1946-01-15 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, JANUARY 15, 1946 The meeting convened at 8:00 P. M. with President Branscheid presiding. ROLL CALL: The roll was called and Councilman Hove, Jones, Osborn, Sweeney and President Branscheid, (5), were noted present. Absent: None. MINUTES: 1. The minutes of the regular meeting of the Council held January 2, 1946, were approved as transcribed. WRITTEN COMIUNICATIONS: V 2. From Messrs. Fred Linderman, R. C. Porter and B. R. Hamlin, requesting the Council to take the necessary action to close that portion of Market Street from the north line of Calhoun Street to the south line of San Jose Avenue, for the Purpose of eliminating considerable costly street work and enabling them to de- velop this area as a residential subdivision. Councilman Osborn moved the matter be referred to the City Manager for study and report. The motion was seconded by Councilman Sweeney and unanimously carried. ORAL COMMUNICATIONS: 3. Mr. Frank Gottstein informed the Council that the City of Oakland now has traffic officers on duty along Harrison Street and the traffic approach to Posey Tube from the Oakland side is easing un considerably as a result. He suggested, however, that it would be necessary to watch the situation very closely to see that this service is maintained. He also reported that the Tube tow car is not kept at the Tube as it is supposed to be, but that after each trip, it returns to the garage at 13th and Madison Streets, thus occasioning great delay in clearing up congestion in the Tube when it occurs. President Branscheid stated that these matters would be checked into. HARINGS: 4. The matter of abatement of nuisance on premises at 2135 Central Avenue, which had been continued from the last meeting of the Council, was presented at this time. There being no one to represent the owners of the property involved, Building Inspector Rogers reported that no further move had been made on this property, except that he had received from representatives of the Church, a request for permission to use the upper floor of the house for auditorium purposes. He stated that he had denied this request inasmuch as the building is not sufficiently sound to accommodate any number of people. He remarked that he had heard nothing with regard to the sale of the property and therefore requested that a resolution be adopted, declaring the building to be a nuisance on these premises and ordering its abatement. Councilman Jones thereupon moved the City proceed with the abatement in line with the provisions of the Health and Safety Code of the State of California and de- claring the property a nuisance to be abated within thirty days from this date. The motion was seconded by Councilman Howe and on roll call carried by the follow- ing vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid (5). Noes: None. Absent: None. The matter was then referred to "Resolutions." 5.1 At the suggestion of President Branscheid, Building Inspector Rogers reported on the abatement of the nuisance at 2310 Lincoln Avenue, stating that all debris resulting from the wrecking of the building, had been removed but that there are still about two truckloads of garbage on the property which had been dumped there by the former tenants. He observed that this could be removed by action of the Health Department in cooperation with the Fire Chief and therefore recommended that the proceedings on the condemnation of the property for the removal of the building be dropped. Following some discussion as to the advisability of dropping the condemnation pro- ceedings prior to the satisfactory cleaning up of the lot, the City Attorney stated that in his opinion, the abatement proceedings had been terminated by the removal of the building and that the cleaning up of the lot could be done to better advantage in the manner suggested by Mr. Rogers. Councilman Sweeney thereupon moved the abatement proceedings be terminated. The motion was seconded by Councilman Osborn and on roll call carried by the follow- ing vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. REPORTS OF C OEM TTEES : v/ 6. From F. J. Croll, Auditor and. Assessor, recommending the tax ordinance of the City of Alameda be changed to allow personal property taxes to be divided equally and paid with the first and second installments of the real estate taxes, in ac- cordance with a bill passed during the last session of the State Legislature. Councilman Jones moved this matter be referred to the City Attorney for prepara- tion of an ordinance covering an amendment to our tax ordinance as outlined in Mr. Croll's letter. The motion was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and president Branscheid, (5). Noes: None. Absent: None. RESOLUTIONS: 7. The following resolution was introduced by Councilman Osborn, who moved its adoption: "Resolution No. 3268 ADopting Specifications, Special Provisions and. Plans for the Construction of a Storm Sewer on the West Side of Everett Street from Blanding Avenue to the Estuary, Calling for Bids, and Directing the City Clerk to Ad- vertise Same." The motion to adopt said resolution was seconded by Councilman Sweeney and on roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon the President declared said resolution duly adopted and passed. 8: The following resolution was introduced by Councilman Osborn, who moved its adoption: "Resolution No. 3269 Authorizing Deposit in General Fund of Moneys Received by Building Inspector from an Unknown Person." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon the president declared said resolution duly adopted and passed. * 9. The following resolution was introduced by Councilman Jones, who moved its adoption: "Resolution No. 3270 Declaring Building Known as 2135 Central Avenue, Alameda, California, to be a public Nuisance." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon the President declared said resolution duly adopted and passed. *At the request of Councilman Jones, the City Manager explained this resolution, pointing out that about one and a half years ago the City Building Inspector had received an anonymous communication in which was enclosed a twenty-dellar bill; that he had immediately referred the matter to the City Manager who in turn pre- sented it to the City Attorney at whose suggestion the money was deposited with the City Clerk pending developments, and that now, nothing having developed, it was believed the money should be deposited with the City. FILING: 10. History of Civilian Defense in Alameda - Reported by R. A. Worden, Chief Co-ordinator. 11. Specifications - No. PW 1-46-1 - For construction of Storm Sewer - West side of Everett Street from Blanding Avenue to the Estuary. In connection with Mr. Worden's report on the History of Civilian Defense in Alameda, Councilman Jones extended the commendation of the Council for the splendid work done by Er. Worden, stating that inasmuch as it reflects the fine attitude of the population of Alameda in the emergency created by the war, this history will be a permanent record of the activities of the citizens of Alameda in furthering the defense of the country. BILLS: 12. An itemized List of Claims against the City of Alameda and the several departments thereof in the total amounts as follows, was presented to the Council at this meeting: General Departments, $6,158.46; Civilian Defense Department, 46.77; Police Department, $1,359.99; Civil Service Department, $149.21; Pound Department, $64.48; Fire DeDartment, $660.58; Street Department, $2,629.31; Health Department, $285.38; Recreation Department $107.82; Federal Recreation Facilities, $127.93; Park Department, $822.73; Golf Course Department, $689.26; Store Department, $904.66; Social Service Department, $181.35; Initiative Relief Fund, $19.75; Street Improvement Fund, $1,169.21; Gas Tax Yo. 2 Fund, $2,395.25; East Bay Municipal Utility District Fund, $2,461.99 and Sales Tax Fund, 4.99. Councilman Howe moved the bills as itemized in the List of Claims filed with the City Clerk on January 15, 1946, and presented to the Council at this time, be allowed and paid. Just prior to adjournment, the President welcomed the representatives of the Junior Chamber of Commerce who were present at the meeting and expressed the hope that this organization would continue to be represented at all future Council meetings.
