Resolution 14948CITY OF ALAMEDA RESOLUTION NO. 14948 CALLING FOR A GENERAL MUNICIPAL ELECTION TO BE CONSOLIDATED WITH THE STATEWIDE GENERAL ELECTION TO BE HELD IN THE CITY OF ALAMEDA ON TUESDAY, NOVEMBER 4, 2014 AND REQUESTING THE ALAMEDA COUNTY BOARD OF SUPERVISORS TO PERMIT THE REGISTRAR OF VOTERS TO RENDER SPECIFIED SERVICES TO THE CITY RELATING TO THE CONDUCT OF SAID ELECTION PURSUANT SECTION 10403 OF THE CALIFORNIA ELECTION CODE WHEREAS, the Charter of the City of Alameda (the "Charter ") provides that the ity's General Municipal Election be held on each even - numbered year and shall be consolidated with the Statewide General Election (the "Consolidated General Municipal Election ") and that the Statewide General Election shall be held in said City on Tuesday, November 4, 2014; and WHEREAS, pursuant to the Charter, it is necessary to elect: one (1) person to fill the office of Mayor; and two (2) persons to fill the office of City Councilmember; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda as follows: Section 1. The City's General Municipal Election is hereby called and ordered to be consolidated with the Statewide General Election to be held in the City of Alameda, State of California, on Tuesday, November 4, 2014, in accordance with the provisions of the Charter and the Elections Code of the State of California, for the purpose of voting upon any ballot measures and electing the following named officers of the City for the terms specified: a) One (1) Mayor of the City of Alameda, term commencing at 8:00 o'clock p.m. on the third Tuesday in December, 2014, and continuing for four (4) years thereafter and until a successor is elected and qualified. b) Two (2) Councilmembers of the City of Alameda, each term commencing at 8:00 o'clock p.m. on the third Tuesday in December, 2014, and continuing for four (4) years thereafter and until a successor is elected and qualified. c) All ballot measures or advisory measures or propositions which may lawfully be submitted at said Election. Section 2. The ballots to be used at the election shall be in form and content as required by law. Section 3. The City Clerk shall ensure the notice of the time and place of holding the election is given and is authorized, instructed and directed to give further or additional notice of the election in time, form and manner as required by law. Section 4. In all particulars not recited in this Resolution, the election shall be held and conducted as provided by law for holding municipal elections. Section 5. The City Clerk is hereby authorized, instructed and directed to coordinate with the Registrar of Voters to procure and furnish any and all official ballots, notices, printed matter and all other supplies, equipment and paraphernalia that may be necessary to properly and lawfully conduct the election. Section 6. The polls for the election shall be open at 7:00 AM on the day of said election and shall remain open continuously from said time until 8:00 PM of the same day when the polls shall be closed, pursuant to Elections Code Section 10242, except as provided in Section 14401 of the Elections Code. Section 7. The City Clerk is hereby directed to file a certified copy of this Resolution with the Alameda County Board of Supervisors and with the Alameda County Registrar of Voters. Section 8. The City Council hereby requests the Alameda County Board of Supervisors (the "Board ") to consolidate the Election with the Statewide General Election to be held on November 4, 2014 pursuant to the requirements of Section 10403 of the Elections Code. Section 9. The Board is hereby requested to make its order and to take such other and further proceedings as may be necessary to issue instructions to the Registrar of Voters to take any and all steps necessary for the holding of the consolidated election. Section 10. The Board is hereby authorized and empowered to canvass the returns of the Election and to certify the results thereof, that only one form of ballot shall be used, and that said consolidated elections shall be held in all respects as if there were only one election. Section 11. The City shall reimburse the County for services performed when the work is completed and upon presentation to the City of a properly approved bill. Section 12. The election precincts within the City for the Consolidated General Municipal Election shall be the same as those established, designated, numbered, fixed and established by the Board of Supervisors of the County of Alameda, State of California, as the election precincts. Section 13. The Consolidated General Municipal Election shall be held and conducted, election officers appointed, voting precincts designated, candidates nominated, ballots printed, polls opened and closed, ballots counted and returned, returns canvassed, results declared, certificates of election issued and all other proceedings incidental to and connected with the Election shall be regulated and done, all in accordance with the provisions of law regulating the Statewide Election. Section 14. The City Clerk is hereby authorized, instructed and directed to provide the Alameda County Registrar of Voters with all pertinent information and material as required. Section 15. Specified services include pre-election, election day, post-election and data processing services, Registrar stock supplies and vendor services and supplies, all as agreed upon by the Alameda County Registrar of Voters and the City Clerk of the City of Alameda. 1, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 1't day of July, 2014, by the following vote to wit: AYES: Councilmembers Chen, Daysog, Ezzy Ashcraft, Tam and Mayor Gilmore — 5.
