1968-08-20 Regular CC Minutesfl rz, 0 REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING AUGUST 20, 1968 The meeting convened at 7:30 otclock p.m. with President McCall presiding. The Pledge of Alle- giance was led by Councilman Fore and was followed by an inspiring Invocation delivered by The Reverend Mr. J. Paul Coleman, Pastor of First United Methodist Church. ROLL CALL: The roll was called and Councilmen Fore, La Croix, Jr., Levy and President McCall, (4), were noted present. Absent: Councilman Isaacs, (1). MINUTES: 1. The minutes of the regular meeting held August 6, 1968, were approved as transcribed. WRITTEN COMMUNICATIONS: 2. From Mesdames A. C. Ray and F. P. Koenig, 2826 and 2830 Fernside Boulevard, respectively, sub- mitting a petition signed by one hundred five property owners and residents of Fernside Boulevard in protest against the use of this thoroughfare by large trucks and requesting relief from the annoy- ance and nuisance therefrom. The President stated it was the intention of the City Council to ask that the City Engineer make a thorough study and report of this situation. He said it was hoped the City would receive the coopera- tion of the many firms whose trucks were involved. It was developed there were both the regular truck routes and certain temporary routes to serve a specific area. President McCall said he understood these interested parties were to speak on the subject during Oral Communications. 3. At this time, Mr. Paul E. Jackson, Attorney, East Bay District of the California State Automobile Association, was called upon to make a presentation. Mr. Jackson first introduced Mr. James Radcliffe, Manager of the Oakland office of the Association, and then reviewed the several times the City of Alameda had won awards in the Annual Nationwide AAA Pedestrian Program. He pointed out this was the fifth time a Special Citation had been given the City for its good record among cities of fifth thou- sand to one hundred thousand population. He also emphasized the importance of the Police Department and its enforcement of traffic regulations in attaining this distinction. Mr. Jackson then read the following, "Pedestrian Safety Inventory - Special Citation for Casualty Records - Cooperation for Pedestrian Safety and Convenience - to Alameda, California, 1967", and presented the plaque to Presi- dent McCall who, in turn, asked Sergeant Paul Nelson of the Alameda Police Department to accept it on behalf of Chief Tulloh and his Officers. The plaque was accepted with thanks and appreciation. ORAL COMMUNICATIONS, AGENDA: 4. Mrs. Catherine Ray referred to the petition-protest against Fernside Boulevard being used as a truck route. She also pointed up the fact that at the intersection of Fernside Boulevard and Versailles Avenue where children would soon be crossing to go to school, there was neither signal lights nor a Crossing Guard. Mrs. Ray commented further that the trucks using this thoroughfare travelled at excessive speeds and she felt some action should be taken to curtail this. Mr. James Martinet, 2915 Fernside Boulevard, Secretary of the Fernside Home Owners Association, stated the truck drivers were using this route simply because it was easier for them. He believed they had ample turning room off the Nimitz Freeway at Twenty-third Avenue to come into Alameda across the Park Street Bridge and also, in leaving Alameda, there was an adequate approach from Park Street onto the Freeway at Twenty-ninth Avenue. He asked that definite action be taken to enforce the use of the regular truck route. Mr. Martinet remarked that this condition had worsened since Fruitvale Bridge had been closed to trucks carrying loads in excess of five thousand pounds. With reference to Fruitvale Bridge, President McCall asked the support of these residents of Fernside Boulevard - and every citizen in Alameda - to write to his Congressman to assist the City of Alameda in getting the necessary Federal appropriation to construct a new Fruitvale Bridge. He pointed up the fact that the United States Army Corps of Engineers had admitted at long last that a new bridge was definitely needed. In response to Mr. Martinet, however, President McCall replied that the City would take immediate steps to have a survey made of the truck traffic. He pointed out the established truck route through the City. Mr. Frank A. Gottstein, 731 Haight Avenue, reviewed the history of the establishment and