1961-12-19 Regular CC Minutes4123 REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, DECEMBER 19, 1961 The meeting convened at 7:30 o'clock p.m. with President Collischonn presiding. The Pledge of Allegiance was led by Councilman McCall and was followed by an inspiring Invocation delivered by The Reverend Mr. H. W. Van Delinder, Pastor of First Presbyterian Church. ROLL CALL: The roll was called and Councilmen Dungan, Godfrey, McCall, Schacht and President Collischonn, (5), were noted present. Absent: None. MINUTES: 1. The minutes of the regular meeting held December 5, and the adjourned regular meeting held December 12, 1961, were approved as transcribed. WRITTEN COMMUNICATIONS: 2. From Mr. E. R. Guthrie, 1907 Willow Street, requesting permission to construct an eight-foot fence on his property. It was agreed this matter would be laid over to the next meeting in order that additional informa- tion could be obtained concerning the situation. ORAL COMMUNICATIONS: 3' G. N. Pope, 1820 Bay Street, spoke about the cost of upkeep of the Alameda Swim Center and stated he had not heard any estimates given concerning the maintenance of the proposed Encinal High School Swimming Pools. REPORTS OF OFFICERS, BOARDS, ETCETERA: 4." From City Manager, reporting all work satisfactorily completed on the project of Constructing a Storm Sewer on Fernside Boulevard between Cambridge and Moreland Drives - recommending it be accepted and the Notice of Completion be ordered filed. Councilman Godfrey moved the recommendation be adopted; that the work on said project be accepted and the Notice of Completion be ordered filed. The motion was seconded by Councilman Schacht and carried on the following roll call vote. Ayes: Five. Noes: None. Absent: None. From City Manager, recommending contract be awarded to Mr. Pete Alexander, sole bidder, for the Operation of Refreshment Concession in Several Parks and on South Shore Beach, for the two-year period ending December 31, 1963, at six per cent of monthly gross receipts with a minimum payment of $100. per month. Councilman Godfrey moved the recommendation be approved and the contract for said concession be awarded to Mr. Alexander at the terms quoted. The motion was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. 6.' From City Manager, recommending contract be awarded to Gallagher & Burk, Inc., low bidder, for the Construction of Arch Culverts at Mound and Jackson Streets and at Fifth Street and Haight Avenue, at the total cost of $11,742. Councilman Godfrey moved the recommendation be adopted; that the contract be awarded to said firm for the specified project at the total cost quoted. The motion was seconded by Councilman Schacht and carried on the following roll call vote. Ayes: Five. Noes: None. Absent: None. 7. From City Planning Board, signed by the Secretary, recommending the amendment of certain sec- tions of the Alameda Municipal Code relating to Veterinary Clinics or Veterinary Hospitals, Kennels, Animal Shelters and Pounds. The Hearing date on this matter was set for the next meeting of the Council, to be held January 2, 1962. 8' 1 8. From the Mayor, nominating Messrs. Robert L. Veres and William J. Hay as members of the Advi- sory Golf Commission for the four-year terms beginning January 1, 1962, and expiring December 31, 1965. This matter was referred to "Resolutions". INTRODUCTION OF ORDINANCES: 9. Councilman Godfrey introduced the following ordinance, after which it was laid over under pro- vision of law and the Charter: "Ordinance No. New Series An Ordinance Authorizing the Conveyance by Quitclaim Deed of a Certain City-Owned Easement to South Shore Land Co., a Nevada Corporation." (Tract No. 1986 - South Shore Unit No. III) UNFINISHED BUSINESS: V 10. Councilman Godfrey referred to the joint meeting of the Council and the Social Service Board held at an adjourned regular meeting on December 12, 1961, and stated the Board had requested the Council to give its interpretation of the Board's duties. He said he had outlined in a letter to the Mayor and other Councilmen what he believed to be the Council's thinking on this subject. Councilman Godfrey then moved the City Clerk write to the Social Service Board expressing the Council's views on the question of the Board's duties, as set forth in his letter. The motion was seconded by Councilman McCall and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. RESOLUTIONS: 11. The following resolution was introduced by Councilman Godfrey, who moved its adoption: "Resolution No. 6302 Resolution of the Council of the City of Alameda Adopting Specifications for Furnishing to the City of Alameda One (1) New, Latest Model Industrial Wheel Tractor Equipped with Loader and Scraper, for the Golf Department, Calling for Bids and Directing City Clerk to Advertise Same." The motion to adopt said resolution was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. 