WRITTENCOMMUNICATIONS: 2.FromtheAlamedaYachtHarbor,signedbyMr.M.DeanAnderson,endorsingtherequestofMr. WilliamOldsforallocationofrevenuesharingfundsforpoliceserviceontheEstuary. CouncilmanLongakermovedtheReportsbeapproved.CouncilmanLevysecondedthemotion. CityAttorneyCunninghamexplainedthattheseReportscompliedwithanewStatelaw,agreatdealof workhadgoneintopreparingthemanditViasfelttheyadequatelymettherequirementsoftheState statutes.Copies had beensenttotheClerksof the StateAssemblyandSenate,theStateLandsCommis- sionandtootherpersons.HesaidheandthestaffmemberwhohadworkedontheReportsrecommended thattheybeapproved.ItwasstatedthePlanningDepartmenthadcopiesforperusalbyanyonedesiring todoso. Asstatedpreviously,Mr.SamuelYoung,AttorneywiththefirmofDavis,Craig &Bartalini,hadrequested thatthismatterbecontinuedtothenextregularmeetingoftheCouncil. Therebeingnoobjections,itwasstatedthesubjectwouldbeconsideredattheregularmeetingonTues-day,February 6,1973. Mrs.Kapellas,whohadrequestedtheopportunitytospeakonthissubject,addressedtheCouncil.She objected to continuingthemattertothenextmeeting,sayingshewassurethereasonfortherequest wasthatanewordinancewasproposedonthesubjectofrecreationandparklanddedication.Shesaid shehadobtainedacopyoftheStatelawonthesubjectandpointedouttheCityhad,ineachinstance involvingnewdevelopmentexceptone,notrequiredthatlandbededicatedoraninlieufeebepaid,also thatunusableopenspacelandhadbeenacceptedtofulfilltheprovisionsoftheordinance,orcredit hadbeengivenforthearchitecture.Shesaidshedidnotseehowcontinuingthismatterwouldbetothe advantageofthecommunityandpointedoutthatconsiderablerevenuehadbeenlosttotheCityinthis way,thatthiswaspreferentialtreatmentbywhichthepeoplewouldsuffer. Mr.James B.Davis,Attorney,statedhispartnerwhowashandlingthismatterhadaconflictofinterest andwasinHaywardthisevening.Ithadbeenforthisreasonthathehadrequestedthematterbe continuedtothenextmeeting. 17.v/FromtheCityManager,recommendingthatarefundbeauthorizedtoPan-PacificDevelopmentCompany intheamountof$2,449coveringunusedBuildingPermits. Onrequest,Mr.CunninghamstatedonthebasisoftherecommendationoftheCityManageritwouldbein order to authorizetherefund. On questionbyCouncilmanLevy,City~1anagerWe 11 erreportedthatexpensesofapproximately $1500 had beenincurredforplancheckinginthisconnectionwhichwasnotincludedintheamountrecommendedfor refund. AcommunicationfromtheBoard,readearlierinthemeeting,requestedthattheCityassumefullresponsi- bilityfortheafter-schoolandsummerrecreationprogramconductedbyCityemployeesonschoolsites, atacostof$22,105. 48 CouncilmanLangakerstatedhehadpresentedthepasitianaftheCouncilto.theBaardatitsmeeting ofJanuary9,1973.HeemphasizedthattheCouncilhadindicatedaNo.1prtor t ty prajectwhichseemed afutmostimpartancewastheflaadingcanditianscreatingprab1emsintheTubeandthehomesanthe narthsideaftheCityintheareaafNasanStreet. CouncilmanMcCallsuggestedthereshouldbeclarificationastothedivisionofexpensesanthe operatianafthefacilitiesinquestionbytheSchoalDistrictandtheCity. Indiscussion,itwaspointedouttheCouncilplannedtogiveadditionalconsideratiantothematter oftherevenuesharingpragramsametimeinMarchandpassiblywouldatthattimemakeafinaldeter- minationwithregardtotheSchoa1District'srequest. CouncilmanMcCallmovedtheBoard'srequestbereferredtotheCityManagerandtheCityAttorneyfar studyandreportandrecommendationtotheCouncil,withtheadditionthattheSchoolDistrictbeasked