1940-04-16 Regular CC Minutes21 REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY _EVENING APRIL16. 1940 The meeting convened at 8:02 o'clock P. M. with President Weichhart presiding. ROLL CALL: 1. The roll was called and Councilmen Carrington, Maurer, Morris and President Weichhart, (4 were noted present. Absent: Councilman Godfrey, (1). MINUTES: 2. Minutes of the regular meeting of the Council held April 2, 1940 were approved as transcribed. WRITTEN COMMUNICATIONS: 3. A communication was presented from Albert J. Rice, requesting a six months' extension of time within which to commence remodeling property known as 1019 Morton Street, reclassification having been authorized October 17, 1939. There being no objections to this extension of time, Councilman Morris moved that the request be recommended, seconded by Councilman Carrington and on roll call carried by the fol- lowing vote. Ayes: Councilmen Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 4. From Omer and Minnie Etter, requesting the Council to authorize the Building Inspector to issue a permit to begin construction work on lot No. 7 of the Stewart Tract on the north line of Central Avenue 300 feet easterly of Chestnut Street. This property was reclassified on August 1, 1939 from Residential District, Class 1, to Residential District, Class 1 3/4 and as the six months' period has elapsed within which time construction may be started on reclassified property, the Building Inspect- or has refused to issue the building permit. After the City Attorney had explained the regulations of our zoning ordinance to the Council and there is no way by which the building permit could be legally authorized, Councilman Maurer suggested the letter be filed and it was so ordered. 5. A letter was received from Frank Gottstein regarding the cost of operation of the Fruitvale Avenue Bridge. As this letter had been previously read by all members of the Council present and there being no objections, the communication was ordered filed. v 6. From the Joint Subaqueous Tunnel Commission, submitting a report containing an analysis of traffic movement between the cities of Alameda and Oakland and estimates of cost of the construction of a new tube in the vicinity of the George A. Posey Tube. There being no objections, the report was referred to the Committee of the Whole. ORAL COMMUNICATIONS: 7. Councilman Morris said he believed representatives of the Pacific Telephone and Telegraph Company were present to address the Council and audience regarding the change of prefix from "Alameda" to "Lakehurst". Mr. Frank Marshall, Division Superintendent, and Mr. E. J. Angwin, Manager of the Alameda Branch, were present. Mr. Marshall explained in detail the reasons for sub- stituting the prefix "Lakehurst" for the currently used prefix "Alameda", proving it is mechanically impossible under the dial system to retain the word "Alameda". 8. Mr. Montin addressed the Council on the matter of transportation, advocating as Previously, the installation of a municipally owned ferry system and utilizing ferry and bus service to the Alameda Mole during the peak hours and bus service through the tube and over the San Francisco-Oakland. Bay Bridge during off-peak hours. REPORTS OF COMMITTEES: From the City Planning Board, recommending reclassification on the Council's own initiative of forty-five foot frontage of property owned by Mrs. Carol Hamilton and lying on the east line of Weber Street, beginning approximately 941 feet south of Central Avenue from Residential District, Class 1 to Residential District, Class to permit the construction of a duplex dwelling. This recommendation was prompted by the fact that the Board has placed Weber Street on the new zoning survey map in the "A-1" District, permitting construction of duplex dwellings on lots containing 5,000 square feet or over, after having been petitioned to this effect by the majority of property owners on Weber Street. Mrs. Hamilton's previous petition for reclassification of the total ninety foot frontage of her property having been denied by both the Planning Board and the Council, it was deemed unjust by the Board to request another twenty dollar re-zoning fee from Mrs. Hamilton. Councilman Morris asked Mrs. Hamilton, who was in the audience, if she had definitely determined upon the forty-five foot frontage instead of a fifty foot frontage as she was tentatively contemplating. Mrs. Hamilton stated she was in accord with the Plan- ning Board recommendation and the forty-five foot frontage was agreeable. There being no objections, the matter was referred to "Resolutions". 10. From the City Planning Board, recommending the reclassification of property known as 2050 Eagle Avenue from Residential District, Class 1, to Residential District, Class 1 3/4, for the purpose of remodeling into a four-family dwelling. This recommendation was prompted because it is the sense of the Planning Board to place this district under the new survey in a classification which will permit the requested use and no objections had been filed against this reclassification. Councilman Maurer moved that the recommendation of the City Planning Board be adopted, seconded by Councilman Morris and on roll call carried by the following vote. Ayes: Councilmen Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). ORDINANCES INTRODUCED: 11. Councilman Maurer introduced the following ordinances, after which they were laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending the Alameda Municipal Code by Adding to Chapter 22 Title IV, a New Article Governing the Municipal Golf Course.1, 12. "Ordinance No. New Series RECLASSIFYING PROPERTY (Known as 2050 Eagle Avenue 13. "Ordinance No. New Series RECLASSIFYING PROPERTY (Eastern Line Weber Street, 941 Feet Southerly from Central Avenue, with Frontage of 45 Feet)." NEW BUSINESS: 14. The City Manager addressed the Council, recommending the City Attorney be authorized to file a brief for the City of Alameda in the suit now pending before the Appellate Court, "City of Oakland vs. Williams", pertaining to the sewage disposal survey, also that the City Attorney be authorized to obtain whatever legal assistance is necessary in connection with the preparation of this brief. Councilman Morris moved the recommendation of the City Manager be adopted, seconded by Councilman Carrington, and on roll call carried by the following vote. Ayes: Council- men Carrington, Maurer Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (J5. 