1946-05-21 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF.ALAMEDA HELD TUESDAY EVENING, MAY 21, - - - - - - - - 1946 The meeting convened at 8 :00 P. M. with President Branscheid presiding. ROLL CALL: The roll was called and Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5), were noted present. Absent: None. MINUTES: 1. The minutes of the regular meeting held May 7, 1946, were approved as trans- cribed. TTEN COMMUNICATIONS: 2. From the Alameda Chamber of Commerce, commending the City Council's action in preparing to pass an ordinance regulating "Solicitations." The Chamber sug- gested in this letter that the cost of twenty -five per cent for the making of solicitations, as stipulated by the proposed ordinance, was too high and that this amount should be reduced to a maximum of ten per cent. The matter was referred to "Introduction of Ordinances." REPORTS OF COMMITTEES: 3: From the City Manager, recommending the bid of Garland Chevrolet Co. for furnishing one new, 1 Ton Dump Truck to the City for the sum of $2,294.92, be accepted and contract awarded to this firm. Councilman Jones moved the recommendation of the City Manager be approved and contract be awarded to the above company for furnishing the specified equipment. The motion was seconded by Councilman Howe and on roll call carried by the fol- lowing vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. 4 From the City Manager, requesting permission to sell an accumulation of old railroad ties now stored at the Golf Course. Councilman Osborn moved the recommendation of the City Manager be accepted and that he be authorized to dispose of the specified ties to the highest bidder. The motion was seconded by Councilman Jones and on roll call carried by the fol- lowing vote. Ayes: Councilmen Jones, Howe, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. 5. From the Board of Education, City of Alameda, requesting a budget allocation of $85,000. for the fiscal year 1946 -47. The communication was ordered filed. 6: From the Public Utilities Board, concerning the transfer and retention of certain portions of the current year's earnings. Council an Osborn moved the request of the Department of Public Utilities be granted and that it be given permission to retain in the Bureau of Electricity Fund all earnings of the utility for the current year in excess of the sum of $555,185.09, as designated. The motion was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None.. Absent: None. 7: From the City Planning Board, recommending the reclassification of a certain portion of the property of Alaska Packers Association, bounded roughly by Buena Vista Avenue, Grand Street, Eagle Avenue and Hibbard Street - being more specifi- cally described in the petition - from the "G" Light Industrial District to the "H" Heavy Industrial District, for the purpose of constructing a plant in which to manufacture fibreboard containers. The matter was referred to "Introduction of Ordinances." 8;' From the City Manager, recommending that Messrs. Louis Schmitz and Fritz Zapf of the Engineering Department attend a meeting of the California Sewage Works Asso- ciation to be held in Monterey on Tune 9, 10 and 11, 1946, and that the sum of $75. be appropriated for their expenses. Councilman Jones moved the City Manager's recommendation be followed by extending permission to the two employees mentioned to attend the conference at Monterey and that $75. be allowed to cover their expenses. The motion was seconded by Council- man Howe and on roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. 9. The City Manager reported that the construction of_ the Storm Sewer -along the westerly side of Everett Street, from Blanding Avenue northerly to the Estuary, has been completed in accordance with Specifications, Special Provisions and Plans No. PW 1 -46 -1, and recommended that the work performed under contract be accepted. Councilman Howe moved the recommendation of the, City. Manager be approved and the project contract be accepted as completed. The motion was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. 10. Osborn referred to the recent communication from the City Manager in which he stated that he is planning to leave the City the first part of June to be in Washington, D. C. on June 10, 1946, and following the conclusion of his business there, he plans to go to Montreal, Canada, to attend the annual meeting of the International Association.of City Managers. Councilman Osborn moved that permission be granted the City Manager to leave the City for the purpose of attending the meetings designated and that the sum of $600. be appropriated for his expenses in this connection. The motion was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Council- men Howe, Tones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. 11'. City Manager McMillan reported to the Council that the City has for some time contemplated the widening of Buena Vista Avenue at Everett Street and the straighten- ing out of the present dead end intersection now existing there. Be stated that he had today received the report from the appraisers on this particular matter, and suggested that, if the Council wished to have this work done, it might be advis- able to instruct the City Attorney to commence proceedings looking toward the condemnation of this property, as well as the property situated at the northeast corner of the intersection of High Street and Fernside Boulevard. He pointed out that fifty per cent of the money required for the projected improvements would come out of the City's Gas Tax moneys, and the balance could be obtained from the State's Planning and Rights -of -Way Fund. Councilman Jones moved that the City Attorney be authorized and directed to ini- tiate condemnation proceedings involving the property described by the City Manager and that a resolution covering this matter be presented for Council action at its next meeting. The motion was seconded by Councilman Howe and carried. 