WRITTEN COMMUUTCATIOHS: -g. From •r, John W. Wilson, 1362 Broadway, concerning Ordinance No. 969, New Series, recently adopted. by the Council, which provides for the abatement of dogs that bite. President Branscheld commented that this ordinance was enacted by the Council in. a move to protect children. and others from. being bitten. by dogs now to be I11- tempered, and stated he felt the people of Alameda were entitled. to this sort of protection. Councilynn Osborn inquired. 1 Mr. Wilson. were present - and finding that he was not, stated that in. answer to Mr. Wilson's remarks, it might be well to state thSt there have been numerous comrlaints about 1-0tI1 5 00-5 o and the dul nartiar f „— case which brought forth this ordinance was that of a dog that had bitten four different persons. boon investigating the possibility of removing this animal it was discovered. that the City of Alameda had no law which adequately covered tbe situation. As a result, the City Attorney was directed to prepare an ordinance along these lies. OUT OrdirISTACe is largely patterned after similar ordinances in. neighboring cities, although.. considerably less severe than some of them. Council- man Osborn stated that, in. his opinion, it Is more necessary to protect the people of the City than it is to nrotect the dogs and he stated further 'that he felt the ordinance:should be all to stand as written. President Branscheid thereupon referred the matter to the City Mana,FLer with the re- quest that he make a eroper resnonse to Yr. Wilson's letter. ORAL COMMUNICATIONS: Mrs. Woodworth addressed the Council or the antiquity of the City Hall, inquir- ing as to whether or not it had ever occurred to anyone that it should be replaced with a new edifice. She stated that her comments were made as a result of her hav- ing noticed a transfer of c.50,000. to the Capital Outlays Fund and she expressed Inc opinion that this money might be used fOr rebuilding the Hall. President Branscheid stated that while the City Hall is undoubtedly quite old it had been very well constructed and is well suited to the purposes of the City, and in view of the present cost of construction, there was no probability of destroy- ing the existing building and putting up a new one. He stated, further, that the matter of cleaning up the building and modernizing it is under active consideration and expressed the hope that at least thds much could be done within a reasonable time Councilman Jones pointed out to Mrs- Woodworth that 1110 Capital Outlays Fund is really a bookkeeping fund - the money being used. for improvements in the ...City, and he also explained the purposes and functions of the Casd7n. pasis Fund. He stated, further, that the City Is presently taking steps to acquire property adjacent to the City Hall for the purlDose of extending tbe Civic Center idea in this locality, and he also commented on the burden which the cost of a new. City Hall would put upon the taxpayera. O. A representative of the mall carriers, working out of the Alameda Post Office, inquired as to the presence of any provision in the franchise granted to the Key System., with reference to the transportation of letter carriers without charge. President Branscheid called upon. 01111 Attorney. Whitney to outline fnis matter for the information. of the inquirer. Sr. Whitney stated that the I..Cey System has flatly rejected this provision, after having taken tbe matter up with_the Post Office De- partment, and the only carriers who will be allowed to ride free are those actually on duty- while riding. From the City Manager, re-Porting on. his Investiation of the 'matter of an extension to the fence at 2137 Central Avenue, which makes it more than six feet in heght, and recommendinr, that the Council grant a ner t mi to raise the fence as re- . quested. Councilman Anderson. moved the recommendation. of the City Manager be adopted. and that a permit be issued allowing the continuance of the fence in question- Councilman Osborn requested that Councilman Anderson. amend his motion to provide that a revocable permit be Issued, which . mi7ht be withdrawn. at any time that the fence in its present condition. should become a nuisance. Councilman Anderson agreed to the amendment, Whereupon the motion was seconded by. Councilman. Osborn and unanimously carried. From F. J. Following the adoption of this resolution, Councilman Jones inquired as to what is being done to assure the proper use of the monies collected. through the parking meters, in line with the agreement made by the Council at the time of the installa tion of the meters. He raised the auestion of the, possibility of this money losing Its identity through such a transfer. President Branscheld requested the Ci* Manager to explain the situation. and FT. • Froerer stated that there was included in the last budget, revenue to the extent of :T,40,000., the source of which wou.716 be the parking meters and which amount would go to the operation of the departments of the City. Government having to do with. the maintenance and operation. of the meters and the enforcement of traffic regulations. He stated there has been a constant check maintained ©n these ex- penditures and that a report has been. prepared. showing that all monies collected from this source have been expended for the purposes set forth in the opinion, of the Attorney General, as was anticipated by the Council at the time of the adop- tion of the budget last year. 16. The following resolution was introduced by Counci_man Jones, who moved. its adoption: "Resolution 30. 