15. The City Manager requested to be allowed to declare as junk and sell the used and superfluous soft balls which are accumulating in the Recreation Department. These balls may be disposed of at approximately one-half their original cost and there is demand for them as practice balls. Councilman Carrington moved the City Manager be so authorized, seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1) lb. The City Attorney requested permission to turn over the preparation of the form of oil lease in connection with the proposed oil concession on the Golf Course, regarding drilling for oil. Councilman Morris inquired if the additional expenditure for legal aid in this regard was justified under the circumstances. Councilman Maurer stated he thought drawing up of this oil lease was a very special matter and should be handled by some attorney who is familiar with that type of lease. The City Attorney undoubtedly could acquire all the necessary knowledge to prepare a lease which would in all details protect the City, but as the time element is an issue and the City Attorney is now entirely occu- pied with other important matters, he believes the employment of an outside attorney is advisable in this instance. Councilman Maurer then so moved - that the City Attor- ney be authorized to employ whatever legal assistance necessary to draw up a proper lease covering the property on Bay Farm Island on which oil wells will be drilled. Councilman Morris inquired of Councilman Maurer if the time element involved would in his opinion warrant the additional expense of extra legal aid, to which Councilman Maurer replied he thought this matter should be handled in any instance by someone wholely familiar with oil leases. On roll call, the motion carried by the following vote. Ayes: Councilmen Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). RESOLUTIONS: 17. Councilman Morris introduced and moved the adoption of "Resolution No. 2467 Authorizing the City Manager to Make Application to the California-Western States Life Insurance Company for Group Hospitalization, Surgical. and Medical Benefits Insurance Covering the Employees of the City of Alameda and Authorizing the Auditor to Make Payroll Deductions for Premiums." Councilman Maurer seconded the motion and on roll call carried by the following vote. Ayes: Councilmen Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 18. Councilman Maurer introduced and moved the adoption of "Resolution No. 2468 Adopting Specifications for Furnishing One Four- Door Sedan to the City of Alameda, Calling for Bids and Directing the City Clerk to Advertise the Same." Councilman Carrington seconded the motion and on roll call carried by the following vote. Ayes: Councilmen Carrington, Maurer, Morris and President Weichhart, (4). Noes: None, Absent: Councilman Godfrey, (1). 19. Councilman Morris introduced and moved the adoption of "Resolution No. 2469 Authorizing Extension of Time for Joint Operation with County of Alameda of Fruitvale Avenue Bridge; Approving Form and Authorizing Execution of Third Supplemental Contract." Councilman Maurer seconded the motion and on roll call carried by the following vote. Ayes: Councilman Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 20. "Resolution No. 2470 Resolution of Intention to Change Zone, on Councilts Own Motion, of Certain Real Property in the City of Alameda, Alameda County, California." Councilman Maurer wished to state at this time he was pleased to move the adoption of this Resolution, particularly as he had been instrumental in the denial of the original petition to reclassify the property as requested by Mrs. Hamilton; that he considered the proposed new structure an improvement to the street and he was glad to see the property owners on Weber Street cooperate with Mrs. Hamilton and that she will now be permitted to use the property to advantage. Councilman Morris added he thought the Planning Board should be complimented in giv- ing this whole matter such sincere consideration and arriving at an excellent com- promise to the original plan. Councilman Morris now seconded Councilman Maurerts motion to introduce the Resolution and on roll call it was carried by the following vote. Ayes: Councilmen Carrington Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 21. Councilman Carrington introduced and moved the adoption of "Resolution No. 2471 Fixing Salary of Radio Technician." Councilman Maurer asked if the position of Radio Technician was not now being made into a full time position instead of a half-time one as at present. The City Manager said that was correct and informed the Council a shop had been equipped at the elec- tric light plant for the purpose of repairing radios in the cars, and the equipment of the City of Alameda is better than that of ninety per cent of other cities. The motion was seconded by Councilman Maurer and on roll call carried by the follow- ing vote. Ayes: Councilmen Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). ORDINANCES PASSED: 22. "Ordinance No. 710 New Series RECLASSIFYING PROPERTY (South Line Santa Clara Avenue, 267 Feet Easterly from Eastern Line of 9th Street)." Councilman Maurer moved the ordinance as read be adopted, seconded by Councilman Carrington and on roll call carried by the following vote. Ayes: Couficiineh Carrington, Maurer, Morris and. President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 23. "Ordinance No. 711 New Series RECLASSIFYING PROPERTY (North Line Santa Clara Avenue, 49 Feet 10 Inches West of St. Charles Street)." Councilman Carrington moved the ordinance as read be adopted, seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). FILING: 24. Notice of Hearing - Before Railroad Commission of State of California. 25. Specifications - For furnishing fordor sedan for use in Social Service Department. 26. Report on Proposed Additional Oakland-Alameda Tube - Joint Subaqueous Tunnel Commission. BILLS: 27. An itemized list of claims against the City of Alameda and the several departments thereof in the total amounts as follows, was presented to the City Council: General Departments, $5,966.93; Police Department, $326.47; Civil Service Department, $49.70; Pound Department, $650:85; Fire Department, $653.97; Street Department, $773.27; Health Department, $182.66; Recreation Department, §102.41; Park Department, $657.81; Golf Course Department, $415.27; Store Department $101.00; Social Service Department, $42.03; Initiative Relief Fund, $153.50; Street improvement Fund, $385.49; Krusi Park Special Fund, $139.20; Subaqueous Tunnel Fund, $490.56. Councilman Maurer moved, seconded by Councilman Carrington, that the claims and bills against the City in the amounts listed and itemized in the List of Claims filed with the City Clerk on April 16, 1940, and presented to the Council at this meeting, be allowed and paid.
