1961-10-17 Regular CC Minutes�� �� � & � Y� REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, OCTOBER 17, 1961 The meeting convened at 7:30 o'clock P.M. with President Collischonn presiding. The Pledge of Allegiance was led by Councilman McCall and was followed by a most inspiring Invocation delivered by The Reverend David Biles, Assistant Pastor of Santa Clara Avenue Methodist Church. ROLL CALL: The roll was called and Councilmen Godfrey, McCall, Schacht and President Collischonn, (4), were noted present. Absent: Councilman Dungan, (1). MINUTES: 1. The minutes of the regular meeting held October 3, and the special meeting held October 11, 1961* were approved as transcribed. WRITTEN COMMUNICATIONS: v 2. From Mrs. Helen Freeman, 831 Laurel Street, requesting a cony of the consensus and determination re the adjudication of the title and use of Alameda's salt marsh, tide and submerged lands as provided under the California Statutes of 1911 and 1913, as amended 1917. The President stated the City Council is satisfied with the opinion expressed in the past, and more recently at the meeting of September 5, by the City Attorney that the Council has no power to adjudi- cate title to real property. Therefore, if this matter is to be pursued further by Mrs. Freeman, the City Attorney can advise her of the procedure she must take in the future. The subject is closed insofar as the City Council is concerned. Mr. Annibale offered to respond to Mrs. Freeman's letter and � ]. From the Redevelopment Agency of Alameda, signed by Mr. the City Council officially approve the proposed Program for the members of the Citizens Advisory Committee for Community it was so ordered. Marshall S. Pease, Chairman, recommending Community Improvement - and also, name Improvement" These matters were referred to "Resolutions" and the item appearing on the agenda later in the meeting, respectively. 4. ". From the Seventh-Day Adventist Church, signed by The Reverend John A. Dewald, Pastor, and The Reverend Ralph Larson, Evangelist, requesting permission to erect a tent near the southwesterly corner of Webster Street and Central Avenue, in which to hold evangelistic meetings beginning October 28, and ending November 18, 1961. Councilman Schacht moved permission be granted to this Church to conduct evangelistic services during the specified period, subject to the observance of all requirements of the Police and Fire Departments and the City Manager. The motion was seconded by Councilman Godfrey and cartied on the following roll call vote. Ayes: Four. Noes: None. Absent: Councilman Dungan, (1). �� �: From South Shore Land Co., signed by Mr. Travers, Vice President, requesting an extension of time in which to commence improvements in Tract No. 1898, South Shore Unit No. II (West of Grand Street). Councilman Schacht moved the request be granted and the extension of time for beginning said project expire ninety days hence - or on January 10, 1962. The motion was seconded by Councilman Godfrey and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Dungan, (1). ORAL COMMUNICATIONS: 6. Several persons requested permission to speak on certain subjects as they came before the Council later on the agenda. This was granted. REPORTS OF OFFICERS, BOARDS, ETCETERA: 7. From City Manager, recounmending contract be awarded to Gallagher & Burk, Inc., low bidder, for the project of Paving the Golf Course Parking Lot, at the total cost of $8,087. Councilman McCall moved the recommendation be adopted; that contract for the specified project be awarded to the designated firm at the total price quote6. The motion was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Dungan, (l)^ 8. From City Planning Board, signed by the Secretary, recommending the amendment of Section 11-14A7 of Zoning Ordinance No. 1277, New Series, by adding Subsection (n) thereto - relating to Patio Covers. 9. From City Planning Board, signed by the Secretary, recommending the removal of the 'PI)" (Planned Development) classification from the R-6-PD Zone in Unit No. III of the South Shore Project. The date of Hearing on the two foregoing recommendations was set for the Council meeting to be held November 7, 1901. 