REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA
HELD TUESDAY EVENING, JANUARY 4, 1944
The meeting convened at 8:00 p. m. with President Godfrey presiding.
ROLL CALL:
The roll was called and. Councilmen Branscheid, Jones and. President Godfrey,
(3), were noted present. Absent: Councilmen Howe and Osborn, (2).
MINU1ES:
1. The minutes of the adjourned regular meeting held. December 28, 1943, were
approved as transcribed.
UNFINISHED BUSINESS:
2. The matter of the request by Mr. A. M. Sylvia for the refund of a plumbing
permit fee in the amount of $3. which had originally been presented to the Council
at its regular meeting held December 21, 1943, was again brought to the attention
of the Council through the City Attorney by communication from the Plumbing Inspec-
tor, A. R. Cranston.
This fee was paid for work proposed to be done at 1625 San Jose Avenue and the
contemplated installation was checked by Mr. Cranston although Mr. Sylvia subse-
quently did not personally perform the work. The Plumbing Inspector recommended
that the fee not be returned as it is his opinion that the City of Alameda fulfilled
its obligation.
The City Attorney stated that in his opinion the fee was lawfully exacted and paid
and the services of the City were performed by the Plumbing Inspector. Further,
as there is no provision in the Municipal Code for the refund of such fees, it is
his recommendation that the request of Mr. Sylvia be denied.
Councilman Branscheid moved the recommendation of the City Attorney be approved
and that the plumbing permit fee of $3. not be returned to Mr. Sylvia. The motion
was seconded by Councilman Jones and unanimously carried.
NEW BUSINESS:
3' City Attorney informed the Council that Mayor Lawrence E. Olson of Glen-
dale, President of the League of California Cities, has appointed him as one of
the members of the League Franchise Committee. This Committee will meet in Los
Angeles on January 14 and 15, 1944. The question before the Committee is with
respect to the conflict of jurisdiction between Cities of California and the Rail-
road Commission on the granting of franchises.
Following the Committee meeting, there will be an informal hearing in Los Angeles
on January 17, at which time there will also be a discussion on this question of
conflict of jurisdiction between Cities and the Railroad Commission with regard
to franchises.
The City Attorney asked the Council if it were its pleasure that he attend this
meeting and if so, that he be authorized so to do and the necessary amount of
money be appropriated to cover his expenses.
Councilman Branscheid moved that the City Attorney, H. Albert George, be authorized
to represent the City of Alameda at the meetings of the Franchise Committee of the
League of California. Cities, to be held in Los Angeles January 14 and 15, 1944, and
at the informal hearing between said committee and the Railroad Commission of the
State to be held in Los Angeles, January 17, 1944, for the purpose of discussing
matters of conflict of jurisdiction between the Commission and the Cities of the
State with relation to franchises granted to public utilities companies, and that
a sum not exceeding $75. be allowed as traveling expenses. The motion was seconded
by Councilman Jones and on roll call carried by the following vote. Ayes: Council-
,
men Branscheid, Jones and President Godfrey, (3). Noes: None. Absent: Councilmen
Howe and Osborn, (2).
Councilman Jones moved the City Manager be instructed to arrange a meeting
between Mr. Homer Grant of the Key System and the members of the Council to dis-
cuss various phases of transportation conditions. The motion was seconded by
Councilman Branscheid and unanimously carried.
RESOLUTIONS:
5. The following resolution was introduced by Councilman Branscheid, who moved
its adoption:
"Resolution No. 2943
In Memoriam of Charles Curtis Anderson
"In the sudden and untimely death of Charles Curtis
Anderson, Alameda has lost one of her foremost citizens.
"His loyal and friendly disposition, his upright and
splendid character endeared him to all with whom he came
in contact.
"As a former Councilman, who had been elected by an
overwhelming vote of the people of this community, and
subseqaently, as the Executive Director of the Housing
Authority of the City of Alameda, he was untiring in his
efforts to promote a higher standard of living conditions
for the recent great influx of people to this city. His
integrity and conscientiousness in performing his duties
earned the great respect of his business associates.
"NOW, THEREFORE, BE IT RESOLVED that we, the members
of the Council of the City of Alameda, in regular session
assembled, hereby express and record, on behalf of ourselves
and of the citizens of the City of Alameda, our sorrow and
deep regret for the death of Charles Curtis Anderson.
"RESOLVED, FURTHER, that this resolution be spread
upon the minutes of this meeting and a copy be transmitted
to Mrs. Anderson that it may extend to her and to the mem-
bers of the family an expression of our sincere sympathy
and heartfelt condolence."
The motion to adopt said resolution was seconded by Councilman Jones and on roll
call carried by the following vote. Ayes: Councilmen Branscheid, Jones and
President Godfrey, (3). Noes: None. Absent: Councilmen Howe and Osborn, (2).
Thereupon the Mayor declared said resolution duly adopted and passed.

ADJOURNMENT:
7. There being no further business to come before the meeting, the Council
adjourned to assemble in regular session on Tuesday evening, January 18, 1944,
at 8:00 p. m.
