1961-07-05 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD WEpNESDAY EVENING, JULY 5, ------- 1961 The meeting convened at 7:30 o'clock p.m. with President Collischonn presiding. The Fledge of 'Allegiance was led by Councilman Godfrey and was followed by an inspiring Invocation delivered by Rabbi Gunther Gates of Temple Israel. ROLL CALL: The roll was called and Councilmen Dungan, Godfrey, McCall, Schacht and President Collischonn, (5), were noted present. Absent: None. MINUTES: 1. The minutes of the regular meeting held June 20, and the special meeting held June 26, 1961, were approved as transcribed. WRITTEN COMUNICATIONS: 2. From Alameda-Contra Costa Transit District, dated June 26, 1961, and signed by Mr. George M. Taylor, Secretary, informing the Council that its inquiries concerning the status of proposed Sunday passes, reduced student fares and the bus routes and schedules in the west end of Alameda after the new Webster Tube is in use will come before the Board of Directors at its meeting to be held July 12, 1961. Two additional letters were also presented from the District, dated July 3, 1961, submitting supple- mental information on these subjects. It was determined that the City would he officially represented at said meeting by the City Manager, the City Engineer, the Mayor and any of the Councilmen who could attend. From Joint Alameda County Admission Day Committee, signed by Mr. J. Richard Maffei, Secretary, requesting an appropriation of $100. for the City's participation in the annual celebration which will be held in Long Beach on September 9, 1961. This matter was referred to the Alameda Chamber of Commerce for its action. 4. From Mrs. Corinne White, 1543-B Webster Street, in application for Permit to operate a News Vend- ing Stand in the sidewalk area at the southwest corner of Lincoln Avenue and Webster Street. The Permit is presently in the name of Mrs. Emily Powell. The application was laid over to the next regular meeting ef the Council inorder that investigation might be made of certain pertinent circumstances. 5. From South Shore Land Co., signed by Mr. Charles T. Travers, Vice President, requesting a sixty- day extension of time to September 15, 1961, in which to install improvements in Unit 11, Tract No. 1893, (West of Grand Street, South Shore Project). o. From South Shore Land Co., signed by Mr. Travers,,requesting an extension of time to December 31, 1961, in which to continue work on improvements in Unit III, Tract No. 1986, (Park Street to Broadway, South Shore Project). With reference to Tract No. 1890, it was suggested that more time would be needed for this work and consequently, Councilman Schacht moved the Council grant an extension of time which would expire,at the Council meeting immediately following ninety days from this date - on October 17, 1961 - and with. regard to Tract No. 1906, the extension of time would expire at the Council meeting of January 2, 1962. The motion was seconded by Councilman Dungan and carried on the following roll call vote. Ayes: Five. Noes: None. Absent: None. t/ 7. From Alameda Historical Society, signed by Mrs. Theodora T. Killinger, Secretary, submitting the following suggested names for the proposed State Beach-Park: La. Bolsa del Encinal; Encinal; Rancho San Antonio; Alameda; William W. Chipman. The matter was referred to 'New Business for further consideration. ORAL COMMUNICATIONS: 8. Mr. Joseph W. Sullivan, 3221 Liberty Avenue, addressed the Council on behalf of Mrs. John Stinson, 3225 Liberty Avenue, who had recently taken a Civil Service examination for a position with the City of Alameda. He argued that Mrs. Stinson had been discharged from her job because of having taken this test and contended the City was legally and morally liable due to its procedure in such matters and should use its best efforts to have her former job restored. The City .Attorney stated ,the City has no liability or responsibility in this question. It is a dis- pute between Mrs. Stinson and her previous employer, and does not concern business which should pro- perly come before the Council. 9. Mr. Frank Cottstein, 731 Haight Avenue, referred to the helicopter service in effect from San Francisco Airport and other points to Oakland and Berkeley. He suggested the Council, the City Manager and the Chamber of Commerce should investigate this matter as he felt this service would be advantageous to Alameda. 3"0 President Collischonn explained he had been in contact with the president of the corporation when this helicopter service was being inaugurated in Oakland and he had indicated that Alameda would most assuredly be interested in having such service established here. He stated he had invited the president to inspect available parcels of land in Alameda m6ichcould be used as a terminal. However, the president had told him the amount of "traffic" was the deciding factor. 0z. Gottsteiu was assured the matter would be pursued. lO. ' Nr. G. N. Pope, 1820 Bu? Street, referred to an article in The Wall Street journal which he felt would be of vital interest to the Councilmen. He was asked to furnish a copy of "How to Make a Pork Barrel" to the Clark, who would reproduce it for distribution. 