to.infarmtheCityofitsintentionsforspendingtheten-centoverridetax.CouncilmanLongaker secondedthemotionwiththeexplanationthatthistaxwasbeingeliminatedunderSenateBill90and incorparatedintotheregulartaxrate,soitwasnatbeinglast.Thequestionwasputandthemotion carriedanthefollowingrollcallvote.Ayes:Five.Naes:None.Absent:None. 20.Thematterofcontinuedconsiderationofproposedmassageestablishmentcontrolsandregulations wasbroughtup. PresidentLaCroixsaidithadbeenbroughttohisattentionthattheSanFranciscoChroniclehad carriedanarticlewithregardtothemassageparlorsintheCityofAlameda,thathefeltstrongly thatthistypeofbusinesswasnotgoodforthecommunityandtheCouncilshouldsupportthePolicein itsendeavortoridtheCityoftheseoperationswhentheywerenotfunctioningproperlyunderthelaw. CouncilmanLongakerreadpassagesfromtheChroniclearticleonthesubjecttowhichhetookexception. HesaidhedidnotlikethistypeofarticleinviewofthefactthattheCitywasinthepracessof preparinganordinancewithwhichthePoliceDepartmentwouldbesatisfied. Nr,Cunninghamreviewedtheproceduresfollowedinthepreparationofthislegislationintheattempt toarriveatanacceptableordinance.SincepreparingthedocumentpresentlybefaretheCouncilhe hadreceivedalengthymemarandumfromthePoliceDepartmentsuggestingnumerouschanges,someof whichwereunconstitutional,andstatingthattopasstheordinanceasproposedwau1daccomplishvery little.HesaidhehadbeenincommunicationwiththeDeputyCountyCounselwho.Viaspreparingthe finalformoftheCountyordinanceonthesubject.Withsomeaftheprovisionsinthisordinance whichwereacceptabletothePoliceDepartmentandotherssuggestedbyotherCityDepartments,plus anaspectwhichhadnotbeencoveredinanyotherdocument,hebelievedhecouldhaveareviseddraft forconsiderationbytheCouncilatitsregularmeetingonFebruary6,whichwau1dbeacceptable legally,tothePoliceDepartmentandtoathermembersofthestaff.Thiswasagreeableanditwas soordered. 21.ThefollawingresolutionViasintroducedbyCouncilman~1cCa11,whomoveditsadoption: "ResolutionNo.8015 AdoptingSpecificationsforFurnishingtotheCityafAlamedaOne ElectronicDistanceMeasuringDeviceandAccessoriesfortheEngineer- ingDepartment,CallingforBidsandDirectingCityClerktoAdvertise Same." Councilmant~cCallreportedthathehadmetwith~lr.Blacklock,representativeofthepartiesopposing theproposedordinance,andCaptainTreadwellofthePoliceDepartmentandthelatterhadsaidthiswas anenforcementtoolwhichviasneededbytheDepartment.Hesaidhehadneveropposedanythingwhi ch was forlawenforcementandsupportedbytheDepartment.IthadbeensuggestedthattheCityAttorneymeet withCaptainTreadwellandrepresentativesofthepeopleinoppositionandtheirAttorney,Mr.RichardA. Baker,tocometosomekindofcompromisesolution.Hesaidhebelievedthishadbeendone;although theproposedregulationsmightnotmeetwiththeagreementofeveryoneinvolved,itwasagoodenforce- menttoolanditshouldmeetwiththeapprovalofownersofrecreationvehicles. ~lr.Cunninghamsaid hehadreceivedaca11from~lr.Baker,whowastherepresentativeoftheMobilehome FamilyOwnersAssociation,andhehadsaidhewassatisfiedwiththeordinance,heandhisAssociation wouldsupport it andhewouldcommunicatewithpeopleinvolvedtomakeknownhissupport.Thepeople involvedpreferredtohavenoregulationofthistypebutMr.Bakerunderstoodthatthissortofthing was a problemand .he supportedtheordinancebecauseherealizedcitiesweregoingtoadoptsomekind ofcontrol. Mr.CunninghamdirectedthatinSectionl7-632(b)thewords"GreenTag"be