1944-04-04 Regular CC MinutesREGULA'R MEETING. OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, APRIL 4, . 1944 The meeting convened at 8:02 u. m. with President Godfrey- presiding. ROLL CALL: The roll was called and Councilmen Branscheid, Howe, Osborn and P resident Godfrey, (4) were noted present. Absent: Councilman Jones, (1). MINUTES: 1. Inc minutes of the regular meeting held March 21, 1944, were approved - transcribed. WRITTEN COMMUNICATIONS: 2 -,-, lorom Mrs. S. Carpaneto, requesting permission to move a dwelling known as 33 Pacific Avenue to the southerly 35 feet of lots 1-2-3, Block. 464-11 in the HaiNght• Tract, more particularly described as the east line of Third Street, 90 feet south of Lincoln Avenue. A communication was also presented from the City Manager, recommending that per- mission be granted to Mrs. Carpaneto to move the above referred to dwelling as specified, as she has now acquired an additional 10 feet of land for the Third Street lots thereby procuring the required 4,000 square feet area. Councilman Branscheid moved the recommtion of the City Manager be approved and that Mrs. Carpaneto be allowed to move her dwelling from its present location to the site as stated in the request, provided all ordinances of the City per- taining to house moving are complied with. The motion was seconded by Councilman Osborn and unanimously carried- From the Tax Collector's Office, County of Alameda, submitting copy- of a resolution adopted by the Board of Supervisors, giving notice of the intended sale at public auction of certain parcels of property deeded to the State for nonpayment of delinquent taxes. The resolution contained the description of one parcel, indicated as "Parcel No. o", situated in the City of Alameda and shown on the "Map of the Town of Encinal and Lands Adjacent", being lots 8, 9 and 10 and portion of alley and south 10 feet of lot 11, Block 320/39. Main bid to the County is ,158.78, plus cost of advertising. Records of the City Assessor's office show that the City. of Alameda has an amount of 473.25 in delinquencies against this property. There being no objections, the matter was referred to "New Business". 4 From the East Bay Division of League of California Cities, giving notice of its next dinner meeting to be held in Berkeley on Friday evening, April 21, 1944, for which. the City of Alameda will act as host. The City Clerk was requested to take care of the necessary reservations for those wishing to attend. ORAL C 0115240 A T IONS 5. MT. Joseph dersick, 1453 Webster Street, requested permission from the Coun- cil to erect an eiht-foot fence in the rear of property occupied by him, to pro- tect storage area from being molested by children. This matter was referred to the City' Manager for his report as to the possibility - of granting such a permit under the present ordinances. Dixon 350. 3504 - 68th Avenue, Oakland Councilman Branscheid moved the City Manager be authorized to sell this motorcycle to Mr. Clark Pardee, 1035 Arnold Street, San Leandro, for the sum of 675. as he was the highest bidder. The motion was seconded by Councilman Osborn and unani- mously carried. REPORTS -F COMMITTEES: . 7. From. the Auditor and Assessor, advising that no assessments will he levied by the City of Alameda for the year 1944-1945, on that certain land involved in the condemnation action known as wUNITED STATES v. 7.155 Acres, in the City of Alameda, etc., ESTHER QUEIROLO, et al., No. 22984-G." The communication was noted and ordered filed. V From 8. ii the City Attorney, advising that, in his opinion, the Council has no authority to cancel taxes on land involved in that condemnation action known as "UNITED STATES v. 7.155 Acres, in the City. of Alameda, etc., ESTHER QUEIROLO, et al. , No. 22984-G," such request for cancellation having been received from M. Mitchell BourQuin, Esq., Special Assistant to The Attorney General, on March 16, 1944. There being no objections, the advice of the City. Attorney was accepted and approved. 9. From the City. Planning Board, recommending the reclassification of that certain property now known as 708 Haight Avenue, lying on the south line of Haight Avenue, beginning1_00 feet east of Webster Street, having frontage of 30 feet and depth of 132 feet 0 inches - from the "C" Multiple Dwelling District to the 'T" Central Busi- ness District. 11; is proposed to erect a hotel on this property. There being no objections, the communication was received and ordered filed and the matter referred to "Ordinances for Introduction". 10. From the City Manager, recommending that the Council authorize the sum. of 950. to be spent from the Street Improvement Fund for the purchase .of a certain strip of land lying on the west side of Webster Street, now owned by the University of Cali- fornia. This strip has been used for street burboses in connection with traffic around and near Posey Tube. Councilman Osborn moved the recommendation of the City Manager be approved and that the amount of 9950. be allocated out of the Street Improvement Fund to purchase the land in Question. The motion was seconded by Councilman Howe and on roll call car- ried by the following vote. Ayes: Councilmen Eranscheid, Howe, Osborn and Presi- dent Godfrey, (4) . noes: hone. Absent: Councilman Jones, (1). From the City Manager, recommending that the sum of 9200. be set aside out Contingent Fund, 70-b, for the extra fee of Coates and Herfurth, Consulting Actu- aries, for their services on an additional survey to be made in conjunction with the survey authorized by Ordinanc e No. 673, New Series, which a group of City em- ployees has desired to have made concerning suyg suggested amendments to the Alameda. Retirement Systeri Inc City Manager had been requested to obtain this information at the last reguiar meeting of the Council. Councilman Howe moved the recommendation of the City. Manager be approved and that tne sum of 200. be allocated out of Contingent Fund, 70-b, to pay the additional fee to the actuaries, Coates and Herfurth, for this supplementary survey of the Retirement System as further stipulated above. The motion was seconded by Council- man Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Osborn and President Godfrey, W. Noes: None. Absent: Councilman Jones, (1). 