HELD TUESDAY EVENING, JULY 2, 1946
The meeting convened at 8:00 P. Y. with President Branscheid presiding.
ROLL CALL:
The roll was called and Councilmen Howe, Jones, Osborn, Sweeney and President
Branscheid, (5), were noted present. Absent: None.
MINUTES:
1. The minutes of the adjourned regular meeting held June 28, 1946, were approved
as transcribed.
ORAL COMMUNICATIONS:
21/ Mr. Prank Gottstein addressed the Council and related his appearance before
the Oakland City Council with reference to the proposed rerouting of traffic over
4th Street during peak hours and stated he was of the opinion that a study of this
proposition would be included in the Oakland traffic survey now under way.
He commented favorably on the matters taken up by the Council in its conference
with the officials of the Key System and also expressed his appreciation of the
manner in which the matter of parking in front of the Rosefield Packing Company
on Webster Street had been cared for.
HEARINGS:
3: In the matter of the Report of Superintendent of Streets of Repairs Made Pur-
suant to Section 31 of the "Improvement Act of 1911" No. 2 - concerning sidewalk
repairs on Clinton Avenue, in front of property known as 2201 Clinton Avenue.
City Engineer Froerer stated that the costs and expenses of the improvements in-
volved in this matter had been defrayed by the property owners and that there was
therefore no necessity for placing a lien on the property.
Councilman Jones moved that in view of Mr. Froererts statement, the present pro-
ceedings be dropped. The motion was seconded by Councilman Sweeney and carried.
REPORTS OF COMMITTEES:
4. From F. J. Croll, Auditor and Assessor, submitting the gross assessment
figures of the City of Alameda for the year 1946, showing a total of $36,361,500.,
which is a gain of $529,075. over the year 1945.
The report was noted and ordered filed.
5:' From the Department of Public Utilities, submitting a copy of its budget and
the resolution ad opting same at its meeting held June 27, 1946.
Councilman Sweeney moved the budget be accepted and ordered filed. The motion
was seconded by Councilman Jones and carried.
President Branscheid commended the Bureau of Electricity on the excellent work it
has done and the fine system it has built up, stating that it was highly efficient
and a credit to the City of Alameda, and that he wished to express the appreciation
of the Council for the fine service contributed to the City of Alameda by the mem-
bers of the public Utilities Board.
6. From the City Attorney, with regard to a suit entitled, "Frank Steffensen,
petitioner, vs. Fred J. Croll as City Auditor of the City of Alameda, California
Respondent," concerning the redemption of certain property known as No. 9 Mastici
Court, and recommending that he be authorized to file an answer in said action.
Councilman Jon es moved that the City Attorney be authorized to file an answer to
the petitioner in question and that the interests of the City in the matter be
protected. The motion was seconded by Councilman Howe and on roll call carried
by the following vote. Ayes: Councilmen Howe, Jones, Osborn, Sweeney and Presi-
dent Branscheid, (5). Noes: None. Absent: None.

7. / From the City Attorney, with regard to a sui t entitled, "Pacific Engineering
Company, a California corporation, Plaintiff, vs. City of Alameda a municipal cor-
poration, Defendant, No. 194683, Superior Court of Alameda County, and recommend-
ing that he be authorized to file an answer in said action.
Councilman Osborn moved the recommendation of the City Attorney be approved and
that he be authorized to proceed in the manner outlined. The motion was seconded
carried vote. Ayes:

8. Councilman Osborn introduced the following ordinance, after which it was
laid over under provision of law and the Charter:

11. The following resolution was introduced by Councilman Howe, who moved its
adoption:
"Resolution No. 3349
The motion to adopt said resolution was seconded by Councilman Tones and on roll
call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn,
Sweeney and president Branscheid, (5). Noes: None. Absent: None. Thereupon
the President declared said resolution duly adopted and passed.
"Ordinance No.
New Series
An Ordinance Authorizing the Surrender and Cancellation
of Leases between City of Alameda and United Engineering
Company, a Corporation; and Authorizing Leasing Certain
Tide and Submerged Lands to United Engineering Company,
a Corporation; Approving the Form and Terms of Said ,
Lease and Authorizing Execution Thereof."
9. At the suggestion of President Branscheid, City Manager McMillan explained
the new lease with United Engineering Company, the execution of which is au-
thorized by the ordinance introduced at this session - stating that the company
has three leases on City owned property at the present time and that the proposed
new lease consolidates the existing leases and includes the proviso that in the
event of condemnation by the Government of any portion of the property, all pro-
ceeds coming out of the condemnation proceedings will become the property of the
City of Alameda and will not be subject to division with the leaseholder.
10. The following resolution was introduced by Councilman Sweeney, who moved
"Resolution No. 3348
Adopting Specifications for Furnishing Crusher Run
Base to the City of Alameda, Calling for Bids and
Directing the City Clerk to Advertise Same."
Creating the Position of "Senior Engineering Aid" in
the Street Department of the City of Alameda, Pre-
scribing the Duties and Fixing the Salary Thereof."

13., Form of Lease - Between City and United Engineering Company.
14. A claim a ainst the General Departments of the City of Alameda in the total
amount of 89.85 was presented to the Council at this time.
Councilman Howe moved the claim as filed with the City Clerk on July 2, 1946,
and presented to the Council at this meeting, be allowed and paid. The motion
was seconded by Councilman Osborn and on roll call carried by the following vote.
Ayes: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5).
Noes: None. Absent: None.
15. At this point, Councilman Jones moved the meeting be recessed in order to
permit a proper study or the remaining resolution (salaries) on the agenda.
The motion was seconded by Councilman Sweeney and carried. The meeting recessed
at 8:25 P. M.
Following the recess, and at 10:30 P. M., President Branscheid reconvened the
session of the Council under the heading of "Resolutions."
RESOLUTIONS:
16. The following resolution was introduced by Councilman Osborn, who moved
its adoption:
"Resolution No. 335o
Establishing Certain Positions of Employment in the
City of Alameda and Fixing the Salaries and Rates of
Compensation for Such Positions and. For all Charter
Offices and Positions under the Jurisdiction of Said
City.“
The motion to adopt said resolution was seconded by Councilman Sweeney and on
roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn,
Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon
the President declared said resolution duly adopted and passed.

17. There being no further business to transact, Councilman Osborn moved the
meeting be adjourned to assemble in regular session on Tuesday evening, July 16,
1946, at 8:00 P. M.