deleted.Hewentonto explaintheprovisionsoftheordinance,po i nti nqoutsubsectioneclprovidedthat the ordinance voul d notbeenforcedunlessanduntilonenoticeofviolationhadbeengiventotheoperatorofavehicleinquestionbytheRlli.ceDepartment. Mr.BlacklockreportedthattheoutcomeofthemeetingwithCouncilmanMcCall,Mr.CunninghamandCaptain TreadwellhadnotbeensuccessfulwiththeexceptionthatCouncilmanMcCallhadsaidhewouldpursue withtheEastBayRegionalParkDistrictthepossibilityoffacilitiesbeingprovidedforthesevehicles comingintotheCity.HesaidhefeltsucharegulationwasnotneededintheCityanditwasnot wantedbytheoperators;however,iftheCityfelttheordinancewasnecessaryhewauldgoalongwiththeamendmentsaspresentlyproposed. Mr.OdieMcNutt,1239ParkAvenue,FieldDirectorfortheNationalCampersandHikersAssociation,said hewouldagreewithMr.BlacklockthattheordinancewasnotneededbutiftheCityfeltitshouldbe adopteditwouldbeacceptablewiththeamendmentsproposedinthepresentdraft.Hesaidherepre- sentedfifty-fourfamiliesintheCityandtheorganizationcontained76,000families;thenational conventionwastobeheldinLosBanosthisyearandhehadhopedthatAlamedawouldbeabletotake careof150or200ofthesefamilieswhilevisitinginthevicinity,pointingouttheconventionwould bringconsiderab 1 emoneyintothearea.Hesaidtheproposedordinancewouldnotpermitthis. CouncilmanMcCallsuggestedMr.McNuttcontacttheAlamedaChamberofCommerceandtheMerchants AssociationsforpossibleuseoftheSouthShoreparkinglotorasimilarareaastheCityhadnodesire todrivepeopleoutofthecommunity. PresidentLaCroixsaidthissubjecthadbeenacontroversialoneforsomemonthsastheCouncilhadfelt theordinanceunderwhichtheCitywasoperatingwasnotproperlyworkable,thatitdidnotaddress 50 itselftotheneedsofthecommunityinsofarasthebuildingtrades,developersandhomeownerswere concernedandithadbeenrequestedthattheregulationsberestudiedbythestaffandbroughtback totheCouncilforaction. ~~r.WellerexplainedthepresentdrafthadbeenpreparedasaresultofameetingheldinOctober withacommitteeconsistingofanumberofdevelopers,Citystaf f members,ChamberofCommerce members,peoplewhowereknowledgeilbleinthefieldandinapositiontoindicatetheimplications ofthevariousmodificationstotheexistingordinance.Hesaidthisdraftwaspresentedtothe Councilintheinterestoftime,beforeanopportunityhadbeenprovidedtodiscussitwiththe committeeorforthePlanningBoardtoreviewit,inasmuchastheCouncilhadindicateditdidnot proposetoenforcetheexistingordinanceandtherewaspressuretogetsomethingbeforeitfor controloftherequirementsinconnectionwithcurrentsubdivisionactivities.Hesuggested,inview ofthefactthattherequestforapprovaloftheTentativeMapforTract3454hadbeencontinuedto themeetingofFebruary6andinviewofthemodificationswhichhadbeenconsideredatthismorning's meeting,itmightbeappropriatethattheordinancealsobelaidovertothemeetingofFebruary6. Mr.We11erexplainedtheconsensusdevelopedbythecon~itteeforpossiblemodificationsofthedraft nowbeforetheCouncil.HesaidinSection3-1312(b)thedefinitionof"dwellingunit"didnotmake itclearthatcommercial-typeresidentialstructuressuchashotels,motels,conva1escenthomes,et cetera,wouldbeexcludedfromtheapplicationofthistax.Ithadbeentheconsensusthatthey shouldbeexcludedbecausethewholethrustoftheordinancewastoprovidethemeansbywhichthe Citycouldtakecareoftherecreationalneedsofanincreasingpermanentpopulationsothatthe transient,momentaryincreaseinpopulationwouldnothavethesameconnotationwithrespectto