1942-08-04 Regular CC MinutesREGULA.13. MEETING OF THE COUNCIL OF THE CITY OF ALAIVIEDA HELD TUESDAY EVENING:, AUGUST 4, 1942 The meeting convened at 8:00 p. m. with Vice President Maurer presiding. ROLL CALL: The roll was called and Councilmen Branscheid, Howe, Jones and Vice President Maurer, (4), were noted present. Absent: President Godfrey, (1). MINUTES: 1. The minutes of the regular meeting held July 21, 1942, were approved as transcribed. WRITTEN COMMUNICATIONS: 2. From Mr. Dave Cooper, requesting the return of $15. paid to the City of Alameda for one month's rent of premises known as 1726 Buena Vista Avenue. Since this payment was made the Division of Tax Deeded lands, represented by the office of the State Con- troller, has made demand upon Mr. Cooper for the rent of these premises as the State has exclusive power to collect rent on tax deeded property. There being no objections, this matter was referred to the City Attorney for a ruling. 3. Camisa 1924 Mulberry Street 1901 Broadway A letter was presented from the City Manager stating that he had issued emergency per- mits to these property owners subject to the ratification by the Council, and after an inspection had been made by the Building Inspector and all regulations of City ordinances pertaining to house moving had been complied with. Councilman Branscheid moved that permits be granted to the above listed persons to move houses as respectively indicated and subject to the provisions of all City ordinances. The motion was seconded by Councilman Jones and unanimously carried. 4. A request was presented from Owen J. White, for a permit to move a house from 2104 Clement Avenue to a lot on Ninth Street between 1520 Ninth Street and the Rich- field Gas Station on the northeast corner of Ninth Street and Santa Clara Avenue. Councilman Branscheid moved this permit be granted, provided all requirements of City ordinances pertaining to house moving be complied with. The motion was seconded by Councilman Howe and unanimously carried. 5. From Mr. C. C. Howard, requesting extension of the time limits on two building permits issued by the Building Inspector in August, 1941, for the construction of two houses to be known as 1562 and 1562-A Lincoln Avenue. After discussion, it was determined that the Council had no jurisdiction in this matter as this procedure is definitely regulated by ordinance and the Council cannot extend time limitations therein specified. 6. At this time, Mr. Howard addressed the Council, requesting permission to move a dwelling now located at 1562 Lincoln Avenue, to a lot in the vicinity of Sherman Street and Pacific Avenue. Councilman Branscheid moved that permission to move this house be granted, provided all regulations of City ordinances pertaining to house moving, be complied with. The motion was seconded by Councilman Jones and unanimously carried. ORAL COMMUNICATIONS: Mr. Harold Randall addressed the Council with regard to the possibility of increas- ing the efficiency of present bus service in Alameda. id. Mrs. McMullin, who teaches at the Everett Nursery School, inquired about the future plans for that building, in the event a decontamination station were established there. Mrs. McMullin was assured by the City Manager that any plans for using the former Everett School as a decontamination center would not hinder its use as a nursery school and in the event it did, an effort would be made to make other arrangements to continue this worthwhile endeavor. OPENING OF BIDS: 9. The following bids were presented and opened for the construction of a By-pass on Webster Street, Route No. 69, as follows: From California Paving Company Accompanied by a Bond in the amount of From Heafey-Moore Co. Accompanied by certified check in amount of From Ransome Company Accompanied by certified check in amount of $3,222.60 700.00 2,336.40 250.00 2,449.20 250.00 There being no objections, these bids were referred to the City Manager and City Engineer for study and recommendation. REPORTS OF COMMITTEES: 10. From the City Manager and Chief of Police, submitting an affidavit that all moneys expended out of the Police Secret Fund during the period from December 31, 1941 to June 30, 1942, have been expended in the manner provided by the Charter. There being no objections, the report was ordered filed. 11. From the City Attorney, recommending that he be authorized to file an answer on behalf of the City in that certain action entitled, "UNITED STATES OF AMERICA, Plaintiff) vs. 7.66 acres of land, more or less, in Alameda County, California, CARLO CARLEVARO, et al., Defendants, No. 22133-W". Councilman Branscheid rnoved the recommendation of the City Attorney be approved and that he be authorized to file an answer in the above mentioned case as set forth in his report. The motion was seconded by Councilman Jones and unanimously carried. v/ 12. From the City Attorney, recommending that he be authorized to file an answer on behalf of the City in that certain action entitled, "UNITED STATES OF AMERICA, Plaintiff, vs. 12.63 acres of land, more or less, in the City of Alameda, Alameda County, California, PACIFIC STATES OIL COMPANY, et al., Defendants, No. 22166-W". Councilman Jones rnoved the recommendation of the City Attorney be approved and that he be authorized to file an answer in the above mentioned case as set forth in his report. The motion was seconded by Councilman Howe and unanimously carried. RESOLUTIONS: 13. The following resolution was introduced by Councilman. Branscheid, who moved its adoption: "Resolution No. 2780 Appointing Member of Retirement Board." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and Vice President Maurer, (4). Noes: None. Absent: President Godfrey, (1). Thereupon Vice President Maurer declared said resolution duly adopted and passed. ORDINANCES FOR PASSAGE: 14. "Ordinance No. 806, New Series An Ordinance Amending Section 17-431 of the Alameda Municipal Code by Adding Subdivision (19) Thereto." Councilman Branscheid moved the ordinance as read be adopted. The motion was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and Vice President Maurer, (4). Noes: None. Absent: Presi- dent Godfrey, (1). FILING: 15. Financial Report - Bureau of Electricity - Year ending June 30, 1942. 16. Auditor's Balance Sheet - Month ending July 31, 1942. 17. Municipal Employees' Retirement System Report - June 30, 1942. BILLS: 18. An itemized List of Claims against the City of Alameda and the several departments thereof in the total amounts as follows, was presented to the City Council: General Departments, $27.48; Civilian Defense Department, $20.00; Police Department, 400.00; Store Department, $500.00; Initiative Relief Fund, $81.00. Councilman Howe moved the bills and claims against the City in the amounts listed and itemized in the List of Claims filed with the City Clerk on August 4, 1942, and pre- sented to the Council at this meeting, be allowed and paid. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and Vice President Maurer, (4). Noes: None. Absent: President Godfrey, (1). ADJOURNMENT: 19.