operation of the Fruitvale Bridge. Mr. Anthony Bruno, 2825 Otis Drive, asked that, since the City Engineer was to make a survey of truck traffic on Fernside Boulevard, he also be instructed to study truck routes in other cities. He empha- sized that Otis Drive had not been constructed to take the heavy truck loads and, therefore, these trucks caused great noise and vibrations. Councilman La Croix referred to Mrs. Ray1s remark about the lack of a Crossing Guard at Fernside Boule- vard and Versailles Avenue - and asked that the City Engineer check with the School District to ascer- tain if such was needed in this area. REPORTS AND RECOMMENDATIONS: 5Y'7 From City Planning Board, signed by the Secretary, recommending the reclassification of the prop- erty known as 2713 Central Avenue, from "R-2", Two-Family Residence District, to "R-4", Neighborhood Apartment District. The Zoning Application was filed by Mr. F. S. Dale and Mrs. Joanne Miller. The Hearing date for this matter was set for the next meeting of the City Council, to be held September 3, 1968. 6Y From City Manager, recommending the Council authorize an increase in the amount of the Petty Cash Fund for the Recreation Department to $100. Councilman La Croix moved the recommendation be approved and said Fund be henceforth set at motion was seconded by Councilman Levy and carried on the following roll call vote. Ayes: None. Absent: Councilman Isaacs, (1). 100. The Noes: Four. NEW BUSINESS: 7.' / President McCall referred to the one per cent "Commuter Tax" proposed by Mayor Alioto of San Francisco on all people who live in the Bay Area and work in San Francisco. He said he believed it behooved the Council of the City of Alameda to support the commuters within this community and oppose such a tax. Therefore, he recommended the Council endorse and support the action of the Board of Supervisors of Alameda County in opposing this Commuter Tax - and so inform the Board that the City Council was in full accord and would like to support it in any action it might take in this respect He stated he had noted the Chairman of the Board of Supervisors of Contra Costa County was calling a meeting of the Mayors of the fourteen cities of that County with the Board of Supervisors to work out some action to oppose this move of Mayor Alioto. President McCall pointed out the commuters spent considerable money in San Francisco and the City itself through the years had offered many services to San Franciscans. He asked the pleasure of the Council and Councilman La Croix moved the City Clerk be instructed to write to the Board of Supervisors of Alameda County as recommended by President McCall. The motion was seconded by Councilman Levy and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Isaacs, (1). RESOLUTIONS: 8. The following resolution was introduced by Councilman La Croix, who moved its adoption: "Resolution No. 7369 Supporting Request of San Francisco Bay Area Rapid Transit District Urging Special Session of Legislature." The motion to adopt said resolution was seconded by Councilman Fore and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Isaacs, (1). The following resolution was introduced by Councilman Fore, who moved its adoption: "Resolution No. 7370 Stating and Requesting Consolidation of a Special Municipal Election to be Held Tuesday, November 5, 1968, with the General Election of the State of California to be Held on Tuesday, November 5, 1968." The motion was seconded by Councilman Levy. Speaking on the question, President McCall asked for - and was granted - authorization to appear before the Board of Supervisors of Alameda County in personal support of this Resolution - in the event there was any thought of holding this matter over until a later date. The question was then put and the motion carried on the following roll call vote. Ayes: Four. Noes: None. Absent: Councilman Isaacs, (1). v/ 10. The following resolution was introduced by Councilman La Croix, who moved its adoption: "Resolution No. 7371 Proposing an Amendment to the Charter of the City of Alameda on Motion of the City Council; Calling a Special Municipal Election in the City of Alameda for the Purpose of Submitting to the Electors Thereof a Proposal to Amend Said Charter, Viz: By Adding Section 11-2 Thereto, Relating to Establishment of Elective Board of Education Consisting of Five Members, Each to Serve Four Year Term; Fixing Date of Said Election, Manner of