12. The following resolution was introduced by Councilman Godfrey, who moved its adoption: "Resolution No. 6303 Resolution of the Council of the City of Alameda Adopting Specifications for Furnishing to the City of Alameda One (1) New, Latest Model, Two Cubic Yard Dump Truck with Dual Rear Wheels, Complete with Hoist and Dump Body Installed, for the Park Department, Calling for Bids and Directing City Clerk to Advertise Same." The motion to adopt said resolution was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. 13. The following resolution was introduced by Councilman Schacht, who moved its adoption: "Resolution No. 6304 Resolution of the Council of the City of Alameda Appointing Member of the Advisory Golf Commission." (Robert L. Veres) The motion to adopt said resolution was seconded by Councilman Dungan and on roll call carried by the following vote. Ayes: Four. Noes: None. Present: Councilman McCall, (1). Absent: None. 14. The following resolution was introduced by Councilman Godfrey, who moved its adoption: "Resolution No. 6305 Resolution of the Council of the City of Alameda Appointing Member of the Advisory Golf Commission." The following resolution was introduced by Councilman Schacht, who moved its adoption: said resolution was seconded by Councilman Schacht and on roll call carried by Ayes: Four. Noes: None. Absent: None. suggested the Clerk prepare resolutions in commendation of Mr. Johnny Vergez Moody, retiring members of the Golf Commission, for presentation at the next "Resolution No. 6306 RESOLUTION OF THE COUNCIL OF THE CITY OF ALAMEDA IN MEMORIAM TO WALTER T. STEINMETZ, RETIRED FIRE CHIEF 'WITH GREAT SORROW, the Council of the City of Alameda records the death of one of its distinguished and faithful former employees, WALTER T. STEINMETZ, Retired Chief of the Alameda Fire Department. 'WHEREAS, Mr. Steinmetz joined the Volunteer Fire Fighters in 1902, and became a member of the official Alameda Fire Department upon its creation in 1909, and, subse- quently, in recognition of his efficient performance of duties and his leadership capabilities, he was appointed in 1912 by the Police and Fire Commission to the position of Fire Chief, in which office he served with honor to himself and the City until his retirement in 1933; and 'WHEREAS, Mr. Steinmetz was responsible for the innovation of installing mechanized equipment in his department which was the first such great improvement in fire fighting in any city west of the Mississippi River; and 'WHEREAS, Mr. Steinmetz was highly respected for his administrative proficiency during his tenure of office and his excellent representation of the City of Alameda in such organi- zations as the Veteran Fireman's Association of Alameda County, the Alameda Police and Fire Pension Association and the Pacific Coast Intermountain Fire Chief's Association. 'NOW, THEREFORE, BE IT RESOLVED, that, in acknowledgement of his many years of out- standing service to the City of Alameda in his constant efforts toward increasing the citi- zens' protection through more efficient techniques of fighting fire and the great spirit of friendly cooperation and high esteem he engendered in all with whom he worked and associated, the Council of the City of Alameda hereby expresses its sincere appreciation and gratitude for the valuable personal influence exerted by this fine man to the benefit of the community. 'BE IT FURTHER RESOLVED that this resolution be spread in full upon the minutes of this meeting and that a copy thereof be transmitted to the family of Mr. Steinmetz that it may extend to its members a sincere expression of sympathy and condolence in their bereavement; and 'BE IT FURTHER RESOLVED that when this meeting of the Council of the City of Alameda adjourns, it shall do so in respect to the memory of Mr. WALTER T. STEINMETZ." The motion to adopt said resolution was seconded by Councilman Dungan and on roll call carried by the following vote. Ayes: Five, Noes: None. Absent: None. 16. The following resolution was introduced by Councilman McCall, who moved its adoption: "Resolution No. 6307 Resolution of the Council of the City of Alameda Requesting Governor of the State of California to Include Within the Special Call to the Legislature of the State of California in Year 1962 the Matter of the Tax Rate of Bay Area Air Pollution Control District." The motion to adopt said resolution was seconded by Councilman Dungan and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. 