11. Mr. Gottstein inquired about the matter of the road leading from Central Avenue to the beach area adjacent to Encinal High School which he had brought up at the last meeting. The City Engineer explained he was in the process of preparing a comprehensive map on the entire area. It was developed that the road and much of the tidelands in question are owned by the Alameda Unified School District. Mr. Annibale pointed up two serious problems - (1) the right of the City to expend public funds on improvement of private property and (2) if such is done, the City's liability to the traveling public. Ile suggested the Council withhold consideration of the subject until the complete reports have been submitted. HEARINGS: 12. The matter was called up concerning the Appeal filed by Mr. Robert C. Olsen from the decision of the Planning Board to deny certain variances pertaining to the construction of a fourplex on his prop- erty at 2630 Santa Clara Avenue. 0r. Schoenfeld, Planning Director, reviewed the history of this case before the Planning Board. Mr. Annibale stated the issues before the Council and quoted the criteria on which its decision should be based. Mr. Robert Olsen addressed the Council and emphasized that he was now willing to meet all requirements and the only variance he desired was to allow a three-foot encroachment into the side yard along Pearl Street for a diotunoe_of aenenty-eight feet for the fourplex he proposed to erect. A lengthy discussion ensued on the matter - it being pointed up that an old dilapidated building had been demolished and the new structure contemplated would be a great improvement to the neighborhood. Mr, Roger F. Thomas, owner of the abutting property at 1415 Pearl Street, also spoke in favor of the appellant. It was suggested that Mr. Olsen prepare more detailed plans of his building and appear once more before the Planning Board for its consideration when it would have more information available on the proposed structure. 0r. Olsen stated he had been waiting three months for a decision in this matter and he did not want to prolong it further. He desired that action be taken by the Council at this meeting and he would abide by the deoioibo. Inquiry was made as to there being any opponents to the Appeal. There was no response and the Presi- dent thereupon declared the Hearing closed. Councilman McCall then moved the Appeal be granted and the variance as shown in modified plan No. 2 be allowed. The motion was seconded by Councilman Dungan and it was lost by the following vote. Ayes: Councilmen Dungan and McCall, (2). Noes: Councilmen Godfrey, Schacht and President Collischonn, (3). Absent: None- REPORTS OF OFFICERS, BOARDS, ETCETERA: l31 From City Manager, recommending rejection of the one bid received for furnishing Automobile and Truck Tires and Tubes during 1961-02 - and that he be authorized to make necessary purchases of these items in the open market. 'Councilman Godfrey moved the recommendation be adopted; that the bid be rejected and the City Manager make said purchases as required. The motion was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes; Five. 0neo; Nnne, Absent: None. 14. From City Manager, recommending contract be awarded to Building Service Corporation, low bidder, for the project of Limited Janitorial Service during 1961-62, at the total cost of $1,722. Councilman Godfrey moved the recommendation be followed; that the contract be awarded to the speci- fied firm for the designated project at the price quoted— The motion was seconded by Councilman Schacht and carried on the following roll call vote. Ayes: Five. Noes: Rone, Absent: None. 4 15. From City Manager, recommending contract be awarded to Broadway Motors for furnishing one Dump Truck for the Golf Department at the price of $3,322.41, representing the le.west and best bid. Councilman Godfrey moved the recommendation be aCoepted; that contract be awarded to said firm for furnishing the specified vehicle at the price quoted. The motion was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. lu: From City Manager, reporting all work satisfactorily completed on the project of Resurfacing Marshall gay and Pacific Avenue from Fifth Street to Main Street - recommending it be accepted and the Notice of Completion be ordered filed. Councilman Godfrey moved the recommendation be adopted; that the work on the specified project be accepted and the Notice of Completion be filed. The motion was seconded by Councilman Schacht and unanimously carried— ^/ l7« From City Attorney, relating to the compromise of a claim of United Pacific Insurance Company against City of Alameda in the amount of $5,462^58, pertaining to the default of its insured, Manuel Marques, Jr,, on a sewer contract with the City. It was recommended the compromise be authorized and the City Auditor he directed to pay United Pacific Insurance Company the sum of $I,536.11 in satis- faction of