12. Councilman Osborn, through the President, inquired of the City Manager if the resolution has been prepared accepting from the Public Roads Administration the road around the Tube. The City Manager replied that the resolution referred to has not been prepared for the reason that the letter from the Public Roads Administration relinquishing the road to the City has not yet been received. INTRODUCTION OF ORDINANCES: 13. Councilman Osborn introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Reclassifying Property by Adding Section 33 to Ordinance No. 725, New Series." 14. Councilman Osborn introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending the Alameda Municipal Code by Adding to Title XIII Thereof a New Chapter and Article to be Known as Chapter 3, Article 1, Regulating Soli- citations for Charitable, Patriotic, Philanthropic and Other Purposes." RESOLUTIONS: 15. The following resolution was introduced by Councilman Howe, who moved its adoption: "Resolution No. 3307 Authorizing City Attorney to Sign Stipulation Extending Time Within Which Action Must be Brought to Trial." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen. Howe, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon the Presi- dent declared said resolution duly adopted and passed. 16. The following resolution was introduced by Councilman Sweeney, who moved its adoption: "Resolution No. 3308 Transferring $35,731.32 from the In Lieu Tax Fund to the General Fund of the City of Alameda." The motion to adopt said resolution was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon the President declared said resolution duly adopted and passed. 17. The following resolution was introduced by Councilman Osborn, who moved its adoption: "Resolution No. 3309 Calling for Bids for Legal Advertising for the City of Alameda for the Fiscal Year 1946 -47." The motion to adopt said resolution was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Howe, Tones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon the President declared said resolution duly adopted and passed. 18. The following resolution was introduced by Councilman Sweeney, who moved its adoption: "Resolution No. 3310 Accepting Conveyance from Fanny J. Chipman of Certain Real Property and Consenting to the Recordation Thereof." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon the President declared said resolution duly adopted and passed. 19. The following resolution was .introduced by Councilman Sweeney, who moved its adoption: "Resolution No. 3311 Authorizing Housing Authority of the City of Alameda to Make Application to State - Director of Finance for State Aid in Acquiring and Establishing Temporary Housing Facilities for Veterans and Their Families and Families of Service Men." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon the President declared said resolution duly adopted and passed. 20. The following resolution was introduced by Councilman Osborn, who moved its adoption: "Resolution No. 3312 Authorizing Execution of an Agreement Between the City of Alameda and the Housing Authority in Aid of Acquiring, Developing, Administering and Removing Emergency Temporary Housing." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Howe, Tones, Osborn, Sweeney and President Branscheid, (5) . The following resolution was introduced by Councilman Jones, who moved its adoption: "Resolution-No. 3313 Adopting Specifications for Furnishing Paving Mixtures and Asphaltic Emulsions to the City of Alameda, Calling for Bids and Directing the City Clerk to Advertise Same." The motion to adopt said.resolution was seconded.by Councilman Howe and on roll call carried by -the following vote.. Ayes: .Councilmen Howe, Tones, Osborn, Sweeney and President Branscheid, (5). The following resolution was introduced by Councilman Sweeney, who moved its adoption: "Resolution No. 3314 Adopting Specifications for Furnis1 ing.Quarry Waste and Earth Fill to the City of Alameda, Calling for Bids and Directing City Clerk to Advertise Same." The following resolution was introduced by Councilman Howe, who moved its adoption: "Resolution No. 3315 Adopting Specifications for Furnishing Gasoline to the City of Alameda for the Fiscal Year 1946 -47, Calling for Bids and Directing City Clerk to Advertise Same." The motion to adopt said resolution was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5). The following resolution was introduced by Councilman Osborn, who moved its adoption: "Resolution No. 3316 Adopting Specifications and Provisions for Resurfacing and Repair of Asphalt and Bituminous Pavement for the Fiscal Year Ending June 30, 1947." The motion to adopt said resolution was seconded by Councilman Tones and on roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon the President declared said resolution duly adopted and passed. 25. The following resolution was introduced by Councilman Sweeney, who moved its adoption: "Resolution No. 3 317 Adopting Specifications and Provisions for Repair of Portland Cement Concrete Sidewalk, Curb and Gutter for Fiscal Year Ending June 30, 1947." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5). The following resolution was introduced by Councilman Osborn, who moved its adoption: "Resolution No. 3318 Authorizing the Reinvestment, Upon Maturity of 1300,000. now in 7/8 Per Cent Treasury Certificates., in 7/8 Per Cent Treasury Certificates and /or Other United States Government Securities." The motion to adopt said resolution was seconded by Councilman Howe and on -roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5). ORDINANCES FOR PASSAGE: 27 "Ordinance .No. 893, New Series An Ordinance Amending the Alameda Municipal Code by Adding to Title XVI Thereof a New Chapter and Article to be Known as Chapter 6, Article 1, Relative to Private Patrol Systems -- Private Watchmen." Councilman Osborn moved the ordinance be adopted as read. Councilman Howe moved the bills as itemized in the List of Claims filed with the City Clerk on May 21, 1946, and presented to the Council at this time, be allowed and paid.
