrequestedtomeetwithCouncilman McCallandthePoliceSergeantinvolvedintheproblemsothatthemattercouldbegivenprompt attentionandtheordinancereturnedforfurtherattentionbytheCouncil.