Holding Same, and Providing for Notice Thereof; and Consolidating Said Special Municipal Charter Amendment Election with the General Election of the State of California to be Held on November 5, 1968." The motion to adopt said resolution was seconded by Councilman Levy and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Isaacs, (1). The President then declared all of the foregoing Resolutions adopted. INTRODUCTION OF ORDINANCES: 11. Councilman Levy moved the following ordinance be introduced, after which it would be laid over under provision of law and the Charter. The motion was seconded by Councilman La Croix and carried on the following roll call vote. Ayes: Four. Noes: None. Absent: Councilman Isaacs, (1). "Ordinance No. New Series Authorizing Amendment to Lease Between City and Todd Shipyards Corporation, Said Amendment Adding Parcel of Submerged Lands to Leased Premises; Approving Form and Authorizing Execution of Said Amendment." 12. Councilman La Croix moved the following ordinance be introduced, after which it would be laid over under provision of law and the Charter. The motion was seconded by Councilman Levy and carried on the following roll call vote. Ayes: Four. Noes: None. Absent: Councilman Isaacs, (1). BILLS: "Ordinance No. New Series An Ordinance Amending Certain Portions of the Alameda Municipal Code Relating to Traffic Regulations." 13. An itemized List of Claims against the City of Alameda and the Departments thereof, in the total amount of S21,452.36, was presented to the Council at this meeting. The List was accompanied by certification from the City Manager that the Claims shown were correct. Councilman Levy moved the bills as itemized in the List of Claims filed with the City Clerk on August 20, 1968, and presented to the City Council at this meeting, be allowed and paid. The motion was seconded by Councilman La Croix and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Isaacs, (1). ORAL COMMUNICATIONS, GENERAL: Y/ 14. Mrs. Karen Crespin, 2208 San Antonio Avenue, reported upon a deplorable situation created by her next door neighbors. She said these people allowed debris and actual garbage to accumulate and it had been necessary to call the Health Department before it had been cleaned up. Mrs. Crespin stated there was foul language used and noisy parties going on and the children were apparently neglected. She inquired if some action could be taken to remedy these conditions. President McCall assured Mrs. Crespin the matter would be investigated. 15. V Mr. Ray Hildebrand, 2021 Shore Line Drive, requested that in his studies of truck traffic, the City Engineer also include Shore Line Drive. 16.4 Mr. Frank A. Gottstein, 731 Haight Avenue, repeated in detail his claim that certain installa- tions by his neighbor had created an injurious situation for him. He explained at length what had been done in constructing additional carports and a driveway which he felt allowed the rainwater run- off to flow onto his property instead of into a certain drainage basin, which latter item was too small to properly do the job required. Following some discussion, Mr. Gottstein was informed that there had been no violations of the City Codes involved and he would have to resort to the Courts if he could not accept this decision. 17. Miss Cora Payne, 858 Laurel Street, stated she was representing the Citizens for an Elective School Board, and wished to indicate their support in whatever way would be most effective. 18. Mr. J. P. McClure, 2811 Yosemite Avenue, deplored the parking of automobiles on the streets which prevented the street sweeper from doing an adequate job of clearing the streets, and suggested the "water wagon" be used to flush out the curb areas. City Engineer Hanna discussed this situation with Mr. McClure and stated the "water treatment" was not very effective. FILING: 19. Amendment to Lease - Between City and Todd Shipyards Corporation. 21. At this point, President McCall spoke of the passing of Mr. William Garvin, President of the Alameda Chamber of Commerce, who was a most popular and active participant in civic affairs. He called up the audience for a moment of silence in observation of the loss of this fine gentleman. ADJOURNMENT: 22. There being no further business to come before the meeting, the Council adjourned in respect to the memory of WILLIAM GARVIN - to assemble in regular session on Tuesday evening, September 3, 1968, at 7:30 o'clock.
