1938-11-01 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD. TUESDAY EVENING, NOVEMBER 1st, 1938 The meeting convened at 8 o'clock P.M. with President Weichhart presiding. The roll was called, and Councilman Carrington, Godfrey, Maurer and President Weich- hart, (4), were noted present. Absent: Councilman Morris,(1). MINUTES: 1. The minutes of the regular meeting of October 18th, 1938, and of the adjourned regular meeting of October 25th, 1938, were approved as transcribed. WRITTEN COMMUNICATIONS 2. Notice of Hearing before the Railroad Commission of application of Southern Pacific Golden Gate Ferries, Ltd. for authority to abandon its vehicular ferry services between San Francisco and Alameda. The notice was filed. ORAL COMMUNICATIONS: 3. Mr. Frank Gottstein addressed the Council in reference to traffic conditions in the Posey Tube. 4. Mr. Clint Price appeared before the Council with the remains of a dog which had been killed by an automobile on Versailles Avenue, and complained about the traffic conditions on that street, particularly since the closing of High Street Bridge. The City Manager was requested to make an investigation. 5. Mr. C. C. Howard addressed the Council objecting to dogs being permitted to run at large in the City. OPENING OF BIDS: 16. Bid was opened for the furnishing to the City of Corrugated Pipe and Culverts for the fiscal year ending June 30, 1939, as follows: From California Corrugated Culvert Company, submitting its price list No. 100-H and a schedule of delivery charges, which constituted bid, and which was accompanied by a certified check in amount of $150.00. The bid was referred to the City Manager and the City Attorney. REPORTS OF COM-MITTEES: From the City Planning Board, recommending that a temporary revocable permit be issued to Mrs. H. Brodke for use of the premises known as 772 Eagle Avenue as a two-family dwelling. Councilman Maurer moved that the recommendation of the Planning Board be adopted, and the permit be issued, seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer and Presiden t Weichhart, (4). Noes: None. Absent: Councilman Morris,(1). 8. From the City Manager, recommending that Otto Rittler, Superintendent of Recreation, be given permission to attend a conference for Recreational Directors to be held in Fresn o on November 11 and 12, and that he be allowed the sum of $30.00 for his expenses. Council- man Carrington moved that the recommendation of the City Manager be adopted and that the permission be granted and the sum of not to exceed $30.00 be allowed for expenses, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer and President Weichhart, (4). Noes: None. Absent: Councilman Morris,(1). 9. A report was presented from the Interurban Transportation Committee, recommending that efforts be continued to secure the construction of a tube parallel with the presen t Posey Tube; for the construction of a new Fruitvale Avenue Bridge and that traffic conges- tion be relieved at 7th and Harrison Streets in Oakland; also that the operation of ferries be continued pending the construction of the new Fruitvale Avenue Bridge. The Mayor com- mended the Committee for the work it had performed and the City Manager informed the Council that various civic and commercial organizations in Oakland were supporting the efforts of this City to secure the parallel tube, including merchants organizations, the Port of Oakland, Oakland Chamber of Commerce, the City of Oakland and the shipping inter- ests. Councilman Maurer moved that the report be received and filed and that the Interurban Transportation Committee remain organized, seconded by President Weichhart, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer and President Weichhart, (4). Noes: None. Absent: Councilman Morris,(1). 40. From the City Attorney, in reference to the Hearing before the State Railroad Com- mission on the application of the Southern Pacific Golden Gate Ferries, Ltd., to obtain authority to abandon vehicular service between San Francisco and Alameda, the hearing to be held on November 15, 1938, in the City Hall, Alameda, and requesting that the Council employ as special counsel some attorney who is specialized and an expert in Railroad Commission matters. Councilman Maurer moved that Mr. R. L. Vaughan, Attorney at Law, be and is hereby employed for the rendition of special services of a professional and technical nature to represent the City of Alameda asEpecial counsel at the hearings to be held, including continuances and further hearings, in the matter of the application of Southern Pacific Golden Gate Ferries Ltd. for authority to abandon its vehicular ferry service between San Francisco and Alameda application No. 22256, now pending before the Railroad Commission of the State of California; and that said R. L. Vaughan be paid for his services on a per diem basis of $100.00 per day, provided such compen- sation be not less than $250.00 nor more than $750.00, seconded by Councilman Godfrey and on roll call carried by the following vote: Axes: Councilmen Carrington, Godfrey, Maurer and President Weichhart. (4). Noes: None. Absent: Councilman Morris.(1). 