recreation.Hesaidiftherewasafeelingthatthesepeopleshouldberequiredtocontributein somefashionthismightbedoneonthebasisofahotel-moteltaxorsomethingofthissort.The intentwouldbetomodifythedefinitionof"dwellingunit"tomakeitclearthathotels,motels,et cetera,wouldnotbeincludedwithintheoperationofthebuildingpermittax. OnSection3-1314-LandDedicationInLieuofPaymentofMoney,Mr.Wellersaidtheintentwasto provideanalternativetotheCouncilinthosecaseswhereitwasclearlypreferabletoprovidefor adedicationoflandasdistinguishedfromthepaymentofmoney,basedlargelyonaquestionofsize whereitwouldbedesirableforlargedevelopmentstoprovideforacreagewithinthedevelopment. IthadbeenthefeelingthattheoptioninthisrespectshouldbegiventotheCityanditshouldbe withinthepurviewoftheCouncilthatifitwasinthepublicinterestitmightrequireany developertodedicatelandinlieuofthepaymentoftax;hefeltthiswaswithintheintentofthe originalandearlierdraftoftheordinance.Hesaidtherehadbeensomequestionastothemeaning oftheterm"improvedrealproperty"andtheconsensushadbeenthat"improvement"basicallymeant thepublicperimeterimprovementswouldbeinstalled,andthepropertywouldberough-graded, althoughitwouldnotbecomtemplatedthattherewouldbephYSicalimprovements.Ithadbeen indicatedthatthisshouldbemoreclearlydefined. Mr.Wellersaiditwasindicatedthatthosedevelopmentswhichhadenteredintoagreementsrequiring dedicationofpropertyorwhichhadgonethroughthePlanningBoardandtheCouncilinconformity withtheexistingordinanceshouldnotberequiredtocomeunderthenewregulations,andthere wouldbesomemodificationinthelanguageofSection3-1314tomakethisclear.Aminorchange inSection3-1315wasthatthetaxwouldbepayableuponissuanceoftheBuildingPermitandif, forsomereason,constructiondidnottakeplacethedeveloperwouldbeentitledtoarefund.On Section3-1317asuggestionhadbeenmadethatthelanguagebechangedtoprovidethatthemoney collectedwouldbedepositedinaspecialaccountoftheGeneralFundandusedprimarilyratherthan princi~forthepurposeofprovidingparkandrecreationalfacilities.Heexplainedifit shouldbefoundthatmoneycollectedwasnolongerneededforrecreationalpurposesorsomeother purposemighthavehigherpriority,theCouncilwouldbeabletomodifytheuseofthefunds. PresidentLaCroixcommentedthatCouncilmanMcCallandhehadsuggestedapercentageofallocation bespecified,suchas75%or80%torecreationand25%or20%forgeneraluse. Mr.Wellersaidhewouldrecommendagainstthisasitwasnotknownhowmuchmoneywouldbeproduced bytheordinanceandtheamountswouldnotbeuniform.HepOintedoutitshouldbeborneinmind thattheordinance,havingbeenadopted,couldalsobemodified. TherewasdiscussiononSection3-1317coveringuseofthetaxmoney.Itwasdeterminedthatthe moneyswouldbeallocatedspecificallytoafundtobeusedsolelyforprovidingparkandrecreational facilHies. Onrequest,Mr.Wellerexpressedtheopinionthatsimpleconversionstocondominiumsshouldnotbe requiredtopaythetaxonthephilosophythattheyaddednothingtothepopulationandnothingtothe burdenoftheparksandrecreationalfacilitiesoftheCity. CouncilmanMcCallexpressedtheviewthatthematterofahotelandmoteltaxshou1dbepursued,that theChamberofCommerceshouldexplorethematterandmakerecommendationstotheCouncilthereon. IndiscussingSection3-1314,CouncilmanLongakersaidthe"inlieuof"problemhadbeenoneofthe mostdifficultdecisionstheCouncilhadhadtomakeandhehopedtherewordedordinancewouldprovide