ROLL CALL: The roll was called and CouncilMen'Cartington, Godfrey, Maurer, Morris and Presi- dent Weichhart, (5), were noted present. Absent: None. MINUTES: 1. The minutes of the regular meeting of August 6, 1940, were approved as transcribed. WRITTEN COMMUNICATIONS: 2. A communication was presented from the International City Managers' Association, extending invitation to the Council to attend its twenty-seventh annual conference to be held in Colorado Springs, Colorado, September 23 to 26, 1940. There being no objec- tions, the communication was ordered filed. From Sheet Metal Workers, International Association, Local Union No. 216, advising of change in wage scale for sheet metal workers. There being no objection, the communi- cation was ordered filed. V 4. From the Southern Pacific Company, referring to its property on the northerly line of Eagle Avenue between a point 150 feet east of Wood Street and Bay Street, Alameda, and requesting the Council to consider a change of zone thereof, which would permit industrial use, at such time as desirable industries may be interested in locating thereon. There being no objection, the communication was ordered filed. HEARINGS: 5. Hearing was continued from the regular meeting of August 6, 1940, on temporary revocable permit issued for premises known as 1617 Central Avenue for boarding house purposes and owned by Mrs. Pauline A. Carver. Certain provisions of City ordinances have been violated by Mrs. Carver, the third floor of the dwelling being occupied with- out proper fire protection or fire escape. Judge E. J. Silver addressed the Council, representing Mrs. Carver, and informed it all regulations had been complied with, excepting the installation of a wit standpipe. Judge Silver requested the Council to waive this requirement, offering to install fire extenguishers in substitute therefor. After discussion, in which the Building Inspector explained phases of the requirements of the Uniform Building Code and City ordinances, Mayor Weichhart stated that stipulations of the City ordinances must be properly com- plied with in every detail, and to the satisfaction of the Building Inspector. Councilman Maurer moved that the hearing be continued until the next regular meeting, at which time a report would be requested of the Building Inspector. The motion was seconded by Councilman Morris and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 6. Mr. Frank A. Gottstein addressed the Council regarding regulations of the City of Alameda pertaining to fire protection in dwellings. REPORTS OF COMMITTEES: 7. From the City Planning Board recommending a temporary revocable permit be issued to Mr. H. L. Kelly, 4844 Daisy Street, Oakland, to allow him to conduct religious meet ings in a structure located on the southeast corner of Melrose Avenue and Maitland Drive, Bay Farm Island. Councilman Maurer moved that the recommendation of the City Planning Board be adopted, and permit be granted to Mr. H. L. Kelly to conduct religious gatherings at the specified location. The motion was seconded by Councilman Carrington and on roll call carried by the following vete. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 8. From the City Attorney, recommending the City of Alameda undertake to defend Police Officers Louis Meyer and Roland G. Dowen in actions brought against them for false imprisonment by Hermina Johanna Egberts and D. George Cole, and to render avail- able to the officers the services of the City Attorney. Councillan Morris moved that the recommndation of the City Attorney be adopted, seconded by Councilman Godfrey and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. From the City Manager, recommending the Council authorize the construction of a new eighteen inch sewer to replace the existing sewer on Pearl Street, the work to be done as a Works Progress Administration Project without contract or call for bids. There being no objections, the matter was referred to "Resolutions". 1&. From the City Manager, recommending the Council authorize the construction of con- crete curbs, gutters, gutter bridges and cement sidewalks, work to be done as a Works P rogress Administration Project without contract or call for bids. There being no objections, the matter was referred to "Resolutions". 11. From the City Manager, recommending the-Council authorize the rehabilitation of 940 electric light standards on City streets, work to be done as a oiorks Progress Ad- ministration Project without contract or call for bids. There being no objections, the matter was referred to "Resolutions". ORDINANCES INTRODUCED: 12. Councilman Carrington introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending Section 17-431 of'the Alameda Municipal Code by Adding Subdivision (14) Thereto." 13. Councilman Maurer introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinande-No.' New Series An Ordinance Amending Section 17-344 of the Alameda Municipal Code." UNFINISHED BUSINESS: 14. Councilman Morris stated he had figures from the City Auditor's office showing the City of Alameda had expended for the joint operation, with the County of Alameda, of the Fruitvale Avenue Bridge for the months of February, March, April, May and June, 1940, the sum of $2,176.84, and believed the City of Alameda should go on record as requesting, or demanding, that this amount of money be refunded by the County of Alameda, particularly in view of the decision of the Federal Courts against the County of Alameda. Councilman Carrington stated he would be in favor of requesting the County of Alameda to refund this money, and it was his understanding, if the County lost the case with the Federal Government, the City of Alameda would be reimbursed for the money it expended. Councilman Morris then moved that the County of Alameda be requested to refund to the City of Alameda the amount of $2,176.84 