REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAIVIEDA
HELD TUESDAY EVENING, OCTOBER 3, 1944
The meeting convened at 8:00 p. m. with President Godfrey presiding.
ROLL CALL:
The roll was called and. Councilmen Branscheid, Howe, Jones, Osborn and
President Godfrey, (5), were noted present. Absent: None.
MINUTES:
1. The minutes of the regular meeting held. September 19, 1944, were approved
as transcribed.
WRITTEN 001,1UNICATIONS:
From General Engineering and Dry Dock Company, regarding the matter of the
abandonment by the City of certain sewer easements on Lafayette, Schiller, Union
and Einturn Streets and offering to pay the City $100. for such releases.
The Council concurred in the opinion that the City should release these ease-
ments to the General Engineering and. Dry Dock Company in consideration of its
payment to the City of $100. for a quitclaim deed. The matter was then referred
to "Ordinances for Introduction."

3. From the Railroad Commission of the State of California, notifying of its
Decision No. 37366 granting to the Southern Pacific Company the right to con-
struct a spur track at grade across Everett Street in the City of Alameda.
There being no objections, the matter was ordered filed.
. From Pacific Bridge Company, notifying the Council of the assignment ,,by it
to the United States of America of all its rights in the lease between City of
Alameda and Pacific Bridge Company covering the McKinley Park Football Field and
Bleachers.
The communication was ordered filed with the suggestion that the City Attorney be
apprised of the matter.

5. From the Tax Collector of the County of Alameda, enclosing Resolution No.
42095, informing the Council of the proposed sale at public auction of certain
property situated in the City of Alameda.
The Council had previously given its consent to the sale as outlined in this
resolution and the matter was ordered filed.
5. From the Alameda Ministerial Union, pertaining to the manner in which the
victory over Germany should be observed and stating that all Churches would be
open for services upon receipt of such news.
The communication was favorably noted and ordered filed.
6v. From Alameda County CIO Council, enclosing copy of Resolution adopted at its
meeting held. September 18, 1944, with regard to a "stay on the job" celebration
on receipt of news of victory over Germany and urgino. Council to use its influence
to prevent mass demonstrations on the streets.
The resolution was ordered filed.
7' Er. John Hall, 1349 Fernside Boulevard, concerning the stench eminating
from the Estuary in the east end of the City and the damage done to paintwork and
brass and copper trim on the houses in that locality.
There was considerable discussion with regard to the various phases of this com-
plaint, particularly the actual damage done to paint and trim work on the homes
in the vicinity from gas caused by discharge of refuse in the Estuary.
Councilman Branscheid moved the matter be referred to the City Manager with
authority to investigate conditions and if necessary, employ such technical
assistance as may be required to determine the causes underlying the situation
complained of. The motion was seconded by Councilman Howe and unanimously carried.
OPENING'OF BIDS:
8. Bids were opened and read for the furnishing of street surfacing mixtures to
the City of Alameda, as follows:

Accompanied by certified check in amount of $250.
From American Bitumuls Company
Accompanied by certified check in amount of $ 41.21
These bids were referred to the City Manager and City Engineer for study and
recommendation.

9. Bids were opened and read for the project of painting the exteriors of
the four Fire Stations in the City of Alameda, as follows:

These bids were referred to the City Manager and City Engineer for study and
recommendation.
REPORTS OF COMMITTEES:
10. From the City Manager, recommending that A. R. Cranston, Plumbing Inspector,
be authorized to attend meeting of Plumbing Inspectors' Association to be held in
Fresno, October 13 to 15, inclusive, and that $50. be appropriated to cover his
expenses.
Councilman Branscheid moved the recommendation of the City Manager be approved;
that A. R. Cranston, Plumbing Inspector, be authorized to attend the meeting
above referred to and that an amount not to exceed $50. be allowed for his ex-
penses. The motion was seconded by Councilman Osborn and on roll call carried
by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and

11. From the City Manager, recommending that contract be awarded to Ransome Com-
pany for the resurfacing and repairing of asphalt and bituminous pavements in the
City of Alameda during the fiscal year ending June 30, 1945, as it was the low
bidder.
Councilman Jones moved the recommendation of the City Manager be adopted; that
contract be awarded to Ransome Company for the work specified above and that
checks be returned to the unsuccessful bidders. The motion was seconded by
Councilman Howe and on roll call carried by the following vote. Ayes: Council-
men Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None.

12. From the City Manager, recommending that certain City officials attend the
One Day Conference of the League of California Cities - Luncheon and Dinner Ses-

sions to be held at Fairmont Hotel, October 10, 1944, and the necessary funds
be appropriated to cover expenses.
Councilman Howe moved the recommendation of the City Manager be approved; that
certain City officials attend this meeting as scheduled and the required amount
of money be allowed to take care of the expenses. The motion was seconded by
Councilman Branscheid and on roll call carried by the following vote. Ayes:
Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes:
None. Absent: None.