assurancethattheSectionwouldpertainonlytolargedevelopments. Mr.WellerexplainedtheproposedchangewouldremovethenecessityfortheCounciltodetermineor quantifythevalueofthequasi-publicfacilitiesbeingoffered.TheCouncil,onitsownmotion, couldsimplyfinditwasbettertoacceptpropertyinlieuofpaymentofafee,andthiswasnot includedinthepresentordinance.Thepropertywou1dbeavailableforpublicuse,astheparcel wouldbededicatedtotheCity. CommentswereinvitedfromtheaudienceandMrs.Kapellasinquiredhowtheproposedregulationwould affectPlannedDevelopment,andwasinformedthatthiscategorywouldbecoveredintheordinanceas 5 wellasotherzones.SheinquirediftheordinancewouldbeclearastotheprOV1SlonoftheStatelaw thatonlypaymentoffeesmightberequiredindevelopmentsoffiftyparcelsorlessorindivisionsof landnotdefinedassubdivisions. Mr.WellerexplainedthisprovisionwasnotcontainedintheproposedCityordinanceas,forthepurpose involved,fiftylotsoranyarbitrarynumberwasnotthecriterionanditwaspossiblethatadeveloper mightcomeinwithtwentylotsinwhichitwouldbeobviouslytotheadvantageoftheCitytoacceptthe dedicationoflandinlieuofpaymentofafee;conversely,itwaspossibleforadevelopertocomein withasixty-lotdevelopmentinwhichitwouldbebettertoacceptafeethantorequirelanddedication. HesaidhefelttheCouncilshouldhavetheoptioninallcasestodetermine,initsbestjudgment, whichwasbetterfromthestandpointofthegeneralpublicinterest. Mr.KapellasinquiredwhyithadbeennecessaryfortheCityCounciltoappointaboardthroughthe ChamberofCommercetodrafttheordinanceunderdiscussionandsaidshewouldliketoseetheChamber advertisetheCityforindustry,whichwasitsprimarypurpose. Mrs.Kapellassaidsheunderstoodtheordinancedidnotspeakclearlytocommercialandindustrial constructionandtheCitycouldnotsurviveonresidentialtaxesalone.Sheinquirediftheproposed ordinancewouldincludeareasspecifiedforindustryonlyoriftherewasaplanbeforethePlanning BoardortheCouncilthatcertainareasintheCityshouldbedesignatedforindustryinorderthat companieswouldhaveaclearviewofwhattheCitydesiredsotheycouldcomeintothecommunity. PresidentLaCroixexplainedthattheproposedregulationwouldnotproposeanynewzonesintheCitybut spokespecificallyofaresidentialparkandrecreationtax. Mr.Cunninghamemphasizedthatthelanddedicationandfeeordinancenowineffectwasbasedsolelyupon theauthoritygiventocitiesbyStatelawandtheCityhadnopowertorequiresubdividerstodonate 1andortopaymoneyexceptforthat 1aw.TheexistingCityordinance,hesaid,comp 1 iedineveryrespect withtheStatelaw,asitmust;creditforprivateopenspacespecificallyexcludedwalkwaysandmany otherthings.Hesuggesteditbeborneinmindthatthekindof 1 aVitheCouncilproposedtorepeal pertainedonlytosubdivisionsandtheonlyauthorityfordoingitViastheSubdivisionMapActwhilethe newlyproposedordinancewasataxmeasureandpertainedtoallnewconstruction. Mr.Oldscomplainedthatcopiesofproposedordinanceswerenotavailabletothepublicforperusal beforeadoptionandheobjectedtothefactthattheCouncildiscussedsubjectswithwhichthepublic wasnotfamiliar.HeprotestedthatmeetingsofCityofficialswereheldwherethesedocumentswere drawnupandtheCouncilfeltnoresponsibilitytowardthecitizensinthesematters. PresidentLaCroixexpresseddisagreementwithMr.Olds'comments,andsuggestedthatheavailhimself oftheopportunityofobtainingcopiesofdesiredinformationintheCityHalloffices. Mr.Oldssaidasheunderstoodthematterunderdiscussion,itwentbacktoanoriginalStatebillwhich intendedtotakeintoconsiderationplanneddevelopmentsoranyplacewherelargepopulationwasbeing