which was the sum the City of Alameda has paid for joint operation of the Fruitvale Avenue Bridge for the months of February, March, April, May and June, 1940. The motion was seconded by Councilman Carrington and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. NEW BUSINESS: 15. Councilman Maurer stated that last Saturday afternoon, August 17, 1940, he had occasion to observe the manner in which the Dime taxicabs in Alameda tend to monopolize parking spaces along Park Street, and moved the City Manager be instructed to investi- gate the feasibility of regulating the taxis to locate at a definite stand, or area, such as in front of a fire hydrant. Such a location would not permit regular parking, except when the car is attended by a licensed driver. In this way, by definitely desig- nating where the taxis may stand, at locations preferably off of Park Street and out of the regular parking zones, parking zones would then be available on Park Street for those drivers having business there. The motion was seconded by Councilman Godfrey, and on roll call carried by the follow- ing vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weich- hart, (5). Noes: None. Absent: None. RESOLUTIONS:' 16. The following resolution was introduced by Councilman Maurer who moved its adoption: "Resolution No. 2508 Approving Memorandum of Agreement for Expenditure of 1/4 Cent Gas Tax Allocated for Streets of Major Importance." The motion to adopt said resolution was seconded by Councilman Morris and upon roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and. President Weichhart, (5). Noes: None. Absent: None. Thereupon, the Mayor de- clared said resolution duly adopted and passed. 17. The following resolution was introduced by Councilman Morris who moved its adoption: "Resolution No. 2509 Authorizing the Deposit of Public Funds in Active and Inactive Deposits in Certain Banks." The motion to adopt said resolution was seconded by Councilman Maurer and upon roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. Thereupon, the Mwor de- clared said resolution duly adopted and passed. 18. The following resolution was introduced by Councilman Carrington who moved its adoption: "Resolution No. 2510 Fixing Time for Hearing Objections Against Closing Portions of Clay Street and Fillmore Street in the City of Alameda." The motion to adopt said resolution was seconded by Councilman Maurer and upon roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. Thereupon, the Mayor declared said resolution duly adopted and passed. 19. The following resolution was introduced by Councilman Maurer who moved its adoption: "Resolution No. 2511 Authorizing Renewal and Extension of Contract With the County of Alameda for the Examination of Con- tacts with Cases of Tuberculosis." The motion to adopt said resolution was seconded by Councilman Godfrey and upon roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and. President Weichhart, (5). Noes: None. Absent: None. Thereupon, the Mayor declared said resolution duly adopted and passed. 20. The following resolution was introduced by Councilman Carrington who moved its adoption: "Resolution No. 2512 Authorizing Construction of Sanitary Sewer on Pearl Street Without Contract." The motion to adopt said resolution was seconded by Councilman Maurer, and upon roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. Thereupon, the Mayor declared said resolution duly adopted and passed. 21. The following resolution was introduced by Councilman Godfrey who moved its adoption: "Resolution No. 2513 Authorizing Construction of Concrete Curbs, Concrete GUtters,'Gutter Bridges and Cement Sidewalks Without Contract." The motion to adopt said resolution was seconded by Councilman Morris and upon roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. Thereupon, the Mayor declared said resolution duly adopted and passed. 22. The following resolution was introduced by Councilman Carrington who moved its adoption: "Resolution No. 2514 Authorizing Painting, Repairing and General Rehabilitation of Electric Light Standards ,." Without Contract." The motion to adopt said resolution was seconded by Councilman Maurer and upon roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and. President Weichhart, (5). Noes: Non. Absent: None. Thereupon, the Mayor declared said resolution duly adopted and passed. ORDINANCES PASSED: 23. "Ordinance No. 724 New Series An Ordinance Repealing Chapter 1 of Title XI of the Alameda Municipal Code and Adding to the Alameda Municipal Code in Lieu Thereof a New Chapter to Regulate, Restrict and. Segregate the Location of Industries, Business, Trades, Dwellings and. Other Specified. Uses; to Regulate and Limit the Height and Bulk of Buildings Hereafter Erected; to Regulate and Determine the Area of Yards and Other Open Spaces; for Said Purpose to Divide the City into Districts or Zones; to Define the Terms Used Herein; and. Repealing All Ordinances in Conflict Herewith." Councilman Maurer moved that, inasmuch as copies of Ordinance No. 724, New Series, were delivered to each of the members of this Council and to the City Manager personally and before the introduction of the ordinance, and the members of the Council are familiar with the contents thereof, reading of the aforementioned ordinance be dispensed with, by unanimous consent. The motion was seconded by Councilman Carrington and unanimously carried. Councilman Maurer then moved that the ordinance so specified be adopted, seconded by Councilman Carrington and on roll call carried by the following vote. "Ordinance No. 725 New Series An Ordinance Adopting a District Map for the Purpose of Bounding and Describing the Use Districts of the City of "lameda." Councilman Godfrey moved the ordinance as read.be'adopted, seconded by .Councilman Carrington and on roll call-carried by the fOilOWing'vote. Ayes: Councilmen