10 From City Planning Board, signed by the Secretary, concerning-the need for extending Sixth Street from Pacific to Buena Vista Avenue - and zeconxnendina the Council give thought to the possible acquioi- `' —~~~~^ 402 tion of the land as shown on the map entitled, "Study of Acceoanaya into Chipman Project", before this area is developed. As requested, Mr. Vernon A. Bartels, 601 Pacific Avenue, addressed the Council, expressing his opposition to any proposed extension of Sixth Street from Pacific to Buena Vista Avenue. Mr. Joseph Bruzzone, 350 Forest Street, Oakland, owner of several parcels of property in this imme- diate area, also registered his opposition to said extension. He pointed up its detrimental effect upon his recently constructed apartment house and his plans for erecting two more multiple dwellings on adjacent properties. Upon their request, both Messrs. Bartels and Bruzzone will receive notification of any uture meet- ings at which this matter is to be considered. The proposal and recommendation of the Planning Board was referred to the City Manager to have cost and feasibility studies made and a report submitted to the Council at a later date. Councilman McCall also suggested Mr, Weller ascertain from the Board of Education the exact site it might have in mind for another school in this area, if and when conditions warrant it. J 11. From City Manager, recommending an extension of time of twenty working days be granted to�_ Gallagher & Burk, Inc. for completion of its contract for the Reconstruction and Resurfacing of Buena Vista Avenue from Park to Grand Street. Councilman Godfrey moved the recommendation be accepted and the extension of time be granted as requested. The motion was seconded by Councilman Schacht and unanimously carried. � lZ. From City Manager, recommending authorization be given to purchase in the open market one Radar Unit for the Police Department, in conformity with Section 3-15 of the City Charter. Councilman Schacht moved the recommendation be approved and the purchase of said equipment be made without formal contract on the finding that this item can be bought at a more economical price in this manner. The motion was seconded by Councilman Godfrey and carried on the following roll call vote. Ayes: Four. Noes: None. Absent: Councilman Dungan, (1). INTRODUCTION OF.ORDINANCES: 13. Councilman McCall introduced the following ordinance, after which it was laid over under provi- sion of law and the Charter: "Ordinance No. New Series An Ordinance Amending the Alameda Municipal Code by Adding Subdivisions (122), (123) and (124) to Section 17-432 Thereof, Relating to Stop Intersections (Noble, Crist and Chester Streets at Broadway)." NEW BUSINESS: 14. Councilman Godfrey spoke of the traffic hazard prevailing at the north,end of Sherman Street due to the railroad crossing at this location and the increased number of automobiles now traveling into this area. Be felt a dangerous situation exists here and suggested the City Manager have the Advi- sory Traffic Committee investigate and report on.smna kind of remedial traffic controls. The President also felt there should be some lighting provided for this entrance to the Estuary developments and asked the City Manager to explore this phase of the situation. Mr. Weller explained that in connection with both of these circumstances there are substantial legal problems involved, but stated he would proceed to check into the mutter. RESOLUTIONS: 15^ The following resolution was introduced by Councilman Schacht, who moved its adoption: "Resolution No. 6280 Resolution of the Council of the City of Alameda Adopting Specifications , for Furnishing to the City of Alameda New, Latest Model, 1962 'Compacts', Five (5) Two-Door Sedans; One (1) Four-Door Sedan; and One (1) Four- Door Station Wagon, with Standard Transmission, Calling for Bids and Directing City Clerk to Advertise Same." The following resolution was introduced by Councilman Godfrey, who moved its adoption: "Reoolutibn No. 6281 Reaolutivn of the Council of the City of Alameda Creating Citizens Advisory Committee for Community Improvement and Prescribing Powers and Duties Thereof." The motion to adopt said resolution was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Four. Noes: None. The following resolution was introduced by Councilman Godfrey, who moved its adoption: "Resolution No. 6282 Resolution of the Council of the City of Alameda Approving Program for Community Improvement (Workable Program)." The motion to adopt said resolution was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Dungan, (1). Mr. G. N. Pope, 1820 Bay Street, 'submitted several questions concerning the subject matter of the two foregoing resolutions which were clarified for his information. 18,« At this point, Mr. Pope also referred to a sign on the northeast corner of Sherman Street and Buena Vista Avenue which completely blocks the view of drivers going south on Sherman Street from the oncoming cars traveling west on Buena Vista Avenue. He felt this was a hazardous condition. The President requested the City Engineer to take appropriate action to correct this situation. 19, The following resolution was introduced by Councilman Godfrey, who moved its adoption: "Resolution No. 6283 Resolution of the Council of the City of Alameda Adopting Specifications, Special Provisions and Plans for Construction of a Passenger Loading Area on Atlantic Avenue Easterly of Main Street, Calling for Bids and Directing City Clerk to Advertise Same." The motion to adopt said resolution was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Dungan, (1). 