concentratedonsmallpiecesofland.Theexistingordinanceseemedtocoverthisaspectwhereasthe proposedregulation,asheunderstood it,providedforabonustoplanneddevelopmentsandinsomecases paymentwouldbeforgiven. PresidentLaCroixexplainedthatnodecisionhadbeenmadeontheproposedordinanceandtheproposal toimposeataxof $150 perunit,withareductionof $50 onplanneddevelopment. Mr.SullivansaidhewassympathetictoMr.Olds'desiretoreaddocumentscomingbeforetheCounciland suggestedthatawaybeprovidedbywhichthepubliccouldbeinformed.HecommendedtheAlamedaTimes- Starreporters,fromwhomhesaidhereceivedagreatdealofinformation. Mr.Sullivansaidhewouldlikeetoseeallnewhabitableconstructionchargedthefeedeterminedbythe Council,whetherhotels,motels,orhospitals,andthatthetaxonplanneddevelopments,whichheunder- stoodtobemoreorlessofamultipletype,beincreased,ifanything.HesaidtheCityofficials seemedtothinkitwasdesirabletobringinmorepeopleandmorehousestocreateabroadertaxbase, whichhefeltwouldnotsolvetheproblemsaswhendevelopmenthadbeenaccomplishedpeoplewouldmove tootherareasandtheCitywouldbeabandoned. Mr.DonaldLindsey,ChairmanoftheChamberofCommercecommittee,saidthecommitteewasincomplete concurrencewiththerevisionsreportedbytheCityManager,thathefelttheCitywouldbeabletowork wellwiththeproposedordinanceanditwouldbringinconsiderablerevenue.Hesaiditwasthecon- sensusoftheChamberCommitteethatthisordinanceshouldnotbeappliedtoconversionsfromapartments tocondominiumunits,anditfavoredtheprovisionthata $50 reductionwouldbegiventoaplanned development.Hesaidthecommitteehadworkedlongandhardtotrytoarriveatanordinancewhich wouldbefairallaroundbothtothedeveloperandtotheCity,hefelttheChamber'sinvolvementwas beneficialtotheCityandhehadbeenhappytoworkonthestudy, PresidentLaCroixexpressedtheappreciationoftheCouncilfortheworkoftheChambercommitteein thisrespect. Mr.FrankA.Ratto,1053 IslandDrive,saidhehadbeenwatCh-doggingthismatterbecausehewashoping forapublicparkonBayFarmIsland.Heexpressedtheopinionthatthedeveloperwouldnotpayasmuch undertheproposedchangeandvoicedtheopinionthattheordinanceshouldcoverconversions. PresidentLaCroixcalledforcommentfromtheCouncilontheproposalthatplanneddevelopmentsshould bechargedataxof $100 perunitandrepeatedhisopinionthatiftheordinancewastobeequitable thisbonusshouldnotbeallowedbutthetaxshouldbe $150 acrosstheboard. Mr.Wellerexplainedthebasisforthesuggestionthatplanneddevelopmentsshouldbecharged $100.He saidtherehadbeenagreatdealofdiscussionaboutthedesirabilityofarchitecturaldesign,aesthetic 52 andvariouskindsofcontrolsoverdevelopmentandoneofthewaystogettotheproblemwasto encourageplanneddevelopment,overwhichtheCityhadverysubstantialauthority,thathefeltthis wasalongstepinthedirectiontothekindsofdesigncontroldesired.Hesaidtheotherreason forsuggestingthatthisconceptbeencouragedwasthateveryplanneddevelopment,becauseofthe reasonwhichhadledthedevelopertopursuethatroute,inherentlyprovidedadditionalopenspace. Consideringthesetwoaspects,hesaidhefelttherewassoundlogicforprovidingtheproposed differential.Heremarkedthatmostofthecommitteemembershadfeltthediversionshouldbe greaterthanproposed.Mr.WellersaidhebelievedtheultimatepurposeoftheCityinmovingtoward theideaofexercisingaffirmativecontroloverarchitecturaldesignwasimportantandthiswasone ofthedevicesformovinginthatdirection,andremovingtheincentivewouldruncountertothe expressedpolicy.
