WRITTEN CCYMUNICATIONS;
From Mr, Harry Young, concerning the providing of berehes at bus stops through-
out the City. Ho stated the Key System wants to get out of the bench business, and
upon. Inquiry, he had. ascertained that several. cities use the service of the National
Bench Company, Inc.
Councilman Jones remarked. that this matter has been. before the Council on. several
different occasions and suggested that in the light of Mr. Young's communication,
it might be well to refer the matter to the City Manager, with the request that he
bring the Council up to date on the sltuatien. Councilman Jones made a motion to
this effect, which was seconded by. Councilman Anderson, and unanimously carried.

Council the matter of reducing the license foe on cigarette vending machinos
operated by him in the City of Alameda. He requested. that these mac hlnes be placed
in the sane categor y. as wholesalers and retail merchants aro in now, on the basis
of manpower employed in the operation. of 350 machines.
Mr. Brandon contended that the placing of a license fee on each individual machine
is discriminatory' in view of the fact that this is not dono in the case of other
types of cabinets out of which customers help themselves in the stores. He pointed
out, further, that Alameda Is the only City to the East Bay that levies as heavy
a tax or . vending machines, stating that this matter has been presented to the Coun-
cils of each city and after a11 . investigation, these machines have been placed in.
the same category a other machines selling at retail.
President Branscheid stated that the Council would be glad to take this matter under
consideratlon, pointing out that the present ordinance is one that was enacted dur-
ing the war years and there are some features of the ordinance which. are more or
loss in. the nature of temporary arrangements. He stated the matter would be takon
under advisement - full considerattion to be given to Er. Brandon's request and an
attemut would be made to make any adjustments in the ordinance which. may appear to
to be advisable or necessary.
Mr. Frank Gettstoin appeared, before the Council and brought up the matter of
the condition of Webster Street, as to surface drainage - stating that at 3:05
o'clock on March 11, he was traveling north 0(1 Webster Street along side a bus and
that by reason of the surface water accumulated. on tho street, dirty water was
splashed all over his car and the bus also washed up largo quantities of rock and
gravel on the sidewalk. Ho stated that at the present time the sidewalk in the
vicinity of Tynan Avenue is still. covered with, rocks and gravel.
It was Yr. Gottstein's contention that in spito of the change of grade made in the
street sometime ago, the street is still too low, pointing out that at the time of
high. tldes, water is backed un through.. the storm. drains into the street.
President Branschoid pointed out to Mr. 005511 30.111 that Webster Street is now a
State highway and that anything done on that highway will have to be done by the
State.
Mr. Gottstein rep.hed that while this might be true, it was the duty of the City
officials to ure, the State to make the necessary grade changes to correct this
condition.
President Branscheld called upon City Manager Froorer to report on this matter and
Mr. Froorer stated that in the main, Mr. Gottstoin's statements are entirely true;
the drainage on Webster Street is about as poor astcould be found anywhere; the
street is settling and this settling will continuo, and as a result, there will be
bird baths along the street. He stated that the drainage is carried from Webster
• Street by two pipe lines which have a very flat gradient; the tido does back up
into the catch basins, but that there Is a program now under way for a storm water

pumping plant which will take care of the water at hip7,h tide. He pointed out that
even if the street were raised one, two or three feet these difficulties would
still be encountered and it would be necessary to pump the drainage off. To stated
that in a project now under consideration for a grade separation, an attempt will
be made by the City to have the matter of drainage on Webster Street taken care

projects - the first step towart . which, in his opinion, would be the refusal to
rent future vacancies. He stated that, from information which he has been able to
obtain, the vacancies are not being taken up by residents of Alameda but bv people
from all over the State and that this is a gross imposition upon the citizens of
Alameda as it places a heavy burden upon the City services required to be furnished.
Councilman Jones stated it should be pointed out to Mr. Gottst 'n that the Council
is working on every conceivable angle of the temporary housing situation. with a
full realization of the seriousness of the problem and an earnest desire to reach
a solution. He stated this question was taken up by the Yayor and City Manager on
their recent trip to Washington and that the City is getting active...cooperation of
the Congressman from. this district and the two Senators from.. California in .. an of-
fort to work out a solution. He stated that he wished to assure everyone that
the Council is not sitting idly by and passing up this matter because it is a
tough ono.
Yr. Gottsteln replied that the reason for his remarks was that, in his opinion, the
Council is in favor of continuing the housing and was assured by Councilman Jones
that such is not the case; that the projects cannot be arbitrarily demolished untiL
some means is found for providing housing for the present occupants.

to employ a diver for the designated work and at the sum specified. The motion was
seconded by Councilman Sweeney and on roll call carried by the following vote.

