The matter vas referred to the City Planning Board inasmuch as the Council felt it
was still in the hands of the Planning Board until it had taken some definite ac-
tion by making a recommendation and the Council had no jurisdiction in the matter
at the present time.
From the ATameda Jiio,ior Chamber of Comlierce, reouesting that the City provide
a stadium. to aid in the physical development of the youth of the City.
President Branscheid stated that tht hile the recreational program of the City had
been somewhat upset by war time conditions and a consequent scarcity of land for
these purposes, the City is now actively engaged in making a real study of the
situation, with. work going on in Lincoln and Washington Parks. He pointed out
that a landscape architect has been .employed for the purpose of reorganizing the
nark Properties and that before very long some definite plans should be forth-
coning. In the meantime, he suggested that the matter ,-.go to the Committee of the
Whole to carry on while the survey is under way.
Councilman Howe moved the matter be referred to the Committee of the Whole. The
motion was seconded by Councilman Osborn and carried.
7rom the Alameda Woman's Tmprovement Club Inc., requesting the improvement
of the football and baseball field. in Lincoln Park and the construction of more
bleachers there.
The meeting convened at 8:00 P. 1:[. with President Branscheid presiding.
The roll was called and Councilmen Howe, 0oin, Osborn. and President Branscheid,

2.. From Alameda Post 2o. 9, American Legion, transmitting a resolution of protest
against the proposed rezoning of submerged lands off of Bay Farm Island.
President Dranscheid remarked that this communication embodied the some ideas as
tnat from the Alameda Junior Chamber of Commerce. Therefore, Councilman Osborn
moved that it be referred to the Committee of the Whole. The motion was seconded
by Councilman Howe and carried.
2ron MTS. Otha B.71eming, 1247 Park Avenue, representing property owners in
the 1200 block on Park Avenue, objecting to the granting by the City Planning
Board of a petition fron Miss Saylor's Chocolates, Inc. for a waiver of the set-
back requirements on lot known as 1251 Pork Avenue, and appealing to the Council
for some way of procuring a hearing on their grievance inasmuch as they did not
file for an appeal . of the Planning • Board's decision within the three-day period
prescribed by the Zoning Ordinance.
Following the reading of this communication, Councilman Jones stated that he felt
that regardless of the fact that the home owners on Park Avenue had not complied
with the terms of the ordinance in the matter of filing their appeal from the
ruling of the Planning Board within three days, they had nevertheless been denied
their full rights in the praises, namely: the right of appeal to the highest
authority of the City in the matter. He stated that even though it might develoD
that the Council would sustain the net of the 71anning Board, nevertheless the
[ residents of Park Avenue were entitled to be fully heard on the subject and. to
the privilege of exhausting their rights in the premises. He expressed the wish.
that the City Attorney look into the situation to see what steps might be taken
to IT'en it possible for the residents of Park Avenue to appear before the Council
and state their case. Uo then made this suggestion a motion.
The motion was seconded by Councilman °Shorn, who stated that he wanted ever:ri;h.ing
possible done to have the right of appeal reinstated. He suggested the possibility
that Miss Saylorls Chocolates, Inc. night have some rights in the premises by vir-
i tue of the ruling of the Planning Board which could not be interfered with but
that, inasmuch as the right of appeal had been lost to the home owners through
inadvertence on their part, he wished to see everything possible done to .have this
right restored to theL.
Er. Frank Gottstein spoke briefly on the subject.

aPpreCiation of the consideration shown them by. Councilmen Jones and Osborn
and expressed the hone that some remedy might be found for the situation.
President Branscheid out the question and the motion was carried.
7ollowing the disposition of this motion, Councilman Jones moved that it be the
policy of the Council that all City Boards before which hearings are Held shall
hereafter furnish memoranda of instructions regarding appeals so that a situa-
tion similar to this one shall not recur and that the City Clerk be instructed
to notify the several Boards of this requirement. Also, that the City Clerk
prepare suitable forms for that, purnose. The motion was seconded by Councilman
Howe and carried.
REPORTS OF C0.11:EIThEES:
6/.Frora the City planning Board, recommending the rezoning of only the westerly
50 feet of two iDarcels of property known as 1537 and 1545-53 Webster Street, be-
ing more particularly described in the petition, from the !ICU Eultiole Dwelling
District to the IIpU Central Business District.
The matter was referred to "Ordinances for Introduction.

