1961-11-07 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMED& HELD TUESDAY EVENING, NOVEMBER 7, - - - - - - - 1961 The meeting convened at 7;30 o'clock p.m. with President Collischonn presiding. The Pledge of Allegiance was led by Councilman Dungan and was followed by an inspiring Invocation delivered by The Reverend Father A. G. Selhorst, Pastor of St. Darnoboe Church. ROLL CALL: The roll was called and Councilmen Dungan, Godfrey, McCall, Schacht and President Collischonn, (5), were noted present. Absent: None. 1. The minutes of the regular meeting held October 17, 1961, ,sere approved as transcribed. WRITTEN C0NNDNICAZZO0S: 2^ From Alameda County Board of Supervisors, submitting a copy of a letter from the State Commander of Disabled American Veterans concerning the establishment of National Cemetery in Alameda County and requesting a report and recommendation from the City Council. There being no objections, the matter was to be referred to the Alameda County Mayors' Conference for review prior to action by the Council. ]. V From Alameda County Board of Supervisors, submitting its resolutions with regard to family fall- out shelters - and recommending the City adopt the County regulations, with such modifications as may he necessary to meet local needs. The City CIerk~ae asked to acknowledge this .communication, informing the Board of Supervisors that Alameda intends to maintain the greatest degree of uniformity possible County-wise in connection with shelter requirements. n 4, From Bay Farm Island Improvement League, signed by Mr. Robert E. De Celle, Chairman of Airport Easement Committee, concerning air easements over the properties of approximately sixty-five residents on Bay Farm Island. It was believed the granting of such easements would depreciate the property values and, ultimately, necessitate the reduction of assessments for property tax purposes. The matter was referred to the City Attorney for explanatory reply to the League. 5. 7 From Island City Gun Club, Inc., in Application for Permit to Fill Property on Maitland Drive, by dozing 30,000 cubic yards of dirt from trucks. The application was accompanied by a bond- in the amount of Five Thousand Dollars, which had been approved by the City Attorney and signed by the Mayor. Councilman Schacht moved the permit be granted to said Club to fill the property as described. The motion was seconded by Councilman Godfrey and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. � 6. From Alameda Woman's Improvement Club, Inc., signed by Mrs. L. Benedetti, Recording Secretary, recommending that benches be replaced at the corner of Santa Clara, Avenue and Ninth Street for the convenience of bus passengers s - and also requenting that the hazardous traffic situation at the inter- section. of Central Avenue and Ninth Street at peak hours be remedied. It being agreeable, the President asked the Clerk to convey the request for the bench restoration at the designated corner to the Alameda-Contra Costa Transit District for its consideration - and referred the mutter of the traffic condition to the City Manager for his investigation and report. v/ 7. From Mrs. Donald Nelson, President, Frank Otis School P. I. A., requesting that the City install sidewalks, curbs and gutters at least along Calhoun Street between Court and Mound Streets to remedy, on behalf of the children, the unsafe and unhealthy conditions in the area of-the School. ' - It was suggested this matter be referred to the City Engineer for a study and report on the estimated cost of constructing said improvements in the whole area involved. The Clerk was instructed to so inform the P. I. A. in acknowledging its letter. ORAL COMMUNICATIONS: 8, Mr. Manuel de Cruz, 334 Beach Road, referred to the letter from the Bay Farm Island Improvement League with regard to the air easements requested by the Port of Oakland from sixty-five property owners in this area. Mr. de Cruz solicited the aid of the City Council in taking whatever action might be deemed necessary to protect the residents from the contemplated condemnation proceedings to obtain these easements if they are not granted through negotiations. Following considerable discussion. of the situation, during which it was pointed out that the City of Alameda has no legal jurisdiction or position in this matter, Mr. de Cruz was advised to make an appointment with the City Attorney to discuss the circumstances and have the subject fully explained. 9. 8r. Frank Gottstein, 721 Haight Avenue, spoke of the attempt by the Plumbers to have the Plumbing Codes of the several East Bay cities made uniform in order to avoid confusion and misunderstanding of the various regulations. He also felt the Inspectors of Alameda should be available in the City Hall at 8:00 o'clock a.m., as they are in other nearby cities, for the convenience of contractors. The City Engineer was asked to check into this mutter. 