13. From the City Manager, concerning the lease on a portion of the Alameda Muni-
;
cipal Golf Course to the United States Government, informing the Council that the
Government has notified the City said lease has been terminated as of June 30,
1944, and the sum of $2,633.66 would be paid by the Government in lieu of the
work it was to do toward restoration. The City Manager recommended this sum be
accepted.
A general discussion was held with regard to the extent of the restoration work
to be done and the adequacy of the amount offered to meet the costs of such
restoration. The City Manager assured the Council that the sum offered was
sufficient.
Councilman Osborn then moved the recommendation of the City Manager be adopted
and the sum of $2,633.66 be accepted from the United States Government to pay
for the restoration work to be done. The motion was seconded by Councilman
Jones and unanimously carried.
14. From the City Attorney, re action entitled, "United States of America,
Plaintiff, vs. 7.155 Acres, etc., Esther Queirolo, et al, Defendants, No.
22984-G," and recommending that the City file a disclaimer to any interest
in the land in question, exc1udin, rights of the public in said streets and
in certain easements.
The matter was referred to "Resolutions."
15. From the City Attorney, re action entitled, "United States of America,
Plaintiff, vs. Certain land, etc., Alameda Belt Line Railway, et al., Defendants,
No. 22407-R," concerning the taking by condemnation proceedings of certain lands
in the City of Alameda, subject to the City's easements for sewers, electric
power lines and public streets.
The matter was referred to "Resolutions."
16. From the City Attorney, relative to the acceptance of a deed from H. R. and
Bertha Groth granting to the City an easement for electric line purposes over a
five-foot strip of land west of and adjacent to Everett School property,running
north 100 feet from the northerly line of Eagle Avenue.
The matter was referred to "Resolutions."
le. From Judge Daniel H. Knox, addressed to the City Manager, requesting authori-
zation to attend the Conference of Justices of the Peace and Constables' Associa-
tion to be held in Fresno, October 5, 6 and 7,and permission to submit statement
of his expenses, to be not over $50.
Councilman Howe moved the request of Judge Knox be granted; that he attend the
above mentioned conference and an amount not to exceed $50. be appropriated to
cover his expenses. The motion was seconded by Councilman Osborn and on roll
call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones:
and Osborn, (4). Noes: President Godfrey, (1). Absent: None.
17. From George R. Doran, Chief of Police, addressed to the City Manager, recom-
mending the elimination of certain stop signs on Eagle Avenue between Grand and
Mulberry Streets.
The matter was referred to "Ordinances for Introduction."
18. The matter of the City Manager's attendance at the Conference of the Interna-
tional City Managers' Association to be held in Chicago, Illinois from October
12 to 17, 1944, was presented by Councilman Jones and he moved the City Manager
be authorized to attend this convention and an amount not to exceed $200. be
appropriated to defray his expenses. The motion was seconded by Councilman Howe
and on roll call carried by the following vote. Ayes: Councilmen Branscheid,
Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None.
ORDINANCES FOR INTRODUCTION:
19. Councilman Branscheid introduced the following ordinance, after which it was
laid over under provision of law and the Charter:
"Ordinance No.
New Series
An Ordinance Vacating Certain Sewer Easements
and Authorizing the Execution of Quitclaim Deed
to General Engineering and Dry Dock Company."
20. Councilman Jones introduced the following ordinance, after which it was laid
over under provision of law and the Charter:
"Ordinance No.
New Series
An Ordinance Amending the Alameda Municipal Code by
Repealing Subsection (19) of Section 17-431 Thereof."
RESOLUTIONS:
21. The following resolution was introduced by Councilman Branscheid, who moved
its adoption:
"Resolution No. 3048
Authorizing Filing of Partial Disclaimer in Eminent
Domain Proceedings Instituted by the United States
of America."
The motion to adopt said resolution was seconded by Councilman Osborn and on roll
call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones,
Osborn and. President Godfrey, (5). Noes: None. Absent: None. Thereupon
the Mayor declared said resolution duly adopted and passed.
22. The following resolution was introduced by Councilman Branscheid, who
moved its adoption:
"Resolution No. 3049
Authorizing the Execution of Stipulation and
Disclaimer in Eminent Domain Proceedings
Instituted by the United States of America."
The motion to adopt said resolution was seconded by Councilman Osborn and on
roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe,
Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None.
Thereupon the Mayor declared said resolution duly adopted and passed.
23. The following resolution was introduced by Councilman Osborn, who, follow-
ing the suggestions of President Godfrey that City Manager Don. C. McMillan be
named as the Committeeman, moved its adoption with Mr. McMillan's name inserted
as the appointee:
"Resolution No. 3050
Resolution Appointing Committeeman to Represent the
City of Alameda on the Committee Provided by Section
25 of 1944 Act of the Legislature Appropriating
$10,000,000, for the Development of a Postwar Public
Program by the State and. Local Agencies."
The motion to adopt said resolution was seconded by Councilman Branscheid and
on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe,
Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None.
Thereupon the Mayor declared said resolution duly adopted and passed.
24. The following resolution was introduced by Councilman Branscheid, who
moved its adoption:
"Resolution No. 3051
Acceptance and Consent to Recordation of Grant of
Easement from H. R. Groth and Bertha Groth to the
City of Alameda."
The motion to adopt said resolution was seconded by Councilman Osborn and on
roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe,
Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None.
Thereupon the Mayor declared said resolution duly adopted and passed.
ORDINANCES FOR PASSAGE:
25. "Ordinance No. 857,
New Series
An Ordinance Amending Ordinance No. 673, New Series,
Entitled "An Ordinance Establishing a Retirement,
Pension and Insurance System for Officers and Em-
ployees of the City of Alameda."
Councilman Jones moved the ordinance be adopted as read. The motion was
seconded by Councilman Osborn and on roll call carried by the following vote.
Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5).
Noes: None. Absent: None.

At this time, Mayor Godfrey suggested the Chief of Police be highly
complimented by the City Manager on the Annual Report made by the Police
Department.
Councilman Osborn also stated he felt the Chief of Police should be further
commended for the fine work being done in the schooling of the personnel of
his department.
30.. Councilman Jones brought up the matter of the type of reports submitted
by the City Engineer covering work within his jurisdiction and made some very
commendatory remarks concerning the nature and scope of the reports.
ADJOURNMENT:
31. There being no further business to be transacted, the Council adjourned
to assemble in regular session on Tuesday evening, October 17, 194, at 8:00
p. m.
