1942-07-21 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, JULY 21, 1942 The meeting convened at 8:00 p. m. with President Godfrey presiding. ROLL CALL: The roll was called and Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5), were noted present. Absent: None. MINUTES: 1. The minutes of the regular meeting held July 7, 1942, were approved as transcribed. WRITTEN COMYUNICATIONS: 2. From the Pacific Coast Plumbing Inspectors Association with regard to public health protection. There being no objections, the communication was ordered filed. 3. From the Bethlehem Steel Company, advising that Tynan Avenue had been closed for a period exceeding twenty-four hours during July 3 and 4, 1942, in order to fulfill one of the requirements necessary to retain this street as a private thoroughfare. The communication was ordered filed. 4. From Blythe F. Johnson, requesting permission to move a house known as 1908 Mulberry Street, to Lot 3 and a portion of Lot 16, Block 39, "Map of lands adjacent to Town of Encinal" - being on Pacific Avenue between Oak and Walnut Streets. This request was accompanied by a recommendation from the Building Inspector that permission be granted as requested provided all provisions of City ordinances be complied with. Councilman Maurer moved the permit be given to Blythe F. Johnson to move this house from 1908 Mulberry Street to the designated location provided all ordinances of the City pertaining to house moving be complied with. The motion was seconded by Councilman Jones and unanimously carried. 5. From Bethlehem-Alameda Shipyard, Inc., requesting that the City move a certain street light to a new location as it is now situated at a point where a contemplated new street between its shipyard and Webster Street is to be constructed. Permission is also requested to remove a portion of existing curb and sidewalk and to install others. There being no objections, this matter was referred to the City Manager. 6. From Mr. W. J. Justin, requesting permission to move a house from 2106 Clement Avenue to a new location on Lincoln Avenue near Union Street. Councilman Branscheid moved the request to move this house be granted, subject to all provisions of City ordinances and the approval of the Building Inspector, who did not have sufficient time to submit his written recommendation prior to presentation of this request. The motion was seconded by Councilman Jones and unanimously carried. REPORTS OF COMMITTEES: 7. The City Manager verbally reported on the matter of awarding contract for the improvement of Encinal Avenue between High Street and Fernside Boulevard, which had been referred to him and the State Division of Highways at the last regular meeting of the Council. It was the City Manager's recommendation that contract for this work be awarded to Heafey-Moore Co., the only bidder, at its bid price of $23,650.50. The State Division of Highways concurs in this recommendation. Councilman Maurer then moved the recommendation of the City Manager be approved and that contract for the improvement of Encinal Avenue be awarded to Heafey-Moore Co. at price quoted. The motion was seconded by Councilman Howe and unanimously carried. 8. From the City Planning Hoard, recommending denial of a petition from Mr. A. M. Sylvia for the reclassification of property known as 1201 Sherman Street from the "A" Single Family Dwelling District, to the "B" Two-to-Four Family Dwelling District, for the purpose of maintaining apartments. The petitioner was not present at this meeting of the Council. Councilman Branscheid moved the recommendation of the City Planning Board be adopted and that the reclassification of property known as 1201 Sherman Street be denied. The motion was seconded by Councilman Maurer and unanimously carried. 9. From the City Manager, submitting a detailed budget for the fiscal year 1942-1943, for the City of Alameda showing estimated revenues and expenditures of the City and all departments thereof. There being no objections, the budget was accepted for filing and referred to the Com- mittee of the Whole. v 10. From the City Attorney, stating it is proper for the Council to order and approve a refund of $42. fee which was collected by the Building Inspector from the Younger Construction Company in payment of a building permit for construction of a warehouse which is the property of the Navy Department and is situated on property owned by the United States Government. The Building Inspector charged this fee as the application for the building permit erroneously showed the property was owned by General Engineering and Dry Dock Company instead of the Federal Government and. City