17. The following resolution was introduced by Councilman Schacht, who moved its adoption: "Resolution No. 6308 Resolution of the Council of the City of Alameda Authorizing the Commencement of Civil Actions Against Certain Electrical Equipment Manufacturers and Suppliers Who Have Conspired to Rig Bids and Fix Prices, to the Damage of the City of Alameda, and Consenting to the Employment of Special Legal Counsel in Connection Therewith." The motion to adopt said resolution was seconded by Councilman Godfrey and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. The President thereupon declared all of the foregoing resolutions duly adopted. ORDINANCES FOR PASSAGE: 18. "Ordinance No. 1397, New Series An Ordinance Reclassifying and Rezoning Certain Property Within the City of Alameda by Amending Zoning Ordinance No. 1277, New Series." (East side of Willow Street, between Otis Drive and Franciscan Way) Councilman Schacht moved the ordinance be adopted as submitted. The motion was seconded by Council- man McCall and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. 19. "Ordinance No. 1398, New Series An Ordinance Authorizing the Execution of an Agreement and Lease by and between the City of Alameda, as Lessee, and the Alameda Unified School District, as Lessor, Said Lease Relating to the Premises for Swimming Pools and Related Facilities at Encinal High School, and Said Agreement Relating to the Sharing of Costs of Construction and Other Necessary Costs, and the Operation and Use of Said Swimming Pools and Related Facilities." The President remarked that, since the last regular Council meeting and with the authorization of the City Council, he had met with the Superintendent of Schools, the President of the Board of Edu- cation and the City Manager and they had gone over each item of expense involved in the project at Encinal High School. He stated he felt the cost-share of fifty-eight per cent for the City and forty-two per cent for the School District was a fair and equitable one, with the Board of Education now having agreed to assume the full cost of the $920. for the State inspection. After much discussion, and upon advice of the City Attorney, Councilman Dungan moved the ordinance be passed with the amendment at this time of the basic Agreement referred to, as follows: Paragraph 3(a) "Total cost of construction according to approved plans and specifications, City of Alameda 58%, School District 42%." Also, Paragraph 3(c) "Fees payable to the State of California Division of Architecture for review and approval of plans and specifications, City 07., School District 1007.." The motion was seconded by Councilman McCall. Speaking on the question, Councilmen Godfrey and Schacht expressed their views to the effect that they still felt the cost share should be on a fifty-fifty basis between the City and the Alameda Unified School District for the entire project. The question was then put, and the motion to adopt said ordinance, as amended, carried on the fol- lowing roll call vote. Ayes: Councilmen Dungan, McCall and President Collischonn, (3). Noes: Councilmen Godfrey and Schacht, (2). Absent: None. FILING: 20. Specifications and Provisions No. MS 12-61-21 - Industrial Wheel Tractor Equipped with Loader and Scraper, for the Golf Department. 21. Specifications and Provisions No. MS 12-61-22 - One Two Cubic Yard Dump Truck with Dual Rear Wheels, Complete with Hoist and Dump Body Installed, for the Park Department. 22. Financial Statement - Bureau of Electricity, as of October 31, 1961 - Verified by Hackleman & Larzelere. BILLS: 23. An itemized List of Claims against the City of Alameda and,the Departments thereof, in the total amount of $26,278.76, was presented to the Council at this meeting. The List was accompanied by certification from the City Manager that the Claims shown were correct. Councilman Schacht moved the bills as itemized in the List of Claims filed with the City Clerk on December 19, 1961, and presented to the Council at this meeting, be allowed and paid. The motion was seconded by Councilman Dungan and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. ADJOURNMENT: 24. At this point, the President asked all to rise for a moment or silence in respect to the memory of Mr. Walter T. Steinmetz, Retired Fire Chief. There being no further business to come before the meeting, the Council then adjourned at 8:30 o'clock - to assemble in regular session on Tuesday evening, January 2, 1962, at 7:30 o'clock.
