1938-08-02 Regular CC MinutesREGULAR MEETING. OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, AUGUST 2nd, 1938 The meeting convened at 8 o'clock P.M. with President Weichhart presiding. The roll was called, and Councilmen Carrington, Godfrey, Maurer, Morris and. Presi- dent Weichhart, (5), were noted present. Absent: None. MINUTES: 1. The minutes of the regular meeting of July 19th, 1938, were approved as transcribed. WRITTEN COMMUNICATIONS: 2. A communication was received from the Alameda Improvement Club, requesting that the Council disregard the recommendation of the City Planning Boardwd rezone the property known as "Vowinckel Tract" from Residential District, Class I, to Residential District, Class II. The communication was referred to "Reports of Committees". ''3. From the California State Planning Board, informing the Council that Federal funds are to be made available to Governmental agencies through the Public Works Ad- ministration and the Works Progress Administration for projects involving city planning. The communication was ordered filed. v4. From the Health Officers' Section, League of California Municipalities, recommend- ing thatthe City Health Officer attend the convention of League of California Munici- palities, to be held September 6, 7, and 8, 1938, in Santa Barbara. The communica- tion was referred to the Committee of the Whole. "5. A petition was presented, signed by 35 merchants and professional men located in the western part of the City, requesting thatthe property known as "Vowinckel Tract" be rezoned from Residential District, Class I, to Residential District, Class II. The petition was referred to "Reports of Committees". OPENING. OF BIDS: 6. Councilman Maurer moved that the regular order of business be suspended and the Council proceed with "Reports of Committees", seconded by Councilman Carrington and unanimously carried. PEPOFTS OF COMMITTEES: 17. From the Public Utilities Board, informing the Council that the Council's recommen- dation of June 15, 1938, concerning the major merchandising policy of the Board was read at a regular meeting held July 14, 1938, and discussed , at an adjourned regular meeting of July 22, 1938, and the recommendations are under consideration by the Board. The communication was ordered filed. v'8. From the City Planning Board, recommending that the Council deny the petition for the reclassification of property known as 325 Pacific Avenue, or the "Vowinckel Tract", from Residential District, Class 1, to Residential District, Class II, for the purpose of constructing bungalow court, multiple family dwellings and a boarding house, and that the Council grant a temporary revocable permit to use the building now located on the property for boarding house purposes. On the request of Mr. Rice, representing the petitionimmlfor a continuance of the hearing, Councilman Carrington moved that consideration be postponed to the next regular meeting of the Council on August 16, 1938, seconded by Councilman Maurer and on roll call carried by the followinglote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and. President Weichhart, (5). Noes: None. Absent: None. 9• From the City Planning Board, recommending the reclassification of property known as 2042 Eagle Avenue, from Residential District, Class I, to Residential District, Class 13/4, for the purpose of remodeling into flats. Councilman Morris moved that the recommendation of the City Planning Board be adopted, seconded by Councilman Carrington and unanimously carried. v10. From the City Planning Board, recommending the reclassification of property known as 2155 Encinal Avenue, from Residential District, Class I, to Residential District, Class 1 3/4, for the purpose of creating a two-family dwelling. Council- man Maurer moved that the recommendation of the Planning Board be adopted, seconded by Councilman Morris and unanimously carried. v11. From the City Planning Board, recommending that the Council grant a temporary revocable permit to use property known as 1916 Buena Vista Avenue for the purpose of making marmalade and ample butter in the basement. Councilman Carrington moved that a temporary revocable permit be granted, seconded by Councilman Maurer and unanimously carried. '12. From the City Planning Board, recommending the Council grant a temporary rev- ocable permit to use the rear of property known as 3207 Fernside Boulevard for the pur- pose of building, repairing and storing boats. After an adjoining property owner had made a verbal protest, Mr. F. B. Peed informed the Council he was negotiating for the purchase of the property and that he intended to make improvements and construct a new home. Also it was pointed out that the property had been used for the purpose for which the permit is requested since 1925. Councilman Maurer moved that the recommendation of the City Planning Board be adoped and that a temporary revocable permit be granted, seconded by Councilman Carrington and on roll call carried by the following vote; Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 13. From the City Manager, submitting a tentative budget The report was referred to the Committee of the Whole. 14. Councilman Maurer moved that the Council refer back by Councilman Carrington and unanimously carried. OPENING OF BIDS: 15. The following bid for- Portland cement was opened: From Powell Bros., Inc. Accompanied by certified check in amount of $300.00 Councilman Godfrey moved that the bid be referred to the City Manager, seconded by Councilman Carrington and unanimously carried. 16. Noes: None. Absent: None. ORDINANCES INTRODUCED: 17. Councilman Carrington introduced the following ordinances, after which they were laid over according to law and the Charter: for the fiscal year 1938-4939 to "Opening of Bids': seconded $ 2.67 per bbl. were opened: Item 1. Item 2 $ .1267 $ .1537 .125 .155 *• .1267 .1567 .1299. .1599 "Ordinance No. New Series Reclassifying Property (Property Known as 2042 Eagle Avenue)", "Ordinance No. New Series Reclassifying Property (Property Known as 2155 Encinal Avenue) UNFINISHED BUSINESS: 18. Mrs. Epstein, representing the Progressive Cosmetologists Association, addressed the Council in reference to proposed ordinance regulating vocational schools, and was informed by the Mayor that the subject had been under consideration by the Council sitting as Committee of the Whole, and that the City Attorney had informed it there is a State law regulating such institutions and that the State regulations should be sufficient without the necessity of the City passing an ordinance. Mrs. Epstein requested that the Council's decision be put in writing and forwarded to her associa- tion. PESOLUTIONS: 19. Councilman Carrington introduced and moved adoption of Pesolution No. 2277 Transferring $4,000 from the General Fund to the Library Fund", Councilman Godfrey seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 20, Councilman Carrington introduced and moved adoption of Resolution No. 2278 Appropriating $250 for Advertising Purposes", Councilman Maurer seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None . Absent: None. FILING: 21. Auditor's Balance Sheet, as of July 30, 1938. BILLS: 22. An itemized list of claims against the City of Alameda and the several departments thereof in the total amounts as follows: General Department $1272.61; Police Depart- ment, $681.91; Fire Department, 0333.00; Street Deprtment, 1983.47; Health Department, $369.96; Recreation Department, $299.85; Park Department, 63.93; Golf Course Depart- ment, $149.57; Store Departmnnt, $227.78; Social Service Department, $323.03; Initiative Relief Fund, 48.O0; Street Improvement Fund $488.10 and East Bay Municipal Utility District Payments Fund, $2499.19. Councilman Maurer moved, seconded by Councilman Morris, that the claims and bills against the City in the amounts as listed and itemized in the List of Claims filed with the City Clerk on August 2, 1938, and presented to the Council at this meeting be allowed and paid. On roll call this motion carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 23.
