1944-11-08 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD WEDNESDAY EVENING, NOVEMBER 8, ------ 1944 The meeting convened at 8:00 p. m. with President Godfrey presiding. ROLL CALL: The roll was called and Councilmen Branscheid, Fowe, Jones, Osborn and President Godfrey, (5), were noted present. Absent: None. MINUTES: 1. The minutes of the adjourned regular meeting held October 27, 1944, were approved as transcribed. WRITTEN COMMUNICATIONS: 2. From the Key System, explaining the proposed changes in routes of its bus lines Nos, 79 and 61, and establishing a new line to be known as No. 71, to serve Bay Farm Island via High Street from East Oakland, and requesting the Council's endorsement of the contemplated schedules. Councilman Osborn moved the City Manager be authorized to inform the Key System that the City of Alameda has no objection to the proposed changes, provided the schedules set forth in its letter of October 27, 1944, are maintained. The motion was seconded. by Councilman Branscheid and unanimously carried. 3. From Mr. Clyde C. Kennedy, Consulting Engineer, submitting his report on "Odors and Paint Discoloration in the Fernside District" as his findings of the investigation of the sewage disposal situation in the Estuary, which had been authorized by the Council. The reading of the report and letter of transmittal was dispensed with at the suggestion of Councilman Branscheid, as each Councilman had received a copy. Councilman Osborn stated that from a reading of the report, he had noted that the canneries were considered to be one of the contributing factors to this situation at this time of year and he moved that the City Manager be instructed to investi- gate the possibility of preventing the depositing of further refuse by them in the Estuary. The motion was seconded by Councilman Howe and unanimously carried. President Godfrey then ordered the report filed. 4' the CIO Political Action Committee, requesting to be informed of the date of any City election to be held in 1945 and the offices to be filled. The City Clerk was instructed to furnish the desired information. OPENING OF BIDS: 5. Bids were opened and read for the project of repairing sidewalks, curbs and gutters during the fiscal year ending June 30, 1945, in accordance with Specifi- cations and Provisions No. PW 10-44-10, as follows: From Lee Scaramelli Accompanied by cashier's check in amount of From Grey Construction Company Accompanied by certified check in amount of - 185.00 258.00 There being no objections, these bids were referred to the City Manager and City Engineer for their study and recommendation. 6: No bids were received for furnishing seal coating asphalt and bituminous pavement during the fiscal year ending June 30, 1945, in accordance with Specifi- cations and Provisions No. PW 10-44-9. President Godfrey inquired as to the possibility of obtaining these materials in the open market. At the suggestion of the City Attorney, the matter was put over until the next Council meeting in order that it might be presented by a resolution. REPORTS OF COMMITTEES: 7. From the City Manager, regarding matter of application of The Society For Christian Instruction of Alameda County, Incorporated, to construct a wire fence above the existing regulation board fence on property at 2226 Pacific Avenue. A thorough investigation of the various phases of this situation had been made and the City Manager therefore recommended that a permit be granted to the above organization to erect the fence as requested. Councilman Branscheid moved the recommendation of the City Manager be approved and the permit issued. The motion was seconded by Councilman Osborn and unani- mously carried. From the City Attorney, reporting on his attendance at a hearing before the Railroad. Commission on the matter of methods and practices of gas corporations in determining and recording the heating value of gas. No definite action was taken at this time, but there will be further hearings and studies. The communication was ordered filed. INTRODUCTION OF ORDINANCES: 9. Councilman Jones introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Adding to Chapter 4, Title X of the Alameda Municipal Code a New Article to be Known as Article 3, Providing an Alternative Procedure for Demolition or Repair of Buildings Unfit for Human Habitation or Occupancy." 10. Councilman Osborn introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Permitting the Distribution of Manufacturing Milk in the City of Alameda Under Specific Requirements and During a Limited Period of Existing Emergency." President Godfrey stated that because of the emergency clause appearing in this ordinance, it would be presented for passage at this meeting at the appropriate time. 11. Councilman Branscheid introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Authorizing and Directing the Execution of an Agreement Renewing Lease Made Between the City of Alameda and Alaska Packers Association, Dated February 5, 1920, for an Additional Term of Twenty- Five Years." UNFINISHED BUSINESS: 12. From the City Manager, •recommending the approval by the Council of the City of Alameda of the Law Enforcement Mutual Aid Plan of the California State War Council. This matter had been laid over from the adjourned regular meeting of the Council held October 27, 1944. There being no objections, the matter was referred to "Resolutions." RESOLUTIONS: 13. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 3056 Approving and Adopting Proposed Law Enforcement Mutual Aid Plan and Authorizing Participation in the Plan by the Officers and Employees of the City of Alameda." The motion to adopt said resolution was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. Thereupon the President declared said resolution duly adopted and passed. 14. The following resolution was introduced by Councilman Osborn, who moved its adoption: 106 "Resolution No. 3057 Resolution Authorizing Execution of Supplemental Agreement with the United States of America for Payment in Lieu of Restoration of Premises Covered by Lease of July 1, 1942, Leasing Portions of Alameda Municipal Golf Course." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. Thereupon the President declared said resolution duly adopted and passed. 15. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 3058 Consenting to Recordation of Grant of Right of Way." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. Thereupon the President declared said resolution duly adopted and passed. 16. The following resolution was introduced by Councilman Howe, who moved its adoption: "Resolution No. 3059 Creating the Office and Position of "Deputy City Attorney." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. There- upon the President declared said resolution duly adopted and passed. 17. The following resolution was introduced by Councilman Osborn, who moved its adoption: "Resolution No. 3060 Fixing Salary of the Position of Deputy City Attorney." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. There- upon the President declared said resolution duly adopted and passed. ORDINANCES FOR PASSAGE: 18. "Ordinance No. 860, New Series An Ordinance Amending Subsection (6) of Section 17-431 of the Alameda Municipal Code, Relating to Through Highways." Councilman Jones moved the ordinance be adopted as read. The motion was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Coun- cilmen Branscheid, Howe, Jones, Osborn and. President Godfrey, (5). Noes: None. Absent: None. 19. "Ordinance No. 861, New Series An Ordinance Repealing Section 17 and Amending Subsection (c) of Section 7 of Ordinance No. 673, New Series, Entitled "An Ordinance Establishing a Retirement, Pension and Insurance System for Officers and Employees of the City of Alameda." Councilman Osborn moved the ordinance be adopted as read. The motion was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Coun- cilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. 20. "Ordinance No. 862, New Series An Ordinance Permitting the Distribution of Manufacturing Milk in the City of Alameda Under Specific Requirements and During a Limited Period of Existing Emergency." Councilman Tones moved the ordinance be adopted as read. The motion was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Coun- cilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. FILING: 21. Auditor's Balance Sheet - Month ending October 31, 1944. 22. Copies of 2 Reports submitted by Key System to Railroad Commission. 23. Renewal Agreement of Lease between City and Alaska Packers Association. 24.. Prior to adjournment, the President extended to the City Manager and others who had assisted in the preparation of the City Annual Report, the congratulations of the Council on a job well done.