April 2n, to July 20, 1049, be granted to McGuire and Hester for completion of their
contract covering ftva installation of the Bay Farm Island Interceptor SOWer and
Force Main.
Councilman Sweeney moved the City Manager's recommendation be adopted; that McGuire
and Hester be granted the necessary extension of time as specified. The motion was
seconded by Councilman Anderson and unanimously carried.
14 . From. the City Manager, submitting a report on. the investigation made of the

request to have the marsb .. area north of Doolittle Drive, oast of the Bay Farm
Island Bridge retained. in. Its present state as a shore bird refuge. Mr. Froeror's
communication pointed out that such a refuge would be desirable - however, this is
the only remaining area in which. the City can dispose of its garbage and. when. the
land is filled, it can be converted into a beach and bark recreation area. If this
land were retained a a bird refuge, it would provide recreation for relatively few
persons during a year. It was suggested that a portion of the area be retained as
a refuge while the balance could be converted into a park-
rs. Juncla W. Kelly, Chairman of the Alameda Section, Salt Marsh Refuge Committee,
addressed the Council, stating that while she was fully aware el Inc fact that the

City has to have some place to dispose of its garbage, it was the fooling of the
group she represents that the wonderful, natural refuge for shore birds which the
City now has should not be lightly thrown away. She stated the City of Alameda
has something, in this bird refuge that can be found in no other place in. the
country. Mrs. Kelly displayed several specimens of birds which are found on the
Alameda beach. and stated that even. though the area would. be taken over for tho
purpose of disuosing of ga:bage, it would not be Tong before that area was filled
and It would be necessary to look for some other spot for this Purpose. She
therefore urged that this other spot ho found now and the bird refuge be retained.
Several others of Yrs. Kelly's group, namely: Yrs. d
Howard L. Cogswell, spoke on the subject.

Mr. Ocswell pointed out that such an area close to the metropolitan area Is ex-
tremely important from a scientific viewpoint as well as from that of teaching.
He stated that the area in the vicinity of Doolittle Drive has more birds per .
unit of surface than any other place in the country.
Councilman Sweeney moved this matter be referred to the Committee of the Whole
for further study. The motion was seconded by Councilman. Osborn.
Councilman. Jones directed attention to the alternative proposed in the report of
the City Manager, to wit; that a portion . of tne land could be retained as a bird .
refuge while the balance wore converted into a park. He inquired if MrS. Kelly
would . wish to comment on this recommendation-
Mrs. Kelly replied by stating that the area is smalll to begin with and if it is
reduced in size too much the entire purposo of retention of the area as a bird
refuge would be defeated.
President Branscheid put the question. and the motion was unanimously carri ed.
lEM. From E. H. Rogers, Building Inspector, requesting the Council to exempt from.
building fees the office building of the East Bay Municipal Utility. District,
being a public utility and also the addition to be made to the Veterans' Memorial
Building being financed by the County of Alameda.
Councilman Anderson. moved tiro Buildin7 Inspector's request be granted and the two
structures mentioned be exempt from building permit fees. The motion was
seconded. by Councilman. Osborn and unanimously carried.

recommendation concerning the awarc . of contract. He stated that as a result of the
canvassing of the bids, the Soott Electrical Combany's bid. of _1, 272. was found to
be the low bid and as it seems to be in. order, he would recommend that it be ac-
cepted and the contract for the performance of this work be awarded to the Snott
Electrical Comnany,
Councilman Anderson moved the recommendation. of the City Manager be adopted; that