10. Mrs. Drex L. Smith, 219 Beach Road, referred to the matter of the requested installation of sidewalks, curbs and gutters in the vicinity of Frank Otis School. She also cited a letter from Mr. Weller dated July 3, 1961, containing estimates of cost of such improvements, and giving the proportionate costs to the City, the School Diatrictan6 the property owners affected. Mrs. Smith pointed out this would be quite expensive and stated the P. I. A. group was now requesting the construction of only the sidewalk along one side of Calhoun Street between Fillmora and Mound Streets, for the benefit of the children who now have to walk in the mud during rainy weather. Messrs. Weller and Hanna explained the details involved in the overall improvements contemplated for this entire area - and it was pointed up that it would be inadvisable to install them piecemeal. HEARINGS: 11. The matter was called up concerning the proposed amendment of Section 11-14A7 of the Alameda Municipal Code (Zoning Ordinance No. 1277, New Series), by adding Subsection (n) relating to Patio Covers. The Clerk stated the Affidavit of Publication was on file, covering the Notice of Hearing in this case. Copies of all pertinent data in the mutter had been furnished the Councilmen and the Planning Board had recommended said amendment. Messrs. Schoenfeld, Planning Director, and Annibale, City Attorney, submitted further information on the subject. Upon inquiry by the President, there were no proponents or opponents who desired to speak in the mutter. The President thereupon declared the Hearing closed. Councilmon'Sohacbt then moved the recommendation of the City Planning Board to amend said section of the Alameda Municipal Code be approved. The motion was seconded by Councilman Godfrey and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. The matter was then referred to "Introduction of Ordinances". 12. The matter was called up with regard to the proposed reclassification of certain real proper- ties in the area bounded roughly by the „north line of the lagoon, centerline of Broadway, centerline of Shore Line Drive and centerline of Park Street, from the R-6-PD, Hotel-Apartment Planned Develop- ment District, to the R-6, Hotel-Apartment District. The Clerk stated the Affidavit of Publication was on file, covering the Notice of Hearing in this action. Also, copies of all relative data had been sent to the Councilmen for their information~ The Planning Board had recommended said reclassification. Messrs. Schoenfeld and Annibale then presented explanations of the situation. The President called for proponents and opponents and there was no response, per se. However, Mr. G. N. Pope inquired concerning what change in density, if any, would result from this reclassification. Mr. Schoenfeld stated it would not necessarily increase the density in this particular area. The President then declared the Hearing closed and Councilman Schacht thereupon moved the recmmnenda- tinu of the Planning Board be adopted and the area described be reclassified from the R-6-PD to the R-6 District. The motion was seconded by Councilman McCall and carried on the following roll call vote. Ayes: Five. Noes: None. Absent: None. The matter was then referred to "Introduction of Ordinances". REPORTS OF OFFICERS, BOARDS ETCETERA: 13. From City Planning Board, signed by the Secretary, recommending approval of Property Division Map filed by Mrs. Bertha S. Bechtle covering her property located on the southeast corner of Pearl Street and Fernside Boulevard. Councilman Schacht moved the Board's recommendation be adopted and said Property Division Map be approved as submitted. The motion was seconded by Councilman McCall and carried on the following roll call vote. Ayes: Five. Noes: None. Absent: None. 14V l4v From Youth Activities Committee, signed by Mr. Herbert M. Robles, Chairman, submitting its report on the general situation of juvenile violence and acts of anti-Semitism. The President directed that the report be acknowledged with thanks and filed. V 15. From City Manager, recommending and requesting that repair of the storm water pump north of Buena Vista Avenue, at a total cost of $1,219.67, be authorized under provisions of Section 3~15 of the City Charter, encompassing great necessity or emergency. ` Councilman McCall moved the recm/xendation be approved and the request be granted to have the neces- sary emergency repairs made to the specified pump at the cost quoted. The motion was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. 16. From City Manager, reom/^xendiog contract be awarded to Gallagher & Burk, Inc., low bidder, for the project of Constructing a Passenger Loading Area on Atlantic Avenue easterly of Main Street, at a total cost of $3,769. The necessity of this construction was questioned by Councilman Godfrey. Upon request, mr. Hanna explained the circumstances. Following considerable discussion of the several aspects of the situa- ����� � ���� tion, Councilman Godfrey moved the matter be laid over to the next meeting of the Council for further consideration. The motion was seconded by Councilman Schacht and unanimously carried. The President suggested the City Manager contact the proper Naval authority to obtain its reaction to the City's desire to restrict parking in this immediate vicinity altogether. The City -ngineer was also asked to furnish a sketch of the proposed project. INTRODUCTION OF ORDINANCES: 17. The following ordinance was introduced by Councilman Scbocbt,'after which it was laid over under provision of law and the Charter: "Ordinance No. , New Series An Ordinance Amending Section 11-14A7 of the Alameda Municipal Code by Adding Thereto Subsection (n) Relating to Patio Covers."' 18. The following ordinance was introduced by Councilman Dungan, after which it was laid over under provision of law and the Charter: "Ordinance 0o. New Series An Ordinance Reclassifying and Rezoning Certain Property Within the City of Alameda by Amending Zoning Ordinance No. 1277, New Series." (Area bounded by Lagoon, Broadway, Shore Line Drive and Park Street - from R-6-PD to R-6 District) 19. The following ordinance was introduced by Councilman Godfrey, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending the Alameda Municipal Code by Adding Sections 17-585 and 17-586 Thereto, Relating to Prima Facie Speed Limits (Tilden Way - 35 M.P.H.)" 20. The following ordinance was introduced by Councilman McCall, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending Title III, Chapter 1, Article 1, of the Alameda Municipal Code and Ordinance No. 1183, New Series, of the City of Alameda, Effecting Changes in Said Code and Ordinance Required by 1961 Amendments to Uniform Local Sales and Use Tax Law of the State of California." 