4054 Transferring '!:fl3,931.65 from the Initiative Relief Fund. to the General Fund of the Citnef Alameda." Councilman Jones moved the bills as itemized in the List of Claims filed with. the City Clerk on June 28, 1949, and presented to the Council at this time, be allowed and paid- , The motion was seconded by Councilman Osborn and on roll call carried by the following vote. Noes: None, Absent: None, 25' to adjournment, Councilman Jones presented the question of the City being renresented at a hearing in Washington on the subject of the "Second Bay Crossing," and asking that the matter be discussed at this time with _a view to determining whether or not such representation is necessary or desirable. He stated that at the Committee of the Whole meeting, Councilman Osborn had sug- gested that such representation was vitally necessary for the protection of the interests of the City in this matter and expressed his opinion that there should be some further discussion. Councilman Osborn stated he definitely felt the decision that may be made in Washington is of vital importance to the City of Alameda inasmuch. as at this hearing the location of the second crossing is to be considered. President Branscheid stated that the only point to be discussed. at the hearing is the matter of an anchorage for a parallel crossing on Yerba Buena Island. Councilman Osborn stated that if pressure is brought to bear and the opinion prevails that a southern crossing would be more advantageous, and if It were decided tat the bride should be built Into the City of Alameda, with its easterly terminus at Fifth Street, and with no provision being made for the southshore freeway and an additional tube to Oakland, it would affect the future of the City very definitely. He stated that, considering the fact that this City suffered by reason of its not being considered in the construction of the • present bridge, it is important that everything possible be done to protect the City's interests in the matter of the •second bridge and to see that the City is • properly represented at Washington- He thereupon offered. the recommendation that the City of Alameda be properly represented at the hearing. Councilman Sweeney pointed out that under no consideration would the City of Alameda want the southern crossing without the southshere freeway; the tube to Oakland and the approach along Main. Street rather than Fifth Street. He ex- pressed the opinion that the City should be covered at all times and stated that he was in full accord with. Councilman Osborn as to the necessity for representa- tion at this hearing. Councilman Jones inquired as to the date of the hearing and was informed it would be held on July 8 and 9, 1949. President Branscheid stated it might he well for everyone concerned to understand that the request for the City of Alameda to be represented in Washington comes from. the proponents of the parallel crossing. Councilman. Jones stated that, In his opinion, it was necessary to take action to provide for the City's representation at this hearing, and moved that the Mayor be authorized to attend the hearing, or appoint a representative to go to Washing- ton, to watch out for the interests of the City of Alameda and that a SUM not to exceed '500, be appronriated to cover the expense of the trip. Commenting on his motion, Councilman Jones stated that as he sees the matter, it will not be necessary for any representative of the City to take any particular stand in the matter, and that his assignment would be primarily that of observing: what goes on. Upon being assured that the sum of Th500. would be ample to cover the cost of the trip, even. though the representative mirrht have to fly to Washington, Councilman Osborn seconded the motion. Speaking on the motion, -Councilman Anderson. stated that it was his understanding that the question before the hearing will. be as to whether or not the Government will grant permission to cross Goat island with a parallel bridge. He pointed out that if the Government grants permission to make this anchorage, to first thing the City of Alameda will get is a second tube under the Estuary. He pointed out, on the other hand, that If the petition. is denied, then probably the southern cross- ing will be built, but offered the opinion that In suoh case the Federal Government will contribute nothing, nor will. it have anything to say about the location of the approac1 . to the southern. crossing. He stated that, in his opinion, the primary ob- jective of the City of Alameda insofar as the southern crossing is concerned is to make certain the approach goes along Hain Street rather than Fifth Street and stated that In this matter, the Federal Government weuad have no res,nonsibility whatsoever. it was his belief, therefore, that the Federal Government should be fully a,nprised concerning the position of the City of Alameda in the matter and how It is going to be affected.