Carring- ton, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 25. "Ordinance No. 726 New Series An Ordinance Repealing Articles 1 and 2, of Chapter 2, Title XIV, of the Alameda Municipal Code and Adding to the Alameda Municipal Code in Lieu Thereof a New Article Establishing the City as a Fire District and Designating and Describing the Fire Zones Therein." Councilman Carrington moved the ordinance as read be adopted, seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 26. "Ordinance No. 727, New Series An Ordinance Amending the'Alameda Municipal Code by Adding a New Article 2, of Chapter 2, Title XIV, Relating to Prohibition of the Operation or Main- tenance of Certain BuS'inesses Within Certain Por- tions of Fire Zone No. 1 of the Fire District." Councilman Maurer moved the ordinance as read be adopted, seconded by Councilman Morris and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 27. "Ordinance No. 728, New Series, An Ordinance Amending the Alameda Municipal Code by Adding to Chapter 3, Title XV Thereof a New Article to be Known as Article 4, Regulating Nursing Homes." Dr. L. Skilling, Health Officer of the City of Alameda, E. H. Rogers, Building Inspect- or and Mss Bess Replogle, Supervising Agent and Director of Social Welfare of the State of California, addressed the Council in explanation and commendation of this ordinance regulating nursing homes. Councilman Carrington moved the ordinance as read be adopted, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 28. "Ordinance No. 729, New Series An Ordinance Amending Section 2-117 of the Alameda Municipal Code", (Introduction of Ordinances). Councilman Carrington moved the ordinance as read be adopted, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None, Absent: None. 29. "Ordinance No. 730, New Series An Ordinance Amending the Uniform Building Code of the City of Alameda Adopted by Ordinance No. 723, New Series". Councilman Godfrey moved that, inasmuch as copies of Ordinance No. 730, New Series, were delivered to each of the members of this Council and to the City Manager personally and before the introduction of the ordinance, and the members of the Council are familiar with the contents thereof, reading of the aforementioned ordinance be dis- pensed with, by unanimous consent. The motion was seconded by Councilman Morris and unanimously carried. 30. "Ordinance No. New Series. RECLASSIFYING PROPERTY (South Line Central Ave., 67.34 Feet West of Paru Street)". Councilman Maurer moved that, as there is nothing to be gained in adopting the above mentioned ordinance at this time and as the new zoning ordinance, No. 724, New Series, which has been adopted at this meeting will automatically take care of this proposed reclassification, the matter be tabled. The motion to table the passage of this ordinance was seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 31. "Ordinance No. New Series RECLASSIFYING PROPERTY (Northwest Corner Van Buren and High Streets)", Councilman Maurer moved that, as there is nothing to be gained in adopting the above mentioned ordinance at this time as the new zoning ordinance, No. 724, New Series, which has been adopted at this meeting will automatically take care of this proposed reclassification, the matter be tabled. The motion to table the passage of this ordinance was seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 32. The City Manager informed the Council he had received a communication from the Toll Bridge Authority, Department of Public Works, that a meeting will be held on Friday, August 23, 1940, to consider the purchase by the State of California of the Carquinez and Antioch Bridges. The City Manager requested the Council make a motion favoring purchase of these bridges and authorize this expression of the Council to be presented to the meeting of the Toll Bridge Authority mentioned above. Councilman Morris then moved that the recommendation of the City Manager be approved, seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: Nore. Absent: None. 33. The Clerk presented for filing the following papers: Affidavit of Publication - Notice of Public Work - re closing portions of Clay Street and Fillmore Street. Renewal Agreement between County of Alameda and the City of Alameda for the examination of contacts with cases of tuberculosis. Report of the Bureau of Electricity, as of July 31, 1940. Budget for the Department of Public Utilities for the fiscal year 1940-41. BILLS: 34. An itemized list of claims against the City of Alameda and the several departments thereof in the total amounts as follows, was presented to the City Council: General Department, $3,734.41; Police Department, $621,50; Civil Service Department, $5.00; Pound Department, $17.52; Fire Department, $428.36. Street Department, $1,002.33; Health Department, $113.34; Recreation Department, '$38.52; Park Department, $1,027.53; . Golf Course Department, $561.87; Store Department, $150.93; Social Service Department, $236.57; Street Improvement Fund, $831.16 and Gas Tax Fund No. 1, $9.88. Councilman Maurer made a motion that the bills and claims against the City in the amounts listed and itemized in the List of Claims filed with the Gity Clerk on August 20, 1940, and presented to the Council at this meeting, be allowed and paid. The motion was seconded by Councilman Godfrey and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 35. Councilman Morris moved that when this meeting adjourn it do so out of respect to the memory of the late Hermann Krusi who has been a benefactor to the people of the City of Alameda. The motion was seconded by Councilman Maurer and unanimously carried. After Mayor Weichhart spoke briefly regarding Mr. Krusi's achievements and generosity, as well as of Mrs. Ida Krusi, the meeting adjourned to meet in regular session on Tuesday evening, September 3, 1940, at 8:00 o'clock .t1P.M.