all claims against the City of Alameda. Councilman Godfrey moved the recommendation be approved and the Auditor be directed to pay the speci- fied sum in settlement of the claim. The motion was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. l8./ From City Manager, requesting aypruval of the recommendations of the Advisory Golf Commission for the expenditures to be made from the Golf Course Improvement Reserve during 1961-02^ in the total sum of $43,535. Councilman Godfrey moved the request be granted and the recommendations of d`e.''Coomioaion° for the specified expenditures be approved. From Auditor-Assessor, submitting the new assessment values of the City of Alameda for 196I-02 and showing the estimated valuation for the tax rate basis as $60,224,453. The communication was noted and ordered filed. 2U.` From City Planning Board, signed by the Secretary, requesting an additional thirty-day period in which to act on the review of a proposed change in the Zoning Ordinance relating to the twelve-unit limit in a building in the D-5I}iytrict. Councilman Godfrey moved the request be granted and an extension of time be allowed as requested for said purpose. The motion was seconded by Councilman Schacht and unanimously carried. "/ 21. From City Clerk, informing the Council of the following appointments to the Youth Activities Com- mittee by Councilman Schacht: Messro, Ashley 0. Jones, 1.040 Fair Oaks Avenue; U. E. North, 1216-A Ninth Street; and James L. Nolin, 1106 Park Avenue. The communication was noted and ordered filed. INTRODUCTION OF ORDINANCES: 22. Councilman McCall introduced the following ordinance, after which it was laid over under provi- sion of law and the Charter: "Ordinance No. New Series An Ordinance Amending the Alameda Municipal Code by Repealing Subdivision (28) of Section 17'342, Relating to Two-Hour Parking, and Adding Subdivision (26) to Section, 17-333, Relating to All Time No Parking." (Oak Street and Clement Avenue) 23. Councilman Schacht introduced the following ordinance, after which it was laid over under provi- sion of law and the Charter: "Ordinance No. New Series An Ordinance Amending the Alameda Municipal Code by Adding Subdivision (12I) to Section 17-432 Thereof, Relating to Stop intersections (Oak and Clement)." 24. Councilman Dungan introduced the following ordinance, after which it was laid over under provi- sion of law and the Charter: . "'Ordinance No. _ New Series An Ordinance Amending the Alameda Municipal Code by Repealing Subdivisions (2), (3), (4), (5) and (6) of Section 17-581 Thereof, Relating to Prima Facie Speed Limits, and Subdivisions (2), (3), (4) and (5) of Section 17-582 Thereof, Relating to the Erection of 35 Niles Per flour Speed Limit Signs (South Shore Area)." D0FI 8ED BUSINESS: 25. The matter was presented with regard to standards for construction of private swimming pools. Reference was made to the memorandum of June 30, 1961, from Mr. Weller, including a memorandum dated June 20` I961, from Mr. Annibale, submittingtheir views pertaining to the "Proposed Regulations for Private, Non-Commercial Swimming Pools', dated October 24, I960, as approved in principle by the City Planning Board at that time. It was pointed out the matter of "Permits and Approval of Plans" are adequately provided for under existing laws and regulations. The opinion was expressed that regulations pertaining to "fencing and lighting" should not be established. The question of "setbacks' is one which the Planning Board could initiate on its own motion as an amendment to the Zoning Ordinance. The Council indicated its concurrence with the report of Messrs. Waller and Annibale on this subject and the City Clerk was instructed to inform the Planning Board of this thinking and that if it so desires, it may initiate proceedings to amend the Zoning Ordinance relative to swimming Tool setbacks. 26. The question was then submitted concerning the "Fire Boat service rendered by the City of Oakland. Again, reference was made to a memorandum from Mr. Weller, dated June 20, 1961, in which it was pointed out the City of Oakland is in no position to guarantee such service if it should be needed. In any event, he didnot'6eliene the expenditure of $18.000, annually was justified as the City's contribution toward the cost of operation and maintenance of said Fire Boat. Mr. Weller also verbally explained several aspects of the subject for the Council's complete under- standing. Following considerable discussion of the circumstances, Councilman Godfrey moved the City Manager inform the City of Oakland the City of Alameda is not in favor of participating in the cost of the Fire Boat, for the main reason that there is no assurance the Fire Boat could give service when actually needed. The motion was seconded by Councilman Schacht and carried on the following roll call vote. Ayes: Five. Noes: None. Absent: None. NEW BUSINESS: 27. The matter of recommending a name for the proposed State Beach Park was next considered. It was developed that information had been received from the Division of