2l. At this point, Councilmen McCall referred to the ordinance relating to the increased speed limit on Tilden Way and stated he believed the riding of bicycles along this route should be prohibited because of the potential danger. He also pointed out many bicycles do not have lights or reflectors on them for night use, as required by ordinance, and he felt these regulations should be enforced. Following some discussion, the City Attorney was directed to prepare an ordinance for introduction at the next meeting which would prohibit bicycle traffic on Tilden Wuy, UNFINISHED BUSINESS: `/ 22" Councilman McCall inquired what progress is being made toward the renovation or demolition of old dilapidated houses. Mr" Neil Clark reported that the Inter-Departmental Housing Committee meets once a month and due to the necessity of inspections and legal procedures, this project is a rather slow process. However, two such structures have already been demolished and the Committee is pre- sently working on two others and will continue in this respect as cases arise. 23.», Councilman McCall also asked what the current status was with regard to the Memorial State' Beach-Park development and Mr. Weller explained the situation. RESOLUTIONS: 24. The following resolution was introduced by Councilman Schacht, who moved its adoption: "Resolution No. 6286 Resolution of the Council of the City of Alameda Adopting Specifications for Furnishing to the City of Alameda One (1) New, Latest Model, Self Contained, Power Propelled Traffic Line Marker for Street Department, Calling for Bids and Directing City Clerk to Advertise Same." The motion to adopt said resolution was seconded by Councilman Godfrey and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. 25.` "Resolution No. Resolution of the Council of the City of Alameda Adopting Specifications for Furnishing to the City of Alameda Two (2) New, Latest Model, 1962 Foor,Dour Eight-Cylinder Sedans with Automatic Transmission, Calling for Bids and Directing City Clerk to Advertise Same."' There was some question about the need for one of these automobiles and, after considerable discus- sion, Councilman Godfrey moved the resolution be laid over to the next meeting in order to obtain further information on the subject during the interim. The motion was seconded by Councilman Schacht and unanimously carried. 26. The following resolution was introduced by Councilman Godfrey, who moved its adoption: "Resolution No. 6287 Resolution of the Council of the City of Alameda Adopting Specifications, Special Provisions and Plans for Construction of Arch Culverts on Lincoln Avenue from Everett Street to High Street, Calling for Bids and Directing City Clerk to Advertise Same." The motion to adopt said resolution was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. 27. The following resolution was introduced by Councilman Schacht, who moved its adoption: "Resolution No. 6288 Resolution of the Council of the City of Alameda of Intention to Order the Vacation of a Portion of Powell Street, in the City of Alameda (Between Oak Street and Park Street)." The motion to adopt said resolution was seconded by Councilman McCall and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. 28. Councilman Godfrey introduced the following resolution and moved its adoption with the under- standing that if one of the present members of the Engineering Staff becomes qualified for promotion, his vacated position as a Senior Engineering Aide will not be filled with additional personnel: "Resolution No. 6289 Resolution of the Council of the City of Alameda Amending Salary Resolution No. 6233 by Creating One Additional Position of Senior Engineering Aide in the Engineering Department." , The motion to adopt said resolution was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. The President thereupon declared all of the foregoing resolutions duly adopted, with the exception as indicated. ORDINANCES FOR PASSAGE: 29. "Ordinance No. 1392, New Series An Ordinance Amending the Alameda Municipal Code by Adding Subdivisions (122), (123) and (124) to Section 17-432 Thereof, Relating to Stop Intersections (Noble, Crist and Chester Streets at Broadway)." Councilman Godfrey moved the ordinance be passed as submitted. The motion was seconded by Council- man McCall and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: 0nna, FILING: 30. Financial Statement - Bureau of Electricity, as of September 30, 1961 - Verified by Backlenxxn & Larzelere. 31. Specifications and Provisions No. MS 11-61-16 - Traffic Line Marker for Street Department. 32. Specifications, Special Provisions and Plans No. PW 11-61-18 - Construction of Arch Culverts on Lincoln Avenue from Everett Street to High Street. BILLS: 33. An itemized List of Claims against the City of Alameda and the Departments thereof, in the total amount of $51,522.48, and a supplementary List in the amount of $1,219.67, were preneuted to the Council at this meeting. The Lists were accompanied by certification from the City Manager that the Claims shown were correct. Councilman Schacht moved the bills as itemized in the Lists of Claims filed with the City Clerk on 0ovehber 7, I961, and presented to the Council at this meeting, be allowed and paid. The motion was seconded by Councilman Godfrey and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. 34.