11. The Council now reverted back to "Opening of Bids." OPENING OF BIDS: '12. The City Manager recommended that the contract for corrugated pipe and culverts be awarded to the California Corrugated Culvert Company at the prices quoted and their price list No. 100-H. Councilman Godfrey moved that the recommendation be adopted and the contract be awarded to the California Corrugated Culvert Company, seconded by Council- man Maurer and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer and President Weichhart, (4). Noes: None. Absent: Councilman Morris,(1). RESOLUTIONS: 13. Councilman Godfrey introduced and moved the adoption of "Resolution No. 2301 In Support of Application of Southern Pacific Company for Closing of Fruitvale Avenue Bridge During Peak Load Periods", Councilman Carrington seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, and President Weichhart, (4). Noes: None. Absent: Councilman Morris,(1). 14. Councilman Maurer introduced and moved the adoption of "Resolution No. 2302 Authorizing the Mayor of the City of Alameda to Consent to the Recordation of Deeds or Grants to Said City", Councilman Carrington seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer and President Weichhart, (4). Noes: None. Absent: Councilman Morris,(1). 15. At this time there was presented a check in the sum of $7500.00 from the Pacific Gas and Electric Company, accompanied by a letter informing the Council that its payment is tendered subject to the passage of a resolution accepting such payment for a gas franchise. 16. Councilman Carrington introduced and moved the adoption of "Resolution No. 2303 Accepting Sum Tendered by Pacific Gas and Electric Company in Payment for Gas Franchise Applied for by It," Councilman Maurer seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer and President Weichhart, (4). Noes: None. Absent: Councilman Morris,(1). 17. Councilman Maurer introduced and moved the adoption of "Resolution No. 2304 Authorizing Execution of Contract with the Alameda Chamber of Commerce for Advertising for the Fiscal Year Ending June 30, 1939", Councilman Carrington seconded the motion, and on roll call carried by the followinglote: Ayes: Councilmen Carrington, Godfrey, Maurer and President Weichhart, (4). Noes: None. Absent: Councilman Morris,(1). 18. Councilman Godfrey introduced and moved the adoption of "Resolution No. 2305 Resolution of the City Council of the City of Alameda Approving Memorandum of Agreement for Accumulation of 1/4 Cent Gas Tax Allocated for Streets of Major Importance", Councilman Carrington seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer and President Weichhart, (4). Noes: None. Absent: Councilman Morris,(1). 19. Councilman Maurer introduced and moved the adoption of "Resolution No. 2306 Transferring $600 to the Library Fund", Councilman Carrington seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer and President Weichhart, (4). Noes: None. Absent: Councilman Morris,(1). 20. Councilman Carrington introduced and moved the adoption of "Resolution No. 2307 Adopting Specifications for Furnishing Three Automobiles to the City of Alameda, Calling Zor Bids and Directing the City Clerk to Advertise the Same", Councilman Godfrey seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer and President Weichhart, (4). Noes: None. Absent: Councilman Morris,(1). 21. Councilman Maurer introduced and moved the adoption of "Resolution No. 2308 Adopting Specifications for Furnishing One Automobile to the City of Alameda, Calling for Bids and Directing the City. Clerk to Advertise the Same", Councilman Carrington seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer and President Weichhart, (4). Noes: None. Absent: Councilman Morris,(1). 22. Councilman Carrington introduced and moved the adoption of "Resolution No. 2309 Adopting Specifications for Furnishing One Automobile to the City of Alameda. Calling for Bids and Directing the City Clerk to Advertise the Same"; Councilman Maurer seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer and President 1Neichhart, (4). Noes: None. Absent: Councilman Morris,(1). ORDINANCE FOR PASSAGE: 23. "Ordinance No. 665 New Series Ordinance Granting to the Pacific Gas and Electric Company, Its Successors and. Assigns, the Franchise to Use, for Transmitting and Distributing Gas within the City of Alameda for Any and All Purposes Other Than Those Authorized Under Section 19 of Article Xi of the Constitution of the State of California as Said Section Existed Prior to its Amendment on October 10, 1911, All Gas Pipes and Appurtenances Which Are Now or May Hereafter Be Lawfully Placed in the Public Streets, Ways and Places within Said City, and to Lay and Use in Said Public Streets, Ways and. Places All Pipes and Appurtenances Necessary or Proper for Said Purposes," Councilman Godfrey moved that the ordinance as read be adopted, seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer and President Weichhart, (4). An itemized list of claims against the City of Alameda and the several departments thereof in the total amounts as follows, was presented to the City Council: General De- partments $2231.25; Civil Service Department, $40.14; Police Department, $695.72; Pound Departmen, 99.25; Street Department, $143.71; Health Department, $192.66; Recreation Department, 65.41 Park Department, $732.28; Golf Course Department, $140.08; Store Department, i 173.08; Social Service Departmenu, 1145.58; Initiative Re]ief Fund, $80.00; Street Improvement Fund, $1023.64; Gas Tax Fund 7/1,416.00. Councilman Carrington moved, seconded by Councilman Maurer, that the claims and bills against the City in the amounts as listed and itemized in the List of Claims filed with the City Clerk on November lst,1938, and presented to the Council at this meeting be allowed and paid. On roll call this motion carried by the following vote: Ayes: Council- men Carrington, Godfrey, Maurer and. President Weichhart, (4). Noes: None. Absent: Councilman Morris, (1). 29.