ordinances definitely exempt the Govern- ment from having to pay any building permit fees. Councilman Maurer then moved that as the City Attorney has ruled this fee should properly be returned, the Younger Construction Company should be so reimbursed. The motion was seconded by Councilman Branscheid and on roll call carried by the follow- ing vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and. President Godfrey, (5). Noes: None. Absent: None. if 11. From the City Manager, recommending the construction of an earth fill levee, com- mencing at the south approach of Bay Farm Island Bridge, thence along the west line of Maitland Drive a distance of 3,400 feet to the intersection of Maitland. Drive and the old County Road, thence along west line of old County Road a distance of 800 feet. The proposed levee is to contain approximately 12,500 cubic feet of fill. It is to be constructed primarily for the protection of the Alameda Municipal Golf Course property. There being no objections, the communication was referred to "Resolutions". ORDINANCES FOR INTRODUCTION: 12. Councilman Branscheid introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending Section 17-431 of The Alameda Municipal Code by Adding Subdivision (19) Thereto." RESOLUTIONS: 13. The following resolution was introduced by Councilman Howe, who moved its adoption: "Resolution No. 2777 Authorizing Execution of Contract with Alameda Chamber of Commerce for Advertising for the Fiscal Year Ending June 30, 1943 and Appropriating $3,300.00 for Such Purposes." The motion to adopt said resolution was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 14. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2778 Authorizing Construction of a Levee Along the Westerly Side of Maitland Drive and Old County Road for the Protection of the Municipal Golf Course; Authorizing the Performance of Such Work by the City Without Con- tract and Authorizing the Purchase of Materials in the Open Market." The motion to adopt said resolution was seconded by Councilman Maurer, and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 15. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2779 Authorizing Performance and Completion of a Project for the Improvement of Webster Street in the City of Alameda and Directing the City Clerk to Advertise for Sealed Bids." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. ORDINANCES FOR PASSAGE: 16. "Ordinance No. 804, New Series An Ordinance Modifying Terms and Conditions of Lease to the United States of.America of Washington Park Bath House." Councilman Maurer moved the ordinance as read be adopted. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and. President Godfrey, (5). Noes: None. Absent: None. 17. "Ordinance No. 805, New Series An Ordinance Authorizing Emergency Suspension of All Building, Electrical, Gas Appliances or Plumbing Ordinances, Authorizing the Use of Substitute Materials and. Methods During the Period of National Emergency and. Declaring an Emergency." Councilman Jones moved the ordinance as read be adopted. The motion was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and. President Godfrey, (5). Noes: None. Absent: None. FILING: 18. Form of Contract with Alameda Chamber of Commerce for Advertising. 19. Financial Report - Goodell, Byers & Henry - City of Alameda, as of June 30, 1942. 20. Specifications - For Construction of By-pass on Webster Street. BILLS: 21. An itemized List of Claims against the City of Alameda and the several departments thereof, including the addition of a warrant payable to Younger Construction Co. in the amount of $42., in the total amounts as follows, was presented to the Council: General Departments, $7,742.64; Civilian Defense Department, $676.87; Police Department, $1,312.12; Civil Service Department, $20.13; Pound Department, $31.41; Fire De- partment, $1,111.41; Street Department, $506.94; Health Department, $177.91; Recreation Department, 132.68; Park Department, $973.92; Golf Course Department, $822.07; Store Department, $301.92; Social Service Department, $94.69; Initiative Relief Fund, $131.00; Street Improvement Fund, 1,287.88 and East Bay Municipal Utility Fund, $2,374.24. Councilman Branscheid moved the bills and claims against the City in the amounts listed and itemized in the List of Claims filed with the City Clerk on July 21, 1942, and pre- sented to the Council at this meeting, be allowed and paid. The motion was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None. Absent: None. ADJOURNMENT: 22. There being no further business to transact, the Council adjourned to assemble in regular session on Tuesday evening, August 4, 1942, at 8:00 p. m.