From the City Eanager, recommending that contract for the construction of a
storm sewer along the westerly side of Everett Street from Blanding Avenue to
the Estuary, in accordance with Specifications, Special Provisions and Plans
therefor No. PW 1-46-1, be awarded to Er. San Hunter at his bid price of 34,162.
Councilman Osborn moved the recommendation of the City manager be accented; that
contract be awarded accordinly and checks be returned to the unsuccessful bid-
ders The motion was seconded by Councilman Jones and on roll call carried by
the following vote. Ayes: Councilmen Howe, Jones, Osborn and President Brans-
cheid, (4) . Hoes: None. Absent: Councilman Sweeney, (1).

From the City Eanager, recommending that F. J. Croll, City Auditor, be
authorized to attend the City Assessor's meeting to be held in Sacramento on
February 25 and 26, 1946, and that the sum of 25. be appropriated for his
expenses.
Councilman Osborn moved the recommendation of the City I:anager be approved and
that r Croll be autnorized to attend the above elentioned meeting and the sum
of ''25. be appropriated to cover his expenses. The motion was seconded by
Councilman Jones and on roll call carried by the following vote. Ayes: Coun-
cilmen Howe, Jones, Osborn and President Branscheid, (4). Hoes: None, Absent:

9. Councilman Howe stated it had come to his notice that there was going to
be a meeting of City laanarers in sacrament() on February 22 and 23, 1946, and
moved that City Eanager EcEillan be authorized to attend the meeting and that
the sun o{ '20. be apnronriated to defray his expenses. The motion was seconded
by Councilman Jones and on roll call carried by the following vote. Ayes:
Councilmen Howe, Jones, Osborn and. President 3ronscheid, (4). Yeas: Hone.
Absent: Councilman Sweeney, (1).

12. Councilman Howe renorted the attendance of Councilman Jones and himself at,
the meeting of the East Bay Chapter National Safety Council in Oakland and his
acceptance on behalf of the City of Alameda of an Award of ::erit for Safe Driving
for the neriod from iTuly 1, to December 31, 1945, - the City of Alameda havinrr,
taken first place in the 1Lunicipal Division for the second consecutive time.
Councilman 1.-Jpe presented the Award to President 73ranscheid, who stated that
the City was very proud of the fine safety work carried on by the City onoioyees
in establishing this record for safe driving.

the City Clerk on ','ebruary 19, 1946, and presented to the Council at this time,
be allowed and paid. The motion was seconded by Council,lan Osborn and on roll

20v/ Prior to adjournment, the City Manager informed the Council that the State
Highway COMMJSSitan will meet in Oakland tomorrow and on the following day will
rake a tri throughout the County. This tour will start from Oakland, go through
the Tube and Cone out on Central Avenue, thence to Park Street, thus giving the
City ::anager an opportunity to explain to the -Zighway Commission the desires of
the City with reference to having that route included in the State :=ighway Sys-
tem.
He stated further that on February 28, the Collier Committee, a Joint Interim
Committee of the Senate and Assembly will make a study for report to the next
session of the Legislature on the over-all changes in the Yighway System struc-
ture of the State in which various roads will be reclassified. He also stated
that the City has been requested by this Committee to make quite a presentation
on the street wor that has to be done within the City on a ten-year basis and
that it will be necessary for us to go back into our records and furnish the
Committee with a complete analysis of the expenditures made for this purpose
by the City during the last ten years, showing the sources of the money thus
spent. He stated that this meeting will be held in the Alameda Court House
and that following the meeting the Committee will make a tour of the County.
For this purpose a bus will be chartered and the trip to be taken will be simi-
lar to the one contemplated by the State Highway Commission-