12. From the City Attorney, with regard to certain damages sustained by City property caused by A. J. McChesney and Melvin McChesney, doing business as Acme House Moving Comhany, while moving houses formerly known as 751 and 753 Eagle Avenue to the north line of Eagle Avenue between Park and Everett Streets. The City Attorney requested that the City' Manager make formal written demand upon A. J. and Melvin McChesney' - Acme House Moving Company - and Standard Accident Insurance Company, its surety, for the payment of said damages in accordance with the terms of the bond and if payment is now made within a reasonable time, the City Attorney be authorized to file an action against the parties above named and their surety for the recovery of damages as more particularly set forth in the City Attorney's letter of April 4, 1944. There being no objections, the matter was referred to "Resolutions". 13. From the City Manager, submitting a report as requested by the Council at its last regular meeting, on the condition of Washington Park Bathhouse. This request was subsequent to the request by the American Legion to permit this building to be occupied by Boy Scout troops. The City Manager reported that the baithing is not in first class condition structurally. The Naval Air Station has requested to use this building in furtherance of its welfare program for approximately 900 civilian employees and, in the event the City will allow the Naval Air Station to use the building, the Navy Department will maintain the building and improve the grounds. The City Manager recommended that if the Naval Air Station officially requests the use of this structure, he be permitted to enter into negotiations to bring about an acceptable arrangement to both the City and the Navy Department. Councilman Howe moved the recommendation of the City Manager be approved and that he be authorized to negotiate with the Naval Air Station for the future use of Washington Park. Bathhouse, providing the building be repaired and maintained as the City Manager was assured it would be in the verbal discussion between him and the Naval Officer et the Air Station, and that a report be submitted concerning the matter. The motion was seconded by Councilman Osborn and unanimously carried. ORDINAI, CES FOR IPIROILYUCTaM: 14. Councilman Branscheid introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Authorizing Execution of an Amendment of Certain Leases Between the City. of Alameda and Lars A. Pedersen Made Pursuant to the Provisions of Ordinance No. 169, New Series." 15. Councilman Osborn introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Reclassifying Property by Adding Section 26 to Ordinance No. 725, New Series." 16. Councilman Howe introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending Sec. 17-442, of Art. 4, Ch. 4, Title XVII, of the Alameda Municipal Code." 17. Councilman Branscheid introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. An Ordinance Adding a New Article, Numbered 5, to Chapter 4, Title XVII of the Alameda Municipal Code." NEW BUSINESS: -L/ - 18 . 'Matter of the sale by the Tax Collector's office of the County of Alameda which was first presented at this meeting under Tilritten Communications" was brought. up. Councilman Branscheid moved the County Tax Collector and the Board of Supervisors . be notified that the Council consents to the sale of this property as proposed and that they. be informed that there is now against it the sum of W3.25 for City of Alameda delinquent taxes, including penalties. Absent: Councilman Jones, (1). 19' this time Bonds No. 837853-K and No. 837854-K - American Surety Company 97 of New York - being City Clerk's and Public Officials' Bonds, respectively, were presented for approval and acceptance. They will run from April 16, 1944, for a period of one year. Councilman Howe moved the above designated bonds be approved and accepted. The notion was seconded by Councilman Hranscheid and unanimously carried. RESOLUTIONS: 20. The following resolution was introduced by Councilman Osborn, who moved its adoption: "Resolution No. 2957 Abolishing Position of Storekeeper." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Osborn and President Godfrey, (4) . Noes: None. Absent: Councilman Jones, (1). Thereupon the Mayor declared said resolution duly adopted and passed. 21. The following resolution was introduced by Councilman Branscheid who moved its adoption: "Resolution No. 2958 Consenting to Ao,,ignment of Certain Leases by United Engineering Company, Ltd., to the Anglo California National bank of San Francisco." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Osborn and President Godfrey, (4) . Noes: None. Absent: Councilman Tones, (1). Thereupon the Mayor declared said resolution duly adopted and passed. 22. The following re solution was introduced by Councilman Howe, who moved its adoption: "Resolution No. 2959 Prescribing the Duties of the Position of Janitress." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Osborn and President Godfrey, (4), Noes: None. Absent: Councilman. Jones, (1). Thereupon the Mayor declared said resolution duly adopted and passed. 23. The following resolution was introduced by Councilman Osborn, who moved its adoption: "Resolution No. 2960 Fixing Salary of the Position of Janitress in the General Administrative Department." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the followinE vote. Ayes: Councilmen Branscheid, Howe, Osborn and President Godfrey, (4) . Noes: hone. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution Lo. 2961 Creating and Establishing One (1) Additional Position of Janitress in the General Adminis- trative Department o1 the City." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Osborn. and President Godfrey, (4) . Noes: None. Absent: Councilman Jones, (1). Thereupon the Mayor declared said resolution duly adopted and passed. 25. The following resolution was introduced by Councilman. Branscheid, who moved its adoption: "Resolution No. 2962 Authorizing Demand for Payment ef Damages to City Property and Institution of Action." The motion to adopt said resolution w as seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Osborn and President Godfrey, (4) . Noes: Lone. Assignment of Lease - From United Engineering Company, Ltd. to Anglo California National Bank o1 San Francisco. BILLS: 29. An itemized List of Claims against the City. of Alameda and the General Departments in the total amount of 61,150. was presented to the Council at this meeting. Councilman Branscheid moved the claim as itemized in the Lis t of Claims filed with the City Clerk on April 4, 1944, and presented to the Council at this time, be allowed and paid.