20. The following resolution as introduced by Councilman Godfrey, who moved its adoption: � . "Resolution No. 6284 Resolution of the Council of the City of Alameda Designating a Portion of Fernside Boulevard, Within the City of Alameda, as a Major City Street." The motion to adopt said resolution was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Dungan, (1). 21. The following resolution was introduced by Councilman Godfrey, who moved its adoption: "Resolution No. 6285 Resolution of the Council of the City of Alameda Authorizing the Acquisition of Certain Real Property for Street, Highway, Sewer and General Municipal Purposes (3. E. Corner Fernside Boulevard and Encinal Avenue)"" The motion to adopt said resolution was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Dungan, (1). The President thereupon declared all of the foregoing resolutions duly adopted and passed. 22+ At this time, the President presented the names of the following persons to comprise the member- ship of the Citizens Advisory Committee for Community Improvement, for approval by the Council: Donald Bruzzone, Eleanor Clark, Sidney Dowling, Sr., Everett E. Farwell, Jr., Russell J. Franck, Rabbi Gunther Gates, Sumner M. Graham, Alton S. Lee, William M. Smock, J. Douglas Stevens, Michael Iilleo, Robert L. Veres, Ernest Wade' Ella May Waterbury and Henry J. Rodriguez. Councilman Godfrey moved the persons named as members of this Committee be confirmed. The motion was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Dungan, (1). The President then appointed Mr. Sumner M. Graham as Chairman of said Committee pending its official organization, at which time the members will select a Chairman. approval: Rabbi Gunther Gates, Ernest Wade, Donald Bruzzone, Henry J. Rodriguez and Sumner M. Graham. Councilman Schacht moved the Council approve the membership of the Sub-Committee as named by the President and also the appointment of Mr. Graham as the Temporary Chairman of the Citizens ' Advisory Committee. The motion was seconded by Councilman Godfrey and carried on the following roll call vote. Ayes: Four. Noes: None. Absent: Councilman Dungan, (1). ORDINANCES FOR PASSAGE: 23" "Ordinance No. 139I, New Series An Ordinance Reclassifying and Rezoning Certain Property Within the City of Alameda by Amending Zoning Ordinance No. 1277, New Series." Ayes: Four. Noes: None. Absent: Councilman Dungan, (1). FILING: 24. Auditor's Financial Statement - City of Alameda, as of September 30, 1961. 25° Specifications and Provisions No. MS 10-61-14 - Furnishing Five Two-Door, One Four-Door "Compact" Sedans and One Four-Door "Compact" StutionWagoo, with Standard Transmission. 26. Specifications, Special Provisions and Plans No. PR 10-01-17 - Construction of Passenger Loading Area on Atlantic Avenue easterly of Main Street. . 27. Program for Community Improvement. BILLS: 28. An itemized List of Claims against the Cit}, of Alameda, and the Departments thereof, in the total amount of $80,703.11, was presented to the Council at this meeting. The List was accompanied by certification from the City Manager that the Claims shown were correct. Councilman Schacht moved the bills as itemized in the List of Claims filed with the City Clerk on October 17, 1961, and presented to the Council at this meeting, be allowed and paid. The motion was seconded by Councilman Godfrey and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Dungan, (1). 29. At this point, Councilman McCall spoke of the death of The Most Reverend John J. Mitty, Arch- bishop of San Francisco, and requested that the Council adjourn this meeting in respect to the memory of this dedicated and devout leader. He asked that The Reverend Father Alvin P. Wagner, The Reverend Aloys G. Selhorst and The Reverend Father Patrick J. O'Brien be notified of this action by the City Council. � 30. 3°. Dpoo request, Councilman McCall announced that a meeting would be held the next evening, Wednes- day, October 18, in the Council Chamber at 8:00 o'clock, of all those people who participated with the Naval Air Station group in a trip to Lidingo, Sweden, Alameda's Sister-City. A film would be shown and there would also be present a number of couples who made a trip to Lidingo during the past summer. There would be interesting reports and representatives from other cities were planning to attend to learn about the Sister-City Program. Councilman McCall stated he expected to be able to make a good report on this Program at the special meeting of the League of California Cities on Sunday, October 22. ADJOURNMENT: 31. President Collisohoon called up the meeting for a moment of silence in respect to the memory of The Most Reverend John J. Mitty, Archbishop of San Francisco. There being no further business to come before the meeting, the Council adjourned - to assemble in regular session on Tuesday evening, November 7, 1961, at 7:30 o'clock. Respectfully submitted,