Beaches and Parks that the State Park Commission was to take action on this matter at its meeting to be held July 21, 1961, and any suggestions should be sent to it prior to July 10. Mrs. Ethel Jaan Kibbe, 510 Central Avenue, addressed the Council on behalf of a group of interested citizens and suggested the name of The Golden Ray State Beach Park". The opinion was expressed that there was no great urgency in deciding upon a name for this recrea- tional facility and it might be well to encourage suggestions from the local citizenry-- within the limitations that the beach-park not be named after any individual, living or dead, and the namu be identified with the City of Alameda. Following considerable discussion, Councilman Schacht moved the Division of Beaches and Parks be requested to postpone action ,for sixty days with regard to selecting a name for the park development in the City of Alameda in order that interested citizens might submit suggestions - but in the event deferment cannot be granted, the City Council tentatively recommends the name of "Alameda State Beach-Park'. The motion was seconded by Councilman Godfrey and unanimously carried. The support of the Press was solicited in publicizing the desire of the Council for names to be sub- mitted by any interested citizen or organization. � 28. Attention was called to a recent bulletin from the League of California Cities quoting House Resolution No. 365, Relative to Steps Leading .to and from Public Buildings. It was urged that said steps be marked with a border on the leading edge to assist elderly or handicapped people in ascend- ing and descending. The City Engineer was requested to make a cost estimate of performing this work and submit it to the Council. RESOLUTIONS: 29. The following resolution was introduced by Councilman Schacht, who moved its adoption: "Resolution No. 6251 Resolution of the Council of the City of Alameda Adopting Specifications for Furnishing to the City of Alameda Quick Coupling Valves and Couplers for the Golf Course, Calling for Bids and Directing City ..Clerk to Advertise Same.' The motion to adopt said resolution was seconded by Councilman Dungan and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None- 30. The following resolution was introduced by Councilman Schacht, who moved its adoption: "Resolution No. 6252 Resolution of the Council of the City of Alameda in Appreciation and Commendation of Wallace D. Miracle for His Laudable Service to the City of Alameda." (Library Board) The motion to adopt said resolution was seconded by Councilman Dungan and on roll call carried by the following vote. The following resolution was introduced by Councilman Schacht, who moved its adoption: "Resolution No. 6253 Resolution of the Council of the City of Alameda in Appreciation and Commendation of Louis D. Gordon for His Excellent Service to the City of Alameda."' (Library Board) The motion to adopt said resolution was seconded by Councilman Dungan and on roll call carried by the following vote. The following resolution was introduced by Councilman Schacht, who moved its adoption: "Resolution No. 6254 Resolution of the Council of the City of Alameda in Appreciation and Commendation of James A. Quinn for His Noteworthy Service to the City of Alameda." (Civil Service Board) The motion to adopt said resolution was seconded by Councilman Dungan and on roll call carried by the following vote— Ayes: Five. Noes: None. Absent: None. 33. The following resolution was introduced by Councilman Schacht, who moved its adoption: "Resolution No. 6255 Resolution of the Council of the City of Alameda in Appreciation and Commendation of Stuart B. Stephens for His Fine Service to the City of Alameda." (Board of Education) The motion to adopt said resolution was seconded by Councilman Dungan and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. 34. The following resolution was introduced by Councilman Schacht, who moved its adoption: "Resolution No. 6256 Resolution of the Council of the City of Alameda Authorizing Execution of Agreement with Charles E. Foster, Subdivider, in Matter of Completion of improvements Relating to That Certain Record of Survey Map Approved by the Council on May lb, 1961. (Buena Vista Avenue, east of Fifth Street)."' The motion to adopt said resolution was seconded by Councilman Dungan and on roll call carried 'by the following vote. Ayes; Five. Noes: None. Absent: 0one, The President thereupon declared all of the foregoing resolutions duly adopted and passed. FILING: 35. Specifications and Provisions No. BS 7-61-12 - Valves and Couplers for Golf Department. BIL�S; i --- 36. An itemized List of Claims against the City of Alameda and the Departments thereof, in the total amount of $28,209^43, was presented to the Council at this meeting. The List was accompanied by certification. from the City Manager that the Claims shown were correct. Councilman Schacht moved the bills as itemized in the List of Claims filed with the City Clerk on July 5, 1961, and presented to the. Council at this